सा.का.नि. 131.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और गृह मंत्राालय, राजभाषा विभाग, केंद्रीय हदी प्रशिक्षण संस्थान, ;लेखा अध्किारीद्ध भर्ती नियम, 2003 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्राालय, राजभाषा विभाग के केंद्रीय हदी प्रशिक्षण संस्थान में लेखा अध्किारी के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम गृह मंत्राालय, राजभाषा विभाग, केंद्रीय हदी प्रशिक्षण संस्थान ;लेखा अध्किारीद्ध भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उनका वर्गीकरण और उनका वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.— उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्‌वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 :- प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध की अवध्,ि जिसके अंतर्गत केंद्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िसाधरणतया तीन वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को छप्पन वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अध्किारी द्वारा, 1 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 131.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Home Affairs, Department of Official Language, Central Hindi Training Institute (Accounts Officer) Recruitment Rules, 2003, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accounts Officer in the Central Hindi Training Institute, Department of Official Language, Ministry of Home Affairs, namely :—

1. Short title and Commencement.—(1) These rules may be called the Ministry of Home Affairs, Department of Official Language, Central Hindi Training Institute (Accounts Officer) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in the regard.

Note l : The period of deputation (including short term contract) including period of deputation (including short term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organisaiton or department of the Central Government shall ordinarily not to exceed three years.

Note 2 : The maximum age limit for appointment by deputation (including short term contract) shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3 : For purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendation of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up-gradation.

G.S.R. 132.—In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and of all other powers enabling him in this behalf and in consultation with the Comptroller and Auditor General of India, the President hereby makes the following rules further to amend the Indian Audit and Accounts Service (Recruitment) Rules, 1983.

1. (1) These rules may be called the Indian Audit and Accounts Service (Recruitment) Amendment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Audit and Accounts Service (Recruitment) Rules, 1983,

(a) in rule 7, in sub-rule (2), in clause (ii), for the words "selection on merit", the word "selection" shall be substituted;

(b) in Schedule-III, in paragraph 6, for the words "selections on merit", the word "selections" shall be substituted.

G.S.R. 134.—Whereas the post of Director (Staff Relations and Legal Cell) and Director (Vigilance Petition), General Central Service Group 'A', Gazetted , Non-Ministerial have been encadred in the grade of Deputy Secretary and are now borne on the cadre of Central Secretariat Services of Department of Posts of this Ministry.

Now, therefore, in exercise of the powers conferred by the proviso to Article 309 of the Constitution read with Section 21 of the General Clauses Act, 1897 (10 of 1897), the President hereby rescinds the Recruitment Rules, regulating the method of appointment to the above post as published in the Gazetted of India, Part II, Section 3, Sub-section (i) vide G.S.R. 201, dated the 26th September, 2007, with effect from 01-12-2013; such rescission shall not affect anything done or omitted to be done under the said Rules before such rescission.

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, कृषि और सहकारिता विभाग, विस्तार निदेशालय, आशुलिपिक ;ग्रेड 2द्ध भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण और उसके वेतनमान वह होगा जो ऊपर अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्‌वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R.135.—In exercise of powers conferred by proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture, Directorate of Extension, Stenographer (Grade-I, II and III) Recruitment Rules, 2003, in so far as they relate to the post of Stenographer (Grade III), except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to post of Stenographer (Grade II) in the Directorate of Extension under the Ministry of Agriculture, Department of Agriculture and Cooperation, namely :—

1. Short title and commencement.—(l) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Stenographer (Grade II) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

टिप्पण 2 : रोजगार कार्यालयों के माध्यम से की जाने वाली नियुक्ति की दशा में, आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

(iii) मोटर कार चलाने का कम से कम तीन वर्ष का अनुभव । वांछनीय : होम गार्ड या सिविल स्वयं सेवक की सेवा का तीन वर्ष का अनुभव ।

टिप्पण : अनुभव संबंध्ी अर्हता सक्षम प्राध्किारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यथयों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथयों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

भूतपूर्व सैनिकों के लिए : प्रतिनियुक्ति/आमेलन सशस्त्रा बल के ऐसे कामकों के संबंध् में भी विचार किया जाएगा जो एक वर्ष की अवध् िके भीतर सेवानिवृत्त होन वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले है। और जिनके पास स्तंभ ;7द्ध के अध्ीन विहित अनुभव और विहित अर्हताएं हैं। ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना है तत्पश्चात्‌ उन्हें पुननयोजन पर बने रहने दिया जा सकता है । ;प्रतिनियुक्ति की अवध्ि साधारणतया 3 वर्ष से अध्कि नहीं होगी ।द्ध

G.S.R. 136.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersesion of the Commission for Agricultural Costs and Prices Group 'C' and 'D' posts Recruitment Rules, 2000 in so far as it relates to the post of Staff Car Dirver, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Staff Car Dirver in the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, Namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, Staff Car Dirver, Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said posts, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. (l) These rules may be called as Legal Metrology (Packaged Commodities) (Amendment) Rules, 2014.

(2) They shall come into force with effect from 1st July, 2014.

2. In the Legal Metrology (Packaged Commodities) Rules 2011, in rule 6, after sub-rule (7), the following shall be inserted, namely :—

"(8) Every package containing soap, shampoos, tooth pastes and other cosmetics and toiletries shall bear at the top of its principal display panel a red or as the case may be, brown dot for products of non-vegetarian origin and a green dot products of vegetarian origin.".

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृृत्ति.— इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है।

लिपिक के पद की प्रोन्नति के लिए सचिवालय प्रशिक्षण और प्रबंध् संस्थान ;आई एस टी एमद्ध या केन्द्रीय सरकार या राज्य सरकार के मान्यताप्राप्त संस्थान से संगठनात्मक व्यवहार संचार कौशल और लेखा व्यवहार का दो सप्ताह का प्रशिक्षण वांछनीय है ।

टिप्पण 1 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना के प्रयोजन के लिए तारीख 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को वेतन आयोग की सिपफारिशों पर आधरित विस्तारित ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि से या कम इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ734 THE GAZETTE OF INDIA : JUNE 21, 2014/JYAISTHA 31, 1936 [PART II—SEC. 3(i)] ;11द्ध

A two week training on organisational behaviour communication skill and accounting practices shall be desirable for the Canteen Attendants for promotion to the post of Clerk from Institute of Secretariat Training and management (ISTM) or any other institute recognized by Central Government or State Government.

Note 1 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission.

Note 2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

सा.का.नि.139.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केंद्रीय जल और विद्युत अनुसंधन स्टेशन, पुणे ;इंजीनियरी और वैज्ञानिक समूह 'क' पदद्ध भर्ती नियम, 1992 को, जहां तक इसका संबंध् संयुक्त निदेशक, मुख्य अनुसंधन अध्किारी, ज्येष्ठ अनुसंधन अध्किारी के पदों से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है केंद्रीय जल और विद्युत अनुसंधन स्टेशन, पुणे जल संसाध्न मंत्राालय में वैज्ञानिक ''ई'', वैज्ञानिक ''डी'', वैज्ञानिक ''सी'', वैज्ञानिक ''बी'' के रूप में क्रमशः पुनः अभिहित संयुक्त निदेशक, मुख्य अनुसंधन अध्किारी, ज्येष्ठ अनुसंधन अध्किारी और अनुसंधन अध्किारी के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः—

1. संक्षिप्त नाम और प्रारंभ.— ;1द्ध इन नियमों का संक्षिप्त नाम जल संसाध्न मंत्राालय, केंद्रीय जल और विद्युत अनुसंधन स्टेशन, पुणे समूह 'क' पदद्ध भर्ती नियम, 2014 है।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृृत्त होंगे।

2. लागू होना.—ये नियम इन नियमों से उपाब( अनुसूची में विनिदष्ट पदों को लागू होंगे ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वह हाेंगी जो उक्त अनुसूची के स्ंतभ ;5द्ध से स्ंतभ ;13द्ध में विनिर्दिष्ट हैं।

अंतर-सह-ज्येष्ठता और न्यूनतम अर्हक अवध्-ि

;1द्ध विद्यमान अनुसंधन अध्किारी ;इंजीनियरीद्ध और अनुसंधन अध्किारी ;वैज्ञानिकद्ध की अंतर-सह-ज्येष्ठता इस शर्त के अध्ीन रहते हुए कि अंतर-सह-ज्येष्ठता, उनकी अपनी-अपनी श्रेणियों में अध्किारियों की नियमित नियुक्ति की तारीख के अनुसार अवधरित की जाएगी ।

;2द्ध कार्मिक और प्रशिक्षण विभाग द्वारा अध्सिूचित और समय-समय पर यथा संशोध्ति नमनीय अनुपूरक स्कीम ;जिसे इसमें इसके पश्चात नमनीय पूरक स्कीम कहा गया हैद्ध के अध्ीन अनुसूची के स्तंभ ;1द्ध में उल्लिखित पदों को प्रचालित किया जाएगा और नीचे सारणी के स्तंभ ;1द्ध में यथाविनिर्दिष्ट पदनामों के साथ उक्त पद सारणी के स्तंभ ;2द्ध में यथाविनिर्दिष्ट वेतन बैंड और ग्रेड वेतन या वेतनमान में रखेंगे और अगली श्रेणी में प्रोन्नति के लिए उसके स्तंभ ;3द्ध में यथाविनिर्दिष्ट अगली श्रेणी में प्रोन्नति के लिए श्रेणी निष्पादित से सहब( न्यूनतम अर्हक अवध् िरखेंगे :-

चयन या पुनर्विलोकन के लिए निम्नलिखित मानदंड और प्रक्रिया नमनीय अनुपूरक स्कीम के अध्ीन वैज्ञानिक ''बी'' श्रेणी से वैज्ञानिक ''सी'', वैज्ञानिक ''सी'' से वैज्ञानिक ''डी'' और वैज्ञानिक ''डी'' से वैज्ञानिक ''ई'' वैज्ञानिकाें की स्वस्थानें प्रोन्नति के लिए अनुसरित की जाएगी, अर्थात्‌ः738 THE GAZETTE OF INDIA : JUNE 21, 2014/JYAISTHA 31, 1936 [PART II—SEC. 3(i)] ;1द्ध दो स्तर के निर्धरण होंगे, पहला स्तर छानबीन प्रयोजनों के लिए आंतरिक स्तर पर होगा और अगला स्तर चयन के लिए बाह्य निर्धरण प्रयोजनों के लिए होगा और इस प्रयोजन के लिए होगा :-

;कद्ध नमनीय पूरक स्कीम के अध्ीन प्रोन्नति के लिए विचार प्रत्येक वर्ष की 1 जुलाई के पूर्व वर्ष में एक बार किया जाएगा और वे अध्किारी जिसका निर्धरण वर्ष के 30 जून तक किया जाना है, पूर्व वर्ष के 31 दिसम्बर तक छह माह की अवध् िके दौरान विशिष्ट पद में अपेक्षित अर्हक अवध् िपूरा करेंगे, अगली उच्चतर श्रेणी में प्रोन्नति के लिए विचार किया जाएगा और अपेक्षित अर्हक अवध् िकी अवधरण करने के लिए निर्णायक अवध् िवर्ष की 1 जनवरी होगी जिसमें निर्धरण किया जाना है ।

;खद्ध जहां विदेश सेवा या भारत या बाहर अध्ययन छुट्‌टी पर पात्रा अध्किारी है, वहां उसके मामले पर विचार किया जाएगा यदि ऐसे व्यक्ति को अगली उच्चतर श्रेणी में नमनीय अनुपूरक स्कीम के अध्ीन स्वस्थाने प्रोन्नति के लिए अनुमोदन किया गया है, ऐसी प्रोन्नति की प्रभावी तारीख केंद्रीय जल और विद्युत अनुसंधन स्टेशन में पदभार ग्रहण करने की तारीख से होगी और वित्तीय पफायदे उसी तारीख से उद्‌्‌भूत होंगे और कोई यात्राा भत्ता और मंहगाई भत्ता साक्षात्कार में उपस्थित रहने के लिए प्रदान नहीं किया जाएगा ।

;गद्ध नमनीय पूरक स्कीम के अध्ीन सभी पात्रा अध्किारियों पर उसके अध्ीन प्रोन्नति के लिए विचार किया जाएगा किंतु आपवादिक रूप से सभी उत्कृृष्ट ग्रेडिंग वाले मेधवी अभ्यर्थियों को विनिदष्ट अर्हक अवध् िमें छूट दी जा सकेगी, किसी एकल अवसर पर एक वर्ष से अनध्कि छूट उनकी संपूर्ण जीवनवृृति में अध्कितम दो अवसरों तक सीमित होगी और अगली श्रेणी के लिए नमनीय अनुपूरक स्कीम के अध्ीन निर्धरण केवल तीन बार होगा और वे अध्किारी जिनको उपांतरित आश्वासित जीविका-वृृत प्रगति स्कीम के अध्ीन कोई श्रेणी प्रदान की गई है, उनको इस संबंध् में समय-समय पर जारी अध्सिूचना आदेशों के द्वारा कार्मिक और प्रशिक्षण विभाग द्वारा अध्सिूचित पात्राता और उपबंधें के अनुसार नमनीय पूरक स्कीम के अध्ीन अगली श्रेणी के लिए विचार किया जा सकता हैै ।

;घद्ध प्रोन्नत कोई अध्किारी, जो अपने साथ पद वहन करता है और परिणाम स्वरूप कोई रिक्ति निम्नतर स्तर पर नहीं होती है और जहां रिक्ति किसी अध्किारी द्वारा अध्विर्षिता पर सेवानिवृृति या स्वैच्छिक सेवानिवृृत्ति या पदत्याग या मृृत्यु के कारण होती है वहां उसे सीध्ी भर्ती या प्रोन्नति के लिए रोस्टर के अनुसार वैज्ञानिक ''बी'' के स्तर पर भरा जाएगा ऋ

;ड़द्ध अनुसंधन और विकास में क्षेत्राीय अनुभव और नमनीयपूरक स्कीम के अध्ीन उच्चतर श्रेणियों में वैज्ञानिकों की प्रोन्नति के लिए वैज्ञानिक परियोजनाओं के क्रियान्वयन में विकास और अनुभव अनिवार्य है ।

;2द्ध उप-नियम ;6द्ध के अध्ीन सारणी के स्तंभ ;3द्ध में विनिर्दिष्ट छानबीन समिति द्वारा आंतरिक छानबीन का पहला स्तर पूरा किया जाएगा जो नमनीय पूरक स्कीम के उन्नयन के लिए मानदंड के अनुसार वार्षिक कार्य रिपोर्ट का मूल्यांकन करेगी और सभी पात्रा अध्किारी जो वैज्ञानिक ''सी'' के लिए ''अच्छा'', वैज्ञानिक ''डी'' के लिए ''बहुत अच्छा'', और अध्कि के बेंचमार्क पाते हैं, उनकी छानबीन होगी और ऐसे अध्किारियों द्वारा किए गए कार्य की वैज्ञानिक अंतर्वस्तु निर्धरण बोर्ड को उपलब्ध् किए जाने के लिए निम्नलिखित पफार्मेट में छानबीन समिति द्वारा की जाएगी अर्थात्‌्‌ :-

;3द्ध उप-नियम ;6द्ध के अध्ीन सारणी के स्तंभ ;4द्ध में विनिर्दिष्ट अनुमोदन प्राध्किारी ;छानबीनद्ध, छानबीन समिति द्वारा सिपफारिश किए गए सभी मामलों पर विचार करेगा और उसी का अनुमोदन करेगा और यदि यह विनिश्चित होता है कि कोई अध्किारी निर्धरण बोर्ड द्वारा प्रोन्नति के लिए अर्हित नहीं होता है तो उसका मामला इसमें विचार करने के लिए एक वर्ष पश्चात छानबीन समिति के समक्ष रखा जाएगा और उप-नियम ;2द्ध में यथाविनिर्दिष्ट छानबीन के लिए प्रक्रिया का पुनः पालन किया जाएगा ।

;6द्ध बाह्य निर्धरण के दूसरे स्तर के प्रयोजनों के लिए -

;कद्ध स्वस्थाने प्रोन्नति के लिए अध्किारियों की उपयुक्तता के मूल्यांकन के लिए, सभी अध्किारी जिनकी छानबीन की गई है और छानबीन समिति द्वारा सिपफारिश की गई है और अनुमोदन प्राध्किारी ;छानबीनद्ध द्वारा अनुमोदन किया गया है, उनका उप-नियम ;6द्ध के अध्ीन सारणी के स्तंभ ;5द्ध में विनिर्दिष्ट निर्धरण बोर्ड द्वारा निर्धरण किया जाएगा ऋ

;खद्ध निर्धरण बोर्ड, प्रत्येक अध्किारी का उनके कार्य के निबंध्नों में कार्य का मूल्यांकन करेगा और उच्चतर श्रेणी में प्रोन्नति हेतु उसकी उपयुक्तता की सिपफारिश करेगा और उक्त बोर्ड विचारणाध्ीन अवध् िके दौरान प्रत्येक अध्किारी के कार्य से अलग उसकी वृृत्तिक के अनुसरण में ऐसे अध्किारी द्वारा दर्शित उत्सुकता और अध्कि दायित्व लेने की क्षमता जिसमें वैज्ञानिक क्रियाकलाप और सेवाएं तथा विकास क्षमताएं प्रबंध्कीय या नेतृृत्व गुण को भी ध्यान में रखेगा ।

;गद्ध निर्धरण बोर्ड, प्रत्येक अध्किारी के कार्य और योग्यता पर विचार करने के पश्चात नमनीय पूरक स्कीम के अध्ीन विचार के लिए उनकी योग्यता में न्यायोचित किए गए कार्य की विनिर्दिष्ट अंतर्वस्तु को एक पृृष्ठ सारांश का दस्तावेज रखेगा और प्रमाणित करेगा कि इस प्रकार सिपफारिश किया गया अध्किारी नमनीय पूरक स्कीम में अध्ीन स्वस्थाने उन्नयन के लिए मानदंड पूरा करते हैं ।

;7द्ध निर्धरण के आधर पर निर्धरण बोर्ड निम्नलिखित में से किसी एक की सिपफारिश करेगा :

;iद्ध अगली उच्चतर श्रेणी में अध्किारी की प्रोन्नति ऋ या

;iiद्ध यथास्थिति - अर्थात श्रेणी में कोई परिवर्तन नहीं ऋ

;गद्ध उन अध्किारियों के मामले का पुनर्विलोकन जिनकी निर्धरण बोर्ड द्वारा, यथास्थिति, सिपफारिश की गई है, एक वर्ष की अवध् िके पश्चात छानबीन समिति द्वारा पुनः सिपफारिश की जाएगी और उप-नियम ;2द्ध से उप-नियम ;4द्ध में विनिर्दिष्ट प्रक्रिया का पुनः पालन किया जाएगा । ;5द्ध निर्धरण बोर्ड द्वारा की गई सिपफारिशें उप-नियम ;6द्ध के अध्ीन सारणी के स्तंभ ;6द्ध में विनिर्दिष्ट अनुमोदन प्राध्किारी ;निर्धरणद्ध द्वारा विचार किया जाएगा और प्रत्येक मामले में इसका विनिश्चय अंतिम होगा ।

;2द्ध स्वास्थाने प्रोन्नति के लिए नमनीय पूरक स्कीम नियम 5 में विनिर्दिष्ट प्रक्रिया के अनुसार वैज्ञानिक फ्सीय्, वैज्ञानिक फ्डीय् और वैज्ञानिक फ्ईय् की श्रेणियों में विभागीय अध्किारियों की बाबत अनुसरित की जाएगी और बिना किसी निर्बंध्न के अनुसूची में उल्लेखित प्रत्येक प्रवर्ग के भीतर संपूर्ण अंर्तबद होगा सिवाय इसके उक्त पदाध्किारियों की कुल संख्या अनुमोदित पदों की कुल संख्या से अध्कि नहीं होगी ।

;3द्ध नमनीय अनुपूरक स्कीम के अध्ीन स्वस्थाने प्रोन्नतियां उस कारण निम्नतर श्रेणी में विनिर्दिष्ट रिक्ति के परिणामस्वरूप संब( अध्किारी के लिए व्यैत्तिफक होगी और संबंध्ति अध्किारी द्वारा धरित चालू पद को प्रोन्नत पद में उसके रुकने के दौरान उन्नत किया जाएगा और पद मूल स्तर पर प्रत्यावर्तित होगा जब अध्किारी उच्चतर पद को रिक्त कर देता है ।

;4द्ध नमनीयपूरक स्कीम के अध्ीन प्रोन्नति के लिए पात्रा पाए उन अध्किारियों की प्रोन्नति की प्रभावी तारीख अनुमोदन प्राध्किारी ;निर्धरणद्ध द्वारा उनकी प्रोन्नति के अनुमोदन की तारीख होगी और किसी भी दशा में भूतलक्षी प्रोन्नति अनुज्ञेय नहीं होगी ।

;5द्ध वे अध्किारी जो छुट्‌्‌टी पर बाहर हैं उन्हें उस तारीख से ही उच्चतर वेतन मान में वेतन के लिए अनुज्ञात किया जाएगा, जिस तारीख को पीछे तैनात होते हैं और उच्चतर पद में कर्तव्यों को धरित करते हैं ।

;6द्ध वे अध्किारी जो प्रतिनियुक्ति पर बाहर हैं, उन्हें उस तारीख से प्रोन्नति दी जाएगी जिसको वे संप्रत्यावर्तित होते हैं और केंद्रीय जल और विद्युत अनुसंधन केंद्र में पदभार ग्रहण करते हैं किंतु प्रोकार्या प्रोन्नति लागू नहीं होगी ।

;7द्ध वे अध्किारी जो छुट्‌टी या प्रतिनियुक्ति या विदेश सेवा के कारणों से निर्धरण के लिए भौतिक रूप से उपस्थित होने में असपफल रहते हैं, तो प्रोन्नति के लिए पात्रा नहीं होंगे ।

;8द्ध वे अध्किारी जिनको धरणाध्किार रखने के साथ तकनीकी त्यागपत्रा लेने के लिए अनुज्ञात किया जाता है उनको उस तारीख से ही प्रोन्नत किया जाएगा जिसको वह केंद्रीय जल और विद्युत अनुसंधन में वापस पदभार ग्रहण करते हैं ।

;9द्ध छानबीन समिति केवल उन अध्किारियों की अभ्यर्थिता पर विचार करेगी जो पूर्वोक्त अनुसूची में यथारूप से अध्किथित सभी पात्राता शर्तों को पूरा करते हैं और स्वविवेक, नमनीय पूरक स्कीम के अध्ीन प्रोन्नति के लिए अध्किारियों के किसी प्रवर्ग हेतु उक्त पात्राता शर्तों में छूट हेतु पूर्वोक्त पात्रा शर्तों में शिथिलता के लिए किसी प्राध्किारी को उपलब्ध् नहीं होगी और वे अध्किारी जो पात्राता शर्तों की अपेक्षा को पूरा नहीं करते हैं, वे इस आधर पर कि उनका कनिष्ठ जो अपेक्षा पूरी करता है, उस पर विचार किया जा रहा है, नमनीय पूरक स्कीम के अध्ीन प्रोन्नति के लिए विचार नहीं किये जाने का पात्रा होगा ।

;10द्ध किसी अन्य वैज्ञानिक पद पर प्रतिनियुक्ति या विदेश सेवा पर व्यतीत अवध् िजो अध्किारी को वैज्ञानिक अनुभव या क्षेत्राीय अनुभव प्राप्त करने में सहायता करती है और केन्द्रीय सिविल सेवा ;छुट्‌टी नियमद्ध 1972 के अनुसार अनुमोदित शैक्षणिक कार्यों में सुधर के लिए ली गई अध्ययन छुट्‌टी या कोई अन्य छुट्‌टी की अवध् िमातृृत्व अवकाश, उक्त छुट्‌टी नियमों में अनुसार मातृृत्व अवकाश को निरंतरता में एक वर्ष की अध्कितम अवध् िकी छुट्‌टी, एक समय केन्द्रीय सिविल सेवा ;छुट्‌टी नियमद्ध 1972 के अध्ीन सीमांत 180 दिन से अध्कि अवध् िमें लिए अनुमोदित अर्जित अवकाश की अर्हक अवध् िके रूप में गणना की जाएगी किंतु गैर-वैज्ञानिक पदों पर प्रतिनियुक्ति या विदेश सेवा पर व्यतीत अवध् िया और छुट्‌टी की अवध् िजिसमें चिकित्सीय आधर पर छुट्‌टी, वैयक्तिक आधरों पर ली गई है, उसे अर्हक अवध् िके लिए गणना में नहीं लिया जाएगा ।

7. निरर्हता.—वह व्यक्ति,—

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगाः

8. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करकेे, और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

9. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होेंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

G..S.R.139.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Water and Power Research Station, Pune (Engineering and Scientific Group 'A' posts) Recruitment Rules, 1982, in so far as they relate to the posts of Joint Director, Chief Research Officer, Senior Research Officer and Research Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the methods of recruitment to the posts of Joint Director, Chief Research Officer, Senior Research Officer and Research Officer, respectively re-designed as Scientist 'E', Scientist 'D', Scientist 'C and Scientist 'B', in the Central Water and Power Research Station, Pune, Ministry of Water Resources, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Water Resources, the Central Water .and Power Research Station, Pune, Group 'A' Posts Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts specified in the column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale .- The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall, save as provided in rule 6, be as specified in columns (2) to (4) of the said Schedule.

4. Inter-se-seniority and minimum qualifying period.-

(1) The inter-se-seniority of the existing Research Officers (Engineering) and Research Officers (Scientific) shall be determined in accordance with the date of regular appointment of officers to the respective grades subject to the condition that the inter-se-seniority shall not be disturbed within their respective grades.

(2) The posts mentioned in column (l) of the Schedule shall be operated under Flexible Complementing Scheme notified by Department of Personnel and Training and as amended from time to time (hereinafter referred to as the Flexible Complementing Scheme) and the said posts with designations as specified in column (1) of the table below shall carry the pay band and grade pay or pay scale as specified in column (2) of said table and shall have the minimum qualifying period linked to performance in a grade for promotion to the next grade as specified in column (3) thereof, for promotion to the next grade:-

5. Criteria for considering in-situ promotions and procedure for selection or review under the Flexible Complementing Scheme.-The following criteria and procedure for selection or review shall be followed for in-situ promotion of scientists from the grade of Scientist 'B' to Scientist 'C', Scientist 'C' to Scientist 'D' and Scientist 'D' to Scientist 'E' under the Flexible Complementing Scheme, namely:-

(1) There shall be two level of assessment, the first level shall be at internal level for screening purposes and the next level shall be for external assessment purposes for selection and for this purpose,-

(a) consideration for promotion under the Flexible Complementing Scheme shall be done once in a year before 1st January of every year and those officers who have completed or shall complete the required qualifying period in a particular post during the period of six months upto 31st December of the year preceding the year in which assessment is to be done and upto 30th June of the year in which the said assessment is to be done, shall be considered for promotion to the next higher grade and the crucial date for determining requisite qualifying period shall be the 1st January of the year in which assessment is to be done;

(b) where an eligible officer is on foreign service or study leave in India or abroad, his or her case shall be considered and if such person has been approved for in-situ promotion under the Flexible Complementing Scheme to the next higher grade, the effective date of such promotion shall be from the date of resumption of duty in the Central Water and Power Research Station and financial benefit shall accrue from the same date and no travelling allowance or dearness allowance shall be provided to attend the interview;

(c) all officers eligible under the Flexible Complementing Scheme shall be considered for promotion thereunder, but exceptionally meritorious candidates with all outstanding grading may be granted relaxation in the specified qualifying period, the relaxation being not more than one year on any single occasion, limited to a maximum of two occasions in their entire career and the assessment under the Flexible Complementing Scheme for next grade shall only be three times and officers who have been granted any grade under Modified Assured Career Progression Scheme may be considered for next750 THE GAZETTE OF INDIA : JUNE 21, 2014/JYAISTHA 31, 1936 [PART II—SEC. 3(i)] grade under Flexible Complementing Scheme according to the eligibility and provisions notified by the Department of Personnel and Training vide their notification and orders issued from time to time in this regard;

(d) an officer promoted carries the post with him and consequently no vacancy is caused at the lower level and where a vacancy is caused due to an officer vacating a post by retirement on superannuation or voluntary retirement or resignation or death, the same shall be filled in at the level of Scientist 'B' in accordance with the roster for direct recruitment or promotion;

(e) field experience in research and development and experience in implementation of scientific projects is compulsory for promotion of scientists to higher grades under the Flexible Complementing Scheme.

(2) The First level of Internal Screening shall be done by the screening committee specified in column (3) of the table under sub-rule (6), which shall evaluate the annual work reports in accordance with the criteria for upgradation under the Flexible Complementing Scheme and all eligible officers who meet with the benchmark of 'Good' for Scientist 'C,' Very Good' for Scientist 'D' and above shall be screened in and a report on the scientific content of work done by such officers shall be given by the Screening Committee in the following format for being made available to the Assessment Board, namely :-

(3) The Approving Authority (Screening), specified in column (4) of the table under sub-rule (6), shall consider all cases recommended by the Screening Committee and approve the same and in case it decides that any officer does not qualify for consideration for promotion by the Assessment Board, his or her case shall be placed before the Screening Committee after one year for its consideration and the procedure for Screening as specified in sub-rule (2) shall be followed again.

(4) For the purposes of second level of external assessment,-

(a) for evaluating suitability of officers for in-situ promotion; all officers who have been screened-in and recommended by the screening committee and approved by the Approving Authority (Screening) shall be assessed by the Assessment Board specified in column (5) of the table under sub-rule (6);

(b) the Assessment Board shall evaluate the accomplishments of each officer in terms of their work and recommend his or her suitability for promotion to the higher grade and the said Board shall, apart from the accomplishments of such officer during the period under consideration, also keep in mind the keenness exhibited by such officer in the pursuit of his or her profession and ability to take up higher responsibilities including scientific activities and services and development capabilities, managerial or leadership qualities;

(c) The Assessment Board shall, after taking into consideration the performance and merit of each officer, document, specifically through one page summary, the specific content of the work done justifying their merit for consideration under the Flexible Complementing Scheme and certify that the officers so recommended meet with the criteria for in situ up-gradation under the flexible Complementing Scheme;

(d) on the basis of its assessment, the Assessment Board may recommend any one of the following:-

(i) Promotion of the Officer to the next higher grade; or

(ii) Status quo-i.e. no change in the grade;

(c) Review of cases of those officers who have been recommended status quo by the Assessment Board shall again be considered by the Screening Committee after a period of one year and the procedure specified in sub- rules # (2) to (4) shall be followed again.

(5) The recommendations made by the Assessment Board shall be considered by the Approving Authority (Assessment) specified in column (6) of the table under sub-rule (6) and its decision on each case shall be final.

(6) The Composition of Screening Committee, Approving Authority (Screening), Assessment Board and the Approving Authority (Assessment), shall be as given in the table below : -

6. Method of recruitment, age limit and qualifications, etc.—(l) The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

(2) The Flexible Complementing Scheme for in-situ promotion, shall be followed in respect of departmental officers to the grades of Scientist 'C, Scientist 'D', and Scientist 'E' in accordance with the procedure specified in rule 5 and there shall be complete interchangeability within each category mentioned in the Schedule without any restriction except that the total number of incumbents shall not exceed the total number of sanctioned posts.

(3) In-situ Promotions under the Flexible Complementing Scheme shall be personal to the officer concerned not resulting in specific vacancy in the lower grade on that account and the post being currently held by the concerned officer shall be upgraded for the duration of his or her stay in the promotion post and the post shall revert to the original level once the officer vacates the higher post.

(4) The effective date of promotion of those officers found eligible for promotion under the Flexible Complementing Scheme shall be the date of approval of their promotion by the Approving Authority (Assessment) and retrospective promotion shall not be admissible in any case.

(5) The officers who are away on leave shall be allowed pay in the higher pay scale only from the date they join back and assume the duties of the higher post.

(6) The officers who are away on deputation shall be given promotion with effect from the date they repatriate and join in the Central Water and Power Research Station but proforma promotion shall not apply.

(7) The officers who fail to appear physically for the assessment for reasons of leave or deputation or foreign service shall not be eligible for promotion.

(8) The officers who have been allowed to take technical resignation with retention of lien shall be promoted only with effect from the date they join back in the Central Water and Power Research Station.

(9) The Screening Committee shall consider the candidature of only those officers who fulfill all the eligibility conditions as laid down in the aforesaid Schedule and discretion shall not be available with any authority for relaxing the said eligibility conditions for any category of officers for promotions under Flexible Complementing Scheme and the officer who does not fulfill the requisite eligibility conditions shall not be entitled to be considered for promotion under Flexible Complementing Scheme on the ground that his junior who fulfils the requirement is being considered.

(10) The period spent on deputation or foreign service to another scientific post which helps the officer to acquire scientific experience or filed experience and period of study leave or any other leave availed for improving academic accomplishments, maternity leave sanctioned as per Central Civil Services(Leave Rules), 1972, leave of a maximum period of one year sanctioned in continuation of maternity leave as per said leave rules, earned leave sanctioned for a period not exceeding 180 days at a time (the ceiling under Central Civil Services(Leave Rules), 1972) shall count as qualifying period for promotion but periods spent on deputation or foreign service to non-scientific posts and period of leave including leave on medical grounds, extraordinary leave availed on personal grounds shall not count towards qualifying period.

7. Disqualification.- No person-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

8. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

9. Saving.- Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission.
