सा.का.नि. 51.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केंद्रीय सरकार स्वास्थ्य परियोजना संगठन, एलोपैथिक ;भेषजज्ञद्ध समूह 'ग' पद भर्ती नियम, 2002, को उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हे ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, केंद्रीय सरकार स्वास्थ्य स्कीम संगठन, स्वास्थ्य और परिवार कल्याण मंत्राालय में भेषजज्ञ ;एलोपैथिकद्ध के पद पर भर्तीं की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्राालय केंद्रीय सरकार स्वास्थ्य स्कीम संगठन, भेषजज्ञ ;एलोपैथिकद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण और वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 51 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Government Health Scheme Organisation, Allopathic (Pharmacist) Group 'C' post Recruitment Rules, 2002, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Pharmacists (Allopathic) in the Central Government Health Scheme Organisation, Ministry of Health and Family Welfare, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Health and Family Welfare, Central Government Health Scheme Organisation, Pharmacist (Allopathic) Recruitment Rules, 2015.

(2) They shall come into force on the date of publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications etc .— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings.—Nothing in these rules shall affect reservation, relaxation of age limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 52 .—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केंद्रीय औषध् िप्रयोग शाला कलकत्ता वर्ग, 3 और वर्ग 4, भर्ती नियम, 1972, को जहां तक उसका सम्बन्ध् ज्येष्ठ प्रयोगशाला सहायक के पद से है, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हे ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, केंद्रीय औषध् िप्रयोगशाला कलकत्ता, स्वास्थ्य महानिदेशालय सेवाएं, स्वास्थ्य और परिवार कल्याण मंत्राालय में ज्येष्ठ प्रयोगशाला सहायक के पद पर भर्तीं की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं, आदि.—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

G.S.R. 52 .— In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Central Drugs Laboratory, Calcutta Class III and Class IV Posts, Recruitment Rules, 1972, in so far as they relate to the post of Senior Laboratory Assistant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Laboratory Assistant in the Central Drugs Laboratory Calcutta, Directorate General of Health Services, Ministry of Health and Family Welfare, namely: -

1. Short title and commencement. — (1) These rules may be called the Central Drugs Laboratory, Kolkata (Senior Laboratory Assistant) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale. —The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc. — The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification. — No person, -

(i) who, has entered into or contracted a marriage with a person having a spouse living; or

(ii) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. — Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. — Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Schedules Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

4. भर्ती की प(ति, आयु-सीमा और अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा और अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. आरम्भिक गठन.—सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्राालय, क्षेत्रा संकार्य प्रभाग, राष्ट्रीय प्रतिदर्श सर्वेक्षण कार्यालय के पफरीदाबाद स्थित मुख्यालय कार्यालय की 'ग' प्रकार की विभागीय कैंटीन में तथा सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्राालय, क्षेत्रा संकार्य प्रभाग, राष्ट्रीय प्रतिदर्श सर्वेक्षण कार्यालय के कोलकाता स्थित प्रादेशिक कार्यालय के 'क' प्रकार के टिपिफन कक्ष में कार्य करने वाले तत्कालीन सभी समूह 'ग' और 'घ' कर्मचारी, उपर्युक्त 'ग' प्रकार की विभागीय कैंटीन और 'क' प्रकार के टिपिफन कक्ष में मंजूर पद पर तत्पश्चात सीध्ी भर्ती के आधर पर भर्ती किये जाने पर 'ग' प्रकार की विभागीय कैंटीन और 'क' प्रकार के टिपिफन कक्ष में वेतन बैंड-1, 5200-20200 रु. के संब( ग्रेड वेतन 1800, 1900, 2000 और 2400 में समूह 'ग' पदों पर इन नियमाें के प्रावधनों के अनुसार समूह 'ग' के संब( पद पर नियमित आधर पर सीध्ी भर्ती द्वारा नियुक्त किये गये समझे जायेंगे और इन नियमों के आरम्भ होने से तुरन्त पहले उनकी पद पर नियमित सेवा प्रोन्नति के लिए अर्हक सेवा के प्रयोजन के लिए हिसाब में ली जायेगी ।

6. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

7. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

टिप्पण 1 .- प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना विस्तार किया गया है, की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

टिप्पण 2 .- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जबकि उसके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, उनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्तिः- केंद्रीय सरकार के अध्ीन ऐसे अध्किारीः

;कद्ध;iद्ध जो नियमित आधर पर सदृश पद धारण किए हाेंऋ या

;iiद्ध जिन्होंने वेतन बैंड-1, 5200-20200 रु. + गे्रड वेतन 1900 रु. में कम से कम आठ ;8द्ध वर्ष नियमित सेवा की है ऋ

;iiiद्ध जिनके पास स्तंभ ;7द्ध के अध्ीन सीध्े भर्ती के लिए विहित शैक्षिक अर्हता हैऋ और

;खद्ध सरकारी विभाग या उपक्रम में भंडाराें या लेखाओं के हैंडलग में तीन वर्ष का अनुभव।

टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधारणतया 3 वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होेंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

कैन्टीन परिचर को लिपिक के पद पर प्रोन्नति के लिए सचिवालय प्रशिक्षण और प्रबंध् संस्थान या भारत सरकार या राज्य सरकार द्वारा मान्यता प्राप्त किसी अन्य संस्थान से संगठनात्मक व्यवहार, संचार कौशल और लेखा व्यवहार पर दो सप्ताह का प्रशिक्षण वांछनीय होगा ।

G.S.R. 53 .—In exercise of the powers conferred by the proviso to Article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Manager- cum-Store Keeper, Halwai-cum-Cook, Clerk, and Canteen Attendent in the Departmental Canteen of the Ministry of Statistics and Programme Implementation, Field Operations Division, National Sample Survey Office, namely:-

1. Short title and commencement.— (1 )These rules may be called the Ministry of Statistics and Programme Implementation, Field Operations Division, National Sample Survey Office, Assistant Manager-cum-Store Keeper, Halwai- cum-Cook, Clerk and Canteen Attendent Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts as specified in column (1) of the Schedule-annexed to these rules.

3. Number of posts, classification, pay band and grade pay or -pay scale.-—The number of the posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4 )of the said Schedule.

4. Method of recruitment, age limit and qualifications, etc.— The method of recruitment, age limit qualification and other matters relating thereto shall be as specified in the column (5) to (13) of the said schedule.

Initial Constitution.—All the erstwhile regular Group 'C' and Group 'D' employees working in the Departmental Canteen Type 'C', Field Operations Division, National Sample Survey Office, Ministry of Statistics and Programme Implementation located at Headquarters Office, Faridabad and Tiffin Room Type 'A' Field Operations Division, National Sample Survey Office, Ministry of Statistics and Programme Implementation located at Regional Office Kolkata and subsequently recruited on direct recruitment basis to the post sanctioned in the aforesaid Departmental Canteen-Type 'C'and Tiffin Room Type 'A' shall be deemed to have been appointed to the respective post of Group 'C' by direct recruitment on regular basis in Group 'C' Posts in the pay band-1 i.e. Rs. 5200-20200 with respective grade pay of Rs.1800, 1900, 2000 and 2400 in the Departmental Canteen Type 'C' and Tiffin Room Type 'A' in accordance with the provisions of these Rules and their continues service in the post immediately before the commencement of these Rules shall be taken into account for the purpose of qualifying service for promotion.

6. Disqualification.— No person.-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rule.

7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing to relax any of the provisions of these rules with respect to any class or category of persons.

8. Saving.—Nothing in these rules shall affect reservation, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other Backward Classes, Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to the 1st January, 2006, the datefrom which the revised pay structure based on the Sixth Cental Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendation of the Pay Commission.

Note-2 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion. their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or 2 (two) years, whichever is less. and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

(a) (i) Holding analogous posts on regular basis; or

(ii) With alteast 8 (eight) years regular service in the pay band- 1, Rs. 5200-20200 + Grade Pay Rs. 1900.

(iii) Possessing educational qualification as prescribed for direct recruitment under column (7) and

(b) Three 3 years experience in a Government Department or Undertaking in handling Stores or Accounts.

Note 1: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed 3 (three) years. The maximum age- limit for deputation is 56 (fifty six) years as on the closing date of receipt. of applications.

Note-2 : The departmental officials in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation, Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note-3 : For the purpose of appointment on deputation or absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has beenextended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommen- dations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the posts for which that grade pay or pay scale is the normal replacement grade without any upgradation.
