4. अनह(cid:6981)ता .–र् ह (cid:7390)न(cid:7334) –
(क) नसिने ऐसे (cid:7390)न(cid:7334) से नसिका पनत या नसिक(cid:7409) प(cid:7360)ी ीिर्नत है, र्र्नाह (cid:7408)कया है; या
(ख) नसिने अपने पनत या अपनी प(cid:7360)ी के ीिर्नत रहते (cid:7263)ए (cid:7408)कसी अ(cid:7008)य (cid:7390)न(cid:7334) से र्र्नाह कर नलया है,
उ(cid:7334) पद पर ननयुन(cid:7334) का पा(cid:7074) नह(cid:7277) होगा :

5. ननल करने क(cid:7409) न(cid:7334) .– हिां के (cid:7008)(cid:7076)ीय सरकार क(cid:7409) राय होगी (cid:7408)क ऐसा करना र्आ(cid:7019)यक या समीचीन है तो र्ह इसके कारण(cid:7298) को लेखब(cid:7373) करते (cid:7263)ए संघ लोक र्सेा आयोग के पराम(cid:6981) से इन ननयम(cid:7298) के (cid:7408)कसी भी उपबंध को (cid:7408)कसी भी (cid:7088)ेणी यार् ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) के नलए आदे (cid:7367)ारा ननल कर सके गी।
6. (cid:7390र्)ाृन(cid:7275) .– इन ननयम(cid:7298) क(cid:7409) कोई बात आर(cid:6979)ण, आयु-सीमा म(cid:7286) छू ट और ऐसी अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डाल पाएगी ननिका उपबंध के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ननकाले गए आदे के अनुसार अनुसूनचत ािनत, अनुसूनचत निािनत, अ(cid:7008)य नपछार् ग(cid:6981), भूतर्पू(cid:6981) सैननक र्एं अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) के नलए (cid:7408)कया ािना अपेन(cid:6979)त है।

| पहले धारत कसी अय काडर बा पद पर नतननयुन क र्अनध है साधारणतया तीन र्ष से अनधक नह होगी। नतननयुन (लघु र्अनध क स ंर्नदा सनहत) पर ननयुन के नलए अनधकतम आयु-सीमा र्आेदन ा करने क अंनतम नतन को 56 र्ष से अनधक नह होगी। टपणः नतननयुन के आधार पर ननयुन के उेय स , कसी अनधकारी ारा 01 र्निरी, 2006 या उस नतन नसि दन स े छर्ठ र् ेतन आयोग क नसार पर आधारत स ंोनधत र् ेतनमान दान कया गया, से पहले क गई ननयनमत र्सेा को छर्ठर् ेतन आयोग क नसार के आधार पर दान कए गए ेडर्-े र्एंर् ेतनमान म क गई र्सेा समझा ािएगा। परंतु यह उस ननत को छोकर होगा हिँ एक से अनधक र्पू स ंोनधत र्ेतनमान को एक ेड म एक सामाय ेडर्-े र्एं र्ेतनमान के सा आमेनलत कर दया गया हो। यह ायदा क े र्ल उन पद के नलए दया ािएगा ननिके नलए ेडर्-े या र्ेतनमान नबना कसी कार के उयन के साधारण नतापन ेड है। |

S.R.O. 38.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supercession of the Ministry of Defence, Ordnance and Ordnance Equipment Factories Group 'B' and Group 'C' posts, Rajbhasha Cadre, Recruitment Rules, 2009, in so far as they relates to the post of Hindi Officer, except as respect things done or omitted to be done before such suppression, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director ( Official Language) in Ordnance and Ordnance Equipment Factories and its Head Quarter formations namely :-
1. Short title and commencement - (1) These Rules may be called the "Ministry of Defence, Ordnance and Ordnance Equipment Factories, (Group 'A' Post), Rajbhasha Cadre, Recruitment Rules, 2016."
(2) They shall come into force on the date of their publication in the Official Gazette.

Number of posts, classification, pay band and Grade Pay or Pay Scale - The number of post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualification etc. - The method of recruitment, age- limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualifications. – No person:
(a) Who, has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule shall be eligible for appointment to any of the said post:
5. Power to relax: - Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.:- Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward classes, Ex-Servicemen, and other special categories of persons in accordance with the order issued by the Central Government from time to time in this regard.

N ote 2: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the Sixth Central Pay Commission recomm- endations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission. | ( iii) With three years' service in the grade rendered after appointment thereto on a regular basis in posts in pay band- 2, Rs.9300 - Rs.34800/- plus Grade pay of Rs.4600/- or equivalent in the parent Cadre or Department; and (B) possessing the following educational qualifications and experience : E ssential: Master's degree of a recognized University in Hindi with English as a compulsory or elective subject or as the medium of examination at the degree level; OR Master's degree of a recognized University in English with Hindi as a compulsory or elective subject or as the medium of examination at the degree level; OR Master's degree of a recognized University in any subject other than Hindi or English, with Hindi medium and English as a compulsory or elective subject or as the medium of examination at the degree level; OR Master's degree of a recognized University in any subject other than Hindi or English, with English medium and Hindi as a compulsory or elective subject or as a medium of a examination at the degree level; OR Master's degree of a recognized University in any subject other than Hindi or English, with Hindi and English as compulsory or elective subjects or either of the two as a medium of examination and the other as a compulsory or elective subject at the degree level. (II) Three years' experience of using or applying terminology (terminological work) in Hindi and translation work from English to Hindi or vice-versa, preferably of technical or scientific literature under Central or State Governments or Autonomous Body or Statutory Organizations or Public Sector Under- takings or Universities or recognized research or educational institutions. OR Three years' experience of teaching in Hindi and English or research in Hindi or English under Central or State Governments or Autonomous Body or Statutory Organizations or Public Sector Undertakings or Universities or recognized research or educational institutions. | |||
| Desirable: Studied one of the languages other than Hindi included in the Eight schedule of the Constitution at 10th level from a recognized Board. T he Departmental Officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on Deputation or absorption. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. ( Period of deputation (Including Short Term Contract) including period of deputation (Including Short Term Contract) in another ex-cadre post held immediately preceding this appointment in the same or some other Organisation or Department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation (including Short Term Contract) shall not be exceeding fifty six years as on the closing date of receipt of applications). N ote : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006 or the date from which the revised pay structure based on the sixth Central Pay Commission recommend- dations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale, and where this benefit will extend only for the post(s) for which that grade pay or pay scale is the normal replacement grade without any upgradation. |
