(2) ये नियम शासकीय राजपत्र में इनके प्रकाशित होने की ितिथ से प्रभावी होंगे ।

(क) जिसने ऐसे ]क्ति के साथ विवाह अथवा अनुबंिधत विवाह किया हो जिसका पति/प_ी जीवित हो, अथवा
(ख) जिसकी प_ी/पति के जीवित रहते (cid:30)ए उसने किसी भी अन्य ]क्ति के साथ विवाह अथवा अनुबंिधत विवाह किया हो, उक्त पद पर नियुक्ति हेतु पात्र नहa होगा :
बशतc, कि भारत सरकार संतुष्ट हो कि ऐसा विवाह उस ]क्ति पर लागू निजी कानून और िववाह के दूसरे पक्ष को स्वीकार्य है और ऐसा करने के लिए अन्य आधार भी हैं तो इस नियम के अंतर्गत कार्रवाई से किसी भी ]क्ति को छू ट मिल सकती है।
िशिथलीकरण का अिधकारिशिथलीकरण का अिधकारिशिथलीकरण का अिधकारिशिथलीकरण का अिधकार---- जहां कें Cीय सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं उन्हे लेखबT करके इन नियमों के किसी भी उपबंध को किसी वर्ग या प्रवर्ग के ]क्तियों के बाबत, आदेश द्वारा शिथिल कर सके गी।
*ावृत्ति*ावृत्ति*ावृत्ति*ावृत्ति- इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छू ट और अन्य रियायतों पर प्रभाव नहa डालेगी, जिनका कें Cीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के ]क्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R52 .— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession
of the All India Handicrafts Board (Class III and Class IV posts) Recruitment Rules, 1967, in so far as they relate to the post of Store Supervisors and Store Clerks/Store Keepers, in supersession of the Development Commissioner (Handicrafts) Group 'C' posts (Technical Asstt., Mechanical Draftsman-cum-Laboratory Asstt., Photographer, Carpenter, Draftsman and Asstt. Curator (Museum and Library) Regional Designs and Technical Development Centres, Office of the Development Commissioner (Handicrafts) Recruitment Rules, 1983, insofar as they relate to the post of Mechanical Draughtsman-cum-Laboratory Assistant, in supersession of the Office of the Development Commissioner (Handicrafts) Group 'B' Handicrafts Promotion Officer, Recruitment Rules, 1984, in supersession of the Office of the Development Commissioner (Handicrafts) Handicrafts Training Officers (Cane and Bamboo) and Assistant Administrative Officer Recruitment Rules, 1994, insofar as they relate to the post of Assistant Administrative Officer, in supersession of the Office of the Development Commissioner (Handicrafts) Group 'C' Posts Recruitment Rules, 1995, insofar as they relate to the post of In-charge Training Officer and in supersession of the Ministry of Textiles, Office of the Development Commissioner (Handicrafts), Investigator, Group 'B' Post, Recruitment Rules, 2011, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Handicrafts Promotion Officer in the Ministry of Textiles, Office of the Development Commissioner (Handicrafts), namely:-
1. Short title and commencement. - (1) These rules may be called the Ministry of Textiles, Office of the Development Commissioner (Handicrafts), Handicrafts Promotion Officer, Group 'B' Non-Gazetted Post, Recruitment Rules, 2016.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale. – The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications, etc.,– The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification. – No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

(क) जिसने ऐसे pयक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते (cid:30)ए किसी pयक्ति से विवाह किया है, उक्त पद पर नियुक्ति का पात्र नहa होगाः
परन्तु यदि के न्Cीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे pयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुrेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी pयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

Note 2: For the purpose of appointment on deputation (including short-term contract) basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 (the date from which the revised pay structure based on the Sixth Central Pay Commission recommendation has been extended) shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation. N ote 3: The departmental senior programmer in Grade Pay of Rs. 6600/- in pay band 3 in scale of pay of Rs. 15600-39100 with 5 years regular service in the grade will also be considered along with outsiders and in case he/she is selected for appointment to the post, the same shall be deemed to have been filled up by promotion. |
