(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

3. भर्ती की प!ति, आयुभर्ती की प!ति, आयुभर्ती की प!ति, आयुभर्ती की प!ति, आयु----सीमा, अर्हताएं आदिसीमा, अर्हताएं आदिसीमा, अर्हताएं आदिसीमा, अर्हताएं आदि....————उक्त पदों पर भर्ती की प;ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ (5) से (13) में विनिNदष्ट हैं ।

4. निरर्हतानिरर्हतानिरर्हतानिरर्हता....————यह Qयक्ति,-

(क) जिसने ऐसे Qयक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते &ए किसी Qयक्ति से विवाह किया है;

उक्त पद पर नियुक्ति का पात्र नहT होगा :

परन्तु यदि कें Vीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह और ऐसे Qयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुWेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी Qयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति....————जहां कें Vीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखब; करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Qयक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

6. .या.या.या.यावृत्तिवृत्तिवृत्तिवृत्ति....————इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहT डालेगी, जिनका कें Vीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य िपछड़े वगZ, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के Qयक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 111.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel850 THE GAZETTE OF INDIA : JUNE 13, 2015/JYAISTHA 23, 1937 [PART II—SEC. 3(i)] and Training) Group ' C ' (Technical) posts Recruitment Rules, 1999, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' Technical posts in the Department of Personnel and Training, Ministry of Personnel, Public Grievances and Pensions, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Personnel, Public Grievances and Pensions, (Department of Personnel and Training) Group 'C' (Technical) posts Recruitment Rules, 2014.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of the said posts, their classification, the pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc. .—The method of recruitment to the said posts, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living;

or

(b) who having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सासासासा....काकाकाका....िनिनिनिन.... 112112112112....————राष्ट्रपित, मूल नियमों के िनयम 45 के उपबंधों के अनुसरण में, सरकारी आवासों के आबंटन (दिल्ली में साधारण पूल) िनयम,1963 का और संशोधन करने के िलए निम्निलिखत िनयम बनाते हैं, अर्थात् :-

1. (1) इन नियमों का संक्षिप्त नाम सरकारी आवासों के आबंटन (दिल्ली में साधारण पूल) संशोधन िनयम, 2015 है।

(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे।

2. सरकारी आवासों के आबंटन (दिल्ली में साधारण पूल) िनयम,1963 में, -

(i) अनुपूरक िनयम 317-ख-2 में, खंड (ण) के पश्चात् निम्निलिखत खंड अंत:स्थािपत किए जाएंगे, अर्थात् :-

'(त) "िनकटतम संबंधी" से दादा, दादी, पोते, पोितयां, ससुर, सास, दामाद, ब] और ऐसे अन्य संबंधी अभिप्रेत हैं, िजनका संबंध आबंटिती के साथ िविधक दत्तक Jहण द्वारा सि; किया गया है ;

(थ) "अितिथ" से आबंटिती के साथ अस्थायी रूप से ठहरने वाला अिनयत अितिथ अभिप्रेत है ।;

(ii) अनुपूरक िनयम 317-ख-6 में, उपिनयम (4) के पश्चात् निम्निलिखत उपिनयम अंत:स्थािपत किया जाएगा, अर्थात् :-

"(5) प्रत्येक अिधकारी उपिनयम (1) के अधीन आवेदन के साथ घोषणा सिहत एक वचनबंध प्रस्तुत करेगा कि वह उसे आबंटित िनवास या उससे संब; उसके किसी भाग या किसी आउट हाउस, गैराज या अस्तबल उसकी स्वीकृ ित के पश्चात् उप किराये पर नहT देगा।",

(iii) अनुपूरक िनयम 317-ख-20 में, -

(क) उपिनयम (1) के स्थान पर निम्निलिखत उपिनयम रखे जाएंगे, अर्थात् :-

"(1) कोई अिधकारी, अपने परिवार और िनकटतम संबंधियों के िसवाय, उसे आबंटित िनवास या उससे संब; किसी आउट हाउस, गैराज और अस्तबल की किसी के साथ भागीदारी नहT करेगा।

(1अ) नौकरों के क्वार्टरों, आउट हाउस, गैराज और अस्तबल का उपयोग, के वल वास्तिवक प्रयोजनों, िजनके अंतर्गत आबंटिती के नौकरों के िनवास या ऐसे अन्य प्रयोजनों के िलए, जो संपदा िनदेशक द्वारा अनुWात किए जा सके , के िलए किया जा सके गा।

(1आ) आबंटिती, जो अपने परिवार और/या िनकटतम संबंधियों के साथ िनवास की भागीदारी करता है, संपदा िनदेशक को ऐसे प्ररूप में, जो संपदा िनदेशालय द्वारा विनिNदष्ट किया जाए, उसे आबंटित िनवास में रह रहे अपने परिवार के सदस्यों और/या िनकटतम संबंधियों की विशिष्टियां देते &ए पूर्व सूचना संपदा िनदेशक को देगा;

परंतु अिनयत अितिथ या अतिथियों के ब्यौरे, यदि ऐसे अितिथ के पन्Vह दिन से अिधक ठहरने की संभावना है, संपदा िनदेशक को ऐसे प्ररूप में, जो संपदा िनदेशालय द्वारा विनिNदष्ट किया जाए, Qयक्ति या Qयक्तियों की पूर्व विशिष्टियां सूिचत की जाएगी।";

(ख) उपिनयम (2) के परंतुक के स्थान पर िनम्निलिखत परंतुक रखा जाएगा, अर्थात्:-

"परंतु छु bी पर जाने वाला आबंटिती िनवास में अपने परिवार के किसी सदस्य या िनकटतम संबंधी को के यर टेकर के रूप में ठहराने के िलए अपने छु bी के आवेदन के साथ अपने परिवार के ऐसे सदस्य या िनकट संबंधी के ब्यौरे अपने कार्यालय या नियंत्रण प्राधिकारी, जो उसे अिभलेख में रखेगा, को प्रस्तुत करेगा;

परंतु यह और कि किसी के यर टेकर द्वारा ऐसे ठहराव की अिधकतम अविध अनुपूरक िनयम 317-ख-11(2) में यथा विनिNदष्ट, परंतु छह मास से अिधक नहT होगी।";

(iv) अनुपूरक िनयम 317-ख-21 में,-

(क) उपिनयम(2) के स्थान पर निम्निलिखत उपिनयम रखा जाएगा, अर्थात् :-

"(2) यदि कोई अिधकारी उसे आबंटित िनवास या उससे संब; उसका कोई भाग या किसी आउट हाउस, गैराज या अस्तबल, इन नियमों के उल्लंघन में उप किराये पर देता है, तो किसी अन्य कार्रवाई, जो उसके विc; की जा सकती है, पर प्रतिकू ल प्रभाव डाले िबना उस पर संपदा िनदेशालय द्वारा निरीक्षण की तारीख से ऐसी नुकसािनयां प्रभारित की जा सके गी जो कें Vीय सरकार द्वारा इस संबंध में समय-समय पर अवधारित की जाए।";

(ख) उपिनयम (3) के स्थान पर निम्निलिखत उपिनयम रखा जाएगा, अर्थात् :-

"(3अ) जहां परिसरों की अप्राधिकृ त उप किरायेदारी के कारण आबंटन को रद्द करने की कार्रवाई की जाती है, वहां संपदा िनदेशक द्वारा आबंटिती के संबंिधत प्रशासनिक कार्यालय को उन प्रयोजनों के िलए िवभागीय कार्यवाही प्रारंभ करने और भारी शास्ति अिधरोिपत करने के िलए प्रारूप आरोप पत्र की प्रति सिहत िनदेश जारी किया जाएगा; तथा प्रशासनिक मंत्रालय संपदा िनदेशक को आबंटिती के विc;

िवरिचत आरोपों के ब्यौरे और अिधरोिपत शास्ति सूिचत करेगा।"

टिप्पटिप्पटिप्पटिप्पणणणण :::: मूल िनयम भारत के राजपत्र में का.आ. 1330, तारीख 11 मई,1963 को प्रकाशित किए गए थे तथा तत्पश्चात् निम्निलिखत अिधसूचना संख्याओं द्वारा संशोिधत किए गए :

(DIRECTORATE OF ESTATES)

New Delhi, the 10th June, 2015

G.S.R. 112 .—In pursuance of the provisions of rule 45 of the Fundamental Rules, the President hereby makes the following further amendments to the Allotment of Government Residences (General Pool in Delhi) Rules 1963, namely:-

1. (1) These rules may be called the Allotment of Government Residences (General Pool in Delhi) Amendment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Allotment of Government Residences (General Pool in Delhi) Rules 1963,

(i) in Supplementary Rule 317-B-2, after clause (o), the following clauses shall be inserted, namely:

'(p) "immediate relations" mean such relations as grandfather, grandmother, grandsons, grand daughters, father-in-law, mother-in-law, son-in-law, daughter-in-law and such other relation established by legal adoption to the allottee;

(q) "guest" means a casual visitor for temporary stay with the allottee.';

(ii) in Supplementary Rule 317-B-6, after sub-rule (4), the following sub-rule shall be inserted, namely:-

"(5) Every officer shall along with an application under sub-rule (1), submit an undertaking with a declaration that he shall not sublet a residence allotted to him or any portion thereof or any of the out-houses, garages or stable appurtenant thereto, after acceptance of the same.";

(iii) in Supplementary Rule 317-B-20, -

(a) for sub-rule (1), the following sub-rules shall be substituted, namely:-

"(1) No officer shall share the residence allotted to him or any of the out-houses, garages and stables appurtenant thereto except with his family and immediate relations.

(1A) The servant quarters, out-houses, garages and stables may be used only for the bonafide purposes including residence of the servants of the allottee or for such other purposes as may be permitted by the Director of Estates.

(1B) The allottee who share the residence with his family and/or immediate relations shall provide prior intimation to the Director of Estates in such form, as may be specified by the Directorate of Estates, furnishing full particulars of his family members and/or immediate relations residing in the residence allotted to him.

Provided that the details of casual visitor or visitors, if such visitor or visitors is likely to stay for more than fifteen days, shall be intimated to the Director of Estates in such form, as may be specified by the Directorate of Estates, intimating full particulars of the individual or individuals.";

(b) for the proviso to sub-rule (2), the following proviso shall be substituted, namely:-

"Provided that an allottee proceeding on leave may accommodate, in the residence any member of his family or immediate relations, as a caretaker, by submitting, along with his leave application, the details of such member of his family or immediate relation, to his office or controlling authority who shall place the same on record:

Provided further that the maximum period of such accommodation by a caretaker shall be as specified in SR 317-B-11(2) but not exceeding six months.";

(iv) in Supplementary Rule 317-B-21, -

(a) for sub-rule (2) the following sub-rule shall be substituted, namely:-

"(2) If an officer sublets a residence allotted to him or any portion thereof or any of the out-houses, garages or stable appurtenant thereto, in contravention of these rules, he may without prejudice to860 THE GAZETTE OF INDIA : JUNE 13, 2015/JYAISTHA 23, 1937 [PART II—SEC. 3(i)] any other action that may be taken against him, be charged such damages from the date of inspection by the Directorate of Estates, as may be determined by the Central Government from time to time, in this respect.";

(b) after the sub-rule (3), the following sub-rule shall be inserted, namely:-

"(3A) Where an action to cancel the allotment is taken on account of unauthorised subletting of the premises, a direction shall be issued by the Director of Estates to the concerned administrative office of the allottee for the purposes of initiation of Departmental proceedings and for imposition of major penalty, along with the copy of a draft charge sheet; and the administrative Ministry shall intimate the Director of Estates the details of the charges framed and the penalty imposed on the allottee under this rule."

(क) िजसने ऐसे jक्ति से, िजसका पित या जिसकी पkी जीिवत है, िववाह किया है, या

(ख) िजसने अपने पित या अपनी पkी के जीिवत रहते &ए किसी jक्ति से िववाह किया है,

उक्त पद पर िनयुक्ति का पात्र नहT होगाः

परन्तु यदि के न्Vीय सरकार का यह समाधान हो जाता है कि ऐसा िववाह उस jक्ति और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुWेय है और ऐसा करने के िलए अन्य आधार हैं, तो वह किसी jक्ति को इस िनयम के प्रवर्तन से छू ट दे सके गी ।

G.S.R. 113.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Cooperation, Data Entry Operator (Grade 'A', 'B' & 'C') and Data Processing Assistant Grade 'A' Recruitment Rules, 2000, in so far as they relate to posts of Data Entry Operator Grade 'A' and Data Entry Operator Grade 'B', except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Electronic Data Processing discipline Group 'C' posts in the Ministry of Agriculture" Department of Agriculture and Cooperation, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Cooperation, Data Entry Operator (Grade 'A' and 'B' posts) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.- The number of the said posts, their classification, pay band and grade payor pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5.Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(क) जिसने ऐसे jक्ति से, जिसका पति या जिसकी पkी जीवित है, विवाह किया है, या

(ख) िजसने अपने पति या अपनी पkी के जीवित रहते &ए किसी jक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहT होगाः

परन्तु यदि के न्Vीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस jक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुWेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी jक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

G.S.R. 114.—exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Department of Agriculture and Co-operation (Economic and Statistical Investigator) Recruitment Rules,1995, insofar as they relates to the post of Economic Investigator and the Department of Agriculture and Co- operation(Senior Economic Investigator and Senior statistical Investigator) Recruitment Rules, 1995, in so far as they relates to the post of Senior Economic Investigator, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Economic Officer and Economic Investigator in the Department of Agriculture and Co-operation, Ministry of Agriculture, namely :-

1 Short title and commencement.— (1) These rules may be called the Ministry of Agriculture, Department of Agriculture and Co-operation, Economic Officer and Economic Investigator Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2 Number of posts, classification and Pay Band and Grade Pay or scale of pay.—The number of the said post, its classification and Pay Band and Grade Pay or the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

1. Short title and commencement.— (1) These rules may be called the Ministry of Statistics and Programme Implementation, Computer Centre, Library and Information Assistant, Group 'B' Post (Amendment) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Ministry of Statistics and Programme Implementation, Computer Centre, Library and Information Assistant, Group 'B' Post Recruitment Rules, 2013, under the Column No. 12, for the words, letter and figures ''Group 'B' Departmental Promotion Committee (for considering Confirmation)'', the words, letter and figure ''Group 'B' Departmental Confirmation Committee (for considering Confirmation)''shall be substituted.
