1. संन(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ : (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नाम (cid:7021र्)ा(cid:7021)(cid:7005)य और प(cid:7407)र्रार क(cid:7016)याण मं(cid:7074)ालय, (cid:7079)योगाला तकनीनयन ((cid:7019र्)सन) और (cid:7019र्)सन (cid:7079)योगाला सहायक, समूह 'ग' भत(cid:7278) ननयम, 2016 है ।

(2) ये रापि(cid:7074) म(cid:7286) (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7275) ह(cid:7298)गे ।

2. लागू होना :- ये ननयम, इन ननयम(cid:7298) से उपाब(cid:7373) अनुसूची के (cid:7021)तंभ (1) म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट पद(cid:7298) को लागू ह(cid:7298)गे ।

5. ननरह(cid:6981)ता :र् ह (cid:7390)न(cid:7334)-

(क) नसिने ऐसे (cid:7390)न(cid:7334) से नसिका पनत या नसिक(cid:7409) प(cid:7360)ी ीिर्नत है, र्र्नाह (cid:7408)कया है,; या

(ख) नसिने अपने पनत या अपनी प(cid:7360)ी के ीिर्नत रहते (cid:7263)ए (cid:7408)कसी (cid:7390)न(cid:7334) से र्र्नाह (cid:7408)कया है,

6. ननल करने क(cid:7409) न(cid:7334) : हिां के (cid:7008)(cid:7076)ीय सरकार क(cid:7409) यह राय है (cid:7408)क ऐसा करना र्आ(cid:7019)यक या समीचीन है,र् हांर् ह उसके नलए ोि कारण ह(cid:7289), उ(cid:7008)ह(cid:7286) लेखब(cid:7373) करके , इन ननयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसीर् ग(cid:6981) या (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) बाबत, आदे (cid:7367)ारा ननल कर सके गी ।

7. (cid:7390र्)ाृन(cid:7275) : इन ननयम(cid:7298) क(cid:7409) कोई बात, ऐसे आर(cid:6979)ण, आयु-सीमा म(cid:7286) छू ट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डालेगी, ननिका के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय–समय पर ािरी (cid:7408)कए गए आदे(cid:7298) के अनुसार अनुसूनचत ािनतय(cid:7298), अनुसूनचत निािनतय(cid:7298), भूतर्पू(cid:6981) सैननक(cid:7298) और अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) के नलए उपबंध करना अपेन(cid:6979)त है ।

New Delhi, the 20th September, 2016

G.S.R. 183.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Safdarjang Hospital, Group 'C' posts of Laboratory Technician and Respiratory Laboratory Assistant Recruitment Rules, 1993, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Central Group 'C' Technician posts in the Ministry of Health and Family Welfare, namely:-

1. Short title and commencement. – (1) These rules may be called the Ministry of Health and Family Welfare Laboratory Technician (Respiratory) and Respiratory Laboratory Assistant, Group 'C' Posts, Recruitment Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale. – The number of posts, their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the aforesaid Schedule.

4. Method of recruitment, age-limit, qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating to the said post, shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification. – No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संन(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ : (1) इन ननयम(cid:7298) का संन(cid:6979)(cid:7385) नाम भारतीय सूचना र्सेा (समूह 'ख' पद) भत(cid:7278) ननयम, 2016 है ।

(2) ये रापि(cid:7074) म(cid:7286) उनके (cid:7079)कान क(cid:7409) तारीख को (cid:7079र्)ृ(cid:7275) ह(cid:7298)गे ।

2. प(cid:7407)रभाषाएं- इन ननयम(cid:7298) म(cid:7286), बि तक (cid:7408)क संदभ(cid:6981) से अ(cid:7008)या अपेन(cid:6979)त न हो,-

(क) "आयोग" से संघ लोक र्सेा आयोग अनभ(cid:7079)ेत है;

(ख) "ननयं(cid:7074)क (cid:7079)ानधकारी" से के (cid:7008)(cid:7076)ीय सरकार का सूचना और (cid:7079)सारण मं(cid:7074)ालय अनभ(cid:7079)ेत है;

(ग) "र्नभागीय अ(cid:7012)य(cid:7278)" से ऐसे अनधकारी अनभ(cid:7079)ेत ह(cid:7289) न(िcid:7008)ह(cid:7286) आयोग के पराम(cid:6981) से या कम(cid:6981)चारी चयन आयोग के मा(cid:7007)यम से र्नभागीय (cid:7079)ो(cid:7008)ननत सनमनत को नसा(cid:7407)र पर ननयनमत आधार पर ननयु(cid:6989)त (cid:7408)कया गया है और ोि इन ननयम(cid:7298) के (cid:7079)ारंभ पर समूह 'ख' कत(cid:6981)(cid:7018)य पद धारण करते ह(cid:7289) या समूह 'ख' कत(cid:6981)(cid:7018)य पद पर धारणानधकार रखते ह(cid:7289);

(घ) "र्नभागीय पुन(cid:7020)ट सनमनत" से ऐसी सनमनत अनभ(cid:7079)ेत है नसिका गठन अनुसूची-3 म(cid:7286) या र्ननन(cid:7416)द(cid:7020)ट र्सेा क(cid:7409) (cid:7408)कसी भी (cid:7088)ेणी म(cid:7286) पुन(cid:7020)ट पर र्नचार करने के नलए (cid:7408)कया गया है ;

(ड.) "र्नभागीय (cid:7079)ो(cid:7008)ननत सनमनत" से ऐसी सनमनत अनभ(cid:7079)ेत है नसिका गठन अनुसूची-3 म(cid:7286) या र्ननन(cid:7416)द(cid:7020)ट र्सेा क(cid:7409) (cid:7408)कसी भी (cid:7088)ेणी म(cid:7286) (cid:7079)ो(cid:7008)ननत पर र्नचार करने के नलए (cid:7408)कया गया है ;

(च) "कत(cid:6981)(cid:7018)य पद" से अनुसूची-1 म(cid:7286) सन(cid:7013)मनलत कोई पद, चाहेर् ह (cid:7021)ायी हो या अ(cid:7021)ायी, अनभ(cid:7079)ेत है;

(छ) "सरकार" से के (cid:7008)(cid:7076)ीय सरकार अनभ(cid:7079)ेत है;

()ि "(cid:7088)ेणी" से र्सेा क(cid:7409) कोई (cid:7088)ेणी अनभ(cid:7079)ेत है;

(झ) "अ(cid:7008)य नपछार् ग(cid:6981)" म(cid:7286) ऐसी ािनत और समुदाय समार्न(cid:7020)ट ह(cid:7298)गे ोि के (cid:7008)(cid:7076)ीय सरकार (cid:7367)ारा समय समय पर अनधसूनचत (cid:7408)कए ािए ;

(i) र्सेा के आरंनभक गठन के समय नसिे या न(िcid:7008)ह(cid:7286) (cid:6996)ये(cid:7020)ठता के (cid:7079)योनि के नलए ननयु(cid:6989)त (cid:7018)यन(cid:6989)तय(cid:7298) क(cid:7409) दा म(cid:7286) गणना म(cid:7286) नलया गया है;

(ii) ननिके /नसिके दौरान (cid:7408)कसी अनधकारी ने उस (cid:7088)ेणी म(cid:7286) कत(cid:6981)(cid:7018)य पद धारण (cid:7408)कया होता य(cid:7408)दर् ह छु (cid:7349)ी पर न होता यार् ह ऐसा पद धारण करने के नलए (cid:7408)कसी एक या अ(cid:7008)य कारण से उपल(cid:7011)ध नह(cid:7277) ा;

(ट) "अनुसूची" से इन ननयम(cid:7298) उपाब(cid:7373) अनुसूची अनभ(cid:7079)ेत है;

(ठ) "अनुसूनचत ािनत और अनुसूनचत निािनत" कार् ही अ(cid:6981) ह(cid:7298)गे ोि उनका संर्नधान के अनु(cid:6994)छेद 366 के खंड (24) और खंड (25) म(cid:7286) है;

(ड) "र्सेा" से ननयम 3 के अधीन ग(cid:7407)ठत भारतीय सूचना र्सेा (समूह 'ख') अनभ(cid:7079)ेत है;

3. भारतीय सूचना र्सेा (समूह 'ख') का गठन- (1) भारतीय सूचना र्सेा (समूह 'ख') के नाम से (cid:6980)ात एक र्सेा होगी नसिम(cid:7286) ननयम 6 और ननयम 7 के अधीन र्सेा म(cid:7286) ननयु(cid:6989)त (cid:7408)कए गए (cid:7018)यन(cid:6989)त ह(cid:7298)गे ।

(2) र्सेा म(cid:7286) (cid:6996)ये(cid:7020)ठ (cid:7088)ेणी पद (समूह 'ख', रापिन(cid:7074)त, अननुसनर्चीय) और कनन(cid:7020)ठ (cid:7088)ेणी पद (समूह 'ख' रापिन(cid:7074)त, अननुसनर्चीय) सन(cid:7013)मनलत ह(cid:7298)गे ।

4. (cid:7088)ेनणयां, (cid:7079)ानधकृ त सं(cid:6990)या और उनका पुन(cid:7414र्)लोकन- (1) अनुसूची-1 म(cid:7286) या र्ननन(cid:7416)द(cid:7397) इन ननयम(cid:7298) के (cid:7079)ारंभ क(cid:7409) तारीख को मं(cid:7074)ालय या र्नभाग या काया(cid:6981)लय क(cid:7409) र्सेा क(cid:7409) र्ननभ(cid:7382) (cid:7088)ेनणय(cid:7298), उनके पदानभधान(cid:7298), सं(cid:6990)या, र्ेतन ब(cid:7289)ड और (cid:7061)ेड र्ेतन म(cid:7286) सन(cid:7013)मनलत कत(cid:6981)(cid:7390) पद आबं(cid:7407)टत ह(cid:7298)गे और अनुसूची-1 म(cid:7286) या उन(cid:7016)लनखत र्नन(cid:7397) (cid:7088)ेणी म(cid:7286) सन(cid:7013)मनलत कत(cid:6981)(cid:7390) पद एक दूसरे के सा अंतर प(cid:7407)र्रत(cid:6981)नीय ह(cid:7298)गे ।

(2) इन ननयम(cid:7298) के (cid:7079)ारंभ होने के प(cid:7391)ात्, र्ननभ(cid:7382) (cid:7088)ेनणय(cid:7298) म(cid:7286) कत(cid:6981)(cid:7390) पद(cid:7298) क(cid:7409) (cid:7079)ानधकृ त (cid:7021)ायी सं(cid:6990)यार् ह होगी ोि सरकार (cid:7367)ारा समय- समय पर र्अधा(cid:7407)रत क(cid:7409) ािए ।

(3) सरकार समय-समय पर र्ननभ(cid:7382) (cid:7088)ेनणय(cid:7298) के कत(cid:6981)(cid:7390) पद(cid:7298) क(cid:7409) सं(cid:6990)या म(cid:7286) अ(cid:7021)ायी प(cid:7407)र्रध(cid:6981)न कर सकती है या उ(cid:7008)ह(cid:7286) घटा सकती है ैिसा (cid:7408)कर् ह समय-समय पर र्आ(cid:7019)यक समझे ।

(4) सरकार, स(cid:7013)यक् (cid:7272)प से ग(cid:7407)ठत (cid:7408)कसी काडर पुन(cid:7414र्)लोकन सनमनत क(cid:7409) नसा(cid:7407)र(cid:7298) पर और, यान(cid:7021)नत, आयोग या कम(cid:6981)चारी आयोग के पराम(cid:6981) से र्सेा म(cid:7286) (अनुसूची-1 म(cid:7286) सन(cid:7013)मनलत र्सेा से नभ(cid:7382)) के र्ल ऐसे प(cid:7074)का(cid:7407)रता या (cid:7079)चार या निसंपक(cid:6981) पद सन(cid:7013)मनलत कर सके गी ोि (cid:7079)ान(cid:7021)नत, (cid:7088)ेणी,र् ेतनमान औरर् ृन(cid:7275)क अंर्त(cid:6981)(cid:7021)तु म(cid:7286) र्सेा समतु(cid:7016)य पद(cid:7298) को र्अा उ(cid:6989)त अनुसूची म(cid:7286) सन(cid:7013)मनलत (cid:7408)कसी पद को र्सेा से अर्प(cid:7414)ति कर सकती है ।

(5) उप ननयम (4) म(cid:7286) नन(cid:7416)द(cid:7397) काडर पुन(cid:7414र्)लोकन सनमनत म(cid:7286) नन(cid:7013)ननलनखत सन(cid:7013)मनलत ह(cid:7298)गे, अा(cid:6981)त्:-

(6) सरकार, आयोग या कम(cid:6981)चारी चयन आयोग के पराम(cid:6981) से ऐसे अनधकारी क(cid:7409) नसिका पद इस ननयम के उपननयम (4) के अधीन र्सेा म(cid:7286) सन(cid:7013)मनलत है, र्सेा क(cid:7409) समुनचत (cid:7088)ेणी म(cid:7286) उनचत समझे, अ(cid:7021)ायी या मूल हैनसयत से, ननयुन(cid:6989)त कर सके गी और उसक(cid:7409) (cid:6996)ये(cid:7020)ठता समय-समय पर इस र्नषय पर सरकार (cid:7367)ारा ािरी साधारण अनुदे(cid:7298) के अनुसार ननयत क(cid:7409) ािएगी ।

5. र्सेा के सद(cid:7021)य- (1) नन(cid:7013)ननलनखत (cid:7018)यन(cid:6989)त र्सेा के सद(cid:7021)य ह(cid:7298)गे:-

(क) ननयम 6 के अधीन कत(cid:6981)(cid:7018)य पद(cid:7298) पर ननयु(cid:6989)त (cid:7018)यन(cid:6989)त; और (ख) ननयम 7 के अधीन कत(cid:6981)(cid:7018)य पद(cid:7298) पर ननयु(cid:6989)त (cid:7018)यन(cid:6989)त ।

(2) उपननयम (1) के खंड (क) के अधीन ननयु(cid:6989)त कोई (cid:7018)यन(cid:6989)त ऐसी ननयुन(cid:6989)त पर अनुसूची 1 म(cid:7286) उसे लागू समुनचत (cid:7088)ेणी म(cid:7286) र्सेा का सद(cid:7021)य समझा ािएगा ।

6. र्सेा का (cid:7079)ारंनभक गठन- (1) र्सेा, इन ननयम(cid:7298) के (cid:7079र्)ृ(cid:7004)त होने क(cid:7409) तारीख को, ऐसे अनधकारी सन(cid:7013)मनलत ह(cid:7298)गे ोि अनुसूची 1 म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट भारतीय सूचना र्सेा समूह 'ख' के र्ननभ(cid:7008)न (cid:7088)ेणी के पद(cid:7298) पर ननयनमत (cid:7272)प से पहले से ननयु(cid:6989)त ह(cid:7289) ।

(2) इन ननयम(cid:7298) के (cid:7079र्)ृ(cid:7004)त होने से पहले उपननयम (1) म(cid:7286) नन(cid:7416)द(cid:7020)ट (cid:7408)कसी (cid:7018)यन(cid:6989)त क(cid:7409) ननयनमत ननरंतर र्सेा क(cid:7409) र्अनध, प(cid:7407)र्री(cid:6979)ा, (cid:7079)ो(cid:7008)ननत के नलए अह(cid:6981)क र्सेा, पुन(cid:7020)ट, (cid:6996)ये(cid:7020)ठता और प(cid:7286)न के (cid:7079)योनि के नलए गणना म(cid:7286) ली ािएगी ।

(3) उस सीमा तक हिां तक ननयं(cid:7074)क (cid:7079)ानधकारी ननयम 7 के उपबंध(cid:7298) के अनुसार र्सेा क(cid:7409) र्ननभ(cid:7008)न (cid:7088)ेनणय(cid:7298) म(cid:7286) (cid:7407)रन(cid:6989)तय(cid:7298) क(cid:7409) (cid:7079)ानधकृ त ननयनमत सं(cid:6990)या को भरने म(cid:7286) असम(cid:6981) हो तो ऐसी (cid:7407)रन(cid:6989)तयां ननयम 7 के उपबंध(cid:7298) के अनुसार भरी ािएंगी ।

7. र्सेा का भर्न(cid:7020)य म(cid:7286) बनाए रखा ािना-(1) इन ननयम(cid:7298) के (cid:7079)ारंभ होने के प(cid:7019)चात् अनुसूची-1 म(cid:7286) नन(cid:7416)द(cid:7020)ट (cid:7408)कसी म(cid:7286) (cid:7088)ेणी म(cid:7286) उ(cid:7006)भूत होने र्ाली (cid:7407)रन(cid:6989)त को इस ननयम के अधीन इसके प(cid:7019)चात् उपबंनधत रीनत से भरा ािएगी ।

(2) (cid:6996)ये(cid:7020)ठ (cid:7088)ेणी (रापिन(cid:7074)त) और कनन(cid:7020)ठ (cid:7088)ेणी (अरापिन(cid:7074)त) म(cid:7286) पद(cid:7298) से र्सेा म(cid:7286) ननयुन(cid:6989)तयां अनुसूची-2 म(cid:7286) यार्ननन(cid:7416)द(cid:7020)ट (cid:7272)प म(cid:7286) क(cid:7409) ािएंगी ।

(3) अनुसूची-2 म(cid:7286) यार्ननन(cid:7416)द(cid:7020)ट (cid:7408)कसी (cid:7088)ेणी म(cid:7286) (cid:7079)ो(cid:7382)नत या पुन(cid:7397) र्अा उस (cid:7088)ेणी म(cid:7286) पुन(cid:7020)ट अनुसूची-3 म(cid:7286) र्ननहत (र्नभागीय (cid:7079)ो(cid:7008)ननत सनमनत या र्नभागीय पुन(cid:7397) सनमनत) क(cid:7409) नसा(cid:7407)र(cid:7298) के आधार पर क(cid:7409) ािएगी ।

(4) अनुसूची-2 म(cid:7286) र्ननन(cid:7416)द(cid:7020)ट सीधी भत(cid:7278) (cid:7367)ारा ननयुन(cid:6989)त अनुसूची-4 म(cid:7286) यार्ननहत रीनत के अनुसार होगी ।

8. प(cid:7407)र्री(cid:6979)ा- (1) (cid:6996)ये(cid:7020)ठ (cid:7088)ेणी भारतीय सूचना र्सेा समूह 'ख' म(cid:7286) या कनन(cid:7020)ठ (cid:7088)ेणी भारतीय सूचना र्सेा समूह 'ख' म(cid:7286) सीधी भत(cid:7278) (cid:7367)ारा र्सेा म(cid:7286) ननयुन(cid:6989)त (cid:7079)(cid:7004)येक (cid:7018)यन(cid:6989)त क(cid:7409) प(cid:7407)र्री(cid:6979)ा र्अनध दोर् ष(cid:6981) क(cid:7409) र्अनध होगी :

परंतु ननयं(cid:7074)क अनधकारी, समय समय पर सरकार (cid:7367)ारा ािरी (cid:7408)कए गए अनुदे(cid:7298) या आदे(cid:7298) के अनुसार प(cid:7407)र्री(cid:6979)ा क(cid:7409) र्अनध को र्न(cid:7021)तार कर सके गा :

परंतु यह और (cid:7408)क प(cid:7407)र्री(cid:6979)ा र्अनध के र्न(cid:7021)तार (cid:7408)कए ािने का कोई र्ननन(cid:7019)चय र्पू(cid:6981र्)त(cid:7278) प(cid:7407)र्री(cid:6979)ा र्अनध क(cid:7409) समान(cid:7009)त के प(cid:7019)चात् साधारणतया आठ स(cid:7009)ताह के भीतर (cid:7408)कया ािएगा और स(cid:7013)ब(cid:7373) अनधकारी को नलनखत (cid:7272)प म(cid:7286) ऐसा करने के नलए कारण(cid:7298) सनहत और र्अनध के भीतर संसूनचत (cid:7408)कया ािएगा ।

(2) प(cid:7407)र्री(cid:6979)ा र्अनध या उसक(cid:7409) र्न(cid:7021)तार क(cid:7409) गई र्अनध के पूरा हो ािने पर, अनधका(cid:7407)रय(cid:7298) को, य(cid:7408)द (cid:7021)ायी ननयुन(cid:6989)त के नलए उपयु(cid:6989)त समझा ािए तो उ(cid:7008)ह(cid:7286) ननयनमत आधार पर उनक(cid:7409) (cid:7407)रन(cid:6989)तय(cid:7298) म(cid:7286) (cid:7079)नतधा(cid:7407)रत (cid:7408)कया ािएगा और यान(cid:7021)नत, उ(cid:7008)ह(cid:7286) स(cid:7013)यक् अनु(cid:7059)म म(cid:7286) उपल(cid:7011)ध होनेर् ाली मूल (cid:7407)रन(cid:6989)तय(cid:7298) के र्न(cid:7271)(cid:7373) पु(cid:7020)ट (cid:7408)कया ािएगा ।

(3) य(cid:7408)द, यास्ननत, प(cid:7407)र्री(cid:6979)ा क(cid:7409) र्अनध या उसके (cid:7408)कसी र्न(cid:7021)तार के दौरान, सरकार क(cid:7409) यह राय है (cid:7408)क कोई अनधकारी (cid:7021)ायी ननयुन(cid:6989)त के नलए उपयु(cid:6989)त नह(cid:7277) है तो सरकार, कारण(cid:7298) को लेखब(cid:7373) करते (cid:7263)ए ऐसे अनधकारी को, यान(cid:7021)नत, र्सेो(cid:7008)मु(cid:6989)त कर सके गी या र्सेा म(cid:7286) उसक(cid:7409) ननयुन(cid:6989)त के र्पू(cid:6981) उसके (cid:7367)ारा धा(cid:7407)रत पद पर उसे (cid:7079)नर्त(cid:7414)तत कर सके गी ।

(4) प(cid:7407)र्री(cid:6979)ा क(cid:7409) र्अनध या उसके (cid:7408)कसी र्न(cid:7021)तार के दौरान सरकार (cid:7408)कसी अ(cid:7012)य(cid:7278) से ऐसे (cid:7079)न(cid:6979)ण और अनुदे पा(cid:7353)(cid:7059)म(cid:7298) को पूरा करने और परी(cid:6979)ा(cid:7312) ता परी(cid:6979)ण(cid:7298) म(cid:7286) उ(cid:7004)तीण(cid:6981) होने के नलए (नसिके अंतग(cid:6981)त (cid:7410)हदी परी(cid:6979)ा भी है) न(िcid:7008)ह(cid:7286) सरकार प(cid:7407)र्री(cid:6979)ा के समाधान(cid:7079)द (cid:7272)प म(cid:7286) पूरी करने क(cid:7409) त(cid:6981) के (cid:7272)प म(cid:7286) उनचत समझती है ।

(5) हिां तक पर्रीी(cid:6979)ा से संबंनधत अ(cid:7008)य र्नषय का संबंध है र्सेा के सद(cid:7021)य सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ािरी (cid:7408)कए गए अनुदे(cid:7298) या आदे(cid:7298) (cid:7367)ारा ानसत ह(cid:7298)गे ।

9. (cid:6996)ये(cid:7020)ठता : (1) र्सेा के सद(cid:7021)य(cid:7298) क(cid:7409) सापे(cid:6979) (cid:6996)ये(cid:7020)ठता उनक(cid:7409) उस सापे(cid:6979) (cid:6996)ये(cid:7020)ठता (cid:7367)ारा ानसत होगी । परंतु य(cid:7408)द ऐसे (cid:7408)कसी सद(cid:7021)य क(cid:7409) (cid:6996)ये(cid:7020)ठता क(cid:7409) तारीख को र्ननन(cid:7416)द(cid:7020)ट (cid:7272)प से र्अधा(cid:7407)रत नह(cid:7277) क(cid:7409) गई है तो उसका र्अधारण सरकार के अधीन समान र्सेा(cid:7312) के सद(cid:7021)य(cid:7298) को लागू ननयम(cid:7298) के अनुसार सरकार के का(cid:7414)मक और (cid:7079)न(cid:6979)ण र्नभाग (cid:7367)ारा (cid:7408)कया ािएगा।

(2) आरंनभक गठन के प(cid:7019)चात् र्सेा म(cid:7286) भत(cid:7278) (cid:7408)कए गए (cid:7018)यन(cid:6989)तय(cid:7298) क(cid:7409) (cid:6996)ये(cid:7020)ठता समय समय पर सरकार (cid:7367)ारा इस र्नषय म(cid:7286) ािरी (cid:7408)कए गए साधारण अनुदे(cid:7298) या आदे(cid:7298) के अनुसार ननयं(cid:7074)ण (cid:7079)ानधकारी (cid:7367)ारा र्अधा(cid:7407)रत क(cid:7409) ािएगी ।

(3) ननयम 4 के उपननयम (4) के उपबंध(cid:7298) के अनुसरण म(cid:7286) र्सेा म(cid:7286) ननयुन(cid:7334) अनधका(cid:7407)रय(cid:7298) क(cid:7409) (cid:6996)ये(cid:7399)ता, समय-समय पर सरकार (cid:7367)ारा ािरी साधारण अनुदे(cid:7298) के अनुसरण म(cid:7286) ननयत होगी ।

(4) य(cid:7408)द उपननयम (1) से (3) के अधीन नह(cid:7277) आनेर् ाले अनधका(cid:7407)रय(cid:7298) का र्अधारण आयोग के पराम(cid:6981) से सरकार (cid:7367)ारा (cid:7408)कया ािएगा ।

10. (cid:7390र्)ाृन(cid:7275) : इन ननयम(cid:7298) क(cid:7409) कोई बात, ऐसे आर(cid:6979)ण, आयु-सीमा म(cid:7286) छू ट और अ(cid:7008)य (cid:7407)रयायत(cid:7298) पर (cid:7079)र्भा नह(cid:7277) डालेगी, ननिका के (cid:7076)ीय सरकार (cid:7367)ारा इस संबंध म(cid:7286) समय-समय पर ािरी (cid:7408)कए गए आदे(cid:7298) के अनुसार अनुसूनचत ािनतय(cid:7298), अनुसूनचत निािनतय(cid:7298), भूतर्पू(cid:6981) सैननक(cid:7298), और अ(cid:7008)य र्नेष (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) के नलए उपबंध करना अपेन(cid:6979)त है ।

11. ननल करने क(cid:7409) न(cid:7334) : हिां के (cid:7076)ीय सरकार क(cid:7409) यह राय ह(cid:7289) (cid:7408)क ऐसा करना र्आ(cid:7019)यक या समीचीन है,र् हांर् ह उसके नलए ोि कारण ह(cid:7289) उ(cid:7008)ह(cid:7286) लेखब(cid:7373) करके ता संघ लोक र्सेा आयोग से पराम(cid:6981) करके , इन ननयम(cid:7298) के (cid:7408)कसी उपबंध को (cid:7408)कसीर् ग(cid:6981) या (cid:7079र्)ग(cid:6981) के (cid:7390)न(cid:7334)य(cid:7298) क(cid:7409) बाबत, आदे (cid:7367)ारा ननल कर सके गी ।

12. नर्न(cid:6981)चन: य(cid:7408)द इन ननयम(cid:7298) के नर्न(cid:6981)चन के संबंध म(cid:7286) कोई (cid:7079)(cid:7019)न उ(cid:7004)प(cid:7382) होता है तो सरकार उसका र्ननन(cid:7019)चय करेगी ।

13. र्सेा म(cid:7286) ननयुन(cid:6989)त:- र्सेा म(cid:7286) सभी ननयुन(cid:6989)तयां काडर ननयं(cid:7074)क (cid:7079)ानधकारी (cid:7367)ारा क(cid:7409) ािएंगी ।

14. भारत के (cid:7408)कसी भी भाग म(cid:7286) र्सेा करने का दानय(cid:7004र्) और र्सेा क(cid:7409) अ(cid:7008)य त(cid:7288):- र्सेा म(cid:7286) ननयु(cid:6989)त अनधकारी का भारत म(cid:7286) या (cid:7408)कसी भी (cid:7021)ान पर बाहर र्सेा करने के दानय(cid:7004र्) होगा ।

         G.S.R.   184.—  In  exercise  of  the  powers  conferred  by  the  proviso  to  article  309  of  the  Constitution  and  in
supersession of the Indian Information Service (Group 'B' posts) Rules, 1989, except as respects things done or omitted
to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment
for Indian Information Service Group 'B' posts in the Ministry of Information and Broadcasting, namely :-
1.       Short  title  and  commencement.-  (1)  These  rules  may  be  called  the  Indian  Information  Service  (Group  `B'
         posts) Rules, 2016.
         (2)     They shall come into force from the date of their publication in the Official Gazette.
2.       Definitions.- In these rules, unless the context otherwise requires,-
         (a)     "Commission" means the Union Public Service Commission;
         (b)     "Controlling  Authority"  means  the  Central  Government  in  the  Ministry  of  Information  and
                 Broadcasting;
         (c)     "Departmental Candidates" means officers who have been appointed on regular basis in consultation
                 with  the  Commission  or  through  the  Staff  Selection  Commission  or  on  the  recommendations  of  a
                 Departmental Promotion Committee and who hold Group `B' duty posts or hold a lien on a Group `B'
                 duty post at the commencement of these rules;
         (d)     "Departmental Confirmation Committee" means a Committee constituted to consider confirmation
                 in any grade of service as specified in Schedule-III;
         (e)     "Departmental Promotion Committee" means a Committee constituted to consider promotion in any
                 grade of service as specified in Schedule-III;
         (f)     "Duty Post" means any post, whether permanent or temporary, included in Schedule-I;
         (g)     "Government" means the Central Government;
         (h)     "Grade" means a grade of the Service;
         (i)     "Other Backward Class" shall comprise the castes and communities as may be notified by the Central
                 Government from time to time;

(j) "regular service" in relation to any grade means the period or periods of service in that grade rendered after appointment, according to the prescribed procedure in this regard, on regular basis to that grade and includes any period or periods –

(i) taken into account for the purpose of seniority in case of those appointed at the initial constitution of the Service;

(ii) during which an officer would have held a duty post in that grade but for being on leave or otherwise not being available for one reason or the other for holding such posts;

(k) "Schedule" means Schedule annexed to these rules;

(l) "Scheduled Castes" and "Scheduled Tribes" shall respectively have the same meaning as assigned to them in clauses (24) and (25) of article 366 of the Constitution;

(m) "Service" means the Indian Information Service (Group `B') constituted under rule 3.

3. Constitution of the Indian Information Service Group 'B'.- (1) There shall be a service known as the Indian Information Service (Group `B') consisting of persons appointed to the Service under rules 6 and 7.

(2) The Service shall consist of Senior Grade posts (Group 'B' Gazetted, Non-Ministerial) and Junior Grade posts (Group 'B' Non-Gazetted, Non-Ministerial).

4. Grades, authorised strength and its review.- (1) The duty posts included in the various grades of the Service, their designations, numbers, Pay Band and Grade Pay of the Ministry or Department or Office-wise allocation on the date of commencement of these rules shall be as specified in Schedule-I and the duty posts included in the particular grade as mentioned in the Schedule-I would be inter-changeable with one another.

(2) After the commencement of these rules, the authorised permanent strength of duty posts in various grades shall be such as may be determined by the Government from time to time.

(3) The Government may make temporary additions or deletions to the strength of the duty post in various grades as deemed necessary from time to time.

(4) The Government may, on the recommendation of a duly constituted Cadre Review Committee and in consultation with the Commission or Staff Selection Commission, as the case may be, include in the Service (other than those included in Schedule-I) only such Journalistic or Publicity or Public Relations posts which are equivalent to the posts, in the service in status, grade, pay scale and professional content or exclude from the service a post included in the said Schedule.

(5) The Cadre Review Committee referred to in sub-rule (4) shall consist of the following, namely:-

1. Joint Secretary -Chairman

(dealing with Indian Information Service)

2. Additional Director General, Press Information Bureau -Member

3. Director, Publications Division -Member

4. Director/ Deputy Secretary (Finance), Ministry of Information

and Broadcasting - Member

5. Director/Deputy Secretary (dealing with Indian Information Service) - Member Secy.

(6) The Government may, in consultation with the Commission or Staff Selection Commission, appoint an officer whose post is included in the Service under sub-rule (4) to the appropriate grade of the Service in a temporary capacity or in a substantive capacity, as may be deemed fit and his seniority shall be fixed in accordance with the general instructions issued by the Government on the subject from time to time.

5. Members of the Service.- (1) The following persons shall be the members of the Service.- (a) persons appointed to duty posts under rule 6; and

(b) persons appointed to duty posts under rule 7.

(2) A person appointed under clause (a) of sub-rule (1) shall, on such appointment, be deemed to be a member of the service in the appropriate grade applicable to him in Schedule-I.

(3) A person appointed under clause (b) of sub-rule (1) shall be the member of the Service in the appropriate grade applicable to him in Schedule-I from the date of such appointment.

6. Initial constitution of the Service.- (1) The Service shall, on the date of commencement of these rules, consist of officers who have already been appointed to the Indian Information Service Group 'B' in various Grades as specified in Schedule-I on a regular basis.

(2) The regular continuous service of a person referred to in sub-rule (1) prior to the commencement of these rules shall count for the purpose of probation, qualifying service for promotion, confirmation, seniority and pension.

(3) To the extent the Controlling Authority is not able to fill the authorised regular strength of vacancies in various grades in the Service in accordance with the provisions of this rule, the same may be filled in accordance with the provisions of rule 7.

7. Future maintenance of the Service.- (1) Any vacancy arising in any of the grades referred in Schedule-I after commencement of these rules shall be filled in the manner hereinafter provided under this rule.

(2) Appointments in the Service to posts in Senior Grade (Gazetted) and Junior Grade (Non-Gazetted) shall be made as specified in Schedule-II.

(3) Appointment to a grade by promotion as specified in Schedule-II or confirmation in the grade shall be made on the basis of the recommendation of the Departmental Promotion Committee or Departmental Confirmation Committee specified in Schedule-III.

(4) The appointment by direct recruitment as specified in Schedule-II shall be made in the manner as specified in Schedule-IV.

8. Probation.- (1) Every person on appointment to the Service by direct recruitment either to Senior Grade Indian Information Service Group 'B' or Junior Grade Indian Information Service Group 'B' shall be on probation for a period of two years:

Provided that the Controlling Authority may extend the period of probation in accordance with the instructions or orders issued by the Government from time to time:

Provided further that any decision for extension of period of probation shall be taken ordinarily within eight weeks after the expiry of the previous period of probation and communicated in writing to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their appointment on regular basis and be confirmed in due course against the available substantive vacancies, as the case may be.

(3) If, during the period of probation or any extension thereof, as the case may be, the Government is of the opinion that an officer is not fit for permanent appointment, the Government may, for reasons to be recorded in writing, discharge or revert the officer to the post held by him prior to his appointment in the Service, as the case may be.

(4) During the period of probation, or any extension thereof, candidates may be required by the Government to undergo such courses of training and instructions and to pass examinations and tests (including examination in Hindi) as the Government may deem fit as a condition to satisfactory completion of the probation.

(5) As regards other matters relating to probation, the members of the Service shall be governed by the instructions or orders issued by the Government from time to time in this regard.

9. Seniority.- (1) The relative seniority of the members of Service shall be governed by their relative seniority obtaining on the date of commencement of these rules, provided that if the seniority of any such member had not been specifically determined on the said date, the same shall be as determined by the Controlling Authority as per orders and instructions issued by the Government on the subject from time to time.

(2) The seniority of persons recruited to the Service after the initial constitution shall be determined by the Controlling Authority in accordance with the general instructions or orders issued by the Government on the subject from time to time.

(3) The seniority of officers appointed to the Service in accordance with the provisions of sub-rule (4) of rule 4 shall be fixed in accordance with the general instructions issued by the Government on the subject from time to time.

(4) If the seniority of officers is not covered under sub-rules (1) to (3), the same shall be determined by the Government in consultation with the Commission.

10. Savings.- Nothing in these rules shall affect reservations, relaxations of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Government, from time to time, in this regard.

11. Power to relax.- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons.

12. Interpretation.- If any question arises as to the interpretation of these rules, the Government shall decide the same.

13. Appointment to the Service.- All appointments to the Service shall be made by the Cadre Controlling Authority.

14. Liability for service in any part of India and other conditions of service.- Officers appointed to the Service shall be liable to serve anywhere in India or outside.

Note - The crucial date for determining the age-limit shall be the closing date for receipt of applications (and not the closing date prescribed for those in Assam, Meghalaya, Arunachal Pradesh, Mizoram, Manipur, Nagaland, Tripura, Sikkim, Ladakh Division of Jammu and Kashmir State, Lahaul and Spiti District and Pangi Sub Division of Chamba district of Himachal Pradesh, Andaman and Nicobar Islands and Lakshadweep).

Educational qualifications and experience etc., for direct recruitment

Essential.- (i) Degree of a recognized University or Institute;

(ii) Diploma/Post Graduate Diploma in Journalism/Mass Communication from a recognized University/Institution; or

Degree in Journalism and Mass Communication from a recognized University/Institute;

(iii) Two years experience of journalistic, publicity or public relation work in a Government Department/Public Sector Undertaking/Autonomous Organization / News agency/Newspaper registered with the Registrar of News Papers of India / any other Listed Private Organization.

Note.1 - Direct recruitment to posts in Senior Grade Indian Information Service Group `B' (Gazetted) shall be made language-wise. The exact language requirement shall be indicated at the time of recruitment. There shall be no category-wise/community-wise reservation for any of the languages.

The candidates must have studied the concerned Indian language upto 10th Class.

Note.2 - Qualifications are relaxable at the discretion of the Commission for reasons to be recorded in writing, in case of candidate otherwise well qualified.

Note.3 - The qualification regarding experience is relaxable at the discretion of the Commission in case of candidates belonging to the Scheduled Castes and the Scheduled Tribes if at any stage of selection, the Commission for reasons to be recorded in writing, is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the vacancies reserved for them.

2. Junior Grade Indian Information Service Group 'B' (Non-Gazetted) (Rs.9300-34800) Grade Pay

Direct recruitment shall be made by the Staff Selection Commission in the manner stated below:-

MINISTRY OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION

G.S.R. 185.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Farakka Barrage Project (Class-II posts) Recruitment Rules, 1969(insofar as they relate to the post of Chief Draftsman); the Farakka Barrage Project (Group 'C' Posts) Recruitment Rules, 1976, and the Farakka Barrage Project, Draftsman Grade II and Draftsman Grade III, Recruitment Rules, 2002 (insofar as they relates to the posts of Draftsman Grade-I and Draftsman Grade-II), except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Chief Draftsman and Draftsman Grade I in the Farakka Barrage Project, namely:-

1. Short title and commencement. – (1) These rules may be called Ministry of Water Resources, River Development and Ganga Rejuvenation, the Farakka Barrage Project, Chief Draftsman and Draftsman Grade-I Recruitment Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay or pay scale.- The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc. - The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification. - No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of the rules with respect to any class or category of persons.

6. Saving. - Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Schedule Tribes, Other Backward Classes,ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
