का.नि.आ. 59.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए; और

(i) सेना सेवा कोर (समूह 'ग' और समूह 'घ' पद) भर्ती नियम, 1977 को, जहां तक उनका संबंध ड्राफ्‌टमैन लेवल IV, ड्राफ्‌टमैन लेवल III, ड्राफ्‌टमैन लेवल II, मेस सुपरवाइजर, सिनेमा प्रोजेक्शनिस्ट/सिनेमा आपरेटर ग्रेड II, वेल्डर, इलैक्ट्रिशियन, क्रशर आपरेटर/अटेन्डेन्ट, मेस वेटर, मॉडल मजदूर और मॉडलर;

(ii) सेना सेवा कोर (वर्ग 'III' पद) भर्ती नियम, 1971 को, जहां तक उनका संबंध सिविलियन भोजन-प्रबन्ध अनुदेशक, पर्यवेक्षक सिविल साधारण परिवहन यूनिट, यान यांत्रिक, सहायक यान यांत्रिक और सिविलियन पैट्रोलियम फिटर;

(iii) सेना सेवा कोर (वर्ग 'IV' पद) भर्ती नियम, 1971 को, जहां तक उनका संबंध क्लीनर, कैम्प गार्ड, टिनकार, हैमरमैन (हथौड़ीवाला), पोलिनमेकर और तिरपोलिन मेकर;

(iv) रक्षा मंत्रालय, समूह 'ग' और समूह 'घ' (अग्नि सेवा) पद भर्ती नियम, 1976 को, जहां तक उनका संबंध कनिष्ठ अनुदेशक/उप अग्निशमन अधिकारी, सिविलियन सहायक फायर मास्टर/सहायक अग्निशमन अधीक्षक, पर्यवेक्षक (अग्निशमन), लीडिंग हैण्ड अग्निशमन (चयन श्रेणी), लीडिंग हैण्ड अग्निशमन (साधारण श्रेणी), अग्निशमन इंजन चालक/चालक ट्रेलर पम्प, फायरमैन श्रेणी-I और फायरमैन श्रेणी-II;

(421)422 THE GAZETTE OF INDIA : OCTOBER 5, 2013/ASVINA 13 , 1935 [PART II—SEC. 4] उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्रालय में सेना की निम्नतर विरचनाओं में समूह 'ग' (अनौद्योगिक) के पदों पर भर्ती की पद्धति का विनियम करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय, सेना सेवा कोर (समूह 'ग' पद) भर्ती नियम, 2013 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ (1) में विनिर्दिष्ट पदों को लागू होंगे।

3. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो उक्त अनुसूची के स्तम्भ (2) से स्तम्भ (4) में विनिर्दिष्ट हैं।

4. भर्ती की पद्धति, आयु सीमा, अर्हताएं, आदि.—उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5) से स्तम्भ (13) में विनिर्दिष्ट हैं।

5. निरर्हता.—वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. षिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करकेे, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत शिथिल कर सकेगी।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहींं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य

पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

टिप्पण 1 : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने[भाग II—खण्ड 4] भारत का राजपत्रा : अक्तूबर 5, 2013/आश्विन 13, 1935 423 ;6द्ध के लिए नियत की गई अंतिम तारीख होगी ;न कि वह अंतिम तारीख जो असम, मेघालय, अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है।द्ध

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली भर्ती की दशा में, आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

;iiiद्ध सभी प्रकार के आग बुझाने वाले साध्त्रिाों, होज पिफटग्स और अग्नि उपकरण और उपस्कर जैसे अग्निशमन इंजन, टे्रलर अग्निशमन पम्प, पफोम ब्रांच आदि के उपयोग और अनुरक्षण में निपुण होना चाहिएऋ

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा या प्रोेन्नति या प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प(तियों द्वारा प्रोेन्नति या प्रतिनियुक्ति/आमेलन किया जाएगा भरी जाने वाली रिक्तियोंं की प्रतिशतता

प्रोन्नति द्वारा जिसके न हो सकने पर आमेलन द्वारा और प्रोन्नति : दोनों के न हो सकने पर सीध्ी भर्ती द्वारा वेतन बैंड-1, 5200—20200 रु. ग्रेड वेतन 2000 रु. में ऐसे लीडग पफायरमैन, जिन्होंने नियमित आधर पर नियुक्ति के पश्चात्‌ उस क्षेणी में निरन्तर दस वर्ष सेवा की है । टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो । टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उन पदों पर विस्तारित होगा जिनके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी। आमेलन : रक्षा मंत्राालय की निम्नतर विरचनाओं में समरूप या समतुल्य या उच्चतर श्रेणी में सेवारत ऐसे व्यक्ति जिनके पास स्तम्भ ;7द्ध में यथाविनिदष्ट अर्हताएं हैं । टिप्पण ः आमेलन के आधर पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उन पदों पर विस्तारित होगा जिनके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

;iiiद्ध बी क्रेन के कार्यकरण के बारे में प्रशिक्षण, मार्गदर्शन और नियंत्राण का ज्ञान और पारियों का भार स्वतंत्रा रूप से संभालने में समर्थ होना चाहिए ।

;ivद्ध किसी मान्यताप्राप्त सिविल या रक्षा दमकल केन्द्र पर न्यूनतम तीन वर्ष की अवध् ितक पफायरमैन के रूप में कार्य किया होना चाहिए ।

;vद्ध शारीरिक रूप से स्वस्थ और कठिन कर्त्तव्यों के निर्वहन के लिए समर्थ और निम्नलिखित शारीरिक योग्यता परीक्षा उत्तीर्ण की हो —

1. लम्बाई बिना जूतों के — 165 सें.मी. परन्तु अनुसूचित जनजाति के अभ्यथयों के लिए 2.5 सें.मी. की रियायत अनुज्ञेय

2. छाती ;बिना पफुलाएद्ध — 81.5 सें.मी. 3. छाती ;पफुलाकरद्ध — 85 सें.मी. 4. वजन 50 किलोग्राम ;न्यूनतमद्ध 5. क्षमता परीक्षण : क. किसी व्यक्ति का वहन करना ;पफायरमैन द्वारा 65.5 किलोग्राम के आदमी को 96 सैकेंड के भीतर 183 मीटर की दूरी तक उठाकर ले जानाद्ध ।

ख. 2.7 मीटर चौड़ी खाई को दोनों पैरों पर पार करना

;लंबी कूदद्ध ।

ग. हाथ और पैरों का उपयोग करते हुए 3 मीटर उध्र्वाकार

रस्सी पर चढ़ना ।

वांछनीय : रक्षा अग्नि अनुसंधन संस्थान, रक्षा मंत्राालय, नई दिल्ली द्वारा संचालित साधरण अग्निशमन पाठ्‌यक्रम या राष्ट्रीय अग्निशमन सेवा महाविद्यालय, नागपुर द्वारा संचालित उप अध्किारी पाठ्‌यक्रम या इसके समरूप कोई मान्यताप्राप्त पाठ्‌यक्रम उत्तीर्ण किया हो ।

S.R.O. 59.—In exercise of the powers conferred by the provision to article 309 of the Constitution and in supersession of -

(i) the Army Service Corps (Group 'C' and Group 'D' posts) Recruitment Rules, 1977, in so far as they relate to the posts of Draughtsman Level IV, Draughtsman Level III, Draughtsman Level II, Mess Supervisor, Cinema Projectionist/Cinema Operator Grade II, Welder, Electrician, Crusher Operator/Attendant, Mess Waiter, Model Mazdoor and Modeller;

(ii) the Army Service Corps (Class III posts) Recruitment Rules, 1971, in so far as they relate to the posts of Civilian Catering Instructor, Supervisor Civil General Transport Units, Vehicle Mechanic, Assistant Vehicle Mechanic and Civilian Petroleum Fitter;

(iii) the Army Service Corps (Class IV posts) Recruitment Rules, 1971, in so far as they relate to the posts of Cleaner, Camp Guard, Tinsmith, Hammer-man, Paulin Maker and Tarpaulin Maker;

(iv) the Ministry of Defence Group C and Group D (Fire Service) Posts Recruitment Rules, 1976, in so far as they relate to the posts of Junior Instructor/Deputy Fire Officer, Civilian Assistant Fire Master/Assistant Fire Superintendent, Supervisor (Fire), Leading Hand Fire (Selection Grade), Leading Hand Fire (Ordinary Grade), Fire Engine Driver/Driver Trailer Pump, Fireman Grade-I and Fireman Grade-II;

except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' (Non-Industrial) posts in the lower formations of the Army in the Ministry of Defence, namely :-

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Army Service Corps (Group 'C' posts) Recruitment Rules, 2013.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale.—The number of the said posts, their classification, the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualification and other matters relating to the said posts shall be as specified in columns (5) to (14) of the said Schedule.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage, with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors, who have completed their qualifying or eligibility service, are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission, except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.

Absorption :

Persons serving in similar or equivalent or higher grades in the lower formations of the Ministry of Defence and possessing qualifications as specified in Column (7).

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय सेना आर्डनेंस कोर, भेषजज्ञ ;समूह फ्गय् पदद्ध भर्ती नियम, 2013 है ।

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

S.R.O. 60.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Compounders (Class III Non-Gazetted) Recruitment Rules, 1969, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the posts of Pharmacist in the Army Ordnance Corps, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Army Ordnance Corps, Pharmacist (Group 'C' Post) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay.—The number of posts, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. ;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय ;मुख्य क्रय निदेशक और उप मुख्य क्रय निदेशकद्ध भर्ती ;संशोधनद्ध नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. रक्षा मंत्राालय ;मुख्य क्रय निदेशक और उप मुख्य क्रय निदेशकद्ध भर्ती नियम, 1988 ;जिसे इसमें इसके पश्चात्‌ उक्त नियम कहा गया हैद्ध के नियम 1 के उप नियम ;1द्ध में फ्और उप मुख्य क्रय निदेशकय् शब्दों का लोप किया जाएगा ।

3. उक्त नियमों की अनुसूची में उप मुख्य क्रय निदेशक के पद और उससे संबंध्ति प्रविष्टियों का लोप किया जाएगा ।

S.R.O. 62.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Defence (Chief Director of Purchase and Deputy Chief Director of Purchase) Recruitment Rules, 1988, namely :—

1. (1) These rules may be called the Ministry of Defence (Chief Director of Purchase and Deputy Chief Director of Purchase) Recruitment (Amendment) Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence (Chief Director of Purchase and Deputy Chief Director of Purchase) Recruitment Rules, 1988 (hereinafter referred to as the said rules), in sub-rule (1) of rule 1, the words "and Deputy Chief Director of Purchase" shall be omitted.

3. In the said rules, in the Schedule, the post of Deputy Chief Director of Purchase and the entries relating thereto shall be omitted.
