सा.का.नि. 58.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्‌वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कार्मिक और प्रशिक्षण विभाग, कार्मिक, लोक शिकायत और पेंशन मंत्राालय में सिस्टम प्रोग्रामर के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कार्मिक, लोक शिकायत और पेंशन मंत्राालय, कार्मिक और प्रशिक्षण विभाग, सिस्टम प्रोग्रामर ;समूह 'ख'द्ध अराजपत्रिात अननुसचिवीय, भर्ती नियम, 2013 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैै,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केंद्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केंद्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केंद्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 :—अर्हताएं, अन्यथा सुअहत अभ्यर्थियों की दशा में ;अर्हताएंद्ध उन कारणों के लिए जो लेखब( किए जाएं । कर्मचारी चयन आयोग या सक्षम अध्किारी के विवेकानुसार करके शिथिल की जा सकती है ।

टिप्पण 2 ः—अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध उन कारणों के लिए जो लेखब( किए जाएं । कर्मचारी चयन आयोग या सक्षम अध्किारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की सम्भावना नहीं है ।

;iiद्ध जिनकी मूल काडर या विभाग में वेतन बैंड-2, 9300—34800 रु. और ग्रेड वेतन 4200 रु. में नियमित आधर पर इसमें नियुक्ति के पश्चात्‌ श्रेणी के पद पर पांच वर्ष की सेवा है ऋ और

;खद्ध स्तंभ ;7द्ध के अध्ीन सीध्ी भर्ती के लिए विहित शैक्षिक अर्हताएं और अनुभव रखते हों ।

टिप्पण 1 : प्रतिनियुक्ति ;आई.एम.टी.पी.द्धकी अवध्,ि जिसके अंतर्गत केंद्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया 3 वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति ;आई.एस.टी.पी.द्ध द्‌वारा नियुक्ति के लिए अध्कितम आयु-सीमा ओवदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति या आमेलन के आधर पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्‌वारा, 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ[भाग II—खण्ड 3(i)] भारत का राजपत्रा : मार्च 15, 2014/पफाल्गुन 24, 1935 285 ;11द्ध

केवल उस पद पर विस्तारित होगा, जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 58.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of System Programmer in Department of Personnel and Training, in the Ministry of Personnel, Public Grievances and Pensions, namely :—

1. Short title and commencement.—(i) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, Department of Personnel and Training, System Programmer (Group 'B', Non-Gazetted, Non-Ministerial) Recruitment Rules, 2013.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band, grade pay or pay scale.—The number of the said post, its classification, and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualification, etc.—The method of recruitment, age-limit, qualification and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or286 THE GAZETTE OF INDIA : MARCH 15, 2014/PHALGUNA 24, 1935 [PART II—SEC. 3(i)] (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1.—Qualifications are relaxable at the discretion of the Staff Selection Commission or Competent Authority, for reasons to be recorded in writing, in case of candidates otherwise well qualified. Note 2.—The Qualifications regarding experience is relaxable at the discretion of the Staff Selection Commission or Competent Authority, for reasons to be recorded in writing, in the case of candidates belonging to the Scheduled Castes or the Scheduled Tribes, if at any stage of selection, the Staff Selection Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

Note 1 : The period of deputation (ISTC) in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not to exceed three years. The maximum age-limit for appointment by Deputation (ISTC) shall not be exceeding fifty-six years as on the closing date or receipt for application.

Note 2 : For the purpose of appointment on deputation basis the

service rendered on a regular basis by an officer prior to the 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has

been merger of more than one pre-revised pay scale into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation.

G.S.R. 59.—In exercise of the powers conferred by Section 112 of the Indian Railway Act 1989 (24 of 1989), the Central Government hereby makes the following amendment to the Statutory Investigation into Railway Accidents Rules 1998, namely:

1. (a) These rules may be called the Statutory Investigation into Railway Accidents (Amendment) Rules 2013.

(b) They shall come into force with immediate effect.

2. In sub rule (2) under rule 2 of the Statutory Investigation into Railway Accidents Rules 1998, for the words ''twenty five lakh rupees", the words '' rupees two crore" shall be substituted.

सा.का.नि. 60.—संविधन के अनुच्छेद 9 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वस्त्रा आयुक्त ;समूह 'ग' एवं 'घ' अराजपत्रिात पद द्ध का कार्यालय भर्ती नियम 1989 के अध्क्रिमण में राष्ट्रपति वस्त्रा आयुक्त का कार्यालय, वस्त्रा मंत्राालय में बहुकार्यात्मक स्टापफ ;एमटीएसद्ध के पदों की भर्ती की प(ति को विनियमित करने संबंध्ी निम्नलिखित नियम बनाता है, नामतः :

1. लघु शीर्षक और प्रारंभ.—;1द्ध इन नियमों को वस्त्रा मंत्राालय, वस्त्रा आयुक्त का कार्यालय, बहुकार्यात्मक स्टापफ ;एमटीएसद्ध, समूह 'ग' पद भर्ती नियमावली 2014 कहा जाएगा ।

;2द्ध ये नियम सरकारी राजपत्रा में उनके प्रकाशन की तिथि से लागू होंगे ।

2. पद की संख्या, वर्गीकरण और पे-बैंड तथा ग्रेड वेतन अथवा वेतनमान.—इनसे संब( उक्त पद की संख्या, उनका वर्गीकरण, पे-बैंड तथा ग्रेड वेतन अथवा वेतनमान इन नियमों के साथ संलग्न अनुसूची के कालम 2 से 4 में यथा-निदष्ट होंगे ।

3. भर्ती की प(ति, आयु-सीमा और अर्हता आदि.—इनसे संबंध्ति भर्ती की प(ति, आयु सीमा, अर्हता और अन्य मामले उक्त अनुसूची के कालम ;5द्ध से ;13द्ध में यथा-निदष्ट होंगे ।

4. अनर्हता.—ऐसा कोई व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति के साथ विवाह कर लिया है अथवा करने की वचनब(ता की है, जिसके कि पहले से ही जीवित पत्नी या जीवित पति मौजूद है ।

;खद्ध जिसने जीवित पत्नी या पति के रहते हुए किसी के साथ विवाह कर लिया है अथवा करने की वचनब(ता की है ।

उक्त पद पर नियुक्ति के लिए पात्रा नहीं होगा :

परन्तु यदि केन्द्र सरकार संतुष्ट होती है कि ऐसा विवाह ऐसे व्यक्ति और विवाह की अन्य पार्टी के लिए लागू व्यक्तिगत कानून के अंतर्गत अनुमेय हैं और ऐसा करने के लिए अन्य आधर हैं तो इस नियम के प्रचालन से किसी व्यक्ति को छूट दे सकती है ।

5. छूट देने की शक्ति.—जहां केन्द्र सरकार की यह राय हो कि ऐसा करना अनिवार्य अथवा समीचीन होगा तो किसी श्रेणी अथवा वर्ग के व्यक्ति को इन नियमों के प्रावधनों से कारणों को लिखित में रिकार्ड किए जाने पर, छूट देने के आदेश दे सकती है ।

6. बचत ;छूटद्ध.—केन्द्र सरकार द्‌वारा समय -समय पर जारी किए जाने वाले आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, भूतपूर्व सैनिकों और विशिष्ट श्रेणी के व्यक्तियों के लिए प्रदान किए जाने के अपेक्षित आरक्षण, आयु सीमा में छूट और अन्य रियायतें इन नियमों से प्रभावित नहीं हाेंगी ।

रोजगार कार्यालय के माध्यम से की गई भर्ती के मामले में आयु सीमा निर्धरण की निर्णायक तारीख उस रोजगार कार्यालय द्‌वारा नाम प्रस्तुत करने की अंतिम तिथि होगी ।

G.S.R. 60.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Office of the Textile Commissioner (Group 'C' and 'D' Non-Gazetted Posts) Recruitment Rules, 1989, the President hereby makes the following rules regulating the method of recruitment to the posts of Multi-Tasking Staff in the Ministry of Textiles, in the Office of the Textile Commissioner namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Textiles, Office of the Textile Commissioner, Multi-Tasking Staff, Group 'C' Post Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such persons and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.
