सा.का.नि.175.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए प्रधनमंत्राी कार्यालय में सहायक निदेशक के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम प्रधनमंत्राी कार्यालय, सहायक निदेशक ;समूह फ्कय्द्ध भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पद की संख्या, उसका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;13द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति.—इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

टिप्पण 1 : प्रतिनियुक्ति की अवध्,ि जिसके अंतर्गत केंद्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धरित किसी अन्य काडर बाह्‌य पद पर प्रतिनियुक्ति की अवध् िहै, साधरणतया 3 वर्ष से अध्कि नहीं होगी ।

टिप्पण 2 ः प्रतिनियुक्ति पर स्थानांतरण द्वारा नियुक्ति के लिए अध्कितम आयु-सीमा, आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अध्कि नहीं होगी ।

टिप्पण 3 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार, प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

टिप्पण 4 : प्रतिनियुक्ति के आधर पर नियुक्ति के प्रयोजन के लिए, किसी अध्किारी द्वारा, 1जनवरी, 2006 से पहले या उस तारीख से, जिससे छठे केंद्रीय वेतन आयोग की सिपफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के, जहाँ एक से अध्कि पूर्व-पुनरीक्षित वेतनमान का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है, और वहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा, जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उन्नयन के साधरण प्रतिस्थापन ग्रेड है, उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान में की गई सेवा समझी जाएगी ।

यदि विभागीय प्रोन्नति समिति है, तो उसकी संरचना

PRIME MINISTER'S OFFICE

New Delhi, the 10th September, 2015

G.S.R.175.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules for regulating the method of recruitment to the post of Assistant Director in the Prime Minister's Office, namely:—

1. Short title and commencement.—(1) These rules may be called the Prime Minister's Office, Assistant Director (Group 'A') Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc..—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.—No person,-

(a) who has entered into or contracted a marriage with a person, having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation Deputation :—

Officers under the Central Government from Intelligence Bureau (IB) :

(i) holding analogous posts on regular basis in the parent cadre or department; or

(ii) with five years' service in the grade rendered after appointment thereto on a regular basis in the pay band-3, Rs. 15,600-39,100 plus grade pay of Rs. 5400 or equivalent in the parent cadre or department;

(iii) with six years' service in the grade rendered after appointment thereto on a regular basis in the pay band-2, Rs. 93,00-34,800 with grade pay of Rs. 4800 or equivalen in the parent cadre or department;

(iv) with seven years' service in the grade rendered after appointment thereto on a regular basis in the pay band-2, Rs. 93,00-34,800 with grade pay of Rs. 4600 or equivalen in the parent cadre or department.

Note 1 : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years.

Note 2 : The maximum age-limit for appointment by transfer or deputation shall not be exceeding 56 years as on the closing date of receipt of applications.

Note 3 : The departmental officers in the feeder cadre who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion.

Note 4 : For the purposes of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any ugpradation.

1. (1) These rules may be called the Central Ground Water Board, Stenographer Grade-Ill (Group 'C Post) Recruitment (Amendment) Rules, 2015 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Ground Water Board, Stenographer Grade-III (Group 'C Post) Recruitment Rules, 2014 in the Schedule, in column (7), for the entries under the heading "(B) Transcription", the following entries be substituted, namely:—

G.S.R.177.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Ground Water Board Gestetner Operator (Senior) Recruitment Rules, 1973, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Gestetner Operator (Senior) in the Ministry of Water Resources, River Development and Ganga Rejuvenation, the Central Ground Water Board, namely:-

1. Short title and commencement.—(l) These rules may be called the Ministry of Water Resources, River Development and Ganga Rejuvenation, the Central Ground Water Board, Gestetner Operator (Senior), Group'C' Post, Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay or Pay Scale.—The number of posts, its classification and the Pay Band and Grade Pay or Pay Scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc..—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualifications.—No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 179.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वस्त्रा मंत्राालय ;स्टापफ कार ड्राइवरद्ध भर्ती नियम, 1996 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पूर्व किया गया है या करने का लोप किया गया है, वस्त्रा मंत्राालय में स्टापफ कार ड्राइवर, साधरण श्रेणी, स्टापफ कार ड्राइवर, श्रेणी-2 और स्टापफ कार ड्राइवर, श्रेणी-1 के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R.179.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Textiles (Staff Car Driver) Recruitment Rules, 1996, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to 'the posts of Staff Car Driver Ordinary Grade, Staff Car Driver, Grade II and Staff Car Driver, Grade I in the Ministry of Textiles, namely:-

1. Short title and commencement. (1).—These rules may be called the Ministry of Textiles, Staff Car Drivers (Group 'C' Posts) Recruitment Rules, 2015 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These Rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of post, classification, pay band and grade pay or pay scale.—The number of posts, their classification, pay band and grade pay or pay scale attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc..—The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the aforesaid Schedule.

5. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard .

Such persons would be given deputation terms up to the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employment.

Note : The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or Department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation/absorption shall be 'Not exceeding 56 years' as on the closing date of receipt of applications.

सा.का.नि.181.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और हर्ड रजिस्ट्रेशन स्कीम ;वर्ग 3 ओर वर्ग 4 पदद्ध भर्ती नियम, 1968, जहां तक इनका संबंध् स्टाकमैंन ;चयन श्रेणीद्ध और स्टाकमैन के पदों से है को, उन बातों के सिवाय अध्क्रिांत करते हुए जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, कृषि मंत्राालय में पशुपालन, डेयरी एवं मत्स्यपालन विभाग सेंट्रल हर्ड रजिस्टे्रशन स्कीम में स्टाकमैन ;चयन श्रेणीद्ध और स्टाकमैन ;कनिष्ठ श्रेणीद्ध के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम कृषि मंत्राालय में पशुपालन, डेयरी एवं मत्स्यपालन विभाग सेंट्रल हर्ड रजिस्टे्रशन स्कीम में स्टाकमैन ;चयन श्रेणीद्ध और स्टाकमैन ;कनिष्ठ श्रेणीद्ध समूह 'ग' पद भर्ती नियम, 2015 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना : ये नियम, इन नियमों से उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं, आदि.—भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है विवाह किया है या विवाह की संविदा की हैंऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की हैंऋ

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

प्रोन्नति द्वारा जिसके न हो सकने पर सीध्ी भर्ती द्वारा प्रोन्नति ः ऐसे स्टाकमैन ;कनिष्ठ श्रेणीद्ध जिसने वेतन बैंड-1, 5200-20200 रफ. ग्रेड वेतन 1900 रफ. की श्रेणी में पांच वर्ष नियमित सेवा की है ।

टिप्पण 1 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा, परंतु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक/पात्राता सेवा के आध्े से अध्कि या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसे अर्हक या पात्राता सेवा पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा, 01 जनवरी, 2006 से पहले या उस[भाग IIखण्ड 3(i)] भारत का राजपत्रा : सितम्बर 19, 2015/भाद्र 28, 1937 1383 ;11द्ध

तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधर पर की गई सेवा को उक्त वेतन आयोग की सिपफारिशों पर आधरित विस्तारित तत्स्थानी गे्रड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

G.S.R.181.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Herd Registration Scheme (Class III and Class IV posts) Recruitment Rules, 1968, in so far as they relate to the posts of Stockman (Selection Grade) and Stockman, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Stockman (Selection Grade) and Stockman (Junior Grade) in the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Central Herd Registration Scheme, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture, Department of Animal Husbandry, Dairying and Fisheries, Central Herd Registration Scheme, Stockman (Selection Grade) and Stockman (Junior Grade) , Group 'C' Posts Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale—The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the aforesaid Schedule.

4. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualifications - No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,[भाग IIखण्ड 3(i)] भारत का राजपत्रा : सितम्बर 19, 2015/भाद्र 28, 1937 1385 shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 2 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Commission.

2. पद संख्या, वर्गीकरण, वेतन बैण्ड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैण्ड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाब( अनुसूची के स्तम्भ ;2द्ध से स्तम्भ ;4द्ध में विनिर्दिष्ट हैं ।

3. भर्ती की प(ति, आयु सीमा, अर्हताएं इत्यादि—उक्त पद पर भर्ती की प(ति, आयु सीमा, अर्हताएं और उनसे संबंध्ति अन्य बातें वे होेंगी जो उक्त अनुसूची के स्तम्भ ;5द्ध से स्तम्भ ;13द्ध में विनिर्दिष्ट हैं ।

4. निरर्हता—वह व्यक्ति

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया हैऋ या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति—इन नियमों की कोई बात ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R.183.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Commission of Railway Safety, Technical Wing (Technical Assistant and Lower Division Clerk, Group 'C') Recruitment Rules 2001, in so far as they relate to the post of Lower Division Clerk, except as respect of things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Lower Division Clerk in the Technical Wing of the Commission of Railway Safety, Ministry of Civil Aviation, namely :—

1. Short title and commencement.—(1) These rules may be called the Commission of Railway Safety, Technical Wing, Lowere Division Clerk (Group 'C' post) Recruitment Rules, 2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.—The number of posts, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualification etc..—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Governemt may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules in respect of any class or category of persons.

6. Saving.—Nothing in these rules shall effect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government form time to time in this regard.
