का.नि.आ. 38.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और रक्षा मंत्रालय, आर्डनेंस तथा आर्डनेंस उपस्कर कारखाना समूह "ख" ,समूह "ग" पद राजभाषा काडर, भर्ती नियम 2009 को, जहां तक उसका संबंध ज्येष्ठ हिंदी अनुवादक, कनिष्ठ हिंदी अनुवादक और हिंदी टंकक पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, आर्डनेंस और आर्डनेंस उपस्कर कारखानों और उसके सृजित मुख्यालयों में ज्येष्ठ अनुवादक समूह "ख" अराजपत्रित, कनिष्ठ अनुवादक समूह "ख" अराजपत्रित और हिंदी टंकक समूह "ग" पदों की भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :—
1. संक्षिप्त नाम और प्रारंभ .—(1) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय, आर्डनेंस और आर्डनेंस उपस्कर कारखाना समूह "ख" और समूह "ग" पद राजभाषा काडर भर्ती नियम, 2017 है।
(2) यह राजपत्र में प्रकाशन की तारीख से लागू होंगे।
2. लागू होनाः— ये नियम इन नियमों से उपाबद्ध सूची के स्तंभ (1) में विनिर्दिष्ट पदों पर लागू होंगे ।
3. पद संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.—उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन मैट्रिक्स में स्तर वे होंगे, जो इन नियमों के साथ उपाबद्ध सूची के स्तम्भ (2) से (4) में विनिर्दिष्ट हैं।

5. अनर्हताः—वह व्यक्ति
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या
(ख) जिसने अपनी पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा .—
परन्तु यदि के न्द्रीय सरकार का समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार के लिए लागू वैयक्तिक कानून के अधीन अनुज्ञेय है एवं ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
6. शिथिल करने की शक्ति.—जहां के न्द्रीय सरकार की राय होगी कि ऐसा करना आवश्यक या समीचीन है तो वह इसके कारणों को लेखबद्ध करते हुए और संघ लोक सेवा आयोग के परामर्श से इन नियमों के किसी भी उपबंध को किसी भी श्रेणी या वर्ग के व्यक्तियों के लिए आदेश द्वारा शिथिल कर सके गी।
7. व्यावृत्ति.—इन नियमों की कोई बात आरक्षण, आयु-सीमा में छू ट और ऐसी अन्य रियायतों पर प्रभाव नहीं डाल पाएगी जिनका उपबंध के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेश के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, भूतपूर्व सैनिक एवं अन्य विशेष प्रवर्ग के व्यक्तियों के लिए किया जाना अपेक्षित है।

S.R.O. 38.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Defence, Ordnance and Ordnance Equipment Factories Group 'B' and Group 'C' Posts Rajbhasha Cadre, Recruitment Rules, 2009, in so far as they relate to the posts of Senior Hindi Translator, Junior Hindi Translator and Hindi Typist , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Translator Group 'B' Non-gazetted, Junior Translator Group 'B' Non-gazetted and Hindi Typist Group 'C' in Ordnance and Ordnance Equipment Factories and its Headquarters formations, namely :—
1. Short title and commencement.—(1) These Rules may be called the Ministry of Defence, Ordnance and Ordnance Equipment Factories, Group 'B' and Group 'C' Posts, Rajbhasha Cadre, Recruitment Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.
3. Number of posts, classification and level in pay matrix.—The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age-limit, qualification, etc. —The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the aforesaid Schedule.
5. Disqualification.—No person,-
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-Servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
