सा.का.नि. 2.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विज्ञान और प्रौद्योगिकी मंत्राालय, विज्ञान और प्रौद्योगिकी की विभागीय कैंटीन में सहायक प्रबंध्क-सह-भंडारी, लिपिक, हलवाई-सह-रसोइया, सहायक हलवाई-सह-रसोइया, कैंटीन परिचर के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विज्ञान और प्रौद्योगिकी मंत्राालय, विज्ञान और प्रौद्योगिकी विभाग, विभागीय कैंटीन, समूह 'ग' पद भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

(5)6 THE GAZETTE OF INDIA : JANUARY 10, 2015/PAUSA 20, 1936 [PART II—SEC. 3(i)] 4. आरंभिक गठन—(1) ऐसे कार्मिक जो इन नियमों के प्रारंभ से ठीक पहले नियमित आधर पर सहायक प्रबंध्क-सह-भंडारी, लिपिक, हलवाई-सह-रसोइया, सहायक हलवाई-सह-रसोइया, चाय बनाने वाला ;कैंटीनद्ध, बैरा, वाश बॉय ;कैंटीनद्ध और सपफाई वाला ;कैंटीनद्ध का पद धरण किए हुए हैं, इन नियमों के उपबंधें के अनुसार नियुक्त किया गया समझा जाएगा।

;2द्ध इन नियमों के प्रारंभ से ठीक पहले संबंध्ति श्रेणियों में उपरोक्त निर्दिष्ट कार्मिक की नियमित निरन्तर सेवा, परिवीक्षा की अवधि, ज्येष्ठता, प्रोन्नति की अर्हक सेवा, पुष्टि और पेंशन के प्रयोजन के लिए सेवा में गणना में ली जाएगी।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है विवाह किया है, या विवाह की संविद की है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ऋ या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुमेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किये गये आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

अनुसूची

;1द्ध ;2द्ध ;3द्ध ;4द्ध ;5द्ध ;6द्ध 1. सहायक *1 ;2014द्ध साधरण केन्द्रीय वेतन बैंड-1, 5200- अचयन आयु 21-28 वर्ष के बीच ;केन्द्रीय सरकार प्रबंध्क- *कार्यभार के सेवा, समूह 'ग', 20200 रु.ग्रेड वेतन द्वारा जारी किए गए अनुदेशों या सह-भंडारी आधर पर अराजपत्रिात, 2400 रु. टाइप 'ए', 'बी' आदेशों के अनुसार सरकारी सेवकों परिवर्तन किया अननुसचिवीय 'सी', '2-ए' और के लिए शिथिल करके 40 वर्ष तक जा सकता है।

'3-ए' कैंटीनों में कार्य की जा सकती है।द्ध करने के लिए प्रतिमाह टिप्पण 1ः--आयु-सीमा अवधरित 250 रु. तथा टाइप '4-ए' करने के लिए निर्णायक तारीख सिवाय और इससे अच्छे कैंटीनों उन अभ्यर्थियों के लिए नियत की गई में कार्य करने के लिए अंतिम तारीख होगी जो असम, प्रतिमाह 500 रु. विशेष मेघालय, अरूणाचल प्रदेश, मिजोरम, भत्ता भी प्राप्त करेगा। मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा-जिले के पांगी उपखंड, अंडमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है। टिप्पण 2 :--रोजगार कार्यालय के माध्यम से की जाने वाली भर्ती की दशा में आयु-सीमा अवधरित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस तक रोजगार कार्यालय से नाम भेजने के लिए कहा गया है।

सीध्े भर्ती किए जाने वाले व्यक्तियों के लिए अपेक्षित सीध्े भर्ती किए जाने वाले परिवीक्षा की अवध्,ि यदि कोई हो और अन्य अर्हताएं

व्यक्तियों के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्तियों की दशा में लागू होंगी या नहीं

;कद्ध किसी मान्यताप्राप्त विश्वविद्यालय से वाणिज्य में बैचलरः नहीं सीध्े भर्ती किए जाने वाले व्यक्तियों या

के लिए दो वर्ष है।

किसी मान्यताप्राप्त विश्वविद्यालय से किसी भी विषय में स्नातक सहित बही खाता रखने या भंडार का परिरक्षण करने में एक वर्ष का डिप्लोमाऋ ;खद्ध अनुभव : सरकारी विभाग या सरकारी उपक्रम में भंडार या लेखा संभालने में तीन वर्ष का अनुभव। टिप्पण 1 :-अर्हताएं, अन्यथा सुर्हित अभ्यर्थियों की दशा में सक्षम प्राध्किारी के विवेकानुसार शिथिल की जा सकती है। टिप्पण 2 :-अनुभव संबंध्ी अर्हताएं, सक्षम प्राध्किारी के विवेकानुसार अनसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राध्किारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है।

भर्ती की प(ति : भर्ती सीध्े होगी या प्रोन्नति द्वारा या प्रोन्नति या प्रतिनियुक्ति या आमेलन द्वारा भर्ती की दशा में वे श्रेणियां,

प्रतिनियुक्ति या आमेलन द्वारा तथा विभिन्न प(तियों द्वारा भरी जिनसे प्रोन्नति/प्रतिनियुक्ति / आमेलन किया जाएगा

जाने वाली रिक्तियों की प्रतिशतता

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा और दोनों प्रोन्नतिः

के न होने सकने पर सीध्ी भर्ती द्वारा । ;iद्ध वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 1900 रु. में ऐसे लिपिक जिन्होंने नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में आठ वर्ष नियमित सेवा की हैः या ;iiद्ध ऐसे हलवाई-सह-रसोइया जिन्होंने वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 2000 रु. में नियमित आधर पर नियुक्ति के पश्चात्‌्‌ उस श्रेणी में पांच वर्ष की नियमित सेवा की है और जिनके पास भंडार और लेखा संभालने का दो वर्ष का अनुभव है और सीधे भर्ती किए जाने वाले लिपिकों के लिए यथा विहित शैक्षिक अर्हताएं हैं अर्थात्‌ जिन्होंने वाणिज्य सहित 12वीं कक्षा उत्तीर्ण की है। टिप्पण 1ः-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से इनमें से जो भी कम हो, कम न हो और उन्होंने उपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो। टिप्पण 2ः-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस8 THE GAZETTE OF INDIA : JANUARY 10, 2015/PAUSA 20, 1936 [PART II—SEC. 3(i)] ;11द्ध

तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफरिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी।

प्रतिनियुक्तिः

केन्द्रीय सरकार के ऐसे अध्किारी

;कद्ध ;iद्ध जो नियमित आधर पर सदृ्‌श पद धरण किए हुए हैंऋ या

;iiद्ध जिन्होंने वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 1900 रु. नियमित आधर पर नियुक्ति के पश्चात्‌ उस श्रेणी में आठ वर्ष नियमित सेवा की है।

;खद्ध जिनके पास स्तंभ ;7द्ध के अध्ीन भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं।

टिप्पण 1ः-प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया 3 वर्ष से अध्कि नहीं होगी।

टिप्पण 2ः-प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी।

टिप्पण 3ः-पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे।

टिप्पण 4ः-प्रतिनियुक्ति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्न्यन का साधरण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी।

यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा

समूह 'ग' विभागीय प्रोन्नति समिति ;पुष्टि के लियेद्ध लागू नहीं होगा । जिसमें निम्नलिखित होंगे :—

1. अवर सचिव, विज्ञान और प्रौद्योगिकी विभाग —अध्यक्ष

2. सचिव, कैंटीन समिति, विज्ञान और प्रौद्योगिकी विभागऋ और —सदस्य

3. अनुभाग अध्किारी, विज्ञान और प्रौद्योगिकी विभाग —सदस्य9 [भाग II—खण्ड 3(i)] भारत का राजपत्रा : जनवरी 10, 2015/पौष 20, 1936 ;1द्ध ;2द्ध ;3द्ध ;4द्ध ;5द्ध ;6द्ध

2. हलवाई *1 ;2014द्ध साधरण केन्द्रीय वेतन बैंड-1, 5200- अचयन आयु 18-25 के बीच ;केन्द्रीय सरकार सह-रसोइया *कार्यभार के सेवा, समूह 'ग', 20200 रु.ग्रेड वेतन द्वारा जारी किए गए अनुदेशों या आधर पर अराजपत्रिात, 2400 रु. आदेशों के अनुसार सरकारी सेवकों के लिए शिथिल करके 40 वर्ष तक परिवर्तन किया अननुसचिवीय की जा सकती है । जा सकता है ।

;खद्ध किसी सरकारी विभाग या उपक्रम में खानपान का दो वर्ष का अनुभव।

;गद्ध खानपान के लिए व्यवसाय कौशल परीक्षण जिसमें स्वच्छता आदि के अनुरक्षण भी हैं, जिसे अभ्यर्थी की उपयुक्ता निर्धरण करने के लिए विभागीय प्रोन्नति समिति द्वारा संचालित किया जाएगा।

टिप्पण ः-अनुभव संबंध्ी अर्हताएं, सक्षम प्राध्किारी के विवेकानुसार अनसूचित जातियों या अनुसूचित जनजातियों के अभ्यर्थियों दशा में तब शिथिल की जा सकती है जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है।

प्रोन्नति जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नतिः

;1द्ध वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 1900 रु. में ऐसे सहायक हलवाई-सह-रसोइया जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवा की है । टिप्पण 1ः-जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से इनमें से जो भी कम हो, कम न हो और उन्होंने उपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए उपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो। टिप्पण 2ः-प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफरिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझा जाएगी।

;खद्ध जिनके पास निम्नलिखित शैक्षिक अर्हता/अनुभव है :- ;iद्ध 10वी. कक्षा उत्तीर्ण सहित खान पान का प्रमाण-पत्रा या डिप्लोमा ऋ और

G.S.R. 2.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Manager-cum-Storekeeper, Clerk, Halwai-cum-Cook, Assistant Halwai-cum-Cook, Canteen Attendent in the Departmental Canteen in the Ministry of Science and Technology, Department of Science and Technology, New Delhi, namely:—

1. Short title and commencement.—(1) These rules may be called the Ministry of Science and Technology, Department of Science and Technology, Departmental Canteen Group 'C' post Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Initial Constitution.—(1) Personnel holding the post of Assistant Managar-cum-Storekeeper, Clerk, Halwai- cum-Cook, Assistant Halwai-cum-Cook, Tea Maker (Canteen), Bearer, Wash Boy (Canteen) and Safaiwala (Canteen) immediately before the commencement of these rules on regular basis shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular continuous service of personnel referred above in the respective grades immediately before the commencement of these rules shall count for the purpose of period of probation, seniority, qualifying service of promotion, confirmation and pension in the service.

5. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

2. पद की संख्या, वर्गीकरण वेतन बैंड और ग्रेड वेतन अथवा और वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, और उनके वेतन बैंड और ग्रेड वेतन या वेतन वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद से सम्बन्ध्ति भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

उक्त पद पर नियुक्ति का पात्रा नहीं होगाः

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध् िके अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत छूट दे सकेगी ।

5. प्रवर्तन से शिथिल करने की शक्ति.—जहां भी केन्द्रीय सरकार का विचार है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किये गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1ः-प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै साधरणतया 3 वर्ष से अध्कि नहीं होगी। प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी।

टिप्पण 2ः-पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहींं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे।

G.S.R. 3 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Human Resource Development, Department of Secondary and Higher Education, Departmental Canteen (Group 'C' and Group 'D' posts) Recruitment Rules, 2001 in so far as it relates to the posts of Store Keeper [now redesignated as Assistant Manager-cum-Store Keeper], Halwai [now re-designated as Halwai-cum-Cook], Assistant Halwai [now re-designated as Assistant Halwai-cum-Cook], Clerk (Coupon/Counter/Kitchen) [re-designated as Clerk], Tea/Coffee Maker, Bearer, Wash Boy [now re-designated as Canteen Attendant] and Safaiwala except as respect things done or omitted to be done before supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' post in the Departmental Canteen of the Ministry of Human Resource Development, Department of Higher Education, namely:—

1. Short title and commencement. — These rules may be called the Ministry of Human Resource Development, Department of Higher Education, Departmental Canteen (Group 'C' posts) Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.— The number of the said posts, their classifications, and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and qualifications, etc.— The method of recruitment age limit, qualifications and other matters connected there with shall be as specified in columns 5 to 13 of the said Schedule.

4. Disqualification.— No person,

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any employee from the operation of this rule.

5. Powers to Relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reason to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of employees.

6. Saving.—Nothing in these rules shall affect reservations, relaxations of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of employees in accordance with the orders issued by the Central Government in this regard from time to time.

Note 2:—Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying

or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qulifying or eligibility service.

Deputation:

Officers of the Central Government;

(a) (i) holding analogous posts on regular basis; or

(ii) with at least eight years'regular service in the PB-1, Rs. 5200-20200 plus grade pay of Rs. 1900.

(iii) possessing the educational qualifications as prescribed for direct recruits under column (7); and

(b) Three years' experience in a Government Department or Undertaking in handling Stores or Accounts.

Note 1:—The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not exceed three years. The maximum age- limit for deputation is 56 years as on the closing date of receipt of applications.

Note 2:—The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

G.S.R. 4 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Water Commission Accounts Officer, Recruitment Rules, 2002, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accounts Officer in the Ministry of Water Resources, Central Water Commission, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, Central Water Commission, Accounts Officer, Group 'A' Post Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc..—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxations of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, और अन्य अर्हताएं, आदि.—पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 5.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the All India Soil and Land Use Survey (Jeep Driver various grades) Recruitment Rules, 2004, in so far as they relate to the posts of Jeep Driver (Ordinary Grade), Jeep Driver (Grade-I) and Jeep Driver (Grade-II), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Jeep Driver (Ordinary Grade, Grade-I and Grade-II) in the Soil and Land Use Survey of India, Department of Agriculture and Co-operation, Ministry of Agriculture, namely :—

1. Short title and commencement.—(1) These rules may be called the Soil and Land Use Survey of India (Jeep Driver Various Grades) Recruitment Rules 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and, pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 6.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विस्तार निदेशालय, मुख्य कलाकार भर्ती नियम, 1962 तथा कलाकार ;ज्येष्ठद्ध भर्ती नियम, 1985 को जहां तक इसका संबंध् मुख्य कलाकार और कलाकार ;ज्येष्ठद्ध के पद से है, उन बातों के सिवाय अध्क्रिान्त करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, विस्तार निदेशालय, कृषि मंत्राालय, कृषि एवं सहकारिता विभाग में मुख्य कलाकार और कलाकार ;ज्येष्ठद्ध के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, कृषि और सहकारिता विभाग, विस्तार निदेशालय, मुख्य कलाकार और कलाकार ;ज्येष्ठद्ध ;समूह खद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा तथा अन्य अर्हताएं, आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है विवाह किया है, या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की हैऋ या

उक्त पदों पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ें वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1ः जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली है।

टिप्पण 2ः प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पूर्व या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी। प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध :- केंद्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्राों या स्वायत्त या कानूनी संगठनों या पब्लिक सेक्टर के उपक्रमों या विश्वविद्यालय या मान्यताप्राप्त संस्थानों के अध्ीन ऐसे अध्किारी :- ;कद्ध;iद्ध जो मूल काडर अथवा विभाग में नियमित आधर पर सदृृश पद धरण किए हुए होंऋ या ;iiद्ध जिन्होंने मूल काडर अथवा विभाग में वेतन बैंड-2, 9300-34800 रफ. ग्रेड वेतन 4200 रफ. में नियमित आधार पर नियुक्ति के पश्चात्‌ उस श्रेणी में पांच वर्ष सेवा की हैऋ और ;खद्ध जिनके पास निम्नलिखित अर्हताएं और अनुभव हों :- आवश्यकः ;iद्ध किसी मान्यताप्राप्त विश्विवद्यालय या संस्थान से ललित कला या वाणिज्यिक कला में डिग्रीऋ ;iiद्ध विभिन्न प्रचार मीडिया जैसे पत्रिाकाओं, पुस्तकों, पोस्टरों, इश्तहारों, किसी सरकारी विभाग या उपक्रम या संगठन में या किसी मान्यताप्राप्त संस्था में पफोल्डरों के लिए कलर अथवा श्याम और श्वेत में अभिन्यास तैयार करने का दो वर्ष का अनुभव। अथवा ;iद्ध किसी मान्यताप्राप्त संस्थान से ललित कला या वाणिज्यिक कला में डिपलोमाऋ ;iiद्ध विभिन्न प्रचार मीडिया जैसे पत्रिाकाओं, पुस्तकों, पोस्टरों, इश्तहारों, किसी सरकारी विभाग या उपक्रम या संगठन में या किसी मान्यताप्राप्त संस्था में पफोल्डरों के लिए कलर अथवा श्याम और श्वेत में अभिन्यास तैयार करने का तीन वर्ष का अनुभव। वांछनीय : पफोटोग्रापिफक का और प्रदर्शनियों का दो वर्ष का अनुभवऋ या आपफसेट और लेटर प्रैस राइटिंग का दो वर्ष का अनुभवऋ या ग्रामीण क्षेत्राों में कृषि और सहब( विषयों पर प्रचार सामग्री हेतु अभिन्यास तैयार करने का दो वर्ष का अनुभव। टिप्पण 1ः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे। प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केंद्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध्ि सम्मिलित है, साधरणतया तीन वर्ष से अध्कि नहीं होगी।

प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध पर नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी।

टिप्पण 2ः प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अध्किारी द्वारा 01 जनवरी, 2006 से पूर्व या उस तारीख से, जिससे छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमानों का सामान्य ग्रेड वेतन या वेतनमानों सहित एक श्रेणी में विलय हो गया है और जहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा, जिसके ;जिनकेद्ध लिए वह ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है उक्त आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जायेगी।

बाह्‌्‌य व्यक्तियों के साथ उस ग्रेड में छह वर्ष की नियमित सेवा के साथ वेतन बैंड-1, 5200-20200 रु. ग्रेड वेतन 2800 रु. में विभागीय कलाकार ;कनिष्ठद्ध पर भी विचार किया जाएगा और यदि इस पद के लिए उसका चयन हो जाता है तो इसे प्रोन्नति द्वारा भरा गया माना जाएगा।

टिप्पण 1ः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे। इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे।

G.S.R. 6.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Extension, Chief Artist Recruitment Rules, 1962 and Artist (Senior) Recruitment Rules, 1985, in so far as they relate to the posts of Chief Artist and Artist (Senior), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Chief Artist and Artist (Senior), in the Directorate of Extension, Ministry of Agriculture, Department of Agriculture and Cooperation, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Chief Artist and Artist (Senior), (Group 'B') Recruitment Rules 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said posts, its classification, and the pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, and other qualifications, etc.—The method of recruitment, to the said posts age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the afare said Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other backward classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time-to-time in this regard.

Essential:

1. (i) Degree in Fine Arts or Commercial Arts from a recognised University or Institute;

(ii) Two Years' experience of preparaing of layout in colour and black and white for different publicity media such as Magazines, Books, Pamphlets, Leaflets, Folders in a Government Department or Undertaking or Organisation or in any recognised Institution.

(i) Diploma in Fine Arts or Commercial Art from a recognised University or Institute.

(Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed three years. 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष वर्ग के व्यक्तियों के लिए उपबंध् अपेक्षित है ।

G.S.R. 7.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Assistant Accounts Officer, Accountant and Junior Accountant, Recruitment Rules, 2002, in so far as it relates to the post of Junior Accountant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Junior Accountant, in the Directorate of Extension, Department of Agriculture and Cooperation, in the Ministry of Agriculture, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Junior Accountant, Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications, etc.—The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time-to-time in this regard.

(ii) with five years' service in the grade rendered after appointment thereto on a regular basis in the pay band- 2, Rs. 9300—34800 with grade pay of Rs. 4200 or equivalent in the parent cadre or Department; and

(b) Possessing the following qualifications and experience-

(i) Successful completion of training in Cash and Accounts work in the Institute of Secretariat Training and Management or equivalent;

(ii) Three years' experience in Cash, Accounts and Budget work. Note 1: The departmental Junior Accountant in Pay Band-1, Rs. 5200—20200 and grade pay Rs. 2800 with eleven years of regular service in the grade will also be considered along with outsiders and in case he or she is selected for appointment to the post, it shall be deemed to have been filled by promotion. Note 2: The departmental officer in the feeder grade who is in direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 3: The period of deputation, (Including Short term Contract) including period of deputation (Inclusing Short term Contract) in another ex-cadre post held immediately preceding this appointment in the same or some other department or organisation of the Central Government, shall ordinarily not exceed threee years. The maximum age-limit for deputation is 56 years as on the closing date of receipt of applications.

Note 4: For the purposes of appointment on deputation/ absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except76 THE GAZETTE OF INDIA : JANUARY 10, 2015/PAUSA 20, 1936 [PART II—SEC. 3(i)] (11)

where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.

No. 185 at pages 1063-1066 relating to Ministry of Agriculture, Central Institute of Fisheries, Nautical and Engineering Training, Cochin, Senior Instructor (Training) Recruitment Rules, 2013, in Schedule, under column (12), in the initial heading "Group 'A' Departmental Promotion Committee (for considering confirmation) consisting of", the word "confirmation" shall be substituted with the word "promotion".
