सा.का.िन.सा.का.िन.सा.का.िन.सा.का.िन. 82828282 .— राष्ट्रपति, संिवधान के अनु(cid:17)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:31)ए और प्रधान मंत्री कार्यालय, लेखाकार (समूह 'ख') भर्ती िनयम, 2015 को, उन बातों के िसवाय अधि)ांत करते (cid:31)ए, जिन्हें ऐसे अधि)मण से पहले किया गया है या करने का लोप किया गया है, प्रधान मंत्री कार्यालय में लेखाकार के पद पर भर्ती की प/ति का िविनयमन करने के िलए निम्नलिखित िनयम बनाते हैं, अर्थात् :-

(ii) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

4. निरर्हतानिरर्हतानिरर्हतानिरर्हता – वह Eक्ति, --
(क) िजसने ऐसे Eक्ति से िजसका पित या जिसकी पFी जीिवत है, िववाह किया है या िववाह की संिवदा की है; या
(ख) िजसने अपने पित या अपनी पFी के जीिवत रहते (cid:31)ए किसी Eक्ति से िववाह किया है या िववाह की संिवदा की है,
उक्त पद पर नियुक्ति का पात्र नहG होगा :
परंतु यदि के न्Hीय सरकार का यह समाधान हो जाता है कि ऐसा िववाह, ऐसे Eक्ति और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुIेय है और ऐसा करने के िलए अन्य आधार हैं तो वह किसी Eक्ति को इस िनयम के प्रवर्तन से छू ट दे सके गी।
5. िशिथलिशिथलिशिथलिशिथल करनेकरनेकरनेकरने कीकीकीकी शक्तिशक्तिशक्तिशक्ति – जहां के न्Hीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं उन्हें लेखब/ करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Eक्तियों की बाबत, आदेश द्वारा िशिथल कर सके गी।
6. $ावृत्ति$ावृत्ति$ावृत्ति$ावृत्ति – इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहG डालेगी, िजनका के न्Hीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूिचत जातियों, अनुसूिचत जनजातियों, अन्य िपछड़े वगM, भूतपूर्व सैनिकों और अन्य िवशेष प्रवर्ग के Eक्तियों के िलए उपबंध करना अपेक्षित है।

| टिप्पण टिप्पण 3333 - प्रतिनियुक्ति के आधार पर नियुक्ति के प्रयोजन के िलए किसी टिप्पण टिप्पण अिधकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से िजससे छठे क े न्Hीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन स ंरचना का विस्तार किया गया है, िनयिमत आधार पर की गई सेवा को, िसवाय उस दशा के , जहां एक से अिधक पूर्व पुनरीक्षित वेतनमान का साधारण =ेड वेतन या वेतनमान सिहत एक Qेणी में िवलय कर दिया गया है और वहां यह फायदा के वल उस पद (उन पदों) पर विस्तारित होगा िजसके िलए =ेड वेतन या वेतनमान िबना किसी उन्नयन का साधारण प्रतिस्थापन =ेड है, उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी =ेड वेतन या वेतनमान में की गई सेवा समझी जाएगी। |

G.S.R.82.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Prime Minister's Office, Accountant (Group 'B') Recruitment Rules, 2015, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Accountant in the Prime Minister's Office, namely:
1. Short title and commencement.- (i) These rules may be called the Prime Minister's Office, Accountant (Group 'B') Recruitment Rules, 2016.
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale.- The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method or recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.
5. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.- Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

N ote 2 : The maximum age limit for appointment by transfer on deputation shall be not exceeding 56 years as on the closing date of receipt of applications. N ote 3: For the purposes of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1.1.2006, or the date from which the revised pay structure based on the recommendations of the Sixth Central Pay Commission has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the said Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up-gradation. |

(ii) ये नियम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

5. निरर्हतानिरर्हतानिरर्हतानिरर्हता : वह iयक्ति :
उक्त पद पर नियुक्ति का पात्र नहG होगा :
(क) जिसने ऐसे iयक्ति से विवाह किया है, जिसका पति या जिसकी पत्नी जीिवत है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते (cid:31)ए किसी iयक्ति से विवाह किया है,
परंतु यदि के न्Hीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे iयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय प/ति के अधीन अनुIेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी iयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
6. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति : जहां के न्Hीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब/ करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के iयक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।
7. 6या6या6या6या वृत्तिवृत्तिवृत्तिवृत्ति : इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहG डालेगी, िजनका के न्Hीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूिचत जनजातियों, अन्य पिछड़े वगM, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के iयक्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R.83— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Collectorate of Central Excise, Senior Personal Assistant Recruitment Rules, 1990, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Private Secretary in the Commissionerates and Directorates under the Central Board of Excise and Customs, Department of Revenue, Ministry of Finance, namely:-
1. Short title and commencement.- (i) These rules may be called the Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, Commissionerates and Directorates, Private Secretary (Group 'B' Post) Recruitment Rules, 2015.
(ii) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale.- The number of said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules.
3. Special provision.- Each Commissionerate and Directorate shall have its own separate cadre, unless otherwise provided by the Central Board of Excise and Customs in this behalf.
4. Method of recruitment, age limit, qualification, etc.- The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
5. Disqualification.- No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving.- Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(ख) िजसने अपने पति या अपनी पत्नी के जीवित रहते (cid:31)ए किसी iयक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्र नहG होगा:
परन्तु यदि कें Hीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे iयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुIेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी iयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

सा.का.िनसा.का.िनसा.का.िनसा.का.िन.85.85.85.85....———— राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विधि और
न्याय मंत्रालय, विधि कार्य विभाग, समूह 'ग' पद भर्ती नियम, 2013 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं;
अर्थात :-
1. संक्षिप्त नाम और प्रारभःसंक्षिप्त नाम और प्रारभःसंक्षिप्त नाम और प्रारभःसंक्षिप्त नाम और प्रारभः (1) इन नियमों का संक्षिप्त नाम विधि और न्याय मंत्रालय, विधि कार्य विभाग, समूह 'ग' पद भर्ती (संशोधन) नियम, 2016 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. विधि और न्याय मंत्रालय, विधि कार्य विभाग, समूह 'ग' पद भर्ती नियम, 2013 में (जिसे इसमें इसके पश्चात्, उक्त नियम कहा गया है) में नियम 1 के उपनियम (1) में, "समूह 'ग' पद" शब्दों और अक्षर के स्थान पर "समूह 'ख' और समूह 'ग' पद" शब्द और अक्षर रखे जायेंगे।
3. उक्त नियम की अनुसूची में, क्रम सं. 1 के सामने, वरिष्ठ न्यायालय लिपिक गे्रड-1 से सम्बन्धित :-
(i) स्तंभ (3) के अधीन की प्रविष्टि में, ''समूह 'ग' '' शब्द और अक्षर के स्थान पर ''समूह 'ख' ''शब्द और अक्षर रखे जायेंगे;
(ii) स्तंभ (9) में ''लागू नही'' प्रविष्टि के स्थान पर ''दो वर्ष'' प्रविष्टि रखी जायेगी ;
(iii) स्तंभ (12) में की प्रविष्टि के स्थान पर निम्नलिखित प्रविष्टि रखी जायेगी, अर्थात् :-
''समूह 'ख' विभागीय प्रोन्नति समिति (प्रोन्नति के संबंध में विचार करने के लिए) जिसमें निम्नलिखित होंगे :-
(i) संयुक्त सचिव और विधि सलाहकार (प्रशासन), -अध्यक्ष (ii) संयुक्त सचिव और विधि सलाहकार विधि कार्य विभाग, -सदस्य (iii) उपसचिव (प्रशासन) विधि कार्य विभाग,

G.S.R.85.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Law and Justice, Department of Legal Affairs, Group 'C' posts Recruitment Rules, 2013, namely:-
1. Short title and commencement. - (1) These rules may be called the Ministry of Law and Justice, Department of Legal Affairs, Group 'C' posts Recruitment (Amendment) Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Law and Justice, Department of Legal Affairs, Group 'C' posts Recruitment Rules, 2013 (hereinafter referred to as the said rules) in rule 1, in sub-rule (1), for the words and letter "Group 'C' posts", the words and letters "Group 'B' and Group 'C' posts" shall be substituted.
3. In the said rules, in the Schedule, against serial number 1, relating to the post of Senior Court Clerk Grade-I,- (i) in the entry under column (3), for the word and letter "Group 'C'", the word and letter "Group 'B'" shall be substituted;
(ii) in column (9), for the entry, "Not applicable", the entry "Two years" shall be substituted;
(iii) in column (12), for the entry, the following entry shall be substituted namely: "Group 'B' Departmental Promotion Committee (for considering promotion) consisting of: -
(1) Joint Secretary and Legal Adviser (Administration), Department of Legal Affairs – Chairman (2) Joint Secretary and Legal Adviser, Department of Legal Affairs
– Member (3) Deputy Secretary (Administration), Department of Legal Affairs – Member''
