सा.का.नि. 76.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विध्,ि न्याय और कंपनी कार्य मंत्राालय ;विधयी विभागद्ध ;समूह 'ग' पदद्ध भर्ती नियम, 1999 को, जहां तक उसका संबंध् प्रूपफ रीडर और प्रलेखन सहायक के पदों से है और विध् िऔर न्याय मंत्राालय, विधयी विभाग ;कॉपी होल्डरद्ध समूह 'ग' पर भर्ती नियम, 2003 को, उन बातों के सिवाय, आंशिक रूप से अध्क्रिान्त करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, विध् िऔर न्याय मंत्राालय, विधयी विभाग में समूह 'ग' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विधयी विभाग ;समूह 'ग' पदद्ध भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

*कार्यभार के सेवा, समूह 'ग' 5200— ;केन्द्रीय सरकार द्वारा जारी किए गए आधर पर ;अराजपत्रिातद्ध, 20200 रफ. + अनुदेशों या आदेशों के अनुसार सरकारी परिवर्तन किया अननुसचिवीय ग्रेड वेतन कर्मचारियों के लिए शिथिल की जा सकती जा सकता है । 2800 रफ. है ।द्ध

टिप्पण : आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरूणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा-जिले के पांगी उपखण्ड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है ।द्ध[भाग II—खण्ड 3(i)] भारत का राजपत्रा : अप्रैल 26, 2014/वैशाख 6, 1936 403 सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित सीध्े भर्ती किए जाने वाले परिवीक्षा की अवध्,ि शैक्षिक और अन्य अर्हताएं

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा या प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न प(तियों द्वारा या प्रतिनियुक्ति या आमेलन किया जाएगा भरी जाने वाली रिक्तियों की प्रतिशतता

;iद्ध 50 प्रोन्नति द्वारा जिसके न हो सकने पर प्रति- प्रोन्नति :— विध् िऔर न्याय मंत्राालय के विधयी विभाग में ऐसे कॉपी होल्डर नियुक्ति द्वारा, दोनों के न हो सकने पर सीध्ी भर्ती द्वारा जिन्होंने वेतन बैंड-1, 5200—20200 रु. + ग्रेड वेतन 1900 रु. की श्रेणी में तेरह ;iiद्ध 50 प्रतिनियुक्ति या आमेलन द्वारा जिसके न हो वर्ष नियमित सेवा की है और जो विभागीय परीक्षा में अंग्रेजी प्रूपफ रीडिंग में अर्हित सकने पर सीध्ी भर्ती द्वारा । हो ।

टिप्पण 1 : आठ वर्ष नियमित सेवा की पात्राता की सेवा इन नियमों के प्रकाशन की तारीख को नियमित आधर पर पोषक पदों को धरण करने वाले व्यक्तियों के लिए वही पात्राता सेवा निरंतर होगी ।

टिप्पण 2 : जहाँ ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति या आमेलन : केन्द्रीय सरकार के कार्यालयों में या भारत सरकार के मुद्रणालयों में नियमित आधर पर समरुप या समतुल्य श्रेणी में सेवारत ऐसे व्यक्ति जिनके पास निम्नलिखित शैक्षिक और अन्य अर्हताएं हैं :—

आवश्यक :

;iद्ध किसी केन्द्रीय अध्निियम/प्रांतीय अध्निियम या किसी राज्य अध्निियम द्वारा या उसके अध्ीन निगमित किसी मान्यताप्राप्त विश्वविद्यालय से या किसी उच्चतर शिक्षा संस्था से जिसे केन्द्रीय सरकार द्वारा विश्वविद्यालय के रूप में समझा गया है या केन्द्रीय सरकार द्वारा अनुमोदित किसी अन्य संस्था या विदेशी विश्वविद्यालय से डिग्री ऋ

;iiद्ध विध् िऔर न्याय मंत्राालय में और/या केन्द्रीय सरकार के या राज्य सरकार के किसी मुद्रणालय में या किसी भी अन्य मुद्रणालय में या किसी समाचार पत्रा कार्यालय में अंग्रेजी में मुद्रण कार्य का न्यूनतम पांच वर्ष का अनुभव ।

;iiiद्ध विभागीय परीक्षा में अंग्रेजी प्रूपफ रीडिंग में अर्हित हो ।

किसी मान्यताप्राप्त विश्वविद्यालय से विध् िमें डिग्री ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

प्रतिनियुक्ति द्वारा ऐसे व्यक्ति जो केन्द्रीय सरकार में वेतन बैंड-1, जिन्होंने वेतन बैंड-1, 5200—20200 रु. + ग्रेड वेतन 2400 रु. में सदृश या समतुल्य पद या पदों को धरण किए हुए हैं और जिनके पास संसदीय कार्य और/या विध्कि प्रकृति के प्रलेखनों से संबंध्ति मामलों के कार्यों में न्यूनतम दो वर्ष का अनुभव है ।

टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

12वीं कक्षा उत्तीर्णऋ

;iiद्ध अंग्रेजी में प्रति मिनट कम से कम 35 शब्द टंकण करने में समर्थ होना चाहिए। ;शारीरिक रूप से असुविदाग्रस्त शिथिल की जा सकती है ।द्ध

टिप्पण 1 : अर्हताएं, अन्यथा सुअहत अभ्यथयों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती है । टिप्पण 2 ः अनुभव संबंध्ी अर्हता ;अर्हताएंद्ध सक्षम प्राध्किारी के विवेकानुसार अनुसूचित जातियों या अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है ;हैंद्ध जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की सम्भावना नहीं है ।

वांछनीय : ;iद्ध किसी मुद्रणालय या समाचारपत्रा कार्यालय में अंग्रेजी कापी होल्डग या प्रूपफ रीडग कार्य का अनुभव । ;iiद्ध हदी का न्यूनतम ज्ञान ।

;iद्ध 50 प्रतिशत सीध्ी भर्ती द्वारा । प्रतिनियुक्ति या आमेलन :

;iiद्ध 50 प्रतिशत प्रतिनियुक्ति या आमेलन द्वारा पदधरियों केन्द्रीय सरकार या राज्य सरकार के ऐसे अध्किारी :— की प्रतिनियुक्ति या लंबी बीमारी या अध्ययन छुट्‌टी या ;कद्ध ;iद्ध जो भारत सरकार या किसी भी मंत्राालय या विभाग के मुद्रणालय किन्हीं अन्य परिस्थितियों के अध्ीन एक वर्ष या इससे में नियमित आधर पर सदृश पद धारण किए हुए हैंऋ या अध्कि अवध् िके लिए बाहर रहने के कारण हुई रिक्तियां ;iiद्ध जो विध् िऔर न्याय मंत्राालय में नियमित आधर पर समूह 'ग' विध् िऔर न्याय मंत्राालय, विधयी विभाग के ऐसे समूह 'ग' पद ;जिसमें सपफाईवाला और पफराश भी सम्मिलित हैद्ध, पद कर्मचारियों में से प्रतिनियुक्ति के आधर पर भरी जा सकेंगी धारण किए हुए हैं और जिसके पास कंप्यूटर प्रचालन का अच्छा जिनके पास स्तंभ ;7द्ध के अध्ीन सीध्े भर्ती किए जाने वाले ज्ञान हैऋ और व्यक्तियों के लिए अर्हताएं और विहित अनुभव है । ;खद्ध जिनके पास स्तंभ ;7द्ध के अध्ीन सीध्े भर्ती के किए जाने वाले

व्यक्तियों के लिए शैक्षिक अर्हताएं और विहित अनुभव है । टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

G.S.R. 76.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in partial supersession of the Ministry of Law, Justice and Company Affairs (Legislative Department) Group 'C' Posts Recruitment Rules, 1999, in so far as they relate to the posts of Proof Reader and Documentation Assistant and in supersession of the Ministry of Law and Justice, Legislative Department (Copy Holder) Group 'C' Posts Recruitment Rules, 2003, except as respects things done or omitted to be done, before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' Posts in the Legislative Department, Ministry of Law and Justice, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Law and Justice, Legislative Department, (Group 'C' Posts), Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, its classification, and Pay Band and Grade Pay or Pay Scale.—The number of post, its classification, Pay Band and Grade Pay or Pay Scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. .—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years, whichever is less and for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 3 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the said Pay Commission.

Deputation or Absorption :

Persons working in similar or equivalent grade on regular basis in the Central Government Offices or Government of India Presses and possessing educational and other qualifications as under :

Essential :

(i) A Degree of a recognised University incorporated by or under a Central Act: Provincial Act or a State Act or any institution for higher education deemed to be a University by the Central Government or any other institution or foreign University approved by the Central Government.

(ii) Minimum five years experience of Printing work in English in the Ministry of Law and Justice and/or any Central Government or a State Government Press or any other Press or a Newspaper office.

(iii) Should qualify in a departmental test in English Proof Reading.

Desirable :

A degree in Law of a recognised University.

Note 1: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम प्रौढ़ शिक्षा निदेशालय, मानव संसाध्न विकास मंत्राालय , स्कूल शिक्षा और साक्षरता विभाग, नई दिल्ली ;कनिष्ठ अनुवादकद्ध भर्ती नियम, 2014 है ।

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडें़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 77.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Adult Education(Hindi Translator), Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Junior Translator in the Directorate of Adult Education, Ministry of Human Resource Development, Department of School Education and Literacy, New Delhi, namely :—

1. Short title and commencement.—(1) These rules may be called the Directorate of Adult Education, Ministry of Human Resource Development, Department of School Education and Literacy New Delhi,(Junior Translator), Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. These rules shall be applicable to the post specified in the Schedule annexued to these rules.

3. Number of posts, classification and scale of pay.— The number of the said posts, their classification and pay band and grade payor scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit, educational qualifications, etc.-—The method of recruitment, age limit, educational qualifications and other matters relating to the said post, shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. No person,-

(a) who has entered into or contracted a marriage with a person having spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 80.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्राकृतिक विज्ञान संग्रहालय, प्रयोगशाला परिचर भर्ती नियम, 1975 को, उन बातों के सिवाय अध्क्रिान्त करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, पर्यावरण एवं वन मंत्राालय के राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय में प्रयोगशाला परिचर के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम पर्यावरण एवं वन मंत्राालय, राष्ट्रीय प्राकृतिक विज्ञान संग्रहालय, प्रयोगशाला परिचर भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पदों की संख्या, उनका वर्गीकरण, पे बैंड, ग्रेड वेतन या वेतनमान.—

इनसे सम्ब( पदों की संख्या, उनका वर्गीकरण तथा वेतनमान, पे बैंड और ग्रेड वेतन वही होगा जो इन नियमों से उपाब( अनुसूची के कालम ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—

उपरोक्त पदों के बारे में भर्ती, आयु-सीमा, अर्हताओं और अन्य मामलों की प(ति वही होगी जो उपरिउल्लिखित अनुसूची के कालम ;5द्ध से ;14द्ध में यथानिर्दिष्ट है।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 81.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Multi-Tasking Staff in the Ministry of Deinking Water and Sanitation, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Drinking Water and Sanitation Multi-Tasking Staff Recruitment Rules, 2012.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, their classification, pay band, grade pay and scale of pay.—The number of post, their classification and the scale of pay, pay band and grade pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc. .—The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (14) of the Schedule aforesaid.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

G.S.R. 82.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Engineer (Civil/Mechanical/ Electrical) and Junior Engineer (Civil/Mechanical/Electrical) in the Ministry of Water Resources, Farakka Barrage Project, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, the Farakka Barrage Project, Junior Engineer (Civil/Mechanical/Electrical) and Assistant Engineer (Civil/Mechanical/Electrical), (Group 'B' Post) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, Pay Band and Grade Pay or Pay .—The number of posts, their classification, Pay Band and Grade Pay or Pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc. .—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 — (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission.

Deputation including short-term contract :

Officer under the Central Government or State Government or Union Territory or Public Sector Undertakings or Statutory Organisations or Univerisities and Recognised Research Institutions :

(i) (a) holding analogous posts on regular basis in the parent cadre or department; or

(b) with five years' regular service in the grade rendered after appointment thereto on a regular basis in posts in Pay Band-2, Rs. 9300—34800 plus Grade Pay of Rs. 4200 in the parent cadre or department; or

(ii) Possessing a Degree in Civil Engineering from a recognised University or Institute.

Note 1: The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including short-term contract in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years.

Note 3 : The maximum age-limit for recruitment by deputation including short-term contract shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 4 : For the purpose of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

(b) Holding the posts of Junior Engineer in the scale of pay or Rs. 9,300-34,800/-+ Rs. 4,200/- (Grade Pay) with 5 years of regular service in the parent department/organization; and

(ii) Possessing a Degree in Mechanical Engineering from a recognised University / Institute.

Note 1: The departmental officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization/ department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for recruitment by deputation shall not be exceeding 56 years as on the closing date of receipt of application.
