का.नन.आ. 9.—रा(cid:7398)पनत, संर्नधान के अनु(cid:6994)छेद 309 के पर(cid:7008)तुक (cid:7367)ारा (cid:7079)द(cid:7275) न(cid:7334)य(cid:7298) का (cid:7079)योग करते (cid:7263)ए और भारतीय इंीिननयर र(cid:6979)ा र्सेा ( भत(cid:7278) और र्सेा क(cid:7409) त(cid:6981)) ननयम, 2004 को, उन बात(cid:7298) के नर्साय अनध(cid:7059)ांत करते (cid:7263)ए न(िcid:7008)ह(cid:7286) ऐसे अनध(cid:7059)ांत करते (cid:7263)ए न(िcid:7008)ह(cid:7286) ऐसे अनध(cid:7059)मण से र्पू(cid:6981) (cid:7408)कया गया है या करने से लोप (cid:7408)कया गया है,र(cid:6979)ा मं(cid:7074)ालय म(cid:7286) भारतीय इंीिननयर र(cid:6979)ा र्सेा म(cid:7286) ननयु(cid:7334) (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409),र्सेा क(cid:7409) त(cid:7300) का र्नननयमन करने के नलए नन(cid:7388)नलनखत ननयम बनाते ह(cid:7289), अा(cid:6981)त्ः- 1. संन(cid:6979)(cid:7385) नाम और (cid:7079)ारंभः- (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नाम भारतीय इंीिननयर र(cid:6979)ा र्सेा (भत(cid:7278) और र्सेा क(cid:7409) त(cid:6981)) ननयम, 2016 है।

(2) ये रापि(cid:7074) म(cid:7286) (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7004)त ह(cid:7298)गे।

2. प(cid:7407)रभाषाएं:- इन ननयम(cid:7298) म(cid:7286) बि तक (cid:7408)क संदभ(cid:6981) से अ(cid:7008)या अपेन(cid:6979)त न होः

(क) "आयोग" से संघ लोक र्सेा आयोग अनभ(cid:7079)ेत है;

(ग) "र्नभानगय अ(cid:7012)य(cid:7278)" से ऐसा (cid:7390)न(cid:7334) अनभ(cid:7079)ेत है नसिे आयोग से पराम(cid:6981) करने के प(cid:7391)ात या र्नभागीय (cid:7079)ो(cid:7382)नत सनमनत क(cid:7409) नसा(cid:7407)र पर ननयनमत आधार पर ननयु(cid:7334) (cid:7408)कया गया है;

(घ) "र्नभागीय (cid:7079)ो(cid:7382)नत सनमनत" से अनुसूची – 4 (cid:7079)(cid:7004)येक पद के सामने उ(cid:7334) पद पर (cid:7079)ो(cid:7382)नत या पुन(cid:7397) के संबंध म(cid:7286) र्नचार करने के नलए र्ननन(cid:7416)द(cid:7397) सनमनत अनभ(cid:7079)ेत है ;

() "(cid:7357)ूटी पद" से अनुसूची -1 के (cid:7021)त(cid:7013)भ -4 म(cid:7286) र्ननन(cid:7416)द(cid:7397) अनभ(cid:7079)ेत है ;

(च) "परी(cid:6979)ा" से सरकार (cid:7367)ारा समय-समय पर या अनधसूनचत र्ननभ(cid:7382) इंीिननयरी र्सेा(cid:7312) और पद(cid:7298) पर भत(cid:7278) के नलए आयोग (cid:7367)ारा संचानलत कोई सन(cid:7013)मनलत (cid:7079)नतयोगी परी(cid:6979)ा अनभ(cid:7079)ेत है ;

(छ) "सरकार" से भारत सरकार अनभ(cid:7079)ेत है ;

()ि "(cid:7088)ेणी" से अनुसूची-1 के (cid:7021)त(cid:7013)भ -2 म(cid:7286) र्ननन(cid:7416)द(cid:7397) र्सेा क(cid:7409) (cid:7088)ेणी अनभ(cid:7079)ेत है ;

(झ) (cid:7408)कसी (cid:7088)ेणी से संबंनधत "ननयनमत र्सेा" से (cid:7408)कसी (cid:7088)ेणी म(cid:7286) दीघ(cid:6981)कानलक ननयुन(cid:7334) के नलए सरकार (cid:7367)ारा अनधकनत (cid:7079)(cid:7408)(cid:7059)या के अनुसार चयन के प(cid:7391)ात उस (cid:7088)ेणी म(cid:7286) क(cid:7409) गई र्सेा क(cid:7409) र्अनध अनभ(cid:7079)ेत है और नसिम(cid:7286) नन(cid:7388)नलनखत कोई र्अनध या र्अनधयां सन(cid:7013)मनलत हैः-

(i) र्सेा के (cid:7079)ारन(cid:7013)भक गठन पर ननयु(cid:7334) (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) दा म(cid:7286) (cid:6996)ये(cid:7399)ता के (cid:7079)योनिा(cid:6981) नहसाब म(cid:7286) ली गई र्अनधः, (ii) ऐसी र्अनध नसिके दैरान कोई अनधकारी उस (cid:7088)ेणी म(cid:7286) (cid:7357)ूटी पद धारण (cid:7408)कए (cid:7263)ए होता, य(cid:7408)दर् ह छु (cid:7349)ी पर नह(cid:7277) होता या अ(cid:7008)या ऐसा पद धारण करने के नलए उपल(cid:7011)ध (cid:7263)आ होता;

(ञ) "अनुसूची" से इन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची अनभ(cid:7079)ेत है।

(ट) "अनुसूनचत ािनतय(cid:7298)" और ''अनुसूनचत निािनतयां" का र्ही अ(cid:6981) है ोि संर्नधान के अनु(cid:6994)छेद 366के ख(cid:7003)ड (24) और ख(cid:7003)ड (25) म(cid:7286) ह(cid:7289)।

(ठ) "अ(cid:7008)य नपछी ािनतयां" है ोि समय-समय पर सरकार (cid:7367)ारा अनधसूनचत ािनत और समुदायसमार्न(cid:7397) होगी ।

(ड) "र्सेा" से ननयम 3 के अधीन ग(cid:7407)ठत भारतीय इंीिननयर र(cid:6979)ा र्सेा अनभ(cid:7079)ेत है।

3. भारतीय इंीिननयर र(cid:6979)ा र्सेा का गठनः – भारतीय इंीिननयर र(cid:6979)ा र्सेा के नाम से (cid:6980)ात र्सेा अनुसूची-1म(cid:7286) र्ननन(cid:7416)द(cid:7397) पद(cid:7298) से नमलकर बनेगी।

4. (cid:7088)ेणी, (cid:7079)ानधकृ त सं(cid:6990)या और उनका पुन(cid:7414र्)लोकनः- (1) र्सेा क(cid:7409) र्ननभ(cid:7382) (cid:7088)ेनणय(cid:7298) म(cid:7286) सन(cid:7013)मनलत (cid:7357)ूटी पद, उनके नाम, सं(cid:6990)या औरर् ेतनमानर् ह ह(cid:7298)ग(cid:7286) ोि उन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची -1 म(cid:7286) र्ननन(cid:7416)द(cid:7397) ह(cid:7289)।

(2) सरकार, समय –समय पर ैिसा र्आ(cid:7019)यक समझे र्ननभ(cid:7382) (cid:7088)ेनणय(cid:7298) म(cid:7286) (cid:7357)ूटी पद(cid:7298) क(cid:7409) सं(cid:6990)या म(cid:7286)र् ृन(cid:7373) या कटौती कर सके गी।

(3) सरकार, आयोग के पराम(cid:6981) से अनुसूची -1 म(cid:7286) सन(cid:7013)मनलत पद(cid:7298) से नभ(cid:7382), र्सेा के ऐसे पद(cid:7298) को, ोि (cid:7079)ान(cid:7021)नत, (cid:7088)ेणी, र्ेतनमान औरर् ृन(cid:7275)क (cid:7272)प से र्सेा म(cid:7286) सन(cid:7013)मनलत पद(cid:7298) के समतु(cid:7016)य, हो, सेना म(cid:7286) सन(cid:7013)मनलत या र्सेा से अर्प(cid:7414)ति कर सके गी।

(4) सरकार , आयोग के पराम(cid:6981) से (cid:7408)कसी ऐसे अनधकारी को, नसिका पद उप ननयम (3)भारत का राजपत्रा : मार्च 26, 2016/चैत्रा 6, 1938 [भाग II-खण्ड 4] 37 के अधीन र्सेा क(cid:7409) समुनचत (cid:7088)ेणी म(cid:7286) र्सेा म(cid:7286) सन(cid:7013)मनलत (cid:7408)कया गया है, अ(cid:7021)ायी हैनसयत म(cid:7286) या (cid:7408)कसी अनध(cid:7399)ायी हैनसयत म(cid:7286) ैिसा उनचत समझ(cid:7286) ननयु(cid:7334) कर सके गी और उस (cid:7088)ेणी म(cid:7286) उसक(cid:7409) (cid:6996)ये(cid:7399)ता सरकार (cid:7367)ारा इस बाबत समय-समय पर ािरी (cid:7408)कए गए साधारण आदे(cid:7298) या अनुदे(cid:7298) के अनुसार ननयत कर सके गी।

5. र्सेा के सद(cid:7021)यः- नन(cid:7388)नलनखत (cid:7390)न(cid:7334) र्सेा के सद(cid:7021)य ह(cid:7298)गे, अा(cid:6981)त् –

(क) ननयम 6 के अधीन र्सेा म(cid:7286) ननयु(cid:7334) समझे गए (cid:7390)न(cid:7334), और

(ख) ननयम 7 के अधीन र्सेा म(cid:7286) ननयु(cid:7334) (cid:7390)न(cid:7334) ।

6. आरंनभक गठनः- भारतीय इंीिननयर र(cid:6979)ा र्सेा ननयम, 2004 के सभी नसर्ननलयन अनधकारी ोि समूह "क" पद ननयनमत आधार पर धारण (cid:7408)कए (cid:7263)ए है ं, भारतीय इंीिननयर र(cid:6979)ा र्सेा ननयम, 2016 म(cid:7286) उनके आरंनभक गठन से (cid:7088)ेनणय(cid:7298)/पद(cid:7298) पर ननयनमत आधार पर त(cid:7004)(cid:7021)ानी पद(cid:7298) और (cid:7088)ेणी म(cid:7286), यान(cid:7021)नत, अनध(cid:7399)ायी या (cid:7021)ानाप(cid:7382) हैनसयत म(cid:7286) ननयु(cid:7334) (cid:7408)कए गए समझ(cid:7286) ािएंगे।

7. र्सेा का र्भाी अनुर(cid:6979)णः- इन ननयम(cid:7298) के आर(cid:7013)भ के प(cid:7391)ात् (cid:7407)रन(cid:7334)यां इन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची-1, अनुसुची-2, अनुसूची-3 और अनुसूची-4 म(cid:7286) या उपबंनधत रीनत से भरी ािएंगी।

8. (cid:6996)ये(cid:7399)ताः- (1) ननयम 6 के अधीन (cid:7408)कसी (cid:7088)ेणी म(cid:7286) ननयु(cid:7334) समझे गए र्सेा के सद(cid:7021)य(cid:7298) क(cid:7409) सा(cid:6979)ेप (cid:6996)ये(cid:7399)ता इन ननयम(cid:7298) के आर(cid:7013)भ क(cid:7409) तारीख उनक(cid:7409) सा(cid:6979)ेप (cid:6996)ये(cid:7399)ता से ानसत होगीः

पर(cid:7008)तु य(cid:7408)द उस तारीख को (cid:7408)कसी सद(cid:7021)य क(cid:7409) (cid:6996)ये(cid:7399)ता र्नन(cid:7397)तः र्अधा(cid:7407)रत नह(cid:7277) क(cid:7409) गई है तो उसे सरकार के अधीन सम(cid:7272)प र्सेा के सद(cid:7021)य(cid:7298) को लागू ननयम(cid:7298) के अनुसार सरकार (cid:7367)ारा र्अधा(cid:7407)रत (cid:7408)कया ािएगा।

(2) ऐसे अनधकारी ोि इन ननयम(cid:7298) के आर(cid:7013)भ के प(cid:7391)ात् (cid:7408)कसी (cid:7088)ेणी म(cid:7286) र्सेा म(cid:7286) सन(cid:7013)मनलत होते ह(cid:7289)। ननयम 6 के अधीन उस (cid:7088)(cid:7286)णी म(cid:7286) ननयु(cid:7334) समझे गए (cid:7390)न(cid:7334)य(cid:7298) से पंन(cid:7334) म(cid:7286) नीचे ह(cid:7298)गे। र्सेा म(cid:7286) ऐसे (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) (cid:6996)ये(cid:7399)ता ननिक(cid:7409) भत(cid:7278) आरन(cid:7013)भक गठन के प(cid:7391)ात क(cid:7409) ािती है, सरकार (cid:7367)ारा क(cid:7409) बाबत समय-समय पर ािरी (cid:7408)कए गए साधारण अनुदे(cid:7298) के अनुसार र्अधा(cid:7407)रत क(cid:7409) ािएगी।

(3) ऊपर के उपबंध(cid:7298) के अंतग(cid:6981)त नह(cid:7277) आनेर् ाले अनधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:6996)ये(cid:7399)ता, आयोग के पराम(cid:6981) से सरकार (cid:7367)ारा र्अधा(cid:7407)रत क(cid:7409) ािएगी।

9. प(cid:7407)र्री(cid:6979)ाः – (1) र्सेा म(cid:7286) ननयु(cid:7334) (cid:7079)(cid:7004)येक अनधकारी, चाहेर् ह परी(cid:6979)ा के मा(cid:7007)यम से कनन(cid:7399) कालर् ेतनमान पर सीधी भत(cid:7278) (cid:7367)ारा या सहायक इंीिननयर समूह ख पद से (cid:7079)ो(cid:7382)नत (cid:7367)ारा ननयु(cid:7334) (cid:7263)आ हो, दोर् ष(cid:6981) क(cid:7409) प(cid:7407)र्री(cid:6979)ा र्अनध पर होगा :

पर(cid:7008)तु ननयं(cid:7074)ण (cid:7079)ानधकारी इस के संबंध म(cid:7286) सरकार (cid:7367)ारा समय –समय पर ािरी (cid:7408)कए गए अनुदे(cid:7298) या आदे(cid:7298) के अनुसार प(cid:7407)र्री(cid:6979)ा र्अनध बा सके गा :

पर(cid:7008)तु प(cid:7407)र्री(cid:6979)ा र्अनध बाने का कोई र्ननन(cid:7391)त क(cid:7409) र्पू(cid:6981) र्अनध क(cid:7409) समान(cid:7385) के प(cid:7391)ात साधारणतया आठ स(cid:7385)ाह के भीतर (cid:7408)कया ािएगा और स(cid:7013)ब(cid:7373) अनधकारी को ऐसा करने के कारण(cid:7298) सनहत उ(cid:7334) र्अनध के भीतर नलनखत म(cid:7286) र्ननन(cid:7391)य को संसूनचत (cid:7408)कया ािएगा।

(2) प(cid:7407)र्री(cid:6979)ा र्अनध के पूरा होने पर अनधका(cid:7407)रय(cid:7298) को, य(cid:7408)द ननयनमत ननयुन(cid:7334) के नलए उपयु(cid:7334) समझा ािता है तो उ(cid:7008)ह(cid:7286) ननयनमत आधार पर अपनी ननयुन(cid:7334) पर रखा ािएगा और उनक(cid:7409) स(cid:7013)यक अनु(cid:7059)म म(cid:7286) पुन(cid:7397) क(cid:7409) ािएगी।

(3) य(cid:7408)द, उपननयम(1) म(cid:7286) नन(cid:7416)द(cid:7397), यान(cid:7021)नत, प(cid:7407)र्री(cid:6979)ा र्अनध या उसक(cid:7409) बाई गई र्अनध के दौरान सरकार क(cid:7409) यह राय है (cid:7408)क कोई अनधकारी रखे ािने के नलए उपयु(cid:7334) नह(cid:7277) है या य(cid:7408)द ऐसी प(cid:7407)र्री(cid:6979)ा क(cid:7409) र्अनध या उसक(cid:7409) बढाई गई र्अनध के दौरान (cid:7408)कसी भी समय सरकार का यह समाधान हो ािता है (cid:7408)क अनधकारी ऐसी प(cid:7407)र्री(cid:6979)ा र्अनध या बाई गई र्अनध क(cid:7409) समान(cid:7385) के प(cid:7391)ात् (cid:7021)ायी ननयुन(cid:7334) के नलए उपयु(cid:7334) नह(cid:7277) होगा तो सरकार कारण(cid:7298) को लेखब(cid:7373) करके उसे, यान(cid:7021)नत, र्सेो(cid:7008)मु(cid:7334)38 THE GAZETTE OF INDIA : MARCH 26, 2016/CHAITRA 6, 1938 [PART II—SEC. 4] या उस पद पर नसिके र् ह प(cid:7407)र्री(cid:6979)ा से र्पू(cid:6981)र् ह धारण (cid:7408)कए (cid:7263)ए ा, उस पर (cid:7079)नर्त(cid:7414)तत या ैिसा यह उनचत समझे, आदे ािरी कर सके गी।

(4) प(cid:7407)र्री(cid:6979)ा र्अनध के दौरा सरकार , उस अनधकारी से, प(cid:7407)र्री(cid:6979)ा र्अनध को समाधान(cid:7079)द (cid:7272)प म(cid:7286) पूरा करने के (cid:7079)योनि के नलए ऐसा (cid:7079)न(cid:6979)ण और अनुदे पा(cid:7353)(cid:7059)म पूरा करने और ऐसी परी(cid:6979)ा और परी(cid:6979)ण(cid:7298) को उतीण(cid:6981) करने क(cid:7409) (नसिम(cid:7286) नह(cid:7008)दी परी(cid:6979)ा सन(cid:7013)मनलत है) ैिसार् ह उपयु(cid:7334) समझ(cid:7286), अपे(cid:6979)ा कर सके गी।

(5) प(cid:7407)र्री(cid:6979)ा क(cid:7409) र्अनध से संबंनधत अ(cid:7008)य मामल(cid:7298) क(cid:7409) बाबत र्सेा के सद(cid:7021)य इस बाबत सरकार (cid:7367)ारा समय-समय पर ािरी (cid:7408)कए गए अनुदे(cid:7298) या आदे(cid:7298) (cid:7367)ारा ानसत ह(cid:7298)गे।

10. र्सेा का दानय(cid:7004र्)ः –(1) र्सेा म(cid:7286) ननयु(cid:7334) अनधकारी भारत म(cid:7286) या भारत से बाहर कह(cid:7277) भी र्सेा करने के दायी होगा।

(2) र्सेा म(cid:7286) ननयु(cid:7334) कोई भी (cid:7390)न(cid:7334), य(cid:7408)द ऐसा अपेन(cid:6979)त हो, भारत क(cid:7409) र(cid:6979)ा से संबंनधत (cid:7408)कसी पद पर चारर् ष(cid:6981) से अ(cid:7008)यून क(cid:7409) र्अनध के नलए नसिम(cid:7286) (cid:7079)न(cid:6979)ण म(cid:7286) नबतायी गयी र्अनध, य(cid:7408)द कोई है, सन(cid:7013)मनलत है, र्सेा करने का दायी होगा, बत(cid:7287) ऐसे (cid:7390)न(cid:7334) ,से,

(क) उसक(cid:7409) ननयुन(cid:7334) क(cid:7409) तारीख से दस र्ष(cid:6981) क(cid:7409) र्अनध क(cid:7409) समान(cid:7385) के प(cid:7391)ात उपरो(cid:7334) र्सेा करने क(cid:7409) अपे(cid:6979)ा नह(cid:7277) क(cid:7409) ािएगी, या

(ख) चालीसर् ष(cid:6981) क(cid:7409) आयु होने के प(cid:7391)ात साधारणतया उपरो(cid:7334) र्सेा करने क(cid:7409) अपे(cid:6979)ा नह(cid:7277) क(cid:7409) ािएगी।

(3) र्सेा का कोई सद(cid:7021)य, बि उसे इसके नलए तैनात (cid:7408)कया ािए,र् ृन(cid:7275)क पाठय(cid:7059)म करने का भी दायी होगा।

(4) ऐसे मामल(cid:7298) क(cid:7409) बाबत ननिके नलए इन ननयम(cid:7298) म(cid:7286) उपबंध नह(cid:7277) (cid:7408)कया गया है, र्सेा के सद(cid:7021)य(cid:7298) क(cid:7409) र्सेा त(cid:7287)र् ह(cid:7277) ह(cid:7298)गी ोि समय-समय पर के (cid:7008)(cid:7076)ीय नसर्नल र्सेा के अनधका(cid:7407)रय(cid:7298) को लागू होती ह(cid:7289)।

11. ननरह(cid:6981)ताः– र् ह (cid:7390)न(cid:7334)-

(क) नसिने ऐसे (cid:7390)न(cid:7334) से नसिका पनत या नसिक(cid:7409) प(cid:7360)ी ीिर्नत है, र्र्नाह (cid:7408)कया है ; या

(ख) नसिने अपने पनत या अपनी प(cid:7360)ी के ीिर्नत होते (cid:7263)ए (cid:7408)कसी (cid:7390)न(cid:7334) से र्र्नाह (cid:7408)कया है,

उ(cid:7334) पद पर ननयु(cid:7334) का पा(cid:7074) नह(cid:7277) होगा।

पर(cid:7008)तु य(cid:7408)द के (cid:7008)(cid:7076)ीय सरकार का यह समाधान हो ािता है (cid:7408)क ऐसा र्र्नाह ऐसे (cid:7390)न(cid:7334) और र्र्नाह के अ(cid:7008)य प(cid:6979)कार को लागू (cid:7021र्)ीय र्ननध के अधीन अनु(cid:6980)ेय है और ऐसा करने के नलए अ(cid:7008)य आधार है तोर् ह (cid:7408)कसी (cid:7390)न(cid:7334) को इस ननयम के (cid:7079र्)त(cid:6981)न से छू ट दे सके गी।

12. सेना अनधकारी पर लागू न होनेर् ाले ननयमः- यह ननयम सेना इंीिननयर र्सेा (र्सेा का(cid:7414)मक) र्नननयम, 1989 के अनुसार र्र्सेाृनत के आधार पर ननयु(cid:7334) सेना अनधका(cid:7407)रय(cid:7298) को लागू नह(cid:7277) ह(cid:7298)गे (cid:6989)य(cid:7298)(cid:7408)कर् े सेना अनधननयम ,1950 (1950 का 46) और त(cid:7373)ीन बनाए गए ननयम(cid:7298) (cid:7367)ारा ानसत ह(cid:7298)गे।

(ख) (cid:7408)कसी र्नन(cid:7397) (cid:7061)ेडर् ेतन म(cid:7286) उ(cid:7382)यन के नलए "ब(cid:7289)चमाक(cid:6981) " सनहत सभी र्ननहत पा(cid:7074)ता मापद(cid:7003)ड ता (cid:7079)ो(cid:7382)नत सन(cid:7382)यम को उ(cid:7340)र् ेतनमान देने के नलए ािंच के समय देखा ािएगा।

(ग) इस र्सेा के अनधका(cid:7407)रय(cid:7298) के नलए अकृ न(cid:7004)यक उ(cid:7382)यन से संबंनधत अ(cid:7008)य मामले सरकार (cid:7367)ारा अनुसूची 5 के अनुसार ािंच सनमनत (cid:7367)ारा समय –समय पर ािरी आदे(cid:7298) ता अनुदे(cid:7286) (cid:7367)ारा इस र्नषय म(cid:7286) ानसत ह(cid:7298)गे।

14. लागू होनाः-(1) ये ननयम, इन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची 1के (cid:7021)तंभ (2) म(cid:7286) या र्ननन(cid:7416)द(cid:7397) पद(cid:7298) को लागू ह(cid:7298)गे।

(2) अनुसूची 1 म(cid:7286) र्ननन(cid:7416)द(cid:7397) पद(cid:7298) को, भारतीय इंीिननयर र(cid:6979)ा र्सेा के नसर्ननलयन अनधका(cid:7407)रय(cid:7298) (cid:7367)ारा भरा ािएगा और ये कभी भी बि तक (cid:7408)क सरकार नलनखत म(cid:7286) आदे (cid:7367)ारा ऐसे र्नननन(cid:7391)य न कर(cid:7286), (cid:7408)कसी अ(cid:7008)य (cid:7390)न(cid:7334) (cid:7367)ारा धा(cid:7407)रत नह(cid:7277) (cid:7408)कए ाि सक(cid:7286) गे।

15. ननल करने क(cid:7409) न(cid:7334)ः- हिां के (cid:7008)(cid:7076)ीय सरकार क(cid:7409) यह राय है (cid:7408)क ऐसा करना र्आयक या समीचीन है,र् हांर् ह इसके नलए ोि कारण ह(cid:7289) उ(cid:7008)ह(cid:7286) लेखब(cid:7373) करके ता संघ लोक र्सेा आयोग से पराम(cid:6981) करके , इन ननयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसीर् ग(cid:6981) या (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) बाबत, आदे (cid:7367)ारा ननल कर सके गी।

16. (cid:7390र्)ाृनतः- (1) इन ननयम(cid:7298) क(cid:7409) कोई बात, ऐसे आर(cid:6979)ण(cid:7298) , आयु-सीमा म(cid:7286) छू ट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डालेगी, ननिका के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ननकाले गए आदे(cid:7298) के अनुसार अनुसूनचत ािनतय(cid:7298) , अनुसूनचत निािनतय(cid:7298). अ(cid:7008)य नपछेर् ग(cid:7300),भूतर्पू(cid:6981) सैननक(cid:7298) और अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) के नलए उपबंध करना अपेन(cid:6979)त है।

(2) इन ननयम(cid:7298) के अनधसूचना से र्पू(cid:6981) समय –समय पर ािरी (cid:7408)कए गए (cid:7021)ापन आदे(cid:7298) के अधीन क(cid:7409) गई ननयुन(cid:7334)यां , (cid:7079)ो(cid:7382)नतयां या पुन(cid:7397) आयोग के पराम(cid:6981) से इन ननयम(cid:7298) के अधीन क(cid:7409) गई समझी ािएंगी।

17. नर्न(cid:6981)चनः-इन ननयम(cid:7298) के नर्न(cid:6981)चन से संबंनधत य(cid:7408)द कोई (cid:7079)(cid:7396) उदभूत होता है तो के (cid:7008)(cid:7076)ीय सरकार उसका र्ननन(cid:7391)य करेगी।

S.R.O. 9.–In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of Indian Defence Service of Engineers (Recruitment and Conditions of Service) Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, regulating the method of recruitment and the conditions of service of persons appointed to the Indian Defence Service of Engineers in Ministry of Defence, namely :- 1. Short title and commencement. (1) These rules may be called the Indian Defence Service of Engineers (Recruitment and Conditions of Service) Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these rules, unless the context otherwise requires;-

(a) "Commission" means the Union Public Service Commission;

(b) "Controlling Authority" means the Government of India in the Ministry of Defence;

(c) "Departmental Candidate" means a person who has been appointed on regular basis after consultation with the Commission or on the recommendations of Departmental Promotion Committee.

(d) "Departmental Promotion Committee" means a Committee specified against each post in Schedule IV to consider promotion or confirmation in the said post;

(e) "duty post" means any post specified in column (2) of Schedule I;

(f) "Examination" means a Combined Competitive Examination conducted by the Commission for recruitment to various Engineering Services or posts as may be notified by the Government from time to time;

(g) "Government" means the Government of India;

(h) "Grade" means a grade of service specified in column (2) of Schedule I annexed to these rules;

(i) "regular service" in relation to any grade means the period of service in the grade rendered after selection according to procedure laid down by the Government for long-term appointment to that grade and includes any period or periods :-

(i) taken in to account for purpose of seniority in the case of those appointed at the initial constitution of the service;

(ii) during which an officer would have held a duty post in the grade but for being on leave or otherwise not being available for holding such post;

(j) "Schedule" means a Schedule annexed to these rules;

(k) "Scheduled Castes" and "Scheduled Tribes" shall have the meanings respectively assigned to them under clause (24) and clause (25) of article 366 of the Constitution;

(l) "Other Backward Classes" shall comprise the caste and communities notified by the Government from time to time.

(m) "service" means the INDIAN DEFENCE SERVICE OF ENGINEERS constituted under rule 3.

3. Constitution of Indian Defence Service of Engineers.- The service known as the Indian Defence Service of Engineers shall consist of posts specified in Schedule I.

4. Grades, authorised strength and it's review.- (1) The duty posts included in various grades of the service, their names, numbers and scales of pay shall be as specified in Schedule I.

(2) The Government may make temporary additions to or reductions from the strength of the duty posts in various grades as it may deem necessary from time to time.

(3) The Government, in consultation with the Commission, include in or exclude from the service such posts as may be deemed to be equivalent to the posts included in the service, in status, grade, scale of pay and professional content, other than those included in Schedule I.

(4) The Government may, in consultation with the Commission appoint an officer whose post is included in the service under sub-rule (3) to the appropriate grade of the service in a temporary capacity or in a substantive capacity, as it may deem fit and fix his seniority in the grade in accordance with the general orders and instructions issued by the Government from time to time in this regard.

5. Members of the service. The following persons shall be members of the service, namely :-

(a) Persons deemed to have been appointed to service under rule 6; and

(b) Persons appointed to the service under rule 7.

6. Initial Constitution. All the civilian officers in the Indian Defence Service of Engineers Rules, 2004 holding Group 'A' posts on regular basis, shall be deemed to have been appointed to the corresponding posts and grades in the service in the substantive or officiating capacity, as the case may be, from the date of their initial appointment to the grades/ posts on regular basis, in the Indian Defence Service of Engineer Rules, 2016.

7. Future Maintenance of the Service.- After commencement of these rules, the vacancies shall be filled in the manner as provided in Schedules I, II, III and IV, annexed to these rules.

8. Seniority.- (1) The relative seniority of members of the service deemed to have been appointed to any grade under rule 6, shall be governed by their relative seniority obtaining on the date of commencement of these rules :

Provided that if the seniority of a member has not been specifically determined on the said date, the same shall be determined by the Government in accordance with the rules applicable to members of similar service under the Government.

(2) Officers who join the service in any grade after the commencement of these rules, shall rank below those deemed to have been appointed to the service in that grade under rule 6. The seniority of persons recruited to the service after the initial constitution shall be determined in accordance with the general instructions issued by the Government from time to time in this regard.

(3) Seniority of officers not covered by the above provisions, shall be determined by the Government in consultation with the commission.

9. Probation.- (1) Every officer on appointment to the service either by direct recruitment to the Junior Time Scale through the examination or by promotion from Group 'B' posts of Assistant Engineer shall be on a probation for a period of two years.

Provided that the Controlling Authority may extend the period of probation in accordance with the instructions or orders issued by the Government from time to time in this regard :

Provided further that any decision for extension of the period of probation shall be taken ordinarily within eight weeks after the expiry of the previous period of probation and the decision in writing shall be communicated to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the period of probation, officers shall, if considered fit for regular appointment, retained in their appointment on regular basis and be confirmed in due course.

(3) If, during the period of probation referred to in sub-rule (1) or any extension thereof, as the case may be, the Government is of the opinion that an officer is not fit for retention or if, at any time during such period of probation, or extension thereof, the Government is satisfied that the officer will not be fit for permanent appointment on the expiration of such period of probation, or extension thereof, the Government may for reasons to be recorded in writing, discharge him from the service or revert him to the post which he has been holding before his promotion, as the case may be, or pass such orders as it may deem fit.

(4) During the period of probation, the officer may be required by the Government to undergo such courses of training instructions and to pass such examination and tests (including an Examination in Hindi) as it may deem fit for the purpose of satisfactory completion of period of probation.

(5) As regards other matters relating the period of probation, the members of the service shall be governed by instructions or orders issued by the Government from time to time in this regard.

10. Liability for service.- (1)The officers appointed to the service shall be liable to serve anywhere in India outside.

(2) Any person appointed to the service, if so required, be liable to serve in connection with the Defence of India, for a period of not less than four years, including the period spent on training, if any, provided that such person -

(a) shall not be required to serve as aforesaid after the expiry of ten years from the date of his appointment; or

(b) shall not ordinarily be required to serve as aforesaid after attaining the age of forty years.

(3) A member of the service shall also be liable to undergo professional courses as and when he is deputed for that.

(4) The conditions of the service of the members of the service in respect of matters for which no provision is made in these rules, shall be the same as are applicable to the officers of the Central Civil Services from time to time.

11. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the posts specified in Schedule I:

Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

12. Rules not apply to Army Officers.- These rules shall not apply to the Army Officers appointed on tenure basis in accordance with provisions of the Military Engineer Services (Army Personnel) Regulations, 1989, as they shall be governed by the Army Act, 1950 (46 of 1950) and the rules framed there under.

13. Non Functional Upgradations:

(a) Whenever an Indian Administrative Service Officer of the State of Joint Cadre is posted at the centre to a particular grade carrying a specific grade pay in Pay Band 3, pay Band 4 or Higher Administrative Grade, the officers belong to batches of Indian Defence Service Engineers that are senior by two years or more and have not so far been promoted to that particular grade would be granted the same grade on non-functional basis from the date of posting of the Indian Administrative Service Officers in that particular grade at the Centre.

(b) All the prescribed eligibility criteria and promotional norms including "benchmark" for upgradation to a particular grade pay shall have to be fulfilled at the time of screening for grant of higher pay scale.

(c) The other matters related to non-functional upgradation to the members of the service shall be governed by the orders in accordance with or instructions issued by the Central Government in this behalf for time to time and by the Screening Committee as provided in Schedule-V.

14. Application.- (1) These rules shall apply to the posts as specified in column (2) of the Schedule-I.

(2) The posts specified in Schedule-I are to be manned by Civilian Officers of Indian Defence Service of Engineers and at no time can be held by another person unless Government so decides by specific orders in writing.

15. Power to relax.- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing, and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons.

16. Saving.- (1) Nothing in these rules shall effect reservations relaxation of age limits and other concessions required to be provided for the persons belonging to the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-Servicemen and other special categories of persons in accordance with orders issued by the Government from time to time in this regard.

(2) All appointments, promotions or confirmations, made in consultation with the Commission, under Establishment orders issued from time to time before notification of these rules shall be deemed to have been made under these rules.

17. Interpretation. If any question arises relating to the interpretation of these rules, it shall be decided by the Central Government.

SCHEDULE – I

**30% of the Senior Duty Posts (Executive Engineer and above), subject to the conditions, that :-

(i) There is no increase in overall strength of the cadre.

(ii) The number of posts to be operated in non-functional second grade Executive Engineer (NFSG), (PB-3, Rs. 15600 – 39100, Grade Pay Rs. 7600) does not exceed the total number of posts available in Executive Engineer (PB-3, Rs. 15600-39100, Grade Pay of Rs. 6600/-).

# Reserve. As per cadre review.

Note 1. Senior most Additional Director General of Indian Defence Service Engineer Cadre will be Director General (Personnel) to look after all personnel matters relating to MES Civilian Officers/Sub-ordinates.

Note 2. The existing incumbents of Additional Chief Engineer on the date of commencement of these rules shall be considered alongwith Superintending Engineers for promotion subject to fulfilment of laid down criteria in this regard, till they are promoted or superannuated from service whichever is earlier.

SCHEDULE II

Minimum educational qualification and age limits for direct recruits to the post of Assistant Executive Engineer Group 'A' to be filled on the results of the Examination to be conducted by the Union Public Service Commission.

A candidate must have :

(i) a degree in Civil, Mechanical or Electrical Engineering from a University incorporated by an Act of the Central or State Legislature in India or other educational Institutions established by an Act of Parliament or declared to be deemed as a University under section 3 of University Grants Commission Act, 1956 (3 of 1956) or a degree or diploma in Engineering from such foreign Universities, Colleges or Institutions and under such conditions as may be recognized by the Government from time to time or possessing, qualifications which have been recognized by the Government as equivalent to above qualifications; and

(ii) attained the age of twenty one years but must not have attained the age of thirty years on the first day of January of the year in which the examination is held.

SCHEDULE – III

Method of recruitment, field of promotion, minimum qualifying service and educational qualification in the next lower grade of feeder grade for promotion to duty posts in the various grades of the Indian Defence Service of Engineer (Group 'A').

Note 1 :- Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more them half of such qualifying or eligibility service or two years, whichever is less and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2:- The promotion of all existing incumbents Assistant Executive Engineer on the date of publication of this service rules shall be considered as per 66 2/3% of quota prescribed for them in the existing service rules of SRO-95, 2004.
