सा.का.नि. 2.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और लाल बहादुर शास्त्राी राष्ट्रीय प्रशासन अकादमी, मसूरी, कार्मिक, लोक शिकायत एवं पेंशन मंत्राालय, कार्मिक एवं प्रशिक्षण विभाग में ज्येष्ठ जिल्दसाज के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कार्मिक, लोक शिकायत एवं पेंशन मंत्राालय, कार्मिक एवं प्रशिक्षण विभाग, लाल बहादुर शास्त्राी राष्ट्रीय प्रशासन अकादमी ज्येष्ठ जिल्दसाज भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

आधरित पुनरीक्षित वेतन संरचना का विस्ताार किया गया है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा तत्स्थानी वेतन या वेतन आयोग की सिपफारिशों के आधर पर विस्तारित वेतनमान में की गई सेवा समझी जाएगी । प्रतिनियुक्ति : केन्द्रीय सरकार या राज्य सरकारों के ऐसे अध्किारी : ;1द्ध जो नियमित आधर पर सदृश पद धरण किए हुए हैं, या ;2द्ध जिन्होंने वेतन बैंड-1 और ग्रेड वेतन 1800 ` में तीन वर्ष नियमित सेवा की है : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित कियी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी । टिप्पणी : प्रतिनियुक्ति या आमेलन के आधर पर नियुक्ति केे प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद या उन पदों पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 2.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Book Binder in the Lal Bahadur12 THE GAZETTE OF INDIA : JANUARY 11, 2014/PAUSA 21, 1935 [PART II—SEC.3(i)] Shastri National Academy of Administration, Mussoorie, Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, Lal Bahadur Shastri National Academy of Administration, Senior Book Binder Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and the pay band and grade pay or pay scale.—The number of the said posts, its classification and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualifications, etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the Pay Commission.

Deputation :

Officers of Central or State Governments :

(i) holding analogous posts on regular basis; or

(ii) with three years' regular service in posts in PB-1 with grade pay ` 1800 : Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organization or Department in the Central Government shall ordinarily not exceed three years. The maximum age limit for appointment on deputation shall not exced 56 years as on the closing date of receipt of application. Note : For purposes of appointment on deputation basis, the services rendered on a regular basis by an officer prior to the 1-1-2006/date from which the revised pay structure bases on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/ pay scale is the normal replacement grade without any upgradation.

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में उन कारणों के लिए, जो लेखब( किए जाएं, संघ लोक सेवा आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण 2 : अनुभव संबंध्ी अर्हता उन कारणों के लिए, जो लेखब( किए जाएँ, संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

G.S.R. 3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Public Relation Officer in the Lal Bahadur Shastri National Academy of Administration, Mussoorie, Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training, namely :—

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and the pay band and grade pay or pay scale.—The number of the post, its classification and the pay band and grade pay and pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-service persons and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 4.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और कृषि मंत्राालय, पशु पालन और डेयरी विभाग, केन्द्रीय पशु प्रजनन पफार्म ;निदेशकद्ध भती नियम, 1993 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, पशु पालन, डेयरी और मत्स्यपालन विभाग केन्द्रीय पशु प्रजनन पफार्म में निदेशक, समूह 'क' राजपत्रिात पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, पशु पालन, डेयरी और मत्स्य पालन विभाग, केन्द्रीय पशु प्रजनन पफार्म निदेशक,;समूह 'क'द्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों के बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

3. पशु प्रजनन और आनुवंशिक विज्ञान या पशुध्न उत्पादन और प्रबंध् या स्त्राी रोग विज्ञान और प्रसूति विज्ञान में स्नातकोत्तर उपाध् ि।

4. पशु चिकित्सा क्लीनिक या बहु क्लीनिक या पशु पफार्म में पशु चिकित्सा सर्जन के तौर पर 5 वर्ष का अनुभव ।

टिप्पण 2 : अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध उन कारणों से जो लेखब( किए जाएं, संघ लोक सेवा आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

टिप्पण 2 : जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवाक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 4.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture, Department of Animal Husbandry and Dairying, Central Cattle Breeding Farm (Director)25 [भाग IIखण्ड 3(i)] भारत का राजपत्रा : जनवरी 11, 2014/पौष 21, 1935 Recruitment Rules, 1993, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Director, Group 'A' Gazetted post in the Central Cattle Breeding Farms, under Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, namely :—

1. Short title and commencement.—(1) These rules may be called the Central Cattle Breeding Farms, Ministry of Agriculture, Department of Animal Husbandry Dairying and Fisheries, Director (Group 'A') Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

3. Method of recruitment, age limit and other qualifications.—The method of recruitment to the said post, age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The eligibility list for promotion shall be prepared with

reference to date of completion by the officers of the prescribed

qualifying service in the respective grade or post.

Note 2 : Where juniors who have completed their qualifying or

eligibility service are being considered for promotion, their seniors

would also be considered provided they are not short of the requisite

qualifing or eligibility service by more than half of such qualifying

or eligibility service or two years, whichever is less, and have

successfully completed their probation period for promotion to the

next higher grade along with their juniors who have already completed

such qualifying or eligibility service.

Note 3 : For the purpose of computing minimum qualifying service

for promotion, the service rendered on a regular basis by an officer

prior to 1-1-2006 or the date from which the revised pay structure

based on the Sixth Central Pay Commission recommendations has

(a) (i) holding analogous posts rendered after appointment

thereto on regular basis in the parent cadre or

Department; or

(ii) with 5 years' service in the grade rendered after

appointment thereto on regular basis in the scale of pay

of Rs. 15600-39100 + Grade Pay of Rs. 5400 in PB-3 or

equivalent in the parent cadre or Department; or

(iii) with 6 years' service in the grade rendered after

appointment thereto on regular basis in the scale of pay

of Rs. 9300-34800 + Grade Pay of Rs. 4800 in PB-2; or

equivalent in the parent cadre or Department; and

(b) Possessing educational qualifications and experience

prescribed for direct recruits under column (7).

(The departmental officers in the feeder category who are in the

direct line of promotion will not be eligible for consideration for

appointment on deputation. Similarly, deputationists shall not be

eligible for consideration for appointment by promotion).

(Period of deputation (including short term contract) period of

deputation in another ex-cadre post held immediately preceding

this appointment in the same or some other organization or

Department of the Central Government shall ordinarily not exceed 4

(four) years. The maximum age limit for appointment by deputation

(including short term contract shall not exceed 56 years as on the

closing date of receipt of applications).

Note : For the purpose of appointment on deputation basis, the

service rendered on a regular basis by an officer prior to 1-1-2006

(the date from which the revised pay structure based on the Sixth

Central Pay Commission recommendation has been extended) shall

be deemed to be service rendered in the corresponding grade pay

or pay scale extended based on the recommendations of the Pay

Commission except where there has been merger of more than one

pre-revised scale of pay into one grade with a common grade pay

and pay scale, and where this benefit will extend only for the post(s)

for which that grade pay or pay scale is the normal replacement

grade without any upgradation.

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन अथवा वेतनमान.—उक्त पद संख्या, उसका वर्गीकरण, वेतन बैंड एवं ग्रेड पे अथवा उससे उपाब( वेतनमान वह होगा, जो उक्त अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

उक्त पद पर नियुक्ति के लिए पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां उसके लिए जो कारण हैं, उन्हें लेखब( करते हुए और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों के बारे में, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई भी बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन हेतु किसी अध्किारी द्वारा 1-1-2006 ;वह तारीख जब से छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित संशोध्ति वेतन संरचना में विस्तार किया गया हैद्ध से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

और अनुभव रखते हों ।

टिप्पण 1 : पोषक प्रवर्ग में ऐसे विभागीय अध्किारी जो प्रोन्नति की सीध्ी पंक्ति में हैं, को प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध् िजिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी बाह्‌य संगठन में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 ः प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

G.S.R. 5.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Surface Transport, Transport Research Division (Transport Wing) (Senior Investigator Group B Posts) Recruitment Rules, 1988, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Economic Officer in the Ministry of Road Transport and Highways, Transport Research Wing, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Road Transport and Highways, Transport Research Wing, Group 'B' Post Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying/ eligibility service by more than half of such qualifying/eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/ eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006, the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Pay Commission.

Deputation : Officers of the Central or State Governments or Union Territories :

1. (a) holding analogous posts on regular basis in parent cadre

or department;

(b) with five years service in the grade rendered after appointment thereto on regular basis in pay band-2 of Rs. 9300—14734800 with grade pay of Rs. 4200 or equivalent in the parent cadre or department; and

2. Possessing educational qualifications and experience

prescribed for direct recruits under column (7).

Note 1 : The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years.

Note 3 : The maximum age imit for appointment by deputation shall not be exceeding 56 years as on closing date of receipt of applications.
