का.नि.आ. 31.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा लेखा विभाग अकानूनी कैंटीन ;समूह 'ग' और समूह 'घ' पदद्ध पद भर्ती नियम, 2000, जहां तक वे हलवाई और सहायक हलवाई के पद से संबंध्ति हैं, को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया हो या किए जाने का लोप किया गया हो, रक्षा मंत्राालय, रक्षा लेखा विभाग में अकानूनी विभागीय वैट कैंटीन के अंतर्गत हलवाई-सह-रसोइया और सहायक हलवाई-सह-रसोइया के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम रक्षा मंत्राालय, रक्षा लेखा विभाग, हलवाई-सह-रसोइया और सहायक हलवाई-सह-रसोइया ;समूह 'ग' पदद्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगेे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन अथवा वेतनमान.—उक्त पदों की संख्या, इनका वर्गीकरण और उनसे संब( वेतन बैंड और ग्रेड वेतन अथवा वेतनमान इन नियमों के साथ संलग्न अनुसूची के स्तम्भ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पदों की भर्ती की प(ति, आयु-सीमा, अर्हताएं तथा इससे संबंध्ति अन्य मामले उक्त अनुसूची के स्तम्भ ;5द्ध से ;13द्ध में विनिदष्ट किए गए हैं ।

4. निरर्हताएं.—वह व्यक्ति—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया हैऋ

उक्त सेवा में नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे़ वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा प्रोन्नति :

ऐसे सहायक हलवाई-सह-रसोइया जिन्हें वेतन बैंड-1, 5200-20200 रफ.

+ ग्रेड वेतन 1900 रफ. में रखा गया है और जिसने उस श्रेणी में कम से कम तीन वर्ष नियमित सेवा की हो ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आध्े से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध्ि सपफलतापूर्वक पूरी कर ली हो।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पूर्व पूरी की गई नियमित सेवा या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित संशोध्ति वेतन ढ़ांचा लागू किया गया है, को310 THE GAZETTE OF INDIA : AUGUST 1, 2015/SRAVANA 10, 1937 [PART II—SEC. 4] ;11द्ध

आयोग की सिपफारिशों के आधर पर लागू किए गए संबंध्ति ग्रेड वेतन या वेतनमान में पूरी की गई सेवा समझी जाएगी।

प्रतिनियुक्ति :

केंद्रीय सरकार के ऐसे अध्किारी -

;कद्ध;iद्ध नियमित आधर पर सदृश पद धारण कर रहे हैंऋ या

;iiद्ध 1900 रु. ग्रेड वेतन सहित 5200-20200 रु. के वेतन बैंड-1, में नियमित आधर पर सहायक हलवाई-सह-रसोइया के पद पर तीन वर्ष की सेवा की होऋ और

;खद्ध निम्नलिखित अर्हताएं और अनुभव रखते हों :—

;iद्ध किसी मान्यताप्राप्त बोर्ड से दसवीं कक्षा उत्तीर्ण हो और भोजन- प्रबंध् अथवा समतुल्य में प्रमाणपत्रा अथवा डिप्लोमा ।

;iiद्ध किसी सरकारी विभाग अथवा उपक्रम में कार्य करने का दो वर्ष का अनुभव और अर्हता रखते हों ।

टिप्पण 1 : केन्द्रीय सरकार के किसी अन्य संगठन/ विभाग या उसी में नियुक्ति से तुरंत पूर्व अन्य संवर्ग/बाह्य पद में प्रतिनियुक्ति की अवध्ि सहित प्रतिनियुक्ति की अवध् िसामान्यतः तीन वर्षों से अध्कि नहीं होनी चाहिए । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा आवेदनों की प्राप्ति की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होनी चाहिए ।

टिप्पण 2 : पोषक वर्ग मेें विभागीय अध्किारी जो प्रोन्नति के लिए तैयार हैं, प्रतिनियुक्ति पर नियुक्ति पर विचार के लिए पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्ति पर आए व्यक्ति प्रोन्नति के द्वारा नियुक्ति के विचार के लिए पात्रा नहीं होंगे ।

;प्रतिनियुक्ति पर आए व्यक्ति की शैक्षिक अर्हता और अनुभव वही होंगे जो स्तम्भ ;7द्ध में सीध्े भर्ती हुए व्यक्तियों के लिए निदष्ट हैंद्ध

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श

किया जाएगा

2. सहायक 11* ;2015द्ध साधरण केन्द्रीय वेतन बैंड-1, अचयन 18 से 25 वर्ष के बीच हलवाई-सह- *;कार्यभार के सेवा, समूह 'ग', 5200— ;इस संबंध् में समय-समय पर जारी रसोइया आधर पर अराजपत्रिात, 20200 रफ. अनुदेशों अथवा आदेशों के अनुसार परिवर्तन किया अननुसचिवीय ग्रेड वेतन विभागीय अभ्यर्थियों को 40 वर्ष तक छूटद्ध टिप्पण : आयु-सीमा अवधरित करने के जा सकता है।द्ध 1900 रफ. लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी ;न कि वह अंतिम तारीख जो असम, मेघालय, अरफणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिापुरा, सिक्किम, जम्मू-कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल एवं स्पीति जिले तथा चम्बा जिले के पांगी-उपखण्ड, अंदमान एवं निकोबार द्वीप या लक्षद्वीप के अभ्यथयों के लिए निर्धरित की गई हैद्ध ।

;कद्ध किसी मान्यता प्राप्त बोर्ड अथवा संस्था से दसवीं नहीं सीध्ी भर्ती के व्यक्तियों के लिए दो वर्ष, कक्षा उत्तीर्ण और भोजन-प्रबंध् अथवा समतुल्य में प्रोन्नत के लिए शून्य प्रमाणपत्रा अथवा डिप्लोमा ।

;खद्ध कैंटीन परिचारक अथवा हलवाई-सह-रसोइया के हेल्पर के रूप में एक वर्ष का कार्य अनुभव ;गद्ध अभ्यर्थी की योग्यता का मूल्यांकन करने के लिए विभागीय प्रोन्नति समिति द्वारा पाककला से संबंध्ति एक व्यावसायिक कौशल परीक्षण किया जाएगा जिसमें स्वास्थ्यकारिता का अनुरक्षण भी सम्मिलित है । टिप्पण : अनुसूचित जाति और अनुसूचित जनजाति समुदाय के अभ्यर्थियों के मामले में सक्षम प्राध्किारी के विवेकानुसार अनुभव से संबंध्ति योग्यताओं में छूट दी जा सकती है, बशर्ते कि चयन के किसी स्तर पर सक्षम प्राध्किारी की यह राय हो कि अपेक्षित अनुभव रखने वाले इन समुदायों के अभ्यर्थी उनके लिए आरक्षित पदों को भरने के लिए पर्याप्त संख्या में उपलब्ध् नहीें हो सकते ।

ऐसे कैंटीन परिचारक जिन्हें वेतन बैंड-1, 5200-20200 रफ. + ग्रेड वेतन 1800 रफ. में रखा गया है और जिसने उस ग्रेड में कम से कम तीन वर्ष नियमित सेवा की हो ।

पाक के संदर्भ में विभागीय प्रोन्नति समिति द्वारा व्यवसाय परीक्षा संचालित की जाएगी जिसमें अनुरक्षण स्वच्छता सम्मिलित है ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पूर्व पूरी की गई नियमित सेवा या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित संशोध्ति वेतन ढ़ांचा लागू किया गया है, को आयोग की सिपफारिशों के आधर पर लागू किए गए संबंध्ति ग्रेड वेतन या वेतनमान में पूरी की गई सेवा समझी जाएगी।

S.R.O. 31.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in Supersession of the Defence Accounts Department Non-statutory Canteens (Group 'C' and Group 'D') posts Recruitment Rules, 2000, in so far they relate to the posts of Halwai and Assistant Halwai, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Halwai-cum-Cook and Assistant Halwai-cum-Cook under Non- statutory Departmental Wet Canteens in the Ministry of Defence, Defence Accounts Department, namely ;-

1. Short title and Commencement.— (1) These rules may be called the Ministry of Defence, Defence Accounts Department, Halwai-cum-Cook and Assistant Halwai-cum-Cook (Group 'C 'posts), Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.— The number of the said post, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in column (5) to (13) of the aforesaid Schedule.

4. Disqualification.— No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicabie to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and any other special categories of persons in accordance with the orders issued by the CentralGovernment from time to time in this regard .

Assistant Halwai-cum-Cook with atleast three years regular service in the pay band-1, Rs.5200-20,200 plus grade pay of Rs.1900.

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion , their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006, the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission have been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission.

(i) 10th Class Pass from a recognized board with a certificate or diploma in catering or equivalent.

(ii) Two years experience in a Government Department or Undertaking preferred and possessing the qualification.

Note 1 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not exceed three years. The maximum age- limit for deputation is 56 years as on the closing date of receipt of application.

Note 2 : The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.
