सासासासा....काकाकाका....निनिनिनि.... 125125125125....-केन्द्रीय सरकार, असम राइफल्स अधिनियम, 2006 (2006 का 47) की धारा 165 की उप-धारा (2) के खंड (क) और खंड (ख) के साथ पठित उप-धारा(1) द्वारा प्रदा शक्तियों का प्रयोग करते हुए असम राइफल्स और भेशजज्ञ, (समूह 'ग' योधक पद) भर्ती नियम 2013 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के अधीन असम राइफल्स में वारंट आफिसर (भेशजज्ञ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभ.... - - - - (1) इन नियमों का संक्षिप्त नाम असम राइफल्स पैरा मेडिकल स्टाफ (भेशजज्ञ) समूह 'ग' योधक पद भर्ती नियम, 2016 है।
(2) ये राजपत्र में उनके प्रकाषन की तारीख को प्रवृत्त होंगे।
2. पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान.... - पद संख्या, उसका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान पद संख्या, वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन या वेतनमान वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2) से (4) में विनिर्दिश्ट हैं।
3. भर्ती की पद्धभर्ती की पद्धभर्ती की पद्धभर्ती की पद्धति, आयु-सीमा, अर्हताएं इत्यादिति, आयु-सीमा, अर्हताएं इत्यादिति, आयु-सीमा, अर्हताएं इत्यादिति, आयु-सीमा, अर्हताएं इत्यादि.... ---- उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी, जो पूर्वोक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिश्ट हैं।
4. निरर्हतानिरर्हतानिरर्हतानिरर्हता.... - - - - वह व्यक्ति -
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्र नहीं होगा :
3328 GI/2016 (803)804 THE GAZETTE OF INDIA : JULY 16, 2016/ASADHA 25, 1938 [PART II—SEC. 3(i)] परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।
5. चिकित्सक दृश्टया योग्यता चिकित्सक दृश्टया योग्यता....----इन नियमों में अंतर्विश्ट किसी बात के होते हुए भी, केवल वे व्यक्ति जो चिकित्सा प्रवर्ग ''षेप-1'' में हैं, इन चिकित्सक दृश्टया योग्यता चिकित्सक दृश्टया योग्यता नियमों के अधीन नियुक्ति के लिए पात्र हाेंगे।
स्पश्टीकरणस्पश्टीकरणस्पश्टीकरणस्पश्टीकरण -इस नियम के प्रयोजन के लिए 'षेप-1' से निम्नलिखित अभिपे्रत है -
(क) कोड अक्षर शेप (एस एच ए पी ई), जो निम्नलिखित कृत्यों का प्रतिनिधित्व करते हैं, द्वारा उपदर्षित, दिए गए कारकों के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण अर्थात् :-
एस - मनोवैज्ञानिक
एच - श्रवण शक्ति
ए - उपांग (अपैन्डेजेज)
पी - शारीरिक क्षमता
ई - दृश्टि-शक्ति
(ख) प्रत्येक कारक के अधीन, किसी अधिकारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 तक की कार्यक्षमता उपदर्षित करते हुए दर्षाई जाएगी, कोड अक्षर के पश्चात् अंक लिखे जाएंगे, सिवाय उसके, जहां कोई अधिकारी सभी कारकों में श्रेणी-1 में हैं, वहां उसका प्रवर्ग एस1 एच1 ए1 पी1 ई1 लिखने के बजाए, शेप-1 लिख कर दर्षाया जा सकेगा। इन अंकों का साधारण मूल्यांकन निम्नानुसार है :-
(1) कहीं भी सभी कर्तव्यों के लिए योग्य ।
(2) सभी कर्तव्यों के लिए योग्य, किन्तु क्या, कर्तव्यों में तीव्र कठिनाई या दोनों कानों की श्रवण शक्ति या आँखों की दृश्टि की तीक्ष्णता की मांग अंतगर््रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता के क्षेत्रों के अनुसार परिसीमाएं हो सकती है।
(3) ''एस'' कारक को छोड़कर, नेमी या निश्क्रिय कर्तव्यों के लिए योग्य, किन्तु ऊँचे स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रों या पहाड़ी भूखंडों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती है ;
(4) अस्पताल में भर्ती होने या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य।
(5) कर्तव्यों के लिए स्थायी रूप से अयोग्य।
6. षिथिल करने की शक्तिषिथिल करने की शक्तिषिथिल करने की शक्तिषिथिल करने की शक्ति....- - - - जहां केंद्रीय सरकार की यह राय है कि ऐसा करना आवष्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेष द्वारा षिथिल कर सकेगी।
7. व्यावृत्तिव्यावृत्तिव्यावृत्तिव्यावृत्ति....----इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेषों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विषेश प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।
8. अन्यदेषीयअन्यदेषीयअन्यदेषीयअन्यदेषीय की अपात्रताकी अपात्रताकी अपात्रताकी अपात्रता - कोई व्यक्ति, जो भारत का नागरिक नहीं है, लिखित में केन्द्रीय सरकार की पूर्व अनुमति के सिवाय, इन नियमों के अधीन नियुक्त नहीं किया जाएगा।
परंतु इस नियम में अंतर्दिश्ट किसी बात के होते हुए बल में नेपाल या भूटान के निवासी की नियुक्ति या नियोजन के लिए वर्जित नहीं करेगी।

(ii) न्यूनतम छातीः 80 सें.मी.(बिना फुलाए हुए) लागू नहीं होता 85 से.मी. (फुलाकर)। (iii) वजन : आयु और ऊँचाई के अनुसार : (iv) दृश्टि : सभी दृश्टि से चिकित्सक दृंश्टया योग्य होनी चाहिए (बेहतर आँख के लिए दृश्टि 6/6 और किसी प्रकार के सुधार के बिना अन्य आंँख 6/9 जिसके अंतर्गत संस्पर्ष लेंस या कार्नियल लेजर सर्जरी और चष्में के बिना भी सम्मिलित है) (v) अभ्यर्थियों को संहत जानु, चपटा पांव, फूलीं हुई नसें या भैंगी आंँखों वाला नहीं होना चाहिए और उच्च रंग दृश्यता वाला होना चाहिए। उन्हें अच्छे मानसिक और शारीरिक स्वस्थ्य का और ऐसे शारीरिक दश से मुक्त होना चाहिए जिसमें उनके कर्तव्यों के दक्षतापूर्ण पालन में बाधा आने की संभावना हो। (ड) शरीरिक दक्षता परीक्षण और लिखित परीक्षा अर्हित होना चाहिए। | लागू नहीं होता |

G.S.R. 125.—In exercise of the powers conferred by sub-section (1) read with clauses (a) and (b) of sub- section (2) of section 165 of the Assam Rifles Act, 2006 (47 of 2006), and in supersession of the Assam Rifles, Pharmacist, Group 'C' Combatised post, Recruitment Rules 2013, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the post of Warrant Officer (Pharmacist) in the Assam Rifles under the Ministry of Home Affairs, namely :-
1. Short title and commencement. – (1) These rules may be called the Assam Rifles Para-Medical Staff (Pharmacist) Group 'C' Combatised posts Recruitment Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and the pay band and grade pay or pay scale. – The number of the post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualifications etc. – The method of recruitment to the said posts, age limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the above said Schedule.
4. Disqualification. - No person-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Medical Fitness.- Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-I, shall be eligible for appointment under these rules.
Explanation. - For the purpose of this rule, "SHAPE- I" shall mean –[भाग II—खण्ड 3(i)] भारत का राजपत्र : जुलाई 16, 2016/आषाढ़ 25, 1938 807 (a) medical classification made by the Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following function, namely:-
S - Psychological;
H - Hearing;
A - Appendages;
P - Physical Capacity;
E - Eye-Sight;
(b) functional capacity of an officer under each factor shall be denoted by numeral 1 to 5 against each code letter, indicating declining functional efficiency. The numerals shall be written next to the code letter, except that where an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I instead of writing S1H1A1P1E1. General evaluation of these numerals is as under:-
(i) Fit for all duties anywhere;
(ii) Fit for all duties but may have limitations as to type of duties and areas of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears or eyes;
(iii) Excepting "S" factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 metres) extreme cold areas or hilly terrain and for long assignments;
(iv) Temporarily unfit for duties on account of hospitalisation or sick leave;
(v) Permanently unfit for duties.
6. Powers to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving. - Nothing in these rules shall affect reservations, relaxation of age limit and the other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
8. Ineligibility of aliens.- No person who is not a citizen of India shall, except with the prior permission of the Central Government in writing, be appointed under these rules:
Provided that nothing contained in this rule bar the appointment or employment of a subject of Nepal or Bhutan in the Force.

Note. - The crucial date for determining the age limit shall be the closing date for receipt of applications from candidates in India (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir State, Lahaul and Spiti District and Pangi Sub- division of Chamba District of Himachal Pradesh, the Union territory of Andaman and Nicobar Islands or the Union territory of Lakshadweep). | Essential : ( a) 10+2 or equivalent; ( b) Degree or Diploma in Pharmacy from any recognised Institution of the Central or a State Government for which the period of training in two years followed by an internship of which the practical training shall not be less than five hundred hours spread over a period of not less than three months: Provided that not less than two hundred and fifty hours are devoted to actual dispensing of prescriptions; (c) possessing the qualifications under section 31 and 32 of the Pharmacy Act, 1948 and registered under section 33 of the said Act; (d) should possess the following physical standards:- Male Female (i) minimum height - 170 cms 157 cms (ii) minimum chest - 80 cms(unexpended) Not applicable measurement - 85 cms(expanded) (iii) weight - Corresponding to height and age; (iv) should be medically fit in all respects. (Visual standard should be 6/6 to right eye and 6/12 left eye or 6/9 both eye without optical device); (v) the candidates should not have knock knees, flat foot, varicose vein or squint in eyes and they should possess high colour vision. The candidates shall be tested for colour vision by Isharhara's test as well Edrich -Green Lantern Test. They must be in good mental and bodily health and free and free from any physical defect likely to interfere with the efficient performance of the duties; and (e) should qualify the physical efficiency and written tests. |

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

4. निरर्हतानिरर्हतानिरर्हतानिरर्हता – वह Lयक्ति –
(क) जिसने ऐसे Lयक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है या विवाह की संविदा की है
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते #ए किसी Lयक्ति से विवाह किया है, या िववाह की संविदा की है
उक्त पद पर नियुक्ति का पात्र नहO होगा :

6. .या.या.या.यावृत्तिवृत्तिवृत्तिवृत्ति – इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहO डालेगी, जिनका के न्Qीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वगT भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के Lयक्तियों के लिए
उपबंध करना अपेक्षित है ।

G.S.R. 126.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Animal Nutritionist in the Ministry of Agriculture and Farmers Welfare, Department of Animal Husbandry, Dairying and Fisheries, namely:-
1. Short Title and commencement.- (1) These rules may be called the Ministry of Agriculture and Farmers Welfare, Department of Animal Husbandry, Dairying and Fisheries, Animal Nutritionist (Group 'A' post) Recruitment Rules, 2016.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, and the pay band and grade pay or pay scale. – The number of the post, its classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications, etc. - The method of recruitment to the said post, age- limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.- No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of these provisions of these rules with respect to any class or category of persons.
6. Saving. - Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ;
उक्त पदों पर नियुक्ति का पात्र नहीं होगा : परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार है तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी।

G.S.R. 127.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Government Health Scheme Delhi (Group 'C') Homeopathic, Recruitment Rules, 1978 and the Central Government Health Scheme (Store Keeper-cum-clerk (Homoeo./Pharmacist (Homoeo.) Organisation outside Delhi) Recruitment Rules, 1986 in so far as they relate to the post of Pharmacist-cum-clerk (Homeopathic), except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Pharmacist-cum-clerk (Homoeopathic) in the Central Government Health Scheme, Ministry of Health and Family Welfare, namely:—
1. Short title and commencement.–(1) These rules may be called the Ministry of Health and Family Welfare, Central Government Health Scheme Organisation, Pharmacist-cum-clerk (Homoeopathic) Recruitment Rules, 2016.
(2) They shall come into force on the date of publication in the Official Gazette.
2. Number of post, classification, pay band and grade pay or pay scale. – The number of the said post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Disqualification. - No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.-Nothing in these rules shall affect reservation, relaxation of age limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 3:The Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years. The maximum age-limit for appointment on deputation shall be not exceeding 56 years as on the closing date of receipt of applications. Note 4: For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006, the date from which the revised pay structure based on 6th Central Pay Commission recom- mendation has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre- revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any up-gradation. |
