का.नि.आ. 10.—राष्ट्रपति, संविधान के अनु(cid:6994)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:7263)ए और रक्षा वैमानिक क्वालिटी आ(cid:7393)ासन सेवा नियम, 2005 को उन बातों के सिवाय अधि(cid:7059)ांत करते (cid:7263)ए, जिन्हें ऐसे अधि(cid:7059)मण से पहले किया गया है या करने का लोप किया गया है, निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारंभ- (1) इन नियमों का संक्षिप्त नाम रक्षा वैमानिक गुणवत्ता आ(cid:7393)ासन सेवा नियम, 2017 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।

2. परिभाषाएँ.—इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) "आयोग" से संघ लोक सेवा आयोग अभिप्रेत है;

(ख) "नियंत्रक प्राधिकारी" से रक्षा मंत्रालय (रक्षा उत्पादन विभाग), भारत सरकार अभिप्रेत है;

(ग) "विभागीय प्रोन्नति समिति" और "विभागीय पुष्टि समिति" से इन नियमों के अधीन गठित ऐसी समितियाँ अभिप्रेत हैं जिनकी संरचना का ब्यौरा अनुसूची II में उल्लिखित है;

(घ) "कर्त(cid:7390) पद" से अनुसूची I में सम्मिलित कोई स्थायी या अस्थायी पद अभिप्रेत है;

(च) "(cid:7088)ेणी" से अनुसूची I में विनि(cid:7416)दष्ट कोई (cid:7088)ेणी अभिप्रेत है;

(छ) "अनुसूची" से इन नियमों से उपाब(cid:7373) अनुसूची अभिप्रेत है;

(ज) "अनुसूचित जातियों" और "अनुसूचित जनजातियों" का वही अर्थ होगा जो भारत के संविधान के अनु(cid:6994)छेद 366 के (cid:7059)मशः खंड (24) और खंड (25) में है;

(झ) "अन्य पिछड़ा वर्ग" का अर्थ और लागू होना वह होगा जो प्रशिक्षण एवम् का(cid:7414)मक विभाग के कार्यालय (cid:6980)ापन संख्या 36012/22/93-Estt (SCT) दिनांक 08 सितम्बर 1993 में अधिकथित है;

(ञ) "सेवा" से नियम 3 के अधीन गठित रक्षा वैमानिक गुणवत्ता आ(cid:7393)ासन सेवा अभिप्रेत है;

(ट) "नियमित सेवा" से किसी अधिकारी द्वारा नियमित आधार पर उसकी नियुक्ति हो जाने के प(cid:7391)ात या तो आयोग के माध्यम से या सम्यक रूप से गठित विभागीय प्रोन्नति के माध्यम से दी गई सेवा अभिप्रेत है और इसमें तदर्थ नियुक्ति सम्मिलित नह(cid:7277) होगी।

3. सेवा की संरचना.—रक्षा वैमानिक गुणवत्ता आ(cid:7393)ासन सेवा, अनुसूची I में यथाविनि(cid:7416)दष्ट (cid:7088)ेणियों के पदों से समाविष्ट एक संगठित समूह 'क' इंजीनिय(cid:7411)रग सेवा होगी।

4. (cid:7088)ेणी, प्राधिकृ त संख्या और उसका पुन(cid:7414)वलोकन.—(1) सेवा की विभिन्न (cid:7088)ेणियों में सम्मिलित कर्त(cid:7390) पद, उनकी संख्या और वेतन मैट्रिक्स में स्तर वे होंगे जो अनुसूची -1 में यथा विनि(cid:7416)दष्ट है।

(2) इन नियमों के प्रारंभ के प(cid:7391)ात, विभिन्न (cid:7088)ेणियों की प्राधिकृ त स्थायी संख्या वह होगी जो सरकार द्वारा समय- समय पर अवधारित की जाए।

(3) सरकार विभिन्न (cid:7088)ेणियों की संख्या में ऐसी अस्थायी वृ(िcid:7373) या कटौती कर सके गी जो वह समय-समय पर आवश्यक समझे।

(4) सरकार, आयोग के परामर्श से अनुसूची I में सम्मिलित पदों से भिन्न कोई पद सम्मिलित कर सके गी या उक्त अनुसूची में सम्मिलित किसी पद को सेवा से निकाल सके गी।

(5) सरकार, आयोग के परामर्श से किसी ऐसे अधिकारी के , जिसका पद इस नियम के उप-नियम (4) के अधीन सेवा में सम्मिलित है, सेवा की किसी समुचित (cid:7088)ेणी में सरकार द्वारा समय-समय पर जारी आदेशों और अनुदेशों के अनुसरण में अस्थायी या अधिष्ठायी हैसियत में, जैसा वह उचित समझे, नियुक्त कर सके गी और उसकी वरिष्ठता नियत कर सके गी।

5. सेवा के सदस्य:- (1) निम्नलिखित (cid:7390)क्ति सेवा के सदस्य होंगे, अर्थात्,-

(क) इन नियमों के प्रारंभ की तारीख पर नियमित आधार पर अनुसूची-I में विनि(cid:7416)दष्ट (cid:7088)ेणियों के कर्त(cid:7390) पद धारण कर रहे (cid:7390)क्ति;

(ख) इन नियमों के प्रारंभ के प(cid:7391)ात, कर्त(cid:7390) पदों पर नियुक्त (cid:7390)क्ति, इस प्रकार उनके नियुक्त किए जाने की तारीख से;

(2) उपनियम (1) के खंड (ख) के अधीन नियुक्त कोई (cid:7390)क्ति ऐसी नियुक्ति की तारीख से अनुसूची-I में लागू सेवा की सुसंगत (cid:7088)ेणी का सदस्य होगा परंतु जब वह उक्त पद पर नियुक्त या तो प्रोन्नति द्वारा या अनुसूची-I में उल्लिखित सीधी भर्ती द्वारा नियुक्त किया जाता है।

6. आरंभिक गठन.—(1) रक्षा वैमानिक गुणवत्ता आ(cid:7393)ासन सेवा नियम के सभी अधिकारी जो नियमित आधार पर इन नियमों के प्रारंभ से ठीक पूर्व सेवा में विभिन्न (cid:7088)ेणियां धारण कर रहे हों, नियमित आधार पर, यथास्थिति, अपने-अपने पद या (cid:7088)ेणियों में सेवा के प्रारंभिक गठन पर सेवा के सदस्य बने रहेंगे।

(2) उपनियम (1) में उल्लिखित अधिकारियों की नियमित निरंतर सेवा इन नियमों के प्रकाशन से पूर्व अपने-अपने तत्स्थानी (cid:7088)ेणियों में ज्येष्ठता, पुष्टि, प्रोन्नति, अकृ त्यिक उन्नयन के प्रयोजन और पेंशन के लिए अर्हक सेवा के रूप में गणना की जाएगी।

7. भविष्य में सेवा का अनुरक्षण.—(1) सेवा की किसी (cid:7088)ेणी में रिक्त पद इन नियमों के प्रारंभ पर ही और उसके प(cid:7391)ात अनुसूची-I में यथाविनि(cid:7416)दष्ट रीति में भरा जाएगा।

(2)(क) सेवा की विभिन्न (cid:7088)ेणियों में प्रोन्नति के प्रयोजन के लिए सरकार द्वारा समय-समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार चयन सूची योग्यता (cid:7059)मवार तैयार की जाएगी। विभागीय प्रोन्नति समिति का गठन उस प्रकार किया जाएगा जैसा अनुसूची II में विनि(cid:7416)दष्ट है:

परन्तु जहां ऐसे कनिष्ठ (cid:7390)क्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ (cid:7390)क्तियों की भी प्रोन्नति हेतु विचार किया जाएगा, परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक या दो वर्ष, इनमें से जो भी कम हो, और उन्होंने अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो।

(ख) वरिष्ठ वै(cid:6980)ानिक अधिकारी (cid:7088)ेणी-I (ज्येष्ठ काल मान) की अकृ त्यिक द्वितीय (cid:7088)ेणी पर नियुक्तियां, चयन समिति की, जिसका गठन उस प्रकार किया जाएगा, जो अनुसूची II में विनि(cid:7416)दष्ट है, सिफारिशों के आधार पर किया जाएगा।

(3) प्रोन्नति के प्रयोजनों के लिए , विभिन्न पदों पर की जाने वाली सेवा के न्यूनतम वर्ष, अनुसूची-I में यथा विनि(cid:7416)दष्ट होंगे।

(4) सीधी भर्ती किए जाने वाले (cid:7390)क्तियों के लिए तथा विभागीय प्रोन्नति के लिए कोटा अनुसूची-I में यथाविनि(cid:7416)दष्ट है।

(5) सीधी भर्ती की प(cid:7373)ति द्वारा ज्येष्ठ वै(cid:6980)ानिक अधिकारी (cid:7088)ेणी-II के पद पर नियुक्ति के लिए शैक्षिक अर्हताएं और आयु-सीमा अनुसूची III में यथाविनि(cid:7416)दष्ट होंगी।

(6) सेवा की विभिन्न (cid:7088)ेणियों में नियुक्ति आयोग के परामर्श से की जाएगी।

8. ज्येष्ठता.—(1) इन नियमों के प्रारंभ होने पर सेवा के सदस्यों की सापेक्ष ज्येष्ठता इन नियमों के प्रारंभ से पूर्व अवधारित रूप में उनकी अपनी-अपनी (cid:7088)ेणियों में सापेक्ष ज्येष्ठता होगी:

परन्तु यदि सेवा के किसी सदस्य की ज्येष्ठता इन नियमों के प्रारंभ होने से पूर्व अवधारित की गई है तो इसे सरकार द्वारा अवधारित किया जाएगा।

(2) सेवा की विभिन्न (cid:7088)ेणियों में नियुक्त (cid:7390)क्ति की ज्येष्ठता इन नियमों के प्रारंभ होने के प(cid:7391)ात सरकार द्वारा समय-समय पर जारी साधारण आदेशों या अनुदेशों के अनुसार अवधारित की जाएगी।

9. परिवीक्षा.—(1) कनिष्ठ वेतनमान में सीधी भर्ती के माध्यम से अथवा प्रोन्नति द्वारा नियुक्त प्रत्येक अधिकारी को सेवा में दो वर्ष की अवधि के लिए परिवीक्षा पर रखा जाएगा:

परंतु नियंत्रक प्राधिकारी, सरकार द्वारा समय-समय पर जारी अनुदेशों के अनुसार, परिवीक्षा अवधि में वृ(िcid:7373) कर सकता हैः

परन्तु आगे यह कि किसी परिवीक्षा अवधि को बढ़ाए जाने के संबंध में कोई निर्णय साधारणतः पिछली परिवीक्षा अवधि की समाप्ति के आठ सप्ताह के भीतर ले लिया जाएगा और ऐसा किए जाने के कारणों सहित संबंधित अधिकारी को परिवीक्षा अवधि बढ़ाए जाने की सूचना लिखित रूप में उक्त अवधि के भीतर ही देनी होगी।

(2) परिवीक्षा की अवधि अथवा उसके बढ़ाए जाने की अवधि के पूरा हो जाने पर, यदि अधिकारियों को स्थायी नियुक्ति के योग्य पाया जाए तो उन्हें अपनी नियुक्ति में नियमित आधार पर बनाए रखा जाए और उन्हें उपलब्ध स्थायी रिक्तियों पर, उचित समय पर, जैसा भी मामला हो, स्थायी कर दिया जाए।

(3) यदि परिवीक्षा की अवधि अथवा उसके बढ़ाए जाने की किसी अवधि, जैसी भी स्थिति हो, के दौरान सरकार की यह राय हो कि कोई अधिकारी स्थायी नियुक्ति के योग्य नह(cid:7277) है तो सरकार उस अधिकारी को सेवामुक्त अथवा उक्त सेवा में नियुक्ति से पहले जिस पद पर कार्य कर रहा था, जैसा भी मामला हो, उसी पर वापस भिजवा सकती है।

(4) परिवीक्षा की अवधि अथवा इसके बढ़ाए जाने की किसी अवधि के दौरान उम्मीदवारों को सरकार द्वारा अपेक्षित प्रशिक्षण और अनुदेश के ऐसे पा(cid:7353)(cid:7059)मों में भाग लेना होगा और ऐसी परीक्षाओं और ऐसे परीक्षणों में (हिन्दी की परीक्षा सहित) सफलता प्राप्त करनी पड़ेगी जिसे सरकार, परिवीक्षा की संतोषजनक समाप्ति के लिए उपयुक्त समझे।

(5) जहां तक परिवीक्षा से संबंधित अन्य मामलों का संबंध है, सेवा के सदस्यों को सरकार द्वारा इस विषय पर समय-समय पर जारी किए जाने वाले अनुदेशों से अभिशासित होंगे।

10. नियंत्रक प्राधिकारी.—रक्षा मंत्रालय (रक्षा उत्पादन विभाग), भारत सरकार, सेवा का नियंत्रक, प्राधिकारी होगा और सरकार के सव(cid:7299)त्तम लाभ के लिए सेवा से संबंधित अधिकारियों के विनियोजन के लिए उत्तरदायी होगा।

11. भारत के किसी भाग में सेवा करने का दायित्व और सेवा की अन्य शत(cid:7288) – (1) सेवा में नियुक्त अधिकारी भारत के भीतर या विदेश में कह(cid:7277) भी सेवा के लिए दायी होंगे।

(2) अधिकारी, यदि प्रतिनियुक्त है, सरकार के किसी अन्य मंत्रालय अथवा विभाग में सेवा करने के लिए दायी होगा।

(3) सेवा का कोई सदस्य, यदि ऐसा अपेक्षित हो, तो चार वर्ष की अन्यून अवधि के लिए जिसके अंतर्गत प्रशिक्षण, यदि कोई हो, में (cid:7390)तीत अवधि भी है, कमीशन प्राप्त अधिकारी के रूप में सेवा के लिए दायी होगाः

परंतु ऐसे किसी (cid:7390)क्ति से,-

(क) नियुक्ति की तारीख से 10 वर्ष की समाप्ति के प(cid:7391)ात पूव(cid:7299)क्त रूप में सेवा करने की अपेक्षा नह(cid:7277) की जाएगी, और

(ख) 40 वर्ष की आयु प्राप्त कर लेने के प(cid:7391)ात पूव(cid:7299)क्त रूप में सेवा करने की सामान्यतः अपेक्षा नह(cid:7277) की जाएगी।

(4) सेवा में नियुक्त अधिकारी, अन्वेषण, विकास और गुणवत्ता आ(cid:7393)ासन कार्य या ऐसे अन्य कार्य की बाबत, जिसके लिए उन्हें प्रतिनियुक्त किया जाए, फील्ड सेवा करने के लिए (जिसमें स्थल पर सेवा या वायुयान या नौसेना पोत आदि द्वारा यात्रा करना भी सम्मिलित है) दायी होगा।

(5) सेवा में नियुक्त अधिकारी भारत में या विदेश में ऐसा प्रशिक्षण लेने के लिए दायी होगा और वह ऐसे विस्तृत अनुदेश पा(cid:7353)(cid:7059)म के लिए प्रतिनियुक्त किया जाएगा जो सक्षम प्राधिकारी समय-समय पर विनि(cid:7391)त करे।

विस्तृत प्रशिक्षण पर प्रतिनियुक्त अधिकारी, जो भारत के बाहर या भारत में निजी फर्म या कारखानों में, प्रशिक्षण की अवधि को विचार में लाए बिना, प्रशिक्षण का पूरा खर्च, उस दशा में वापस करने के लिए दायी होगी जब वह किसी भी कारण से प्रशिक्षण के दौरान या ऐसा प्रशिक्षण पूरा करने के प(cid:7391)ात, तीन वर्ष की अवधि के भीतर अपनी सेवा समाप्त कर देना चाहता है।

12. सेवा की अन्य शत(cid:7288)- (1) इन नियमों में स्पष्ट तौर पर न दिए गए विषयों के संबंध में इस सेवा के सदस्यों की सेवा की शत(cid:7288) इस सेवा के संबंध में सरकार द्वारा जारी किन्ह(cid:7277) विशेष आदेशों के अधीन तथा जहां तक हो सके भारत सरकार के अधीन ऐसे ही समान वै(cid:6980)ानिक संस्थानों या संगठनों में संगत प्रस्थिति के अधिकारियों (सिविलियन) पर[भाग II—खण्ड 4]भारत का राजपत्रा : पफरवरी 25, 2017/पफाल्गुन 6, 1938 29 लागू शत(cid:7300) के समान होंगी। इस सेवा के अधिकारियों की सेवानिवृत्ति का मसला समय-समय पर यथा संशोधित मूल नियम 56 द्वारा नियंत्रित होगा।

(2) आचरण और अनुशासन के विषय में, सेवा के अधिकारी, समय-समय पर यथा संशोधित, के न्(cid:7076)ीय सिविल सेवा (आचरण) नियम, 1964 और के न्(cid:7076)ीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 द्वारा शासित होंगे।

(3) सेवा के अधिकारियों के लिए चिकित्सीय मानक वही होंगे जो सरकार के अधीन अन्य समान वै(cid:6980)ानिक संगठनों में वै(cid:6980)ानिक और प्रौद्योगिकीविदों के लिए है। विशेष दशाओं में, भारत सरकार का रक्षा मंत्रालय (रक्षा उत्पादन विभाग),स्वास्थ्य सेवांए महानिदेशालय के परामर्श से, स्वास्थ्य सेवा के इस मानक को शिथिल करने के लिए सक्षम होगा। जिन अधिकारियों के चयन में, सीमित क्षेत्र सेवा अंतर्वलित है उनकी यथाविहित विशिष्ट चिकित्सीय जांच, यथास्थिति, या तो चयन के समय या क्षेत्र सेवा के लिए जाने के समय, की जाएगी।

13. अकृ त्यिक उन्नयन (एन एफ यू) - (क) जब कभी भारतीय प्रशासनिक सेवा में राज्य अथवा संयुक्त काडर के अधिकारी को वेतन मैट्रिक्स के लेवल 10, 11, 12, 13, 14 और 15 वाली किसी विशिष्ट (cid:7088)ेणी के लिए के न्(cid:7076) में तैनात किया जाता है तो सेवा के बैचों से संबंधित अधिकारी, जो दो वष(cid:7300) या अधिक तक के लिए वरिष्ठ हैं और अभी तक उस विशिष्ट (cid:7088)ेणी में उनकी प्रोन्नति नह(cid:7277) की गई है उनको के न्(cid:7076) में उस विशिष्ट (cid:7088)ेणी में भारतीय प्रशासनिक सेवा के अधिकारियों की तैनाती की तारीख से, अनुसूची IV के अनुसार गठित की गई विभागीय खोजबीन समिति की संस्तुतियों पर अकृ त्यिक आधार पर वही (cid:7088)ेणी मंजूर की जाएगी।

(ख) उ(cid:7340)तर वेतनमान मंजूर करने के लिए खोजबीन के समय सभी निर्धारित पात्रता मानदंड और प्रोन्नति के प्रतिमानकों जिनमें वेतन मैट्रिक्स में स्तर के किसी विशिष्ट लेवल पर उन्नयन के लिए बेंचमार्क सम्मिलित है, को पूरा करना होगा।

(ग) अकृ त्यिक आधार पर उ(cid:7340)तर वेतनमान मंजूर करने के लिए अन्य निबंधन और शत(cid:7288) इस विषय पर के न्(cid:7076) सरकार द्वारा समय-समय पर जारी किए जाने वाले आदेशों और अनुदेशों के अनुसार होंगी।

14. निरर्हता- वह (cid:7390)क्ति,-

(क) जिसने ऐसे किसी (cid:7390)क्ति से, जिसका पति या जिसकी प(cid:7360)ी जीवित है, विवाह किया है; या

(ख) जिसने अपने पति या प(cid:7360)ी के जीवित रहते (cid:7263)ए किसी (cid:7390)क्ति से विवाह किया है;

उक्त पद पर नियुक्ति का पात्र नह(cid:7277) होगा:

परन्तु यदि के न्(cid:7076) सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे (cid:7390)क्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनु(cid:6980)ेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी (cid:7390)क्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

15. शिथिल करने की शक्ति.—जहां के न्(cid:7076) सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है उन्हें लेखब(cid:7373) करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के (cid:7390)क्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

16. निर्वचन.—यदि इन नियमों के निर्वचन की बाबत कोई विवाद उत्पन्न होता है तो उसका विनि(cid:7391)य सरकार द्वारा किया जाएगा।

17. (cid:7390)ावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नह(cid:7277) डालेगी, जिनका के न्(cid:7076)ीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वग(cid:7299) और अन्य विशेष प्रवर्ग के (cid:7390)क्तियों के लिए उपबंध करना अपेक्षित है।

रक्षा वैमानिक गुणवत्ता आ(cid:7393)ासन सेवा के अंतर्गत जिसमें समूह 'क' के पदों की संख्या और वेतन मैट्रिक्स में स्तर, भर्ती की प(cid:7373)ति, पात्रता और एक (cid:7088)ेणी से अन्य में प्रोन्नति के लिए अन्य शत(cid:7288) भी सम्मिलित हैं:-

* 2017 में, कार्यभार के आधार पर परिवर्तन किया जा सकता है।

(ख) इंजीनियर संस्थान (भारत) की परीक्षा संस्था के ख(cid:7003)ड 'क' और 'ख' में उत्तीर्ण होना चाहिए;या

(ग) ऐसे विदेशी वि(cid:7393)विद्यालय या महाविद्यालय या संस्था से और ऐसी शत(cid:7300) के अंतर्गत जिन्हें सरकार समय- समय पर ऐसी शत(cid:7300) के अधीन इस प्रयोजन के लिए मान्य करे, इंजीनियरी में डि(cid:7061)ी या डिप्लोमा होना चाहिए; या (घ) इलेक्ट्रॉनिक और दूरसंचार इंजीनियर्स (भारत) संस्था की (cid:7401)ातक सदस्यता परीक्षा उत्तीर्ण होना चाहिए;

आयु-सीमा : इंजीनियरी सेवा परीक्षा के लिए अ(cid:7012)यर्थी को 21 वर्ष की आयु प्राप्त करना आवश्यक है और उसने परीक्षा के वर्ष की 01 जनवरी को 30 वर्ष से ज्यादा आयु प्राप्त न की हो।

New Delhi, the 3rd February, 2017

S.R.O. 10.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of the Defence Aeronautical Quality Assurance Service Rules, 2005, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely :-

1. Short Title and Commencement.—(1) These rules may be called the Defence Aeronautical Quality Assurance Service Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—In these rules, unless the context otherwise requires,-

(a) "Commission" means the Union Public Service Commission;

(b) "Controlling Authority" means the Ministry of Defence (Department of Defence Production) in the Government of India;

(c) "Departmental Promotion Committee" and "Departmental Confirmation Committee" mean the committees constituted under these rules, the details of composition of which is mentioned in Schedule II ;

(d) "Duty post" means any post, whether permanent or temporary, included in Schedule I ;

(e) "Government" means the Government of India;

(f) "Grade" means any of the grades specified in Schedule-I;

(g) "Schedule" means Schedule annexed to these rules;

(h) "Scheduled Caste" and "Scheduled Tribes" shall have the meaning respectively assigned to them under clause (24) and clause (25) of Article 366 of the Constitution;

(i) "Other Backward Classes" shall have the same meaning and applicability as laid down in Department of Personnel and Training O.M. No.36012/22/93-Estt(SCT) dated 08th September, 1993.

(j) "Service" means the Defence Aeronautical Quality Assurance Service under rule 3.

(k) "regular service" means service rendered by the officer after they are appointed on regular basis either through the Commission or through promotion by duly constituted Departmental Promotion Committee and shall not include ad-hoc appointment.

3. Composition of the Service.—The Defence Aeronautical Quality Assurance Service shall be an Organised Group `A' Engineering Service comprising posts in the grades as specified in Schedule - I.

4. Grades, authorised strength and its review.—(1) The duty posts included in various grades in the Service, their number and Levels in the Pay Matrix, shall be as specified in Schedule I.

(2) After the commencement of these rules, the authorised permanent strength of the various grades shall be such as may, from time to time, be determined by the Government.

(3) The Government may make temporary additions or deletions to the strength of the various grades as it may deem necessary from time to time.

(4) The Government may, in consultation with the Commission, include in the Service any post other than those included in Schedule-I or exclude from the Service a post included in the said Schedule.

(5) The Government may, in consultation with the Commission, appoint an officer whose post is included in the Service under sub-rule (4) of this rule, to the appropriate grade of the Service in a temporary or substantive capacity, as may be deemed fit, and fix his seniority in the grade in accordance with the general orders and instructions issued by the Government from time to time.

5. Members of Service.—(1) The following persons shall be the members of the Service, namely;-

(a) persons holding the duty post in the grades specified in Schedule - I on regular basis on the date of commencement of these rules ;

(b) persons appointed to duty posts after the commencement of these rules from the date they are so appointed.

(2) A person appointed under clause (b) of sub-rule (1) shall be a member of the Service in the relevant grade, applicable to him in Schedule - I from the date of such appointment, provided he has been appointed to the said post either by promotion or by direct recruitment mentioned in Schedule-I.

6. Initial Constitution.—(1) All officers borne on the Defence Aeronautical Quality Assurance Service rules holding various grades in the service immediately before commencement of these rules on regular basis shall continue to be members of the Service in the respective posts or grades on regular basis, as the case may be, at the time of initial constitution of the Service.

(2) The regular continuous service of officers mentioned in sub-rule (1), prior to the publication of these rules in the respective corresponding grades shall count as qualifying service for the purpose of seniority, confirmation, promotion, Non-Functional Upgradation (NFU) and pension.

7. Future Maintenance of the Service.—(1) The vacant posts in any of the grades of the Service, on and after the commencement of these rules shall be filled in the manner as specified in Schedule-I.

(2)(a) For considering promotion of officers from one grade to another, the select list shall be prepared in accordance with the general orders or instructions issued by the Government from time to time. The composition of the Departmental Promotion Committee shall be as mentioned in Schedule-II :

Provided that where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, which ever is less, and have successfully completed their probation period, for promotion to the next higher grade, along with their juniors who have completed such qualifying or eligibility service.

(b) The appointments to the Non-functional Second Grade for Senior Scientific Officer Grade-I (Senior Time-Scale) shall be made on the basis of the recommendations of the Screening Committee, the composition of which shall be as specified in Schedule-II.

(3) The minimum years of service to be rendered in various posts for the purpose of promotion shall be as specified in Schedule -I.

(4) The quotas for direct recruitment and departmental promotion shall be as specified in Schedule-I.

(5) The educational qualifications and age limit for appointment to the post of Senior Scientific Officer Grade-II by the method of direct recruitment shall be as specified in Schedule-III.

(6) Appointments to various grades of the Service shall be made in consultation with the Commission.

8. Seniority.—(1) The relative seniority of the members of the Service on the commencement of these rules shall be the relative seniority in their respective grades as determined before commencement of these rules:

Provided that if the seniority of any member of the service had not been specifically determined before commencement of these rules, it shall be determined by the Government.

(2) The seniority of persons appointed to various grades of the service after commencement of these rules shall be determined in accordance with the general orders or instructions issued by the Government from time to time.

9. Probation.—(1) Every officer on appointment to the Service, either by direct recruitment or by promotion in Junior Scale shall be on probation for a period of two years:

Provided that the Controlling Authority may extend the period of probation in accordance with the instructions issued by the Government from time to time:

Provided further that any decision for extension of a probation period shall be taken ordinarily within eight weeks after the expiry of the previous probation period and communicated in writing to the concerned officer together with the reasons for so doing within the said period.

(2) On completion of the period of probation or any extension thereof, officers shall, if considered fit for permanent appointment, be retained in their appointments on regular basis and be confirmed in the due course against the available substantive vacancies, as the case may be.

(3) If, during the period of probation or any extension thereof, as the case may be Government is of the opinion that an officer is not fit for permanent appointment, Government may discharge or revert the officer to the post held by him prior to his appointment in the service, as the case may be.

(4) During the period of probation, or any extension thereof, candidates may be required by Government to undergo such courses of training and instructions and to pass examinations and test (including examination in Hindi) as Government may deem fit, as a condition to satisfactory completion of the probation.

(5) As regards other matters relating to probation the members of the Service will be governed by the instructions issued by the Government in this regard from time to time.

10. Controlling Authority.—The Ministry of Defence (Department of Defence Production), Government of India shall be the Controlling Authority of the service and shall be responsible for the deployment of the officers of the service to the best advantage of the Government.

11. Liability to service in any part of India and other conditions of service.—(1) Officers appointed to the Service shall be liable to serve anywhere in India or outside.

(2) Officers, if deputed, shall be liable to serve in any other Ministry or Department of the Government.

(3) Any member of the Service shall, if so required, be liable to serve as a Commissioned Officer in the Armed Forces for a period of not less than four years including the period spent on training, if any:

Provided that such a person,-

(a) shall not be required to serve as aforesaid after the expiry of ten years from the date of appointment, and

(b) shall not ordinarily be required to serve aforesaid after attaining the age of forty years.

(4) Officers appointed to the Service shall be liable to field service (including service on land or travel by Service aircraft or Naval ships, etc.) in respect of investigation, development, indigenisation and quality assurance work or such other work to which they may be deputed.

(5) Officers appointed to the Service shall be liable to undergo such training and be detailed on courses of instruction in India or abroad as the Competent Authority may decide from time to time. An officer detailed for training outside India or with a private firm or factories in India, irrespective of the duration of the training, shall be liable to refund in full the cost of training if, for any reason, during the training or within a period of three years after the completion of such training, he chooses to discontinue his service.

12. Other conditions of service.—(1) The conditions of service of the members of the Service in respect of matters not expressly provided for in these rules, shall as far as and subject to any special orders issued by the Government in respect of the Service, be the same as those applicable to officers (Civilians) of corresponding status in similar scientific institutions or organisations under the Government of India. The matter of retirement of officers of the Service shall be governed by the Fundamental Rule 56, as amended from time to time.

(2) In the matter of conduct and discipline, officers of the Service shall be governed by the Central Civil Service (Conduct) Rules, 1964 and Central Civil Service (Classification, Control and Appeal) Rules 1965, as amended from time to time.

(3) Medical Standards of fitness for officers of the Service shall normally be the same as for scientists and technologists serving in other similar scientific organisations under the Government. In special cases, the Government of India in the Ministry of Defence (Department of Defence Production) shall, in consultation with the Directorate General of Health Services, be competent to grant relaxations. Officers selected for assignments involving limited field service shall undergo special medical check up as may be prescribed, either at the time of selection or when they proceed on field service, as the case may be.

13. Non-functional upgradation (NFU). - (a) Whenever any Indian Administrative Service officer of the State or Joint Cadre is posted at the Centre to a particular grade in Level 10, 11, 12, 13, 14 and 15 in the Pay Matrix, the officers[भाग II—खण्ड 4]भारत का राजपत्रा : पफरवरी 25, 2017/पफाल्गुन 6, 1938 37 belonging to batches of the Service that are senior by two years or more and have not so far been promoted to that particular grade, would be granted the same grade on non-functional basis from the date of posting of the Indian Administrative Service officers in that particular grade at the Centre on the recommendations of the Departmental Screening Committee constituted in accordance with Schedule-IV.

(b) All the prescribed eligibility criteria and promotional norms including 'benchmark' for up-gradation to a particular Level in the Pay Matrix would have to be met at the time of screening for grant of higher pay scale.

(c) The other terms and conditions for grant of higher pay scale on Non-functional basis shall be as per orders and instructions issued on the matter by the Central Government from time to time.

14. Disqualifications.—No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the service:

Provided that the Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

15. Power to relax.—Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Commission, relax any of the provisions of these rules with respect to any class or category of persons.

16. Interpretation.—If any question relating to interpretation of these rules arise, it shall be decided by the Government.

17. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions, required to be provided for Scheduled Castes, Scheduled Tribes, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Government from time to time in this regard.

Minimum educational and other qualifications and age limit for direct recruitment to Senior Scientific Officer Grade II

A candidate must have :-

(a) Obtained a Degree in Engineering from a University incorporated by an Act of the Central or State Legislature in India or other Educational Institutes established by an Act of Parliament or declared to be deemed as University under section 3 of the University Grants Commission Act, 1956; or

(b) Passed Sections A and B of the Institution Examinations of the Institution of Engineers (India); or

(c) Obtained a Degree or Diploma in Engineering, from such foreign University or College or Institution and under such conditions as may be recognised by the Government for the purpose from time to time; or

(d) Passed Graduate Membership Examination of the Institution of Electronics and Telecommunication Engineers (India); or

(e) Passed Associate Membership Examination Part II and Part III or Sections A and B of the Aeronautical40 THE GAZETTE OF INDIA : FEBRUARY 25, 2017/ PHALGUNA 6, 1938 [PART II—SEC. 4] Society of India; or

(f) Passed Graduate Membership Examination of the Institution of Electronics and Radio Engineers, London held after November, 1959.

Age Limit.—A candidate for Engineering Services Examination must have attained the age of 21 years and must not have attained the age of 30 years as on the 1st of January of the year of Examination.

Note 1 : The prescribed age limit may vary in accordance with the notifications issued by the Commission.

Note 2 : The upper age limit is relaxable for Schedule Castes or Schedule Tribes or Other Backward Classes and certain other categories as notified by the Commission for the examination from year to year.

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. आवेदन :- यह नियम, इन नियमों के साथ उपबंधित अनुसूची में विनि(cid:7416)दष्ट पद पर लागू होते हैं ।

3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.–उक्त पद की संख्या, उसका वर्गीकरण, और वेतन मैट्रिक्स में स्तर वह होगा जो इन नियमों से उपाबध्द पूव(cid:7299)क्त अनूसूची के स्तंभ (2) से स्तंभ (4) में विनि(cid:7416)दष्ट हैं।

4. भर्ती की प(cid:7373)ति, आयु सीमा, अन्य अर्हताएं आदि - भर्ती की प(cid:7373)ति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूव(cid:7299)क्त अनुसूची के स्तंभ (5) से (13) में विनि(cid:7416)दष्ट हैं।

5. निरर्हता.–वह (cid:7390)क्ति.–

(क) जिसने ऐसे (cid:7390)क्ति से जिसका पति या जिसकी प(cid:7360)ी जीवित हैं, विवाह किया है, या विवाह की संविदा की है;

(ख) जिसने अपने पति या अपनी प(cid:7360)ी के जीवित रहते (cid:7263)ए किसी (cid:7390)क्ति से विवाह किया है, या विवाह की संविदा की है;

उक्त पद पर नियुक्ति का पात्र नह(cid:7277) होगा :

परन्तु यदि के न्(cid:7076)ीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे (cid:7390)क्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अऩु(cid:6980)ेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी (cid:7390)क्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

6. शिथिल करने की शक्ति.–जहां के न्(cid:7076)ीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब(cid:7373) करके , तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के (cid:7390)क्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

7. (cid:7390)ावृत्ति.–इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नह(cid:7277) डालेगी, जिनका के न्(cid:7076)ीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अऩुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वग(cid:7300), भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के (cid:7390)क्तियों के लिए उपबंध करना अपेक्षित है ।

S.R.O. 11.—In exercise of the powers conferred by the proviso to article 309 of the constitution and in supersession of the Directorate of Quality Assurance (Naval), Ministry of Defence( Directorate General Quality Assurance), Stenographer Grade-II and Grade-III, Group-'C' Posts Recruitment Rules, 2002, in so far as they relate to the post of Stenographer Grade-II, and the Directorate of Quality Assurance (Naval), Ministry of Defence (DGQA) Stenographer Grade-I, (Group-'B' Non-Gazetted, Post) Recruitment Rules, 2003, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Grade-I in the Ministry of Defence, Department of Defence Production, Directorate of Quality Assurance(Naval), namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Defence, Department of Defence Production, Directorate of Quality Assurance (Naval), Stenographer Grade-I Group 'B' post, Recruitment Rules, 2017.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the post specified in the schedule annexed to these rules.

3. Number of post, classification and level in the pay matrix.- The number of the said post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the aforesaid Schedule.

4. Method of recruitment, age-limit, other qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns(5) to (13) of the aforesaid Schedule.

5. Disqualification.-No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.- Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
