सा.का.नि. 185.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन समूह 'ग' और समूह 'घ' पद भर्ती नियम, 2001 को, जहां तक उसका संबंध् चाय/कापफी बनाने वाला, बैरा और वॉश बॉय के पदों से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, गृृह मंत्राालय, पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन में कैंटीन परिचर के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम गृृह मंत्राालय, पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन, कैंटीन परिचर, समूह 'ग' पद भर्ती नियम, 2014 है।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड-वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हताएं.— वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और भूतपूर्व सैनिकोें के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 185.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Bureau of Police Research and Development Departmental Canteen, Group 'C' and Group 'D' posts Recruitment Rules, 2000, in so far as it relates to the posts of Tea/Coffee Maker, Bearer and Wash Boy, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Canteen Attendant in the Ministry of Home Affairs, Bureau of Police Research and Development, Departmental Canteen, namely :—

1. Short title and commencement.— (1) These rules may be called the Ministry of Home Affairs, the Bureau of Police Reasarch and Development, Departmental Canteen, Canteen Attendant, Group 'C' Posts Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age- limit , qualifications, etc.—The method of recruitment to the said post, age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualifications. — No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and Ex-servicemen, in accordance with the orders issued by the Central Government from time to time in this regard.

टिप्पण 1- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो।

टिप्पण 2- प्रोन्नति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अध्किारी द्वारा 1 जनवरी, 2006 से या उस तारीख से, छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी।

G.S.R. 186.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Cooperation, Staff Car Driver Special Grade, Staff Car Driver Grade-I and Staff Car Driver Grade-II Recruitment Rules, 2004 and the Department of Agriculture and Cooperation Staff Car Driver (Oridinary Grade) Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Staff Car Driver (Special Grade), Staff Car Driver Grade-I, Staff Car Driver Grade-II and Staff Car Driver (Ordinary Grade) in the Department of Agriculture and Cooperation, Ministry of Agriculture, namely :—

1. Short title and commencement.— (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Staff Car Driver (Special Grade), Staff Car Driver Grade-I, Staff Car Driver Grade-II and Staff Car Driver (Ordinary Grade) Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said post, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule

4. Method of recruitment, age- limit , qualifications, etc.—The method of recruitment to the said post, age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification. — No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, Other Backward Classes and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

टिप्पण 1 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजनार्थ किसी अधिकारी द्वारा, 1 जनवरी, 2006 से पूर्व या उस तारीख की छठे केन्द्रीय वेतन आयोग की सिपफारिशों के आधार पर संशोध्ति वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को वेतन आयोग की सिपफारिशों के आधार पर विस्तारित तत्स्थानी वेतन/ वेतनमान पर की गई सेवा माना जाएगा ।

G.S.R. 187.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Commission for Agricultural Costs and Prices Group 'C' and 'D' posts Recruitment Rules; 2000, excluding the recruitment rules for the grade of Staff Car Driver, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment to the posts of Steno Grade-I1I, Upper Division Clerk and Lower Division Clerk (including Hindi Typist) in the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, namely:-

1. Short title and commencement.— (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Commission for Agricultural Costs and Prices, Group 'C' posts, Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade payor pay scale.—The number of the said post, its classification, pay band and grade payor pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. — No person,-

(a) who has entered into or contracted a marriage with person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post.

Provided that the Central Government, may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The maximum age-limit for appointment on deputation shall be not exceeding 56 years' as on the closing date of receipt of applications. (i) 85 percent by direct recruitment through Staff As stated in Col. 10 Selection Commission. (ii) 10 percent of the vacancies shall be filled from amongst the Group 'C' Staff of Commission for Agricultural Costs and Prices(CACP) in the Grade Pay of Rs. 1800 and who possess 12th Class pass or equivalent qualification and have rendered 3 years' regular service in the grade on the basis of departmental qualifying examination. सा.का.नि. 188.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वनस्पति संरक्षण, संगरोध् एवं संग्रह निदेशालय सहायक ;विध्द्धि भर्ती नियम 1985, वनस्पति संरक्षण, संगरोध् एवं संग्रह निदेशालय विध् िअध्किारी भर्ती नियम 1989 को, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कृृषि मंत्राालय, कृृषि एवं सहकारिता विभाग, वनस्पति संरक्षण, संगरोध् एवं संग्रह निदेशालय, पफरीदाबाद में सहायक ;विध्द्धि, विध् िअध्किारी और वरिष्ठ विध् िअध्ि कारी के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृृषि मंत्राालय, कृृषि एवं सहकारिता विभाग, वनस्पति संरक्षण, संगरोध् एवं संग्रह निदेशालय, पफरीदाबाद विध् िशाखा, भर्ती नियम, 2014 है।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, उनके वेतन बैंड तथा ग्रेड-वेतन या वेतनमान वह होगें, जो इन नियमों से अनुब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट किए गए हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं .—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट किए गए हैं ।

4. निरर्हता.— वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की हैऋ उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई भी बात, ऐसे आरक्षण, आयु में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों अन्य पिछड़े वर्गों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रतिनियुक्ति की अवध्,ि ;अल्पकालिक संविदा सहितद्धऋ

केंद्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िसाधारणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति ;अल्पकालिक संविदा सहितद्ध पर नियुक्ति के लिए अध्कितम आयु-सीमा, आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

G.S.R. 188.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Plant Protection, Quarantine and Storage, Assistant (Legal) Recruitment Rules, 1985, Directorate of Plant Protection, Quarantine and Storage, Law Officer, Recruitment Rules, 1989, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant (Legal), Law Officer and Senior Law Officer in the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Plant Protection, Quarantine and Storage, Faridabad, namely :-

1. Short title and commencement:— (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Plant Protection, Quarantine and Storage, Faridabad, Law Stream, Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade payor pay scale.— The number of post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications.— The method of recruitment to the said post, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government, may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex- servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 189.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Junior Translator (General Central Service Group 'B' Non-Gazetted, Non- Ministerial) in the Ministry of Agriculture, Department of Agriculture and Co-operation, Directorate of Plant Protection, Quarantine and Storage, Faridabad, namely :-—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Plant Protection, Quarantine and Storage, Junior Translator (General Central Service) (Non-Ministerial Group 'B' Non-Gazetted post) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications.— The method of recruitment to the said post, age limit, qualification and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with UPSC relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to the 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be deemed to be service rendered in the corresponding grade payor pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade payor pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up- gradation.

टिप्पणीः चयन प्रक्रिया के दौरान यदि अनुसूचित जाति/ अनुसूचित जनजाति समुदायों के अपेक्षित अनुभव रखने वाले अभ्याथयों की संख्या आरक्षित रिक्त पदों को भरे जाने के लिए उपलब्ध् नहीं होगी तो इन समुदायों के उम्मीदवारों के अनुभव संबंध्ी योग्यता;ओंद्ध में छूट दी जा सकती है ।

स्वच्छता के रखरखाव सहित भोजन बनाने की दक्षता के निर्धरण में विभागीय प्रोन्नति समिति द्वारा व्यवसाय दक्षता परीक्षा ली जाएगी ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक/ पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके वरिेष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा बशर्ते यह तब जबकि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आधे से अध्कि से या कम इनमें से जो कोई भी कम हो, और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

3. Method of recruitment, age limit and qualifications, etc.— The method of recruitment, age limit, educational qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex- serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

4. निरर्हता.— वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या पत्नी जीवित हो, से विवाह किया है, या

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

बशर्ते कि केन्द्रीय सरकार इस बात से संतुष्ट हो कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो अन्य व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उसे लिखित रूप में रिकार्ड करके तथा संघ लोक सेवा आयोग के परामर्श से इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई भी बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : यदि किसी अध्किारी को प्रोन्नति के विचार के क्षेत्रा में शामिल किया जाता है और किसी प्रशासनिक कारणों से उन्हें प्रशिक्षण हेतु नहीं भेजा जा सका, वे प्रोन्नति हेतु विचार के पात्रा रहेंगे, पर इस शर्त के अध्यध्ीन ऐसे अध्किारी प्रोन्नति की तारीख से एक साल के अंदर प्रशिक्षण करेंगे ।

टिप्पण 2 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे जयेष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से , इनमें से जो भी कम हो, से कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 3 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की गणना के प्रयोजन के लिए 1 जनवरी, 2006 या वह तारीख जिसको छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तारित की गई है, से पूर्व किसी अध्किारी द्वारा नियमित आधर पर की गई सेवा वेतन आयोग की सिपफारिशों पर आधरित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

टिप्पण 1 : पोषक प्रवर्ग के वे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

G.S.R. 192.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of the Ministry of Urban Development, Central Public Works Department, Deputy Director General (Horticulture) Group 'A' post Recruitment Rules, 2006, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Deputy Director General (Horticulture) in the Ministry of Urban Development, Central Public Works Department, namely :-

1. Short title and commencement.—(1) These rules may be called the Ministry of Urban Development, Central Public Works Department, Deputy Director General (Horticulture) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay or pay scale.— The number of post, its classification and pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification etc.— The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons.

6. Note 1:- If any officer included in the field of consideration for promotion could not be released for training due to any administrative reasons, he/she shall continue to be eligible for consideration for promotion, subject to the condition that such officer shall undergo training within a period of one year from the date of promotion.

Note-3: For the purpose of computing minimum qualifying service for Promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006, or the date from which the revised pay structure based on the sixth central pay commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or Pay Scale extended based on the recommendations of the pay commission.

Deputation : -

Officers under the Central Government or the State Governments or the Union territory administration :-

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with two years' service in the grade rendered after appointment thereto on a regular basis in pay band-4 (Rs. 37400 - 67000) and grade pay of Rs.8900 or equivalent in the parent cadre or department; or

(iii) with three years' service in the grade rendered after appointment thereto on a regular basis in pay band-4 (Rs.37400 - 67000) and grade pay of Rs. 8700 or equivalent in the parent cadre or department; and

(b) possessing the following educational qualification and experience : -

(i) M. Sc. in agriculture with specialization in Horticulture from a recognized University or Institute; or M.Sc. in Horticulture with Floriculture or Olericulture from a recognized University or Institute; or M. Sc. in Botany with Horticulture as a subject from a recoginzed University or Institute; or B.Sc. in agriculture or Botany or Horticulture with master's degree in land-scape architecture from a recognized university or institute or Master degree in Florifulture and landscaping from a recognized, university or institute and

(ii) fifteen years' experience in Horticulture including Ornamental Gardening ranging over various fields of Horticulture,

Note 1 :-The Departmental officers In the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly. deputationist shall not be eligible for consideration for appointment by promotion.

4. अयोग्यता.— कोई व्यक्ति,—

;कद्ध जिसने किसी व्यक्ति के साथ जिसका जीवन साथी जीवित है, से विवाह किया है, अथवा विवाह का अनुबंध् किया है, या ;खद्ध जिसने अपने जीवन साथी के जीवित रहने पर किसी अन्य व्यक्ति के साथ विवाह किया है अथवा विवाह का अनुबंध् किया है ।

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

बशर्ते केन्द्रीय सरकार यदि संतुष्ट होती है कि यह विवाह ऐसे व्यक्ति और विवाह मेें दूसरे पक्ष पर लागू पर्सनल लॉ के तहत अनुमत्य है और ऐसा करने के लिए वहां पर अन्य आधर मौजूद हैं, किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकती है ।

5. छूट का अध्किार.—जहां पर केन्द्रीय सरकार का मत है कि ऐसा करना आवश्यक या समीचीन है, आदेश द्वारा और लिखित में दर्ज किए जाने वाले कारणों का उल्लेख करके किसी वर्ग या श्रेणी के व्यक्तियों के संबंध् में इन नियमों के किसी भी प्रावधन में छूट दे सकती है ।

6. बचत.—केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक और अन्य विशेष श्रेणियों के उम्मीदवारों के लिए आरक्षण, आयु-सीमा में छूट और प्रदान की जाने वाली अपेक्षित अन्य रियायतों पर ये नियम किसी भी रूप में प्रभावी नहीं होंगे ।

G.S.R. 193.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Pharmacopoeial Laboratory for Indian Medicine (Group 'C' posts) Recruitment Rules, 1978, in so far as they relate to the post of Upper Division Clerk, except in respect of things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Upper Division Clerk, Pharmacopoeial Laboratory for Indian Medicine, Ghaziabad, namely :-—

1. Short title and commencement .— (1) These rules may be called the Department of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homoeopathy, Pharmacopoeial Laboratory for Indian Medicine, Ghaziabad (Upper Division Clerk post) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade payor pay scale.—The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns(2) to (4) to the scheduled annexed to these rules.

3. Method of recruitment, age limit and qualifications, etc.— The method of recruitment to the said post, age, limit, qualifications and other matters connected therewith shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person, -

(a) Who has entered into or contracted a marriage with person having a spouse living; or

(b) Who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that Central Governmental may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect of any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for candidates belonging to the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
