सा.का.नि. 54.—केन्द्रीय सरकार, आपदा प्रबंध्न ;राष्ट्रीय आपदा मोचन बलद्ध नियम, 2008 के नियम 3 के साथ पठित आपदा प्रबंध्न अध्निियम, 2005 ;2005 का 53द्ध की धरा 75 की उप-धरा ;1द्ध और उप-धरा ;2द्ध के खंड ;चद्ध द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रीय आपदा मोचन बल समूह ''क'', राजपत्रिात योद्‌ध्क पद भर्ती नियम, 2011 का संशोध्न करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ः—

1. ;1द्ध इन नियमों का संक्षिप्त नाम राष्ट्रीय आपदा मोचन बल समूह 'क', राजपत्रिात, योद्‌ध्क पद भर्ती ;संशोध्नद्ध नियम, 2015 है।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. राष्ट्रीय आपदा मोचन बल समूह 'क' राजपत्रिात, योद्‌ध्क पद भर्ती नियम, 2011 की अनुसूची में, —

;कद्धः उप महानिरीक्षक के पद से संबंध्ति क्र.सं. 3 के सामने स्तंभ ;11द्ध में, मद ;iiद्ध के स्थान पर, निम्नलिखित मद रखी जाएगी, अर्थात्‌ः—

G.S.R. 54.—In exercise of the powers conferred by sub-section (1) and clause (f) of sub-section (2) of section 75 of the Disaster Management Act, 2005 (53 of 2005), read with rule 3 of the Disaster Management (National Disaster Response Force) Rules, 2008, the Central Government hereby makes the following rules to amend the National Disaster Response Force, Group 'A', Gazetted, Combatised Posts Recruitment Rules, 2011, namely:-

1. (1) These rules may be called the National Disaster Response Force, Group 'A', Gazetted, Combatised Posts Recruitment (Amendment) Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the National Disaster Response Force, Group 'A', Gazetted, Combatised Posts Recruitment Rules, 2011 ,—

(a) against serial number 3, relating to the post of Deputy Inspector General, in column (11), for item (ii), the following item shall be substituted, namely:-

"(ii) shall be in medical category" SHAPE I.

Note:- The period of deputation shall ordinarily be for five years and in the case of Indian Police Service Officers, the period of deputation shall be governed by tenure policy specified by Ministry of Home Affairs for Indian Police Service Officers.";

सा.का.नि. 57.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए सचिवालय प्रशिक्षण और प्रबंध् संस्थान, सहायक निदेशक ;अंग्रेजी आशुलिपि और टंकणद्ध भर्ती नियम, 1986 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, सचिवालय प्रशिक्षण और प्रबंध् संस्थान, कामक, लोक शिकायत और पेंशन मंत्राालय में सहायक निदेशक ;अंग्रेजी आशुलिपि और टंकणद्ध के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सचिवालय प्रशिक्षण और प्रबंध् संस्थान, सहायक निदेशक ;अंग्रेजी आशुलिपि और टंकणद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अर्हताएं आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 57.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Institute of Secretariat Training and Management, Assistant Director (English Shorthand and Typewriting) Recruitment Rules, 1986, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post Assistant Director (English Shorthand and Typewriting) in the Institute of Secretariat Training and Management, Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, namely:-—

1. Short title and commencement.-— (1) These rules may be called the Institute of Secretariat Training and Management, Assistant Director (English Shorthand and Typewriting) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette

2. Number of posts, classification and pay band and grade pay.— The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed hereto .

3. Method of recruitment, age limit and qualifications. etc.-— The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualifications.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

The maximum age limit for appointment by deputation shall not be exceeding fifty six years as on the closing date of the receipt of applications).

Note:- For the purpose of deputation, the service rendered on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 58.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विस्तार निदेशालय ;समूह 'ग' और समूह 'घ' पदद्ध भर्ती नियम, 1964, जहां तक उनका संबंध् सहायक तकनीकी अध्किारी के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, कृषि मंत्राालय, कृषि और सहकारिता विभाग विस्तार निदेशालय, सहायक तकनीकी अध्किारी के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय, कृषि और सहकारिता विभाग, विस्तार निदेशालय, सहायक तकनीकी अध्किारी समूह ''ख'' पद भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड तथा ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा, परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति :—

केंद्रीय या राज्य सरकार या संंघ राज्य क्षेत्रा या विश्वविद्यालयों या मान्यता- प्राप्त अनुसंधन संस्थानों या भारत सरकार के उपक्रमों या अर्ध् सरकारी या स्वायत्त या सांविध्कि निकायों के अध्ीन ऐसे अध्किारी :—

Promotion is from Cameraman-cum-Plate-Maker in pay band-1, Rs. 5200-20200 with grade pay of Rs. 2800 with six years regular service in the grade.

Note 1: Where juniors who have completed their qualifying or eligibility services are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility services or two years whichever is less and have successfully completed their probation period for promotion to the next higher grade along- with their juniors who have already completed such qualifying or eligibility service.

Note 1: The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note 2: Period of deputation (including short-term contract) including period of deputation (including short-term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department in the Central Government shall ordinarily not exceed three years. The Maximum age limit for appointment by deputation shall not be exceeding fifty-six years as on the closing date for the receipt of applications.

G.S.R. 59.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Extension (Group 'C' and Group 'D' Posts) Recruitment Rules, 1964 and Directorate of Extension, Offset Production Officer (Group 'B' Posts) Recruitment Rules, 1996 in so far as they relate to the post of Offset Production Officer and Press Supervisor, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Offset Production380 THE GAZETTE OF INDIA : MARCH 21, 2015/PHALGUNA 30, 1936 [PART II—SEC. 3(i)] Officer and Press Supervisor, in the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension namely:-

1. Short title and commencement.—( 1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Directorate of Extension, Offset Production Officer and and Press Supervisor, (Group 'B') Post Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of the said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment to the said posts, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to Relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 60.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और कृृषि और सहकारिता विभाग वरिष्ठ तकनीकी सहायक मृृदा संरक्षण भर्ती नियम 1986 तथा कृृषि और सहकारिता विभाग वरिष्ठ तकनीकी सहायक ;मृृदा संरक्षणद्ध भर्ती नियम, 1999 को उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, कृृषि मंत्राालय, कृृषि और सहकारिता विभाग के अध्ीन प्राकृृतिक संसाध्न प्रभाग में वरिष्ठ तकनीकी सहायक -श्रेणी-1 ;मृृदा संरक्षणद्ध तथा वरिष्ठ तकनीकी सहायक श्रेणी-2 मृदा संरक्षण के पदों की भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृृषि मंत्राालय, कृृषि और सहकारिता विभाग, प्राकृृतिक संसाध्न प्रबंध्न प्रभाग में वरिष्ठ तकनीकी सहायक-श्रेणी-1 ;मृृदा संरक्षणद्ध एवं वरिष्ठ तकनीकी सहायक श्रेणी-2 मृदा संरक्षण भर्ती नियम, 2015 है।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन अथवा वेतनमान.—पदों की संख्या, उनका वर्गीकरण, वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे हाेंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें संघ लोक सेवा आयोग से परामर्श कर और लेखब( करके इन नियमों के किसी उपबंध् को, किसी वर्ग या श्रेणी के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

जिन्होंने वेतन बैंड-2, 9300-34800 रफ. + ग्रेड वेतन 4200 रफ.में विभागीय ज्येष्ठ तकनीकी सहायक ग्रेड-2 ;मृृदा संरक्षणद्ध के पद पर श्रेणी में पांच वर्ष नियमित सेवा की हों तथा प्रतिनियुक्ति व्यक्तियों के साथ स्तंभ 7 के अध्ीन सीध्ी भर्ती के लिए विहित शैक्षिक अर्हता रखते हों, पर भी विचार किया जाएगा तथा यदि पद पर नियुक्ति के लिए उनका चयन किया जाता है, तो पद को प्रोन्नति द्‌्‌वारा भरा हुआ समझा जाएगा ।

टिप्पण 1ः पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होेंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्‌्‌वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । प्रतिनियुक्ति की अवध् ि;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् ि है साधरणतया तीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्‌्‌वारा नियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहाँ एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह पफायदा केवल उस पद पर388 THE GAZETTE OF INDIA : MARCH 21, 2015/PHALGUNA 30, 1936 [PART II—SEC. 3(i)] ;11द्ध

विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित, विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R. 60 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Cooperation Senior Technical Assistant (Soil Conservation) Recruitment Rules, 1986 and the Department of Agriculture and Cooperation Technical Assistant (Soil Conservation) Recruitment Rules, 1999, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Senior Technical Assistant-Grade-I (Soil Conservation) and Senior Technical Assistant-Grade-II (Soil Conservation) in the Natural Resources Management Division, Department of Agriculture and Cooperation, Ministry of Agriculture, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Natural Resources Management Division [Senior Technical Assistant Grade-I (Soil Conservation) and Senior Technical Assistant Grade-II (Soil Conservation)] Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.— The number of the said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order for reasons to be recorded in writing, and in consultatin with the Union Public Service Commission, relax any of provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservations, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with orders issued by the Central Government from time to time in this regard.

Note 1: The Departmental officers in the feeder category who are in direct line of promotion will not be eligible for consideration for appointment on Deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. सा.का.नि. 61.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और खान ब्यूरो ;समूह ग अनुसचिवीयद्ध भर्ती नियम 1965, को वहां तक कि उसका संबंध् उच्च श्रेणी लिपिक के पद से है उन बातों के सिवाय आंशिक रूप से अध्क्रिान्त करते हुए, जिन्हे ऐसे उपांतरण से पहले किया गया है या करने का लोप किया गया है, खान मंत्राालय, भारतीय खान ब्यूरो में उच्च श्रेणी लिपिक के पदों पर भर्तीं की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम भारतीय खान ब्यूरो में उच्च श्रेणी लिपिक भर्ती नियम, 2014 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड तथा ग्रेड वेतन या उससे संलग्न वेतनमान वे हाेंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

2. विभागीय प्रतियोगिता परीक्षा-ऐसे अवर श्रेणी लिपिकों तक सीमित होगी जिन्होंने उस श्रेणी में कम से कम पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा, परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति- केंद्रीय सरकार के अध्किारी-

पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होेंगे। इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 1- प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवध् िहै, साधारणतया 3 वर्ष से अध्कि नहीं होगी ।

G. S. R. 61.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in partial modification of Indian Bureau of Mines (Group 'C', Non-Gazetted, Ministerial) Recruitment Rules, 1965 , in so far as they relate to the post of Upper Division Clerk, except as respects things done or omitted to be done before such modification, the President hereby makes the following rules regulating the method of Recruitment to the posts of Upper Division Clerk in Indian Bureau of Mines, Ministry of Mines, namely :-

1. Short title and commencement.—(1) These rules may be called the Indian Bureau of Mines, Ministry of Mines, Upper Division Clerk Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.— The number of the said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforsaid Schedule.

4. Disqualification.— No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing,and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with orders issued by the Central Government from time to time in this regard.

Note 2: For more purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall deemed to be service rendered in the corresponding pay/ pay scale extended based on the recommendations of the Pay Commission.

Deputation:

Officers of the Central Government.

(i) holding analogous post on regular basis; or

(ii) with eight years regular service of Lower Division Clerks in PB-1 of Rs.5200-20200 with Grade Pay of Rs.1900 or equivalent.

The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note-1: Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years.

Note-2: The maximum age limit for appointment by deputation shall be 'Not exceeding 56 years' as on the closing date of receipt of applications.

सा.का.नि. 62.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और बी सी जी वैक्सीन प्रयोगशाला, गिंडी, मद्रास ;समूह 'ग' पदद्ध भर्ती नियम 1981 को, जहां तक उसका संबंध् उच्च श्रेणी लिपिक के पद से है, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, स्वास्थ्य और परिवार कल्याण मंत्राालय, के बी सी जी वैक्सीन प्रयोगशाला, गिंडी, चैन्नई में उच्च श्रेणी लिपिक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्राालय, बैकिलस कालमेटे-गुएरिन वैक्सीन, प्रयोगशाला, गिंडी, चैन्नई, उच्च श्रेणी लिपिक ;समूह 'ग' पदद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पदों में से किसी पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 2 : रिक्तियों के एक भाग को इस निमित सीमित जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया विभागीय प्रतियोगी परिक्षा के आधर पर भरा जा सकेगा । जाएगा, परंतु यह जब तक कि उनके द्वारा की गई ऐसी अर्हक या विभागीय परीक्षा के लिए पात्राता सेवा संबंध्ति संगठन में पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि या अवर श्रेणी लिपिक की श्रेणी में पांच वर्ष की नियमित सेवा दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसे पात्राता सेवा पहले होगी । ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझा जाएगा ।

प्रतिनियुक्ति- केंद्रीय सरकार के ऐसे अध्किारी-

C. G. Vaccine Laboratory, Guindy, Chennai namely: -

1. Short title and commencement .—(1) These rules may be called the Ministry of Health and Family Welfare, Bacillus Calmette-Guerin Vaccine Laboratory, Guindy, Chennai Upper Division Clerk (Group 'C' Post), Recruitment Rules, 2015.

(2) They shall come into the force on the date of their publication in the Official Gazette.

Note 2:- For the purpose of computing minimum qualifying service for promotion, the service rendered on a reguler basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the Pay Commission.

Deputation:

Officers of Central Government

(i) holding analogous post on regular basis;

or

(ii) with eight years regular service in the grade of Lower Division Clerk or equivalent.

(iii) The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.

(iv) Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

(v) Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years.

The maximum age limit for appointment by deputation shall be 'Not exceeding 56 years as on the closing date of receipt of applications.

Note: For the purpose of appointment on deputation or absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be deemed to the service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of the pay into one grade with a common Grade Pay/Pay Scale and where this benefit will extend only for the post or posts for which that Grade Pay or Pay scale is the normal replacement grade without any up gradation.
