सा.का.नि. 241.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राजस्व विभाग, सहायक मुख्य लेखा अध्किारी और प्रशासनिक अध्किारी भर्ती नियम, 1983 और केन्द्रीय उत्पाद शुल्क कलक्टरी ;प्रशासनिक अधिकारी/सहायक मुख्य लेखा अध्किारी/लेखा परीक्षकद्ध भर्ती नियम, 1987 को उन बातों के सिवाए अध्क्रिांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड, राजस्व विभाग, वित्त मंत्राालय के अध्ीन क्षेत्राीय विरचनाओं और निदेशालयों में प्रशासनिक अध्किारी के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :—
1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम वित्त मंत्राालय, राजस्व विभाग, केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड, प्रशासनिक अध्किारी ;समूह 'ख' पदद्ध भर्ती नियम, 2013 है ।
;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।
4. निरर्हता.—वह व्यक्ति—
;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या
;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्रा नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा प्रोन्नति :
वेतन बैंड-2, 9300-34800 रु. और ग्रेड वेतन 4200 रु. में केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के अध्ीन ऐसी उप कार्यालय अध्ीक्षक जिसने उस श्रेणी में पांच वर्ष की नियमित सेवा की हो ।
टिप्पण 1 : उप कार्यालय अध्ीक्षक ;स्तर-1द्ध या उप कार्यालय अध्ीक्षक ;स्तर-2द्ध ;उपकार्यालय अध्ीक्षक के रूप में अभिहितद्ध की श्रेणियों में विलय के पूर्व की गई सेवा, प्रोन्नति की पात्राता की गणना के हिसाब में ली जाएगी ।
टिप्पण 2 : प्रोन्नति के लिए पात्राता सूची काडर के भीतर पारस्परिक ज्येष्ठता के साथ केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड के अध्ीन विभिन्न श्रेणियों के उपकार्यालय अध्ीक्षकों द्वारा अर्हक सेवा के पूरा होने की तारीख को प्रति निर्देश से तैयार की जाएगी ।
टिप्पण 3 : केन्द्रीय उत्पाद शुल्क और सीमा शुल्क बोर्ड द्वारा यथाविहित प्रशिक्षण का सपफलतापूर्वक समापन प्रशासनिक अध्किारी के पद पर प्रोन्नति के लिए अनिवार्य होगा। कोई अध्किारी जिसने प्रोन्नति के पूर्व प्रशिक्षण को पूरा नहीं किया है, उसे प्रोन्नति से दो वर्ष के भीतर उसी को सपफलतापूर्वक पूरा करना होगा । कोई अध्किारी जिसने प्रशासनिक अध्किारी के लिए अनिवार्य प्रशिक्षण सपफलतापूर्वक पूरा नहीं किया है, उस पर मुख्य लेखा अध्किारी के पद पर प्रोन्नति के लिए विचार नहीं किया जाएगा । वे अध्किारी जिनकी प्रोन्नति पर सेवा निवृत्ति के पूर्व एक वर्ष से कम की सेवा शेष है, उन्हें छूट दी जा सकेगी ।
टिप्पण 4 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/ पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी मे प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।
टिप्पणः 5. प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अधिकारी द्वारा नियमित आधर पर की गई सेवा उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

G.S.R. 241.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Revenue Assistant Chief Accounts Officer and Administrative Officer Recruitment Rules, 1983 and the Central Excise Collectorates (Administrative Officer/Assistant Chief Accounts Officer/Examiner of Accounts) Recruitment Rules, 1987 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Administrative Officer in the field formations and Directorates under the Central Board of Excise and Customs, Department of Revenue in the Ministry of Finance, namely :—
1. Short title and commencement.—(1) These rules may be called the Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, Administrative Officer (Group 'B' Post) Recruitment Rules, 2013.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay of pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications etc..—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.—No person,—
(a) who, has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputy Office Superintendent under the Central Board of Excise and Customs in pay band-2, Rs. 9300-34800 plus grade pay of Rs. 4200 with five years' regular service in the grade. Note 1: The service rendered in the pre-merger grades of Deputy Office Superintendent Level-I or Deputy Office Superintendent Level-II (designated as Deputy Office Superintendent) shall be taken into account in computing the eligibility for promotion.
Note 2 : The eligibility list for promotion shall be prepared with reference to the date of completion of qualifying service by the Deputy Office Superintendents of different cadres under the Central Board of Excise and Customs, of prescribed service in the grade with inter-se seniority within the cadre remaining the same.

promotion to the post of Administrative Officer. An officer who has not completed the training before promotion shall have to successfully complete the same within two years from promotion. An officer who has not successfully completed mandatory training for Administrative Officer shall not be considered for promotion to the post of Chief Accounts Officer. Officers with less than one year of service remaining before retirement on promotion, stand exempted from training.
Note 4 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.
Note 5 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said pay commission.

अध्ीनस्थ विधन संबंध्ी समिति, लोक सभा ने विपणन एवं निरीक्षण निदेशालय ;समूह 'ग' अराजपत्रिात पदद्ध, उच्च श्रेणी लिपिक भर्ती नियम, 2012 जिसे 19 जनवरी, 2013 को सा.का.नि. सं. 25 द्वारा भारत के राजपत्रा में अध्सिूचित किया गया था की जांच करते समय इंगित किया कि लघु शीर्षक में इंगित वर्ष प्रकाशन के वर्ष के साथ मिलान नहीं करता है । समिति ने सिपफारिश की कि लघु शीर्षक में इंगित वर्ष को आसान संदर्भ के लिए प्रकाशन वर्ष के साथ मिलान किया जाना चाहिए । अतः यह निर्णय लिया गया है कि विपणन एवं निरीक्षण निदेशालय ;समूह 'ग' अराजपत्रिात पदद्ध, उच्च श्रेणी लिपिक भर्ती नियम, 2012 में संशोध्न किया जाए और उपरोक्त संशोध्न को 7 जुलाई, 2012 से अनुदर्शी प्रभाव दिया जाए । अतः उपर्युक्त नियम में प्रस्तावित प्रविष्टि को डालना 7 जुलाई, 2012 के अनुदर्शी रूप में लागू होगा। यह प्रमाणित किया जाता है कि अध्सिूचित किए जा रहे भर्ती नियमों से प्रस्तावित संशोध्न में दिया जा रहा अनुदर्शी प्रभाव द्वारा किसी पर भी प्रतिकूल प्रभाव नहीं पड़ेगा ।

G.S.R. 242.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules to amend the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012 notified vide G.S.R. No. 165 dated 3rd July, 2012, namely :—
1. (1) These rules may be called the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment (Third Arrendment) Rules, 2013.
(2) They shall be deemed to have come into force with effect from the July 7th, 2012.
2. In the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012, notified vide G.S.R. No. 25 dated the 14th January, 2013, the following shall be substituted, narrely :—
"These rules may be called the Directorate of Marketing and Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment (First Amendment) Rules, 2013".

Explanatory Memorandum
The Committee on Subordinate Legislation, Lok Sabha, while examination of the Directorate of Marketing & Inspection (Group 'C' Non-gazetted posts), Upper Division Clerk Recruitment Rules, 2012, notified in the Gazette of India vide G.S.R. No. 25 dated 19th January, 2013, pointed out that the year in the short title does not tally with the year of publication. The Committee has recommended that the year in the short title should tally with the year of publication for easy referencing. Therefore, it has been decided to amend the Directorate of Marketing & Inspection (Group 'C' Non- gazetted posts), Upper Division Clerk Recruitment Rules, 2012 and to give retrospective effect to the aforesaid amendment with effect from the 7th July, 2012. As such, insertion of the proposed entry in the said rule will have retrospective application from 7th July, 2012. It is certified that none will be adversely affected by the retrospective effect being given to the proposed amendment in the recruitment rules being notified.
Note : The Principal Rules were published in the Gazette of India, Part II, Section 3, Sub-section (i) vide G.S.R. No. 165 dated the 3rd July, 2012 and subsequently amended vide G.S.R. No. 25 dated the 14th January, 2013 and was last amended by notification G.S.R. No.145 dated 30th May, 2013.
