सा.का.नि. 254.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और क्षेत्रीय प्रचार निदेशालय (वर्ग 3 तथा वर्ग 4 पद) भर्ती नियम, 1971 और क्षेत्र प्रचार निदेशालय (प्रदेश) समूह 'ग' और 'घ' पद भर्ती नियम, 1986 को, जहां तक उनका संबंध् उच्च श्रेणी लिपिक के पद से है, उन बातों के सिवाए अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है, सूचना और प्रसारण मंत्रालय में, क्षेत्रीय प्रचार निदेशालय में उच्च श्रेणी लिपिक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—(1) सूचना और प्रसारण मंत्रालय, क्षेत्रीय प्रचार निदेशालय, उच्च श्रेणी लिपिक (समूह 'ग' पद) भर्ती नियम, 2013 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीेकरण और उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.—उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।

4. निरर्हता.—वह व्यक्ति—

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति.—जहां केंद्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केंद्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

प्रोन्नति : वेतन बैंड-1 (5200-20200 रु.) तथा ग्रेड वेतन 1900 रु. में क्षेत्रीय प्रचार निदेशालय के मुख्यालय या क्षेत्रीय कार्यालय में ऐसे अवर श्रेणी लिपिक जिन्होंने नियमित आधार पर उस पद पर नियुक्ति के पश्चात्‌ उस श्रेणी में आठ वर्ष सेवा की हो।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख जिसको छठे केंद्रीय वेतन आयोग की सिफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी। प्रतिनियुक्तिः

केंद्रीय सरकार का ऐसा अधिकारी— (i) जिसने नियमित आधार पर सदृश पद धारण किया हुआ है; या (ii) जिसने वेतन बैंड-1 (5200-20200 रु.) और ग्रेड वेतन 1900 रु. में नियमित आधार पर उस पद पर नियुक्ति के पश्चात्‌ उस श्रेणी में आठ वर्ष नियमित सेवा की हो।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

टिप्पण 2 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बा]य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी।

टिप्पण 3 : प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

टिप्पण 4 : प्रतिनियुक्ति या आमेलन के आधार पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केंद्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अधिक पूर्व पुनरीक्षित वेतनमान का साधारण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

MINISTRY OF INFORMATION AND BROADCASTING

G.S.R. 254.—In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Directorate of Field Publicity (Class III and Class IV posts) Recruitment Rules, 1971, and the Directorate of Field Publicity (Regions) (Group 'C' and 'D' posts) Recruitment Rules, 1986 in so far as it relates to the post of Upper Division Clerk, except as respects things done or omitted to be done before such supersessions, the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk in the Directorate of Field Publicity in the Ministry of Information and Broadcasting, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Information and Broadcasting, Directorate of Field Publicity, Upper Division Clerk, (Group 'C' Post) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and the pay band and grade pay or pay scale.—The number of said post, its classification and the pay band and grade pay or the pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the above said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for do doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Schedules Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1.-Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2.-For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1.1.2006 or the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission.

(ii) with eight years' regular service in the grade rendered after appointment thereto on regular basis in pay band-1 (Rs. 5200—20200) and grade pay of Rs. 1900.

Note 1.-The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2.-Peroid of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years.

Note 3.-The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of the applications. Note 4.-For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1st January, 2006, the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 255.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्‌्‌वारा प्रदत्त शक्तियों का प्रयोग करते हुए सौर ऊर्जा केंद्र, अपारंपरिक ऊर्जा स्रोत मंत्रालय (ड्राईवर) भर्ती नियम, 1986 को अधिक्रांत करते हुए, नवीन और नवीकरणीय ऊर्जा मंत्रालय, सौर ऊर्जा केंद्र में समूह 'ग' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते ह, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम नवीन और नवीकरणीय ऊर्जा मंत्रालय, सौर ऊर्जा केंद्र (ड्राईवर) समूह 'ग' पद

G.S.R. 255.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Solar Energy Centre, Department of Non-Conventional Energy Sources (Driver) Recruitment Rules, 1986, the President hereby makes the following rules regulating the method of recruitment to Group 'C' posts in the Ministry of New and Renewable Energy, Solar Energy Centre, namely:—

1. Short title and commencement.— (1) These rules may be called the Ministry of New and Renewable Energy, Solar Energy Centre, (Driver) Group 'C' Posts, Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 256.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्राकृतिक विज्ञान संग्रहालय, विज्ञान और प्रौद्योगिकी विभाग, (श्रेणी-III पद) भर्ती नियम, 1975 को, जहां तक उनका संबंध रोकड़िया पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, पर्यावरण एवं वन मंत्रालय के राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय में रोकड़िया के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

(ii) जिनकी मूल काडर या विभाग में वेतन बैंड-1, 5200-20,200 रु॰ और ग्रेड वेतन 1900 रु॰ या समतुल्य श्रेणी में नियमित आधार पर नियुक्ति के पश्चात्‌ आठ वर्ष की नियमित सेवा है; और

(ख) किसी मान्यता प्राप्त बोर्ड या विश्वविद्यालय से बारहवीं कक्षा या समतुल्य पास हैं और या तो सचिवालय प्रशिक्षण तथा प्रबंधन संस्थान से रोकड़ और लेखा में प्रशिक्षण लिए हैं, या सरकारी कार्यालय में रोकड़ और लेखा कार्य का तीन वर्ष का अनुभव रखते हैं।

टिप्पण 1ः प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नहीं होगी।

टिप्पण 2ः प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी।

G.S.R. 256.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of National History Museum, Department of Science and Technology, (Class III Posts) Recruitment Rules, 1975 in so far as they relate to the post of Cashier, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Cashier in the National Museum of Natural Hisotry, Ministry of Environment and Forests, namely:—

1. Short title and commencement.— (1) These rules may be called the Ministry of Environment and Forests, National Museum of Natural History, Cashier Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of said post, its classification and the pay band and grade pay attached thereto, shall be as specified in Columns (2) to (4) of the Schedule annexed to these rules.

3. Method of Recruitment, age-limit, qualifications etc.—The method of recruitment, age-limit, qualifications and other matters connected therewith shall be as specified in Columns (5) to (13) of the aforesaid Schedule.

4. Disqualification. No Person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such a person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax— Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing; relax any of the provisions of these rules with respect to any class or category of persons or posts.

6. Saving— Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government, from time to time, in this regard.

सा.का.नि. 257.—राष्ट्रपति, संविधान के अनुच्छेद, 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्राकृतिक विज्ञान संग्रहालय, विज्ञान और प्रौद्योगिकी विभाग, (श्रेणी-III पद) भर्ती नियम, 1975 को, जहां तक उसका संबंध प्रयोगशाला सहायक पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, पर्यावरण एवं वन मंत्रालय के राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय में, प्रयोगशाला सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभः (1) इन नियमों का संक्षिप्त नाम पर्यावरण एवं वन मंत्रालय, राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय, प्रयोगशाला सहायक भर्ती नियम, 2013 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण, वेतन बैंड तथा ग्रेड वेतन या वेतनमान—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2) से स्तम्भ (4) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि—उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वह होंगी जो उक्त अनुसूची के स्तम्भ (5) से स्तम्भ (13) में विनिर्दिष्ट हैं।

4. निरर्हता— वह व्यक्तिः—

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या

उक्त पद पर नियुक्ति का पात्र नहीं होगाः

प्रोन्नतिः राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय और क्षेत्रीय प्राकृतिक विज्ञान संग्रहालयों में ऐसे प्रयोगशाला परिचायक जिनकी वेतन बैंड-1, 5200-20200 रु॰ और ग्रेड वेतन 1800 रु॰ श्रेणी में नियमित आधार पर नियुक्ति के पश्चात्‌ वहां तीन वर्ष की नियमित सेवा है।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा।

सा.का.नि.258.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय संग्रहालय, नई दिल्ली (वर्ग I और II पद) भर्ती नियम 1963, को जहां तक उसका संबंध रसायनज्ञ, सहायक रसायनज्ञ, और ज्येष्ठ रासायनिक सहायक के पदों से हैं, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, संस्कृति मंत्रालय के राष्ट्रीय संग्रहालय, नई दिल्ली में रसायनज्ञ, उप रसायनज्ञ, और सहायक रसायनज्ञ, के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌,ः—

1. संक्षिप्त नाम और प्रारंभ. —(1) इन नियमों का संक्षिप्त नाम संस्कृति मंत्रालय, राष्ट्रीय संग्रहालय नई दिल्ली, समूह 'क' और समूह 'ख' पद भर्ती नियम, 2013 हैं।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन.—उक्त पद की संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन वह होगा, जो इन नियमों से उपाबंद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की पद्धति, आयु-सीमा अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।

4. निरर्हता. — वह व्यक्ति :—

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है या;

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्र नहीं होगाः

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति. — जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपाबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों के बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृति. — इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

टिप्पणः आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी। (न कि वह अंतिम तारीख जो असम, मेघालय, अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है। )

सीधे भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित सीधे भर्ती किए जाने वाले व्यक्तियों परिवीक्षा की भर्ती की पद्धतिः भर्ती सीधे होगी या शैक्षिक और अन्य अर्हताएं के लिए विहित आयु और शैक्षिक अवधि, यदि प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन अर्हताएं प्रोन्नत व्यक्तियों की कोई हो द्वारा तथा विभिन्न पद्धतियों द्वारा भरी दशा में लागू होंगी या नहीं जाने वाली रिक्तियों की प्रतिशतता

रसायन विज्ञान में मास्टर डिग्री। (ii) संग्रहालय की सामग्री के परीक्षण और

(i) किसी मान्यता प्राप्त विश्वविद्यालय से लागू नहीं होता सीधे भर्ती प्रोन्नति द्वारा जिसके न हो सकने पर किए जाने प्रतिनियुक्ति द्वारा (जिसके अंतर्गत वाले व्यक्तियों अल्पकालिक संविदा भी है) दोनों के विश्लेषण या परिरक्षण में विज्ञान के के लिए न हो सकने पर सीधी भर्ती द्वारा। अनुप्रयोग में पांच वर्ष का अनुभव।

दो वर्ष

टिप्पण 1ः- अर्हताएं अन्यथा सुअर्हित अथ्यर्थियों की दशा में उन कारणों के लिए जो लेखबद्ध किए जाएं संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है।

टिप्पण 2ः- अनुभव संबंधी अर्हता उन कारणों के लिए जो लेखबद्ध किए जाएं संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित पदों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की संभावना नहीं है।

(2) बाहर के किसी मान्यताप्राप्त संस्थान या विश्वविद्यालय से प्रशिक्षण या अनुभव[भाग II—खण्ड 3(i)] भारत का राजपत्रा : नवम्बर 9, 2013/कातक 18, 1935 1479 प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में, वे श्रेणियां यदि विभागीय प्रोन्नति समिति है, भर्ती करने में किन परिस्थितियों में संघ लोक जिनसे प्रोन्नति/प्रतिनियुक्ति/आमेलन किया जाएगा तो उसकी संरचना सेवा आयोग से परामर्श किया जाएगा

संग्रहालय/निदेशक संस्कृति मंत्रालय-सदस्य

प्रोन्नतिः वेतन बैंड - 3, 15600-39100 रु॰ + ग्रेड वेतन 5400 रु. में प्रोन्नति के लिए समूह 'क' सीध्ी भर्ती करते समय और किसी अध्किारी की राष्ट्रीय संग्रहालय के ऐसे उप रसायनज्ञ जिन्होंने उस श्रेणी में पांच विभागीय समिति की संरचना प्रतिनियुक्ति या संविदा पर नियुक्ति करते समय वर्ष नियमित सेवा की है। टिप्पणः सेवा की अवध् िके दौरान सचिवालय प्रशिक्षण और संग्रहालय - अध्यक्ष प्रबंध्न संस्थान या भारत सरकार द्वारा मान्यताप्राप्त किसी भी 2. संयुक्त सचिव - संस्कृति संस्था द्वारा संचालित एमएस ऑफिस स्वीट्‌ में कम से कम एक मंत्रालय, - सदस्य सप्ताह के कालावध् िका प्रशिक्षण पाठ्‌यक्रम सफलतापूर्वक पूरा 3. निदेशक (संरक्षण), राष्ट्रीय किया हो। टिप्पण 1ः जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी पुष्टि के लिए समूह 'क' विभागीय अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया समिति की संरचना जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया 1. महानिदेशक, राष्ट्रीय संग्रहालय-अध्यक्ष जाएगा परन्तु यह जब तक कि उसके द्वारा की गई ऐसी अर्हक/पात्रता 2. निदेशक/उपसचिव, संस्कृति मंत्रालय-सदस्य सेवा, अपेक्षित अर्हक/पात्रता सेवा, के आध्े से अध्कि से या 3. निदेशक (संकलन और प्रशासन), राष्ट्रीय दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे संग्रहालय-सदस्य कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही 4. निदेशक (प्रदर्शनी और जनसंपर्क), राष्ट्रीय पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी संग्रहालय-सदस्य परिवीक्षा की अवध् िसफलतापूर्वक पूरी कर ली हो। टिप्पण 2ः प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले/उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है नियमित आधर पर की गई सेवा को वेतन आयोग की सिफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी। प्रतिनियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है)ः—

केन्द्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रों या पब्लिक सेक्टर उपक्रमों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधन संस्थाओं या अर्द्धसरकारी या कानूनी या स्वायत्त संगठनों के अध्ीन कार्यरत ऐसे अध्किारीः

(क) (i) जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैं;

या

(ii) जिन्होंने मूल काडर या विभाग में वेतन बैंड - 3, 15600-39100 रु. + ग्रेड वेतन 5400 रु. के वेतनमान के पदों पर या समतुल्य पदों पर नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में पांच वर्ष सेवा की हो;

या

(iii) जिन्होंने मूल काडर या विभाग में वेतन बैंड - 2, 9300-34800 रु. + ग्रेड वेतन 4800 रु. के वेतनमान के पदों पर या समतुल्य पदों1480 THE GAZETTE OF INDIA : NOVEMBER 9, 2013/KARTIKA 18, 1935 [PART II—SEC. 3(i)] (11) पर नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में छः वर्ष सेवा की हो;

या

(iv) जिन्होंने मूल काडर या विभाग में वेतन बैंड - 2, 9300-34800 रु. + ग्रेड वेतन 4600 रु. के वेतनमान के पदों पर या समतुल्य पदों पर नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में सात वर्ष सेवा की हो;

या

(v) जिन्होंने मूल काडर या विभाग में वेतन बैंड - 2, 9300-34800 रु. + ग्रेड वेतन 4200 रु. के वेतनमान के पदों पर या समतुल्य पदों पर नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में दस वर्ष सेवा की हो; और

(ख) जिनके पास स्तंभ (7) के अध्ीन सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए विहित अर्हताएं और अनुभव हों।

टिप्पण 1ः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति/आमेलन पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

टिप्पण 2ः प्रतिनियुक्ति की अवध् ि(जिसके अंतर्गत अल्पकालिक संविदा भी है), जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया चार वर्ष से अध्कि नहीं होगी। प्रतिनियुक्ति द्वारा नियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है) के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अध्कि नहीं होगी।

टिप्पण 3ः प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले/उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद (उन पदों) पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है वेतन आयोग की सिफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में तीन वर्ष सेवा की हो;

या

(iv) जिन्होंने मूल काडर या विभाग में वेतन बैंड — 2, 9300-34800 रु. + ग्रेड वेतन 4200 रु. के

वेतनमान के पदों पर या समतुल्य पदों पर नियमित

आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में दो वर्ष

सेवा की हो; और

(ख) जिनके पास स्तंभ (7) के अध्ीन सीध्े भर्ती किए जाने वाले

व्यक्तियों के लिए विहित अर्हताएं और अनुभव हों।

पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति

में हैं, प्रतिनियुक्ति/आमेलन पर नियुक्ति के लिए विचार किए जाने

के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा

नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

New Delhi, the 31st October, 2013

G.S.R. 258 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the National Museum, New Delhi (Class I and II posts) Recruitment Rules, 1963, in so far as they relate to the post of Chemist, Assistant Chemist and Senior Chemical Assistant in the National Museum, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Chemist, Deputy Chemist and Assistant Chemist in the National Museum, New Delhi in the Ministry of Culture, namely:—

1. Short title and commencement.— (1) These rules may be called the Ministry of Culture, National Museum, New Delhi, Group 'Á' and 'B' posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay.—The number of the said post, its classification and the Pay Band and Grade Pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living has entered into or contracted a marriage with any person,

shall not be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. — Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.— Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 259.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय संग्रहालय, नई दिल्ली (वर्ग I और II पद) भर्ती नियम, 1963, को जहां तक उसका संबंध सहायक संरक्षक के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, संस्कृति मंत्रालय के राष्ट्रीय संग्रहालय, नई दिल्ली में सहायक संरक्षक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम संस्कृति मंत्रालय, राष्ट्रीय संग्रहालय, नई दिल्ली (सहायक संरक्षक) समूह 'ख' पद भर्ती नियम, 2013 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन.—उक्त पद की संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।

(ख) जो स्तम्भ-7 में सीध्ी भर्ती के लिए विहित शैक्षिक योग्यताएं और अनुभव रखता हो।

टिप्पणः 1-पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति/आमेलन पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

G.S.R. 259.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the National Museum, New Delhi (Class I and II posts) Recruitment Rules, 1963, in so far as they relate to the post of Assistant Conservator in the National Museum, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Conservator in the National Museum, New Delhi in the Ministry of Culture, namely:—

1. Short title and commencement.— (1) These rules may be called the Ministry of Culture, National Museum, New Delhi, (Assistant Conservator) Group 'B' posts Recruitment Rules, 2013.

(2) They shall come in to force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay.— The number of the said post, its classification and the pay band and grade pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc.— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the above said Schedule.

4. Disqualification.— No persons,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consulation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

Note 1: The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation/absorption. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

सा.का.नि. 260.—भारत के संविधन के अनुच्छेद, 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति एतद्‌दारा विदेश मंत्रालय के विध् िएवं संध् िप्रभाग, समूह 'क' पद, भर्ती नियमावली, 1989 का अध्क्रिमण करते हुए, उन बातों को छोड़कर जो ऐसे अध्क्रिमण से पहले की जा चुकी हैं या करने के लिए छोड़ दी गई हैं, विदेश मंत्रालय के विध् िएवं संध् िप्रभाग में समूह 'क' की भर्ती के तरीके को विनियमित करने के संबंध् में निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों को विदेश मंत्रालय , विध् िएवं संध् िप्रभाग , समूह 'क' पद भर्ती नियमावली, 2013 कहा जाएगा।

(2) ये राजपत्र में प्रकाशन की तारीख से प्रभावी होंगे।

2. प्रयोज्यता.— ये नियम इन नियमों के साथ सम्बद्ध अनुसूची के कॉलम (1) में विनिर्दिष्ट पदों के संबंध् में लागुू होंगे।

3. पदों की संख्या, वर्गीकरण,पे बैंड तथा ग्रेड पे अथवा वेतनमान.— उक्त पदों की संख्या, उनका वर्गीकरण और उनसे जुड़े पे बैंड तथा ग्रेड पे अथवा वेतनमान उक्त अनुसूची के कॉलम (2) से (4) में विनिर्देशों के अनुसार होंगे।

4. भर्ती का तरीका, आयु-सीमा और अर्हताएं.—भर्ती का तरीका, आयु-सीमा, अर्हताएं और उक्त पदों से संबंध्ति अन्य बातें कथित अनुसूची के कॉलम (5) से (13) में विनिर्देशों के अनुसार होंगे।

5. अनर्हता.— कोई ऐसा व्यक्ति (क) जिसने किसी ऐसे व्यक्ति से विवाह किया है या विवाह का इकरार किया है जिसकी एक जीवित पति/पत्नी है, अथवा (ख) जिसने एक जीवित पति/पत्नी के रहते हुए किसी अन्य व्यक्ति से विवाह किया या विवाह का इकरार किया है, उक्त पद पर नियुक्ति के लिए पात्र नहीं होगाः

परंतु यदि केंद्र सरकार की यह राय हो कि ऐसा विवाह उस व्यक्ति और दूसरे व्यक्ति के संबंध् में लागू पर्सनल लॉ के अंतर्गत स्वीकार्य है और ऐसे विवाह के लिए दूसरे आधर विद्यमान हैं तो किसी व्यक्ति को इन नियमों के लागूकरण से छूट प्रदान कर सकती है।

6. छूट देने की शक्ति.— जहां केंद्र सरकार मानती है कि ऐसा किया जाना जरूरी या अपरिहार्य है तो वह आदेश पारित करके तथा लिखित रूप से कारणों का उल्लेख करते हुए और संघ लोक सेवा आयोग से परामर्श करके व्यक्तियों के किसी वर्ग या श्रेणी के संबंध् में इन नियमों के किसी प्रावधन के प्रवर्तन में छूट प्रदान कर सकती है।

7. व्यावृत्तियां.— इन नियमों में कही गयी कोई बात केंद्र सरकार द्वारा समय-समय पर इस निमित्त जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और व्यक्तियों की अन्य विशेष श्रेणियों को दिए जाने वाले आरक्षण, आयु-सीमा में छूट और अन्य रियायतों को प्रभावित नहीं करेेगी।

प्रतिनियुक्तिः

भारतीय विध् िसेवा अथवा भारतीय विदेश सेवा के अध्किारी जो नियमित आधर पर सदृश पदों पर सेवारत हों और जिनके पास निम्नलिखित शैक्षिक अर्हताएं एवं अनुभव होः—

(i) अंतरराष्ट्रीय विध् िया अंतरराष्ट्रीय संबंधें/अन्तरराष्ट्रीय संगठनों में विशेषज्ञता के साथ किसी मान्यताप्राप्त विश्वविद्यालय से विध् िमें मास्टर डिग्री या समतुल्य।

टिप्पणीः

अंतरराष्ट्रीय विध् िमें अन्य बातों के साथ-साथ, अंतरराष्ट्रीय विध् िके मुख्य क्षेत्र जैसे सामुद्रिक विध्,ि मानवाध्किार विध्,ि अंतरराष्ट्रीय पर्यावरण विध्,ि अंतरराष्ट्रीय आपराध्कि विध् ितथा अंतरराष्ट्रीय व्यापार विध्ि शामिल होंगे।

(ii) विध् िमें न्यूनतम शैक्षिक योग्यता प्राप्त करने के उपरांत विध्कि कार्यों अर्थात्‌ अध्विक्ता, सरकार की विध्कि सेवा, विध् िमें अध्यापन या शोध् संचालन या मार्गदर्शन में 20 वर्षों का अनुभव जिसमें कम-से-कम 10 वर्ष, अंतरराष्ट्रीय विध् िया अंतरराष्ट्रीय संबंधें के क्षेत्र में हो।

(iii) मास्टर डिग्री स्तर पर नहीं परन्तु एम॰ फिल या पीएच॰ डी स्तर पर अंतरराष्ट्रीय विध् िमें विशेषज्ञता प्राप्त उम्मीदवार भी पात्र होंगे।

वाछंनीयः

(i) अंतरराष्ट्रीय विध् िमें डाक्टरेट।

(ii) अंतरराष्ट्रीय सम्मेलन कार्य में विध् िसे संबंध्ति पहलुओं और सामान्य अंतरराष्ट्रीय विध्,ि विशेषाध्किारों, उन्मुक्तियों तथा अंतरराष्ट्रीय व्यापार कानूनों और अंतरराष्ट्रीय नदियों तथा सामुद्रिक कानूनों से संबंध्ति विध्यिों के बारे में गोष्ठियों, सम्मेलनों और चर्चाओं में भाग लेने संबंध्ी 5 वर्ष का अनुभव।

फीडर संवर्ग के ऐसे विभागीय अध्किारी जो पदोन्नति के सीध्ी रेखा में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति पदोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे।

(इस नियुक्ति के तत्काल पहले उसी संगठन में या केन्द्रीय सरकार के किसी अन्य संगठन या विभाग में किसी संवर्ग इतर पद पर प्रतिनियुक्ति की अवध् िसहित प्रतिनियुक्ति की अवध् िसामान्यतः 5 वर्ष से अध्कि नहीं होगी। प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु सीमा आवेदन स्वीकार करने की अंतिम तारीख तक 56 वर्ष से अध्कि नहीं होगी)।

सशस्त्र बलों के कार्मिकों की प्रतिनियुक्ति अथवा पुनः नियोजन :

सशस्त्र बलों में लेफ्टिनेंट जनरल अथवा नौसना तथा वायु सेना में समकक्ष श्रेणी के पदधरकों, जो एक वर्ष की अवध् िमें सेवानिवृत्त होने वाले हैं अथवा जिन्हें आरक्षित वर्ग में स्थानांतरित किया जाना है तथा जो निर्धरित अर्हताएं एवं अनुभव रखते हैं, पर भी विचार किया जाएगा। चयन के पश्चात्‌ ऐसे अध्किारियों की प्रतिनियुक्ति की अवध् िसशस्त्र बलों में उनकी कार्यमुक्ति की तारीख तक होगी। उसके बाद वे पुनर्नियोजन की शर्तों पर सेवा जारी रख सकते हैं। यदि ऐसे पात्र अध्किारी पद पर चयन से पहले ही सेवानिवृत्त हो चुके हैं अथवा आरक्षित वर्ग में स्थानांतरित किए जा चुके हैं तो उन्हें पुनर्नियोजन के आधर पर नियुक्त किया जाएगा। (सिविल पदों के संदर्भ में अध्विर्षिता की आयु तक पुनर्नियोजन)।

सशस्त्र बलों के कार्मिकों की प्रतिनियुक्ति अथवा पुनः नियोजनः सशस्त्र बलों में मेजर जनरल अथवा नौसेना तथा वायु सेना में समकक्ष श्रेणी के पदधरक, जो एक वर्ष की अवध् िमें सेवानिवृत्त होने वाले हैं अथवा जिन्हें आरक्षित वर्ग में स्थानांतरित किया जाना है तथा जो निर्धरित अर्हताएं एवं अनुभव रखते हैं, पर भी विचार किया जाएगा। चयन के पश्चात्‌ ऐसे अध्किारियों की प्रतिनियुक्ति की अवध् िसशस्त्र बलों में उनकी कार्यमुक्ति की तारीख तक होगी। उसके बाद वे पुनर्नियोजन की शर्तों पर सेवा जारी रख सकते हैं। यदि ऐसे पात्र अध्किारी पद पर चयन से पहले ही सेवानिवृत्त हो चुके हैं तो अथवा आरक्षित वर्ग में स्थानांतरित किए जा चुके हैं उन्हें पुनर्नियोजन के आधर पर नियुक्त किया जाएगा। सिविल पदों के संदर्भ में अध्विर्षिता की आयु तक पुनर्नियोजन।

(ख) सीध्ी भर्ती के लिए जो कॉलम 7 में निर्धरित शैक्षिक अर्हता तथा अनुभव रखते हों। फीडर संवर्ग के ऐसे अध्किारी जो पदोन्नति की सीध्ी रेखा में हैं, प्रतिनियुक्ति पर नियुक्ति के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्त अध्किारी पदोन्नति द्वारा नियुक्ति पर विचार के पात्र नहीं होंगे।

सशस्त्र बलों के कार्मिकों की प्रतिनियुक्ति अथवा पुनर्नियोजनः

G.S.R. 260.—In exercise of the power conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of External Affairs, Legal and Treaties Division, Group 'A' posts Recruitment Rules, 1989, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to certain Group 'A' posts in the Legal and Treaties Division in the Ministry of External Affairs, namely:—

1. Short title and commencement.—(1) These Rules may be called the Ministry of External Affairs, Legal and Treaties Division, Group 'A' Posts Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Offical Gazette.

2. Application.—These rules shall apply to the posts mentioned in column (1) of the schedule, annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The Number of the said posts, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications.—The method of recruitment, age limit, qualification and other matters to the said posts, shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.—

No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may be order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Armed Forces Personnel and other special categories of persons, in accordance with the orders issued by the Central Government from time to time, in this regard.

(iii) Candidates having specialization in International Law in

M. Phil or Ph. D level, but not at Master's level will also be eligible.

Desirable:

(i) M.Phil or Doctorate in International Law.

(ii) 5 years' experience in International Conference work in its

Legal aspects, as also participation in seminars. Conferences and negotiations relating to matters pertaining to general

International Law, privileges and immunities, International Trade Laws and laws relating the International rivers and Law

of Sea.

The departmental officers in the feeder category who are in

the direct line of promotion will not be eligible for consideration

for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

The Armed Froces Personnel of the rank of Act. Brigadier and Lt. Such persons would be given deputation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be continued on re- employment. In case such eligible officers have retired or have been transferred to reserve before and actual selection to the post is made their appointment will be on Re- employment basis.
