सा.का.नि. 11.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विज्ञान और प्रौद्योगिकी विभाग ;समूह 'ग' एवं समूह 'घ' पदद्ध भर्ती नियम, 2001 को जहां तक उनका संबंध् प्रबंध्क ;अतिथि गृहद्ध के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, विज्ञान और प्रौद्योगिकी मंत्राालय में प्रबंध्क ;अतिथि गृहद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विज्ञान और प्रौद्योगिकी मंत्राालय में प्रबंध्क ;अतिथि गृहद्ध समूह 'ग' पद भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और वेतनमान वे होंगे जो उक्त अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो ऊपर अनुसूची के स्तम्भ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैै,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी भी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किन्ही उपबंधें को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

;iiद्ध जिन्होंने 2400 रफ. ग्रेड वेतन के साथ वेतन बैंड-1, 5200—20200 रु. या समकक्ष में विद्यमान काडर या विभाग में नियमित आधर पर नियुक्ति के पश्चात्‌ 5 वर्ष की सेवा की है ।

वांछनीय : जिनके पास केंद्रीय सरकार या राज्य सरकार या विश्वविद्यालयों या वैज्ञानिक अनुसंधन संस्थानों या परिषदों या स्वशासी या कानूनी निकायों या पब्लिक सेक्टर उपक्रमों में केयरटेकर या प्रबंध्क ;कैंटीनद्ध या नयाचार सहायक का दो वर्ष का अनुभव है और जिनके पास लेखाओं के रखरखाव की जानकारी और कम से कम एक वर्ष का अनुभव है ।

टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध, साधरणतया तीन वर्ष से अध्कि नहीं होगी।

टिप्पण 2 : प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा, 1 जनवरी, 2006 से या उस तारीख से, जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधर पर की गई सेवा को उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझा जाएगा, सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमानों का सामान्य ग्रेड वेतन या वेतनमानों के साथ एक श्रेणी में विलय हो गया है, और जहां यह लाभ केवल उस पद ;उन पदोंद्ध के लिए विस्तारित होगा, जिसके ;जिनकेद्ध लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधारण प्रतिस्थापन ग्रेड है ।

G.S.R. 11.—In exercise of the powers conferred by the proviso to Article 309 of the Constiution and in supersession of the Department of Science and Technology (Group 'C' and 'D' posts) Recruitment Rules, 2001, in so far as they relate to the post of Manager (Guest House), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Manager (Guest House) in the Department of Science and Technology under the Ministry of Science and Technology, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Science and Technology, Department of Science and Technology, Manager (Guest House), Group 'C' post Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of posts, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matter relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marnage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with the respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : The period of deputation (including short term contract) including the period of deputation (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not exceed three years.

Note 2 : The maximum age limit for appointment by deputation (including short term contract) shall be not exceeding 56 years as on .the closing date of receipt of applications.

Note 3 : For purpose of appointment on deputation, the service rendered on a regular basis by an officer prior to 1st January, 2006 or

the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one

grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up-gradation.

G.S.R. 12.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Gestetner Operator-cum-Blue Print Machine Operator Recruitment Rules, 2012, namely:-

1. (1) The rules may be called the Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Gestetner Operator- cum-Blue Print Machine Operator Recruitment (Amendment) Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Gestetner Operator-cum-Blue Print Machine Operator Recruitment Rules, 2012, in the Schedule, in column (9), for the entries "Two years", the following entries shall be substituted, namely:-

"Not applicable."

1. (1) These rules may be called the Central Institute of Coastal Engineering for Fishery, Bangalore, Foreman (Drilling), Driller and Field Assistant Recruitment (Amendment) Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the said rules of Field Assistant, in Schedule—

(i) against serial number 3, in column (9) for "Two years" substitute "Two years for direct recruits".

(ii) against serial number 3, in column (11) for "Rs.1900" substitute "Rs.1800".

सा.का.नि. 15.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्‌वारा प्रदत्त शक्तियों का प्रयोग करते हुए और खाद्‌य मंत्राालय ;समूह 'क' और समूह 'ख' अननुसचिव पदद्ध भर्ती नियम, 1992 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, उपभोक्ता मामले मंत्राालय, खाद्‌य और सार्वजनिक वितरण विभाग, समूह 'क' और समूह 'ख' अननुसचिव पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम उपभोक्ता मामले, खाद्‌य और सार्वजनिक वितरण मंत्राालय, खाद्‌य और सार्वजनिक वितरण विभाग ;समूह 'क' और समूह 'ख' अननुसचिव पदद्ध भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट है ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैै,

उक्त पदों में से किसी पर नियुक्ति का पात्रा नहीं होगा :

परन्तु किसी केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्‌वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनर्रीक्षण वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के, जहां एक से अध्कि पूर्व-पुनर्रीक्षित वेतनमानों को साधरण गे्रड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है, और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा, जिसके ;जिनकेद्ध लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

वांछनीय : किसी मान्यताप्राप्त विश्वविद्‌यालय से प्राणी विज्ञान या वनस्पति विज्ञान या जैव रसायन विज्ञान या कृषि के क्षेत्रा में पीएचडी ।

टिप्पण :—पोषक वर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्निति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्‌वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । प्रतिनियुक्ति की अवध्,ि जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया पाँच वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्‌वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्‌वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के, जहां एक से अध्कि पूर्व-पुनर्रीक्षित वेतनमानों को साधरण गे्रड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है, और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा, जिसके ;जिनकेद्ध लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेउ वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

टिप्पण :—अर्हताएं, कारणों को लेखब( करते हुए अन्यथा सुअहत अभ्यर्थियों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती है ।

टिप्पण :— अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की सम्भावना नहीं है ।

G.S.R. 15.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Food ( Group 'A' and Group 'B' Non-Secretariat posts) Recruitment Rules, 1992, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, to regulate the method of recruitment to the Group 'A' and Group 'B' Non-Secretariat posts in the Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Consumer Affairs, Food and Public Distribution, Department of Food and Public Distribution (Group 'A' and Group 'B', Non-Secretariat Posts) Recruitment Rules, 2013.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any persons,

shall not be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 16.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय लोक निर्माण विभाग ;तकनीकी अध्किारीद्ध भर्ती नियम, 2002 को उन बातों के सिवाय ऐसे अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, राष्ट्रपति एतद्‌द्वारा शहरी विकास मंत्राालय, केन्द्रीय लोक निर्माण विभाग में तकनीकी अध्किारी के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम शहरी विकास मंत्राालय, केन्द्रीय लोक निर्माण विभाग ;तकनीकी अध्किारीद्ध समूह 'ख' पद भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद की संख्या, उसका वर्गीकरण और वेतन बैंड और ग्रेड वेतन या उससे संब( वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हता आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैै,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

बशर्ते केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी भी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकती है ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि या दो वर्ष, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परीवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

G.S.R. 16.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Public Works Department (Technical Officer) Recruitment Rules, 2002, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Technical Officer, Central Public Works Department in the Ministry of Urban Development, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Urban Development, Central Public Works Department (Technical Officer) Group 'B' post Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of posts, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to the rules.

3. Method of recruitment, age-limit and qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the above said schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall not be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxations of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the Pay Commission.
