का.नि.आ. 16.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सैनिक इंजीनियरी सेवा ;परिमाण सर्वेक्षण और संविदाद्ध काडर समूह 'क' पद भर्ती नियम, 2014 को, जहां तक उसका संबंध् कार्यपालक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध के पद से है, उन बातों के सिवाए अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, रक्षा मंत्राालय के अध्ीन सैनिक इंजीनियरी सेवा में कार्यपालक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, सैनिक इंजीनियरी सेवा कार्यपालक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध समूह 'क' पद भर्ती नियम, 2015 है ।

;2द्ध ये तारीख 17 पफरवरी, 2005 से प्रवृत्त हुए समझे जाएंगे ।

2. पद की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे, जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है ऋ

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके और संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

;iद्ध जो श्रेणी में आठ वर्ष की नियमित सेवा करते हैं और सिविल इंजीनियरी में डिग्री रखते हैं या भारत सर्वेक्षण संस्थान से उत्तीर्ण हैं अथवा अंतिम परीक्षा में भाग ले रहे हों, या

;iiद्ध जो श्रेणी में दस वर्ष की नियमित सेवा रखते हैं तथा किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से सिविल इंजीनियरी में डिप्लोमा रखते हैं या भारत सर्वेक्षण संस्थान से भवन और परिमाण सर्वेक्षण परीक्षा में इंटरमीडिएट उत्तीर्ण हैं ।

टिप्पण 1ः उपरोक्त ;खद्ध के संबंध् में, प्रोन्नति के लिए पात्राता सूची अध्किारियों द्वारा अपनी-अपनी श्रेणी या पद में विहित अर्हक सेवा पूरी होने की तारीख के प्रति निदेश से तैयार की जाएगी ।

टिप्पण 2ः जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनके ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी-अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो । सहायक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध जो डिग्री रखते हैं और सहायक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध जो डिप्लोमा रखते हैं की पात्राता सूची तैयार करते समय यह उपबंध् पृथक्तः लागू होंगे ।

टिप्पण 3ः सैनिक इंजीनियर सेवा ;परिमाण सर्वेक्षण और संविदाद्ध काडर समूह 'क' पद भर्ती नियम, 2005 के आरंभ की तारीख अर्थात्‌ 17 पफरवरी, 2005 को चार वर्ष की सेवा रखने वाले सभी सहायक कार्यपालक इंजीनियर110 THE GAZETTE OF INDIA : MAY 9, 2015/VAISAKHA 19, 1937 [PART II—SEC. 4] ;11द्ध

;परिमाण सर्वेक्षण और संविदाद्ध जो श्रेणी में पद धरण किए हुए हैं और किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से सिविल इंजीनियरी में डिग्री या डिप्लोमा रखते हैं या भारत सर्वेक्षण संस्थान से भवन और परिमाण सर्वेक्षण परीक्षा में इंटरमीडिएट पास हैं उन्हें भी कार्यपालक इंजीनियर ;परिमाण सर्वेक्षण और संविदाद्ध के लिए प्रोन्नति पर उपरोक्त खंड ;कद्ध और ;खद्ध के प्रवृत होने से पहले विचार किया जायेगा ।

स्पष्टीकारक ज्ञापन- ;कद्ध कामक और प्रशिक्षण विभाग और संघ लोक सेवा आयोग के अनुमोदन के अनुसार का.नि.आ. 25, तारीख 27 मार्च, 2014 द्वारा अध्सिूचित सेना इंजीनियर सेवा ;परिमाण सर्वेक्षण और संविदाद्ध समूह 'क' पद के लिए भर्ती नियम भूतलक्षी प्रभाव अर्थात्‌ 17 पफरवरी, 2005 से कार्यान्वित किए जाने थे, तथापि, टंकण संबंध्ी त्राुटि के कारण इनका अध्सिूचना में उल्लेख किया गया था कि वे राजपत्रा में इनके प्रकाशन की तारीख को प्रवृत्त होंगे जिन्हें संशोध्ति किया जाना अपेक्षित है ।

;खद्ध सेना इंजीनियर सेवा ;परिमाण सर्वेक्षण और संविदाद्ध समूह 'क' पद एक संगठित समूह 'क' सेवा है । संगठित समूह 'क' सेवा में ज्येष्ठ समय वेतनमान की श्रेणी में प्रोन्नति के लिए पात्राता कनिष्ठ समय वेतनमान मेें नियमित चार वर्ष की सेवा है । अतः वेतन बैंड 3 ग्रेड वेतन 5400 रफपये सहायक कार्यपालक इंजीनियर की श्रेणी में पांच वर्ष की पात्राता सेवा वेतन बेंड, ग्रेड वेतन 6600 रफ. में कार्यपालक इंजीनियर की श्रेणी में प्रोन्नति के लिए चार वर्ष के रूप में प्रतिस्थापित की जाती है ।

यह स्पष्ट किया जाता है कि इन नियमों को भूतलक्षी प्रभाव देने के किसी भी व्यक्ति पर प्रतिकूल प्रभाव नहीं पडे़गा ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

New Delhi, the 29th April, 2015

S.R.O. 16.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Defence , Military Engineer Services (Quantity Surveying and Contracts Cadre), Group 'A' Posts Recruitment Rules, 2014 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Executive Engineer (Quantity Surveying and Contracts ) in the Military Engineer Services under the Ministry of Defence, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence , Military Engineer Services (Quantity Surveying and Contracts Cadre), Group 'A' Posts Recruitment Rules, 2015.

(2) They shall be deemed to have come into force with effect from the 17th February, 2005.

2. Number of posts, classification and pay band and grade pay or pay scale.—The number of the said post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit and other qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of these rules.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

Rs. 15600-39100 Grade Pay Rs. 5400 with four years regular service in the grade and possessing Degree in Civil Engineering from a recognised University; or passed final or direct final examination of Institution of Surveyors, (India).

(b) 33.33% from Assistant Engineer (Quantity Surveying and Contracts) in the pay scale of Rs. 6500-10500 (Pre- revised) now revised as Pay Band - 2, Rs. Rs.9,300 - 34,800 Grade Pay of Rs. 4600.

(i) with eight years regular service in the grade and possessing Degree in Engineering (Civil), or passed final or direct final examination of Institution of Surveyors (India).

or

(ii) with ten years regular service in the grade and possessing Diploma in Civil Engineering from a recognised University or Institution or passed Intermediate in Building and Quantity Surveying Examination of Institution of Surveyors (India).

Note 1.- In respect of (b) above, the eligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post.

Note 2.- Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service. This provision shall be applicable separately to Assistant Engineer (Quantity Surveying and Contracts) possessing degree and Assistant Engineer (Quantity Surveying and Contracts) possessing Diploma while preparing the eligibility list.

Note 3.- All Assistant Executive Engineers (Quantity Surveying and Contracts) holding the post as on the 17th February, 2005, with four years service in the grade and possessing Degree or Diploma in civil engineering from a recognised university or institution or passed intermediate in Building and Quantity Surveying examination of institution of Surveyor (India), shall also be considered for promotion to Executive Engineer (Quantity Surveying and Contracts) before the provisions at (a) and (b) above are operated.

Explanatory Memorandum.- (a) As per the approval of the Department of Personnel and Training and Union Public Service Commission, the recruitment rules for the Military Engineer Services (Quantity Surveying and Contract) Group 'A' posts, notified, vide S.R.O. 25 dated the 27th March, 2014, was to be implemented with retrospective effect, that is, from 17th February, 2005, however, due to typographical error it was mentioned in the notification that they shall come into force on the date of their publication in the Official Gazette which is required to be amended.

(b) Military Engineer Services (Quantity Surveying and Contract) Group 'A' posts is an organised Group 'A' Service. In the organised Group 'A' Service, the eligibility for promotion to the grade of Senior Time Scale is four years regular service in the Junior Time Scale. Therefore, eligibility service of five years in the grade of Assistant Eexecutive Engineer in Pay Band - 3. Grade Pay Rs. 5400 is substituted as four years for promotion to the grade of Eexcutive Engineer in the Pay Band - 3, Grade Pay Rs. 6600. It is clarified that by giving retrospective effect to the rules, no one is adversely affected.

2. गुणता आश्वासन महानिदेशालय में कार्यरत सिविलियनों के लिए निवास स्थान के आवंटन के लिए नियम, 1996 में नियम 9 के खंड ;कद्ध के उप-खंड ; iद्ध के स्थान निम्नलिखित उप-खंड रखा जाएगा, अर्थात्‌ः—

''; iद्ध यदि किसी सरकारी सेवक को जिसको उच्च टाइप का आवास आवंटित कर दिया जाता है जो किसी विशिष्ट टाइप का आवास के अप्राप्यता के कारण अध्शिेष पड़ा है जिसके लिए सरकारी सेवक हकदार है वह अनुज्ञप्ति पफीस की सपाट दर संदाय करने का दायी होगा और यदि सरकारी सेवक के अनुरोध् पर उच्चतर टाइप का आवास आवंटित कर दिया जाता है तो ऐसे मामले में वह साधरण अनुज्ञप्ति पफीस का तीन गुणा अनुज्ञपित पफीस संदाय करने का दायी होगा :

परन्तु किसी सरकारी सेवक के किसी उच्च टाइप का आवास आवंटित करने के लिए यह वचनबंध् देगा कि उसे आवंटन प्राध्किारी द्वारा मांग किए जाने पर वह आवंटित आवास खाली कर देगा :

परन्तु यह और कि आवंटन प्राध्किारी द्वारा ऐसी कोई मांग नहीं की जाएगी, जब तक कि वह ऐसे सरकारी सेवक को उसकी पात्राता का आवास आवंटित नहीं कर देता या उसके बदले में मकान किराया भत्ता नहीं देता ।'' ।

S.R.O. 17.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Rules for Allotment of Residential Accommodation to Civilians serving in Directorate General of Quality Assurance, 1996, namely :-

1. (1) These rules may be called the Rules for Allotment of Residential Accommodation to Civilians Serving in the Directorate General of Quality Assurance (Amendment) Rules, 2015.

(2) They shall come into force from the date of their publication in the Official Gazette.

2. In the Rules for Allotment of Residential Accommodation to Civilians serving in the Directorate General of Quality Assurance, 1996, in rule 9, in clause (a), for sub- clause (i), the following sub-clause, shall be substituted, namely :-

"(i) If a Government servant is allotted a higher type of accommodation which is lying surplus due to non- availability of a particular type of accommodation for which the Government servant is entitled, he shall be liable to pay the flat rate of licence fee and if the higher type of accommodation is allotted on the request of a Government servant, in such a case, he shall be liable to pay a license fee three times the normal licence fee:

Provided that for allotting an accommodation of higher type, a Government servant shall give, an undertaking that he will vacate the accommodation allotted, on demand, by the allotting authority:

Provided further that no such demand shall be made by the allotting authority unless it allots to such a Government servant an accommodation of his entitlement or house rent allowance in lie thereof." .
