सा.का.नि. 194.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन समूह 'ग' और समूह 'घ' पद भर्ती नियम, 2001 को, जहां तक उसका संबंध् हलवाई के पद से है, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है, या करने का लोप किया गया है, गृह मंत्राालय, पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन में हलवाई-सह-रसोइया के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम गृह मंत्राालय, पुलिस अनुसंधन और विकास ब्यूरो, विभागीय कैंटीन, हलवाई-सह-रसोइया ;समूह 'ग' पदद्ध भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या ;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की हैऋ उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्‌वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्‌वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : अनुभव संबंध्ी अर्हता सक्षम प्राध्किारी के विवेकानुसार अनुसूचित जातियोंं और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है ।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा प्रोेन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न प(तियों द्वारा जिनसे प्रोेन्नति या प्रतिनियुक्ति/आमेलन किया जाएगा भरी जाने वाली रिक्तियों की प्रतिशतता

प्रतिनियुक्ति द्वारा जिसके न हो सकने पर सीध्ी भर्ती द्वारा । प्रतिनियुक्ति :-केन्द्रीय सरकार के ऐसे अध्किारीः-

;कद्ध;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धारण किए हुए हैंऋ या ;iiद्ध ऐसे सहायक हलवाई-सह-रसोइया जिन्होंने वेतन बैंड-1, 5200-20200 रु. + गे्रड वेतन 1900 रु. में तीन वर्ष नियमित सेवा की हैऋ और ;खद्धजिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं :- ;iद्ध 10वीं कक्षा या समतुल्य उत्तीर्ण सहित खानपान का प्रमाण-पत्रा या डिप्लोमा । ;iiद्ध किसी सरकारी विभाग या निर्दिष्ट उपक्रम में दो वर्ष का अनुभव । टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध्ि है, साधरणतया तीन वर्ष से अध्कि नहीं होगी । टिप्पण 2 : प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी । टिप्पण 3 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं हाेंगे ।

टिप्पण 4 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद विस्तारित ;उन पदों परद्ध होगा, जिसके लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधारण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

MINISTRY OF HOME AFFAIRS

New Delhi, the 9th September, 2014

G.S.R. 194.—In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Bureau of Police Research and Development Departmental Canteen, Group "C" and Group "D" posts Recruitment Rules, 2000, in so far as it relates to the post of Halwai, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Halwai-cum-Cook in the Ministry of Home Affairs, Bureau of Police Research and Development, Department Canteen, namely :-

1. Short title and commencement.— (1) These rules may be called the Ministry of Home Affairs, Bureau of Police Research and Development, Departmental Canteen, Halwai-cum- Cook (Group 'C' Post) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualifications.— No Person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, except any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and Ex-servicemen in accordance with the orders issued by the Central Government from time to time in this regard.

Note : The qualification regarding experience is relaxable at the discretion of the competent authority in case of candidates belonging to Scheduled Castes or Scheduled Tribes, if at any stage of selection the competent authority is of the opinion that sufficient number of candidates belonging to these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

(ii) Assistant Halwai-cum-cook with three years regular service in the pay band-1, Rs. 5200- 20200 with grade pay of Rs.1900; and

(b) possessing the following qualifications and experience.

(i) 10th Class or equivalent pass with a certificate or diploma in catering.

(ii) Two years experience in a Government Department or Undertaking preferred.

Note 1 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years.

Note 2 : The maximum age limit for deputation is 56 years as on date of receipt of applications.

Note 3 : The departmental official in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 4 : For purposes of appointment on deputation, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered the corresponding grade[भाग II—खण्ड 3(i)] भारत का राजपत्रा : सितम्बर 13, 2014/भाद्र 22, 1936 1109 11 pay or pay Scale extended based on the recommendations of the Said Pay Commission except where 'there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which the grade pay or pay scale is the normal replacement grade without any up gradation.

;iद्ध किसी मान्यताप्राप्त विश्वविद्याालय से बैचलर डिग्रीऋ और ;iiद्ध प्रशासनिक प्रशिक्षण संस्थान या केन्द्रीय प्रशिक्षण संस्थान या विश्वविद्याालय या महाविद्यालय में प्रबंध् सेवाओं के क्षेत्रा मे दस वर्ष का अनुभव जिसके अन्तर्गत तकनीकी और प(तियों का दो वर्ष का अध्यापन का अनुभव भी हो ।

वांछनीय :

;iद्ध किसी मान्यताप्राप्त विश्वविद्यालय से मास्टर डिग्रीऋ

;iiद्ध सरकारी मान्यताप्राप्त संस्थान से उच्च प्रबंध् सेवा पाठ्‌यक्रम सपफलतापूर्वक पूरा किया हो ।

प्रतिनियुक्ति और पुननयोजन : ;सशस्त्रा बल कामक के लिएद्ध : वेतन बैंड-3 ग्रेड वेतन 7600 रु. में लेफ्रिटनेंट कर्नल या भारतीय नौसेना या भारतीय वायु सेना मे समतुल्य पंक्ति में ऐसे सशस्त्रा बल कामकों पर भी विचार किया जाएगा जो एक वर्ष अवध् िके भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रतिनियुक्ति व्यक्तियों के लिए अर्हताएं और विहित अनुभव है । यदि ऐसे अध्किारियों का चयन हो जाता है तो उन्हें उस तारीख तक प्रतिनियुक्ति के निबंध्नों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्रा बल से निर्मुक्त किया जाना है, तत्पश्चात उन्हें पुनवनियोजन के निबंध्नों पर विचार किया जा सकेगा । ऐसे पात्रा अभ्यथयों की दशा में जब वे उस पद पर से वास्तविक से पूर्व सेवानिवृत्त हो जाते है या रिजर्व में स्थानांतरित किए जाते हैं तो उनकी नियुक्ति पुननयोजन के आधर पर की जाएगी । ;सिविल पदों के प्रतिनिर्देश अध्विषता की आयु तक पुननयोजनद्ध ।

प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या

किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित

किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् ि है,

साधरणतया 4 वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा

नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की

अंतिम तारीख को छप्पन वर्ष से अधिक नहीं होगी ।

टिप्पण : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए,

किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से

जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित

पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर

पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि

पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित

एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर

विस्तारित होगा, जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी

उन्नयन का साधारण प्रतिस्थापन ग्रेड है वेतन आयोग की सिपफारिशों

पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

G.S.R. 195.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Institute of Secretariat Training and Management Joint Director (Management Services) Recruitment Rules, 1986, except as respects things done or omitted to have been done, before such supersession the President hereby makes the following rules regulating the method of recruitment to the post of Joint Director (Management Services) in the Institute of Secretariat Training and Management, Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, namely:-

1. Short title and commencement.—(l) These rules may be called the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), Institute of Secretariat Training and Management Joint Director (Management Services) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and pay band and grade pay or pay scale.—The number of the said post, its classification and pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the schedule annexed to these rules.

3. Method of recruitment, age limit and qualification, etc.— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special category of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(b) possessing the following educational qualifications and experience:

Essential :

(i) Bachelor's Degree of a recognised University; and

(ii)ten years' experience including two years teaching experience of techniques and methods in the area of management services in Administrative Training Institute, Central Training Institute, university or college

Desirable :

(i) Master's Degree from a recognised University;

(ii) Should have successfully completed the Advanced Management Service Course from Government recognised Institute

[Deputation or Re-employment (for armed forces personnel): Armed Forces Personnel in the rank of Lieutenant Colonel or equivalent in Indian Navy or Indian Air Force in the pay band-3 with grade pay of Rs.7600, who are due to retire or to be transferred to reserve within a period of one year and have the qualifications and experience prescribed for deputationist shall also be considered. If selected, such officers will be given deputation terms up to the date on which they are due for release from the Armed Forces; thereafter they may be considered on re-employment terms. In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made their appointment will be on re-employment basis. (Re- employment upto the age of superannuation with reference to civil posts)].

(Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed four years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of receipt of a applications.)

Note : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January,2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement grade without any upgradation.

G.S.R. 196 .—Reference Recruitment Rules of Legal and Treaties Cadre of Ministry of External Affairs notified vide GSR No. 260 in the Gazette Notification dated November 9,2013. The following amendments are made in the above notification.

1. Under column 7(i) and 11(i) of all schedules - "and /" may be added between the phrases "in the field of International Law" and "or International Relations" .

2. Under column 11(i) in the Schedule of 'Additional Secretary' - the word "or" may be substituted by the word "of".
