सा.का.नि. 95.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड समूह 'क' और समूह 'ख' पद भर्ती नियम, 2003 तथा विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड ;समूह 'ग' पदद्ध भर्ती नियम, 2005, को, जहां तक उनका संबंध् क्रमशः अध्ीक्षक ;तकनीकीद्ध ;हिन्दी शाखाद्ध और सहायक ;तकनीकीद्ध ;पद हिन्दी शाखा मेंद्ध पदों से है, उन बातों के सिवाय अध्क्रिान्त करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड में अध्ीक्षक ;तकनीकीद्ध ;हिन्दी शाखाद्ध और सहायक ;तकनीकीद्ध ;हिन्दी शाखाद्ध के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम विध् िऔर न्याय मंत्राालय, विधयी विभाग, राजभाषा खंड, अध्ीक्षक ;तकनीकीद्ध ;हिन्दी शाखाद्ध और सहायक ;तकनीकीद्ध ;हिन्दी शाखा द्धसमूह 'ख' पद भर्ती नियम, 2015 है।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे हाेंगे, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी, जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति : ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध राजभाषा खंड, विधयी विभाग के ऐसे सहायक ;तकनीकीद्ध;हिन्दी शाखाद्ध जिन्होंने वेतन बेंड-2 9300-34800 रु. + गे्रड वेतन 4200 रु. में पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्न्यन का साधरण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी।

प्रशिक्षण : प्रोन्नति, प्रोन्नत पद के कर्तव्यों और उतरदायित्वों के क्षेत्रा में विधयी प्रारूपण और अनुसंधन संस्थान विधयी विभाग में दो सप्ताह प्रशिक्षण के पूरा करने के अध्यध्ीन होगा :

परन्तु यह वे कि व्यक्ति जो विभागीय प्रोन्नति समिति की बैठक की तारीख से पहले प्रोन्नति के लिए प्रशिक्षण पूरा नहीं किया हो उन्हें भी इस शर्त के अध्यध्ीन रहते हुए विचार में लिया जाएगा कि वे विभागीय प्रोन्नति समिति की बैठक की तारीख से एक वर्ष की अवध् िके भीतर अपेक्षित प्रशिक्षण पूरा करेंगे ।

टिप्पण : वे व्यक्ति जो दो वर्ष के भीतर सेवा निवृत होने वाले हैं उन्हें प्रोन्नति के लिए प्रशिक्षण को पूरा करने से छूट होगी ।

प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध

1. केंद्रीय सरकार या राज्य सरकारों या संंघ राज्य क्षेत्रा प्रशासनों या पब्लिक सेक्टर उपक्रमों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधन648 THE GAZETTE OF INDIA : MAY 30, 2015/JYAISTHA 9, 1937 [PART II—SEC. 3(i)] ;11द्ध संस्थानों या अर्ध्-सरकारी या स्वायत्त निकायों अथवा कानूनी संगठनों या राज्य न्यायिक सेवाओं के ऐसे अध्किारी :

;कद्ध ;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैंऋ या

;iiद्ध जिन्होंने मूल काडर या विभाग में वेतन बैंड-2, 9300-34800 रु. + गे्रड वेतन 4200 रुपये में या समतुल्य में उस श्रेणी में पांच वर्ष नियमित की सेवा की होऋ

;iiद्ध केंद्रीय अध्निियम, प्रांतीय अध्निियम या राज्य अध्निियम द्वारा या उसके अध्ीन स्थापित या निगमित किसी मान्यताप्राप्त विश्वविद्यालय या केंद्रीय सरकार द्वारा उच्चतर शिक्षा के लिए सम किसी अन्य विश्वविद्यालय संस्था या केंद्रीय सरकार द्वारा अनुमोदित कोई अन्य संस्था या विदेशी विश्वविद्यालय से विध् िमें बैचलर डिग्री ;एलएलबीद्ध :

;iiiद्ध दो वर्ष की अवध् िके लिए किसी राज्य न्यायिक सेवा का सदस्य रहा हो ।

या

केंद्रीय सरकार के ऐसे सेवक जिनके पास दो वर्ष की अवध् िके लिए विध् िकार्य का अनुभव हो ।

या

दो वर्ष की अवध् िके लिए किसी राज्य सरकार के विध् िविभाग में पद धरण किया हो ।

या

किसी मान्यताप्राप्त संस्था में दो वर्ष के लिए विध् िका अध्यापक रहा हो ।

या

केंद्रीय सरकार या राज्य सरकार या संंघ राज्य क्षेत्रा प्रशासन या पब्लिक सेक्टर उपक्रमों या विश्वविद्यालयों या पब्लिक सेक्टर बैंको में विध्कि मामलों या विध्कि मामलों के अनुवाद या विध् िका अध्यापन या विध्ि प्रशासन में दो वर्ष का अनुभव हो :

या

केंद्रीय सरकार या राज्य सरकार/संंघ राज्य क्षेत्रा में कानून प्रारूपण का दो वर्ष का अनुभव ।

;ivद्ध केंद्रीय अध्निियम, प्रांतीय अध्निियम या राज्य अध्निियम द्वारा या उसके अध्ीन स्थापित या निगमित किसी मान्यताप्राप्त बोर्ड विश्वविद्यालय या केंद्रीय सरकार द्वारा उच्चतर शिक्षा के लिए सम किसी अन्य विश्वविद्यालय संस्था या केंद्रीय सरकार द्वारा अनुमोदित किसी649 [भाग II—खण्ड 3(i)] भारत का राजपत्रा : मई 30, 2015/ज्येष्ठ 9, 1937 ;11द्ध संस्था या विदेशी विश्वविद्यालय से हिन्दी माध्यम द्वारा या उच्चतर विद्यालय परीक्षा में हिन्दी विषय के रूप में दिया गया या बारहवीं स्तर परीक्षा या कोई उच्च परीक्षा पास या समतुल्य या केंद्रीय अध्निियम, प्रांतीय अध्निियम या राज्य अध्निियम द्वारा या उसके अध्ीन स्थापित किसी मान्यताप्राप्त बोर्ड या विश्वविद्यालय या किसी संस्था या केंद्रीय सरकार द्वारा उच्चतर शिक्षा के लिए समविश्वविद्यालय या केंद्रीय सरकार द्वारा अनुमोदित किसी संस्था या विदेशी विश्वविद्यालय से कोई उच्च परीक्षा पास ।

वांछनीय :

किसी मान्यताप्राप्त विश्वविद्यालय से हदी में मास्टर डिग्री जिसमें डिग्री स्तर पर अंग्रेजी एक अनिवार्य या वैकल्पिक विषय के रूप में रहा हो या परीक्षा के माध्यम के रूप में रहा होऋ

या

किसी मान्यताप्राप्त विश्वविद्यालय से अंग्रेजी में मास्टर डिग्री जिसमें डिग्री स्तर पर हदी एक अनिवार्य या वैकल्पिक विषय के रूप में रहा हो या परीक्षा के माध्यम के रूप में रहा होऋ

या

किसी मान्यताप्राप्त विश्वविद्यालय से हदी और अंग्रेजी से भिन्न किसी भी विषय में हदी माध्यम से मास्टर डिग्री जिसमें डिग्री स्तर पर अंग्रेजी और हदी अनिवार्य या वैकल्पिक विषय रहे होंऋ

या

किसी मान्यताप्राप्त विश्वविद्यालय से हदी या अंग्रेजी से भिन्न किसी भी विषय में अंग्रेजी माध्यम से मास्टर डिग्री जिसमें डिग्री स्तर पर हदी और अंग्रेजी अनिवार्य या वैकल्पिक विषय रहें होंऋ

या

किसी मान्यताप्राप्त विश्वविद्यालय से हदी या अंग्रेजी विषय से भिन्न किसी भी विषय में मास्टर डिग्री जिसमे अंग्रेजी या हदी माध्यम के रूप में रहा हो तथा डिग्री स्तर पर अंग्रेजी या हदी अनिवार्य या वैकल्पिक विषय के रूप में या परीक्षा के माध्यम के रूप में रहा हो ।

टिप्पण 1 :— प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अध्किारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है नियमित आधर पर की गई सेवा को सिवाय उस दशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर ;उन पदोंद्ध विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

टिप्पण-2 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होेंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्त के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण-3ः प्रतिनियुक्ति की अवध् िजिसके अंतर्गत अल्पकालिक संविदा भी है जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

से परामर्श करना आवश्यक है ।

टिप्पण :- आयु-सीमा अवधरित करने के लिए निर्णायक तारीख भारत में अभ्यथयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर,651 [भाग II—खण्ड 3(i)] भारत का राजपत्रा : मई 30, 2015/ज्येष्ठ 9, 1937 ;6द्ध नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौेल और स्पीति जिले तथा चम्बा-जिले के पांगी-उपखण्ड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए विहित की गई है ।द्ध

टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2 : अनुभव संबध्ी अर्हता ;अर्हताएंद्ध, कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती है, जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध् होने की संभावना नहीं है।

G.S.R. 95.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing, (Group 'A' and Group 'B' posts) Recruitment Rules, 2003 and the Ministry of Law and Justice, Legislative Department, Official Languages Wing, (Group 'C' posts) Recruitment Rules, 2005, in so far as they relate to the posts of Superintendent (Technical) (Hindi Branch) and Assistant (Technical) (Posts in Hindi Branch) respectively, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Superintendent (Technical) (Hindi Branch) and Assistant (Technical) (Hindi Branch), Ministry of Law and Justice, Legislative Department, Official Languages Wing, namely :-

1. Short title and commencement.—(1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, Superintendent (Technical) (Hindi Branch) and Assistant (Technical) (Hindi Branch), Group 'B' Posts Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale— The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns 2 to 4 of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 13 of the aforesaid Schedule.

5. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

on a regular basis by an officer prior to the 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

Training:

Promotion shall be subject to completion of two weeks training in the Institute of Legislative Drafting and Research, Legislative Department in the field of duties and responsibilities of the promotional post :

Provided that those persons who have not completed training for promotion before the date of meeting of Departmental Promotion Committee shall also be considered subject to the condition that the required training shall be completed within one year of the date from meeting of Departmental Promotion Committee.

Note :Those persons who are due to retire within two years shall be exempted from completion of such training for promotion.

Deputation (including short term contract) :

1. Officers of the Central Government or State Government or Union territory Administrations or Public Sector Undertakings or Universities or Recognised Research Institutions or Semi Government or Autonomous Bodies or Statutory Organisations or State Judicial Service, -

(a) (i) holding analogous post on regular basis in the parent cadre or Department; or

(ii) with five years' regular service in the grade in pay band-2, Rs.9300-34800 with grade pay of Rs.4200 or equivalent in the parent cadre or Department; and

(b) possessing the following educational qualifications and experience: -

(i) Bachelor's Degree in any subject with Hindi and English as compulsory or optional subjects, or either of the two as medium of examination and other as optional or compulsory subject;

(ii) Bachelor's Degree in Law (L.L.B.) from a recognised University established or incorporated by or under a Central Act; Provincial Act or a State Act or any institution for higher education deemed to be a University by the Central Government or any other institution or foreign University approved by the Central Government;

(iii) should have been a member of a State Judicial Service for a period of two years; or

should have held a post in the Law Department of a State Government for two years; or

should be a Central Government servant who has had experience in legal affairs for two years; or

should be a teacher of law for two years in a recognised institution; or

should have two years' experience in legal matters, or translation of legal matters or teaching of Law or Legal Administration in Central Government or State Government or Union Territory Administration or Public Sector Undertakings or Universities or Public Sector Banks; or

should have two years' experience of drafting of statutes in the Central Government or State Government/ Union territory .

(iv) passed 12th Standard Examination or any higher examination from a recognised Board or University established or incorporated by or under a Central Act; Provincial Act or a State Act or any institution for higher education deemed to be a University by the Central Government or any other institution or foreign University approved by the Central Government through Hindi medium or had offered Hindi as a subject in Secondary School Examination or equivalent or any higher examination from a recognised Board or University established or incorporated by or under a Central Act; Provincial Act or a State Act or any institution for higher education deemed to be a University by the Central Government or any other institution or foreign University approved by the Central Government.

Desirable :

Masters' Degree from a recognised University in Hindi with English as a compulsory or elective subject or as the medium of examination at the Degree level;

Or

Masters' Degree of a recognised University in English with Hindi as a compulsory or elective subject or as the medium of examination at the Degree level;

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है, और ऐसा करने के लिए अन्य आधर हैं, तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 96.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Law and Justice, Legislative Department, Official Languages Wing, (Group 'A' and Group 'B' posts) Recruitment Rules, 2003, in so far as they relate to the post of Stenographer Regional Languages [Posts in the Regional Languages Branch) [re-designated as Personal Assistant (Regional Languages)] except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Personal Assistant (Regional Languages), in the Ministry of Law and Justice, Legislative Department, Official Languages Wing, namely :-

1. Short title and commencement.— (1) These rules may be called the Ministry of Law and Justice, Legislative Department, Official Languages Wing, Personal Assistant (Regional Languages), Group 'B' post Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard.

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम पशुपालन, डेयरी और मत्स्यपालन विभाग, ;मात्स्यिकी प्रभाग, समूह ''क'' समूह ''ख'' और समूह ''ग'' पद भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम इन नियमों से उपाब( अनुसूची के स्तभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पद संख्या, उनका वर्गीकरण और ग्रेड वेतन तथा वेतन बैंड या वेतनमान.—पदों की संख्या, उनका वर्गीकरण और उनका वेतन बैंड और ग्रेड वेतन या वेतनमान वें होंगे, जो उक्त अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संध लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी।

जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, जहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलता- पूर्वक पूरी कर ली हो।

Post Recruitment Rules, 2002, Department of Animal Husbandry and Dairying, Deputy Commissioner (Fishing Harbour) Recruitment Rules, 2002, except as respects things done or omitted to be done before such supersession, the president hereby makes the following rules regulating the method of recruitment to the posts of Fisheries Research Investigator (Ordinary Grade), Senior Technical Assistant (Fisheries), Fisheries Research Investigation Officer, Assistant Commissioner (Fisheries), Deputy Commissioner (Fisheries), Joint Commissioner (Fisheries), Assistant Director (Fishing Harbour), Assistant Commissioner (Fishing Harbour), Deputy Commissioner (Fishing Harbour) in the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries), namely:-

1. Short title and commencement.— (1) These rules may be called the Department of Animal Husbandry Dairying and Fisheries, (Fisheries Division, Group 'A', Group 'B' and Group 'C' posts) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.— These rules shall apply to the posts specified in column (1) of the schedule annexed to these rules.

3. Number of posts, its classification, pay band and grade pay or pay scale. —The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age limit, qualification.— The method of recruitment to the said post, age limit, qualifications and other matters relating to be said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of these provisions of these rules with respect to any class or category of persons.

7. Savings.— Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 98.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सूचना और प्रसारण मंत्राालय ;प्रकाशन विभाग तथा विज्ञापन और दृश्य प्रचार निदेशालयद्ध मुद्रण तथा उत्पादन व कला और प्रदर्शनी ;समूह 'क' और समूह 'ख' पदद्ध भर्ती नियम 1985 को जहां तक उनका संबंध् सहायक उत्पादन प्रबंध्क ;मुद्रण और प्रचारद्ध तथा सहायक निदेशक ;उत्पादनद्ध के पदों से है, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, सूचना और प्रसारण मंत्राालय में सहायक उत्पादन प्रबंध्क ;मुद्रण और प्रचारद्ध तथा सहायक निदेशक ;उत्पादनद्ध के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम सूचना और प्रसारण मंत्राालय, सहायक उत्पादन प्रबंध्क ;मुद्रण और प्रचारद्ध और सहायक निदेशक ;उत्पादनद्ध, समूह 'ख' पद, भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—;1द्ध ये इन नियमों के साथ संलग्न अनुसूची के स्तंभ ;1द्ध में विनिर्दिष्ट पदों को लागू होंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पदों की संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या उससे संबंध्ति वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा और अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता— वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकोें और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण : भर्ती का उपरोक्त ढंग इन नियमों के टिप्पण : अध्सिूचित होने के तीन वर्ष तक स्थगित रखा जाएगा 1. जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होेंने अपनी अर्हक/ और तब तक सहायक उत्पादन प्रबंध्क ;मुद्रण और पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो प्रचारद्ध या सहायक निदेशक ;उत्पादनद्ध के ग्रेड में वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु सभी रिक्तियों को प्रोन्नति से भरा जाएगा । तीन साल यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्राता सेवा, अपेक्षित की अवध् िबीत जाने पर उपरोक्त ग्रेड की रिक्तियों अर्हक/पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो को भर्ती के निर्धरित ढंग से भरा जाएगा । भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

2. प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी।

प्रतिनियुक्ति :

केंद्रीय सरकार या राज्य सरकार या संघ राज्य क्षेत्रा के अध्ीन ऐसे अध्किारी —

;कद्ध ;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण कर रहे हैंऋ या

;iiद्ध जिन्होंने मूल काडर या विभाग में वेतन बैंड-2, 9300— 34800 रु. ग्रेड वेतन 4200 रु. या समतुल्य श्रेणी में उस पद पर नियमित आधर पर नियुक्ति के पश्चात 5 वर्ष सेवा की हो ऋ

और

;खद्ध जिसके पास स्तंभ 7 के अध्ीन सीध्ी भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अर्हताएं और अनुभव हैं ।

टिप्पण 1 :

पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 :

प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् ितीन वर्ष से अध्कि नहीं होगी । प्रतिनियुक्ति द्वारा अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 3 :

प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दिशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G. S.R. 98.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Information and Broadcasting (Publications Division and the Directorate of Advertising and Visual Publicity) Printing and Production and Art and Exhibition (Group 'A' and Group 'B' posts) Recruitment Rules, 1985, in so far as it relates to the posts of Assistant Production Manager and Assistant Director (Production), except as respects things done or omitted to have been done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Production Manager (Printing and Publicity) and Assistant Director (Production) in the Ministry of Information and Boradcasting, namely :—

1. Short title and commencement .— (1) These rules may be called the Ministry of Information and Broadcasting Assistant Production Manager (Printing and Publicity) and Assistant Director (Production) Group 'B' Post Recruitment Rules, 2015.

(2) They shall come into the force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Scheduled annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale.— The number of said post, their classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Method of recruitment, age-limit and qualifications .— The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.- No person,-—

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from operation of this rule.

6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the candidates belonging to the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with orders issued by the Central Government from time to time in this regard.

Note 1 : Qualifications are relaxable at the discretion of the Union Public Service Commission in case of candidates otherwise well qualified.

Note 2 : The qualification(s) regarding experience is relaxable at the discretion of the Union Public Service Commission for reasons to be recorded in writing, in case of candidates belonging to Scheduled Castes or Scheduled Tribes if at any stage of selection the Union Public Service

Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

be filled by the method of promotion. After expiry of not short of requisite qualifying or eligibility service by the three years' period, the vacancies in the said Grade more than half of such qualifying or eligibility service of shall be filled by the above method of Recruitment. two years, whichever is less, and have successfully com- pleted their probation period for promotion of the next higher grade along with their juniors who have already completed such qualifying/eligibility Service.

2. For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 01-01-2006 the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission.

Deputation :

Officers under the Central or State Government or Union Territories

(A)(i) holding analogous posts on regular basis in the parent cadre or department; or

(ii) with 5 years' service in the grade rendered after appointment thereto on a regular basis in the Pay Band-2, Rs. 9300-34800 + Grade Pay of Rs. 4200 or equivalent in the parent cadre or Department; and

(B) Possessing the eudcational qualifications and experience prescribed for diect recurit under Column (7).

Note 1 :

The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 :

Period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years. The maximum age-limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3 :

For the purpose of appointment on Deputation basis, the service rendered on a regular basis by an officer prior to 01-01- 2006 or the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post( s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 99.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वस्त्रा मंत्राालय, हथकरघा विकास आयुक्त का कार्यालय, आशुलिपिक श्रेणी I, II और III भर्ती नियम, 2004 को, जहां तक उसका संबंध् आशुलिपिक श्रेणी I के पद से है, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, वस्त्रा मंत्राालय, हथकरघा विकास आयुक्त का कार्यालय में आशुलिपिक श्रेणी I के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम वस्त्रा मंत्राालय, हथकरघा विकास आयुक्त का कार्यालय,ं आशुलिपिक श्रेणी I, भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—पद संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंध्ति अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता— वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की हैऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकोें और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति : ;जिसके अंतर्गत अल्पकालिक संविद भी हैद्ध आमेलन

द्वारा :—

केंद्रीय या राज्य सरकारों या संघ राज्य क्षेत्राों या विश्वविद्यालयों या मान्यताप्राप्त अनुसंधन संस्थाओं या पब्लिक सेक्टर उपक्रमों या अर्( सरकारी या कानूनी या स्वायत्व संगठनों के अध्ीन ऐसे अध्किारी :—

;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैंऋ या

;iiद्ध जिन्होंने मूल काडर या विभाग में वेतन बैंड-1, 5200—20200 रुपये ग्रेड वेतन 2400 रुपये में दस वर्ष नियमित सेवा की है ।

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के723 [भाग II—खण्ड 3(i)] भारत का राजपत्रा : मई 30, 2015/ज्येष्ठ 9, 1937 ;11द्ध पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 2 : प्रतिनियुक्त की अवध् ि;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध जिसके अंतर्गत केन्द्रीय सरकार उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै ;जिसके अंतर्गत अल्पकालिक संविदा भी हैद्ध साधरणतया 3 वर्ष से अध्कि नहीं होगी ।

प्रतिनियुक्ति ;जिसके अंतर्गत अल्पकालिका संविदा भी हैद्ध द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

टिप्पण 3 : प्रतिनियुक्ति/आमेलन के आधर पर नियुक्ति के प्रयोजनों के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दिशा के, जहां एक से अध्कि पूर्व पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन का साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

आमेलन के लिए : केवल केन्द्रीय सरकार या राज्य सरकारों या संघ राज्य क्षेत्राों के अध्किारी ही आमेलन के आधर पर नियुक्ति के लिए विचार किए जाने के पात्रा होंगे ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से

1. Short title and commencement .— (1) These rules may be called the Ministry of Textiles, Office of the Development Commissioner for Handlooms Stenographer Grade-I Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualification etc.— The method of recruitment, age-limit, qualifications and other matters relating these to shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.- No person,-—

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered, provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended shall be deemed to be service rendered in the corresponding pay or pay scale extended based on the recommendations of the Pay Commission.

Deputation (including short-term) contract/Absorption :

Officers under the Central or State Government or Union Territories or recognized Research Institutions or Public Sector Undertakings or Semi-Government or Statutory or Autonomous Organisation :

(i) holding analogous posts on regular basis in the parent cadre or department; or

(ii) with ten years regular service in Pay Band-1, Rs. 5200-20200 plus grade pay of Rs. 2400 in the parent department.

Note 1 : The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 2 : The Period of deputation (including short-term contract) including the period of deputation in another ex-cadre post held immediately preceding to the current appointment in the same or some other organization or department shall not normally exceed three years.

The maximum age-limit for appointment by deputation (including short-term contract) shall not exceed 56 years as on the closing date of the receipt of the applications.

Note 3 : For purposes of appointment on deputation/ absorption basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation.

For absorption :

Only officers of Central Government or State Government or Union Territories shall be eligible for consideration for appointment on absorption basis.
