काकाकाका....िनिनिनिन....आआआआ.... 22227777....————राष्ट्रपति संविधान के अनु(cid:17)छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते !ए और सशस्त्र बल मुख्यालय िसिवल सेवा िनयम, 2001 को, उन बातों के सिवाय जो ऐसे अधि-मण से पूर्व की गई है या किए जाने का लोप किया गया है, अिध-ांत करते !ए निम्नलिखित नियम बनाते हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभसंक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम सशस्त्र बल मुख्यालय िसिवल सेवा िनयम, 2018 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएंपरिभाषाएंपरिभाषाएंपरिभाषाएं.—इन नियमों में, जब तक कि संदर्भ में अन्यथा अपेक्षित न हो,–

(क) ''नियुक्तिनियुक्तिनियुक्तिनियुक्ति प्राधिकारीप्राधिकारीप्राधिकारीप्राधिकारी'' से किसी Dेणी के संबंध में उस Dेणी में नियुक्तियां करने के लिए के न्Eीय िसिवल सेवा (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 के अधीन सशक्त प्राधिकारी अभिप्रेत है ।

(ख) किसी Dेणी के संबंध में ''अनुमोदित सेवाअनुमोदित सेवाअनुमोदित सेवाअनुमोदित सेवा'' से निम्नलिखित अभिप्रेत है:-

(97)98 THE GAZETTE OF INDIA : MAY 5, 2018/VAISAKHA 15, 1940 [PART II—SEC. 4] (i) उस Dेणी में सीधे भर्ती किए गए किसी आफिसर की दशा में, उस वर्ष की पहली जनवरी से जो उस परीक्षा वर्ष के बाद वाले वर्ष की जिसके लिए सीधे भर्ती की गई थी, उस Dेणी में की गई नियमित सेवा की अवधि या अवधियाँ, जिनके अंतर्गत अनुपस्थिति की वह अवधि या अवधियाँ भी हैं, िजनके दौरान उसने िनयमित आधार पर पद धारण किया होता और यदि वह छु Mी पर न होता या ऐसा पद धारण करने के लिए अन्यथा उपलब्ध होता;

(ii) उस Dेणी में विभागीय परीक्षा के माध्यम से भर्ती किए गए किसी आफिसर की दशा में उस वर्ष की पहली जनवरी से, जिसकी रिक्तियों के लिए ऐसी परीक्षा ली गई थी, उस Dेणी में की गई नियमित सेवा की अवधि या अवधियाँ, जिनके अंतर्गत अनुपस्थिति की वह अवधि या अवधियाँ सम्मिलित हैं जिसके दौरान उसने नियमित आधार पर पद धारण किया होता यदि वह छु Mी पर न होता या ऐसा पद धारण करने के लिए अन्यथा उपलब्ध होता;

(iii) निम्नतर Dेणी में सेवा की अवधि के आधार पर उस Dेणी में भर्ती किए गए अधिकारी की दशा में उस वर्ष की पहली जनवरी से, जिस वर्ष में भर्ती की गई थी, उस Dेणी में की गई नियमित सेवा की अवधि या अवधियाँ जिसके अंतर्गत अनुपस्थिति की वह अवधि या अवधियाँ भी सम्मिलित हैं जिसके दौरान उनके नियमित आधार पर पद धारण किया होता यदि वह ऐसा पद धारण करने के लिए छु Mी पर न होता या अन्यथा उपलब्ध होता;

(ग) ''सीधेसीधेसीधेसीधे भर्तीभर्तीभर्तीभर्ती'' से, यथास्थिित, कर्मचारी चयन आयोग या आयोग द्वारा उस प्रयोजन के लिए आयोजित प्रतियोगिता परीक्षा के आधार पर सहायक अनुभाग अधिकारी की Dेणी में या अनुभाग अधिकारी की Dेणी में भर्ती किया गया Sयक्ति अभिप्रेत है;

(घ) किसी Dेणी के संबंध में ''कर्त!यकर्त!यकर्त!यकर्त!य पद पद पद पद'' से उस Dेणी का पद अभिप्रेत है जो सेवा में सम्मिलित है और प्रधान िनदेशक, निदेशक और संयुक्त निदेशक की Dेिणयों के संबंध में, जिसके अंतर्गत अनुसूची–3 में विनिTदष्ट पद सम्मिलित होंगे; और अन्य अतिरिक्त पद भी जो सरकार द्वारा संबW Dेणी में समय-समय पर मंजूर किए जा सकें गे, सम्मिलित होंगे;

(ङ) ''पात्रपात्रपात्रपात्र अिधकारीअिधकारीअिधकारीअिधकारी'' से उस वर्ष की एक जनवरी को जिसके लिए चयन सूची तैयार की जानी है इन नियमों के िनयम 7 और 8 के अनुसार, प्रधान निदेशक, िनदेशक, संयुक्त िनदेशक, उप िनदेशक, अनुभाग अधिकारी या सहायक अनुभाग अधिकारी के पदों में प्रोन्नति के लिए विचार किये जाने वाले पात्र अधिकारी अभिप्रेत हैं;

(च) ''चयनचयनचयनचयन का क्षेत्रका क्षेत्रका क्षेत्रका क्षेत्र'' से पात्र अधिकारियों की ज्येष्ठता -म में तैयार की गई वह सूची अभिप्रेत है जिससे चयन सूची में शामिल किए जाने के लिए चयन किया जाएगा;

(छ) ''सरकारसरकारसरकारसरकार'' से भारत सरकार अभिप्रेत है;

(ज) ''#ेणी#ेणी#ेणी#ेणी'' से िनयम 4 में विनिTदष्ट कोई भी Dेणी अभिप्रेत हैं;

(झ) ''दीर्घकालिकदीर्घकालिकदीर्घकालिकदीर्घकालिक नियुक्तिनियुक्तिनियुक्तिनियुक्ति'' से विशुWत: अस्थाई या तदर्थ नियुक्ति जैसे छु Mी या अन्य स्थानीय रिक्तियों के प्रति नियुक्ति या सीधे भर्ती के कोटा की रिक्तियों में न भरी गई रिक्तियों के प्रति, एक वर्ष से अनधिक अवधि की नियुक्तियों से सुभिन्न अनिश्चितकालीन अवधि के लिए नियुक्ति अभिप्रेत है;

(ञ) ''अन्यअन्यअन्यअन्य पिछडा वर्गपिछडा वर्गपिछडा वर्गपिछडा वर्ग'' से सरकार द्वारा सिविल सेवाओं और भारत सरकार के पदों में आरक्षण के प्रयोजन के िलए समय-समय पर अधिसूचित जातियाँ या समुदाय अभिप्रेत है;

(त) ''''''''सेवासेवासेवासेवा के स्थाके स्थाके स्थाके स्थाई आफिसरई आफिसरई आफिसरई आफिसर'' से ऐसा Sयक्ति अभिप्रेत है जिसे प्रवेश Dेणी में स्थाई कर दिया गया है;

(थ) ''अनुसूचीअनुसूचीअनुसूचीअनुसूची'' से इन नियमों की अनुसूची अभिप्रेत है;

(द) ''''''''अनुसूिचतअनुसूिचतअनुसूिचतअनुसूिचत जाितजाितजाितजाित'' और ''अनूसूिचत जनजाितअनूसूिचत जनजाितअनूसूिचत जनजाितअनूसूिचत जनजाित'' के -मश: वही अर्थ होंगे जो उनके भारत के संविधान के अनु(cid:17)छेद 366 के -मश: खंड (24) और (25) में हैं;

(ध) ''िनयमिनयमिनयमिनयम'' से सशस्त्र बल मुख्यालय िसिवल सेवा िनयम, 2018 अभिप्रेत है;

(न) प्रधान निदेशक, िनदेशक, संयुक्त िनदेशक, उप िनदेशक, अनुभाग अिधकारी या सहायक अनुभाग अधिकारी की Dेणियों के संबंध में ''चयन सूचीचयन सूचीचयन सूचीचयन सूची'' से प्रतिवर्ष तत्संबंधी Dेणी में विद्यमान और वर्ष के दौरान होने वाली संभािवत अनुमानित रिक्तियों, जिन्हें प्रोन्नति द्वारा भरा जाना है, भरने के लिए तैयार की गई सूची अभिप्रेत है;

(य) ''सेवासेवासेवासेवा'' से सशस्त्र बल मुख्यालय सिविल सेवा अभिप्रेत है;

(र) किसी Dेणी के सबंध में ''अस्थाअस्थाअस्थाअस्थाई आफिसरई आफिसरई आफिसरई आफिसर'' से वह Sयक्ति अभिप्रेत है जो ऐसी नियुक् ित के िलए िनयिमत रूप से अनुमोदित होने के आधार पर उस Dेणी में अस्थाई या स्थानापन्न्ा नियुक्ति धारण कर रहा है या उस Dेणी में नियुक्त किया गया वह Sयक्ति अभिप्रेत है जिसे अभी परिवीक्षा से हटाया जाना है;

(ल) ''रिक्तिरिक्तिरिक्तिरिक्ति वर्ष वर्ष वर्ष वर्ष'''''''' सरकार द्वारा समय -समय पर जारी निदfशों के अनुसार होगा;

(व) ''आयोगआयोगआयोगआयोग'' से संघ लोक सेवा आयोग अभिप्रेत है;

3. लागू होनालागू होनालागू होनालागू होना....————ये नियम सशस्त्र बल मुख्यालय में अनुसूची-1 में विनिTदष्ट या अनुसूची-2 में यथादhशत अंतर सेवा संगठनों के किसी भी Dेणी में पद धारण करने वाले Sयक्तियों को लागू होंगे ।

4. सेवासेवासेवासेवा की संरचनाकी संरचनाकी संरचनाकी संरचना....————(1) सेवा निम्नलिखित छ: Dेणियों से मिलकर बनेगी:-

(क) प्रधान निदेशक

(ख) िनदेशक

(ग) संयुक्त िनदेशक

(घ) उप िनदेशक

(ङ) अनुभाग अिधकारी

(च) सहायक अनुभाग अिधकारी

(2) प्रधान निदेशक, िनदेशक, संयुक्त िनदेशक, उप निदेशक के पद के न्Eीय िसिवल सेवा समूह 'क' राजपत्रित पद के रूप में वर्गीकृ त किए जाएंगे । अनुभाग अधिकारी की Dेणी के पद के न्Eीय िसिवल सेवा समूह 'ख' राजपत्रित के रूप में वर्गीकृ त किए जाएंगे और सहायक अनुभाग अधिकारी की Dेणी के पद के न्Eीय िसिवल सेवा समूह 'ख' अराजपत्रित, अनुसचिवीय के रूप में वर्गीकृ त किए जाएंगे ।

5. सेवासेवासेवासेवा की प्राधिकृ त संख्याकी प्राधिकृ त संख्याकी प्राधिकृ त संख्याकी प्राधिकृ त संख्या और उसका पुन5वलोकन और उसका पुन5वलोकन और उसका पुन5वलोकन और उसका पुन5वलोकन.—(1) इन नियमों के प्रारम्भ की तारीख को सेवा की विभिन्न Dेणियों में सम्मिलित कर्तSय पद, उनकी संख्या और वेतन मैट्रिक्स में स्तर वे होंगे जो अनुसूची-1 में विनिTदष्ट हैं।

(2) उप िनयम (1) में अंतhवष्ट किसी बात के होते !ए भी सरकार,-

(क) सेवा की विभिन्न Dेणियों के कर्तSय पदों में समय-समय पर अस्थाई परिवर्तन या परिवर्तन कर सके गी;

(ख) आयोग के परामर्श से सेवा में सशस्त्र बल मुख्यालय और अंतर सेवा संगठनों के ऐसे पदों को सम्मिलित कर सके गी जिन्हें प्रास्थिति Dेणी, वेतन मैट्रिक्स में स्तर और वृतिक विषय में इन पदों के समतुल्य समझा जा सके गा या सेवा में पहले से ही सम्मिलित किसी कर्तSय पद को अपवhजत कर सके गी; और

(ग) आयोग के परामर्श से खंड (ख) के अधीन सेवा में सम्मिलित किसी कर्तSय पद के आफिसर को अस्थाई क्षमता में या अधिष्ठायी क्षमता से समुचित Dेणी में नियुक्त कर सके गी और सदृश्य Dेणी में लगातार नियमित सेवा को गणना में लेने के पश्चात उस Dेणी में उसकी ज्येष्ठता िनयत कर सके गी ।

6. सेवा के सदस्यसेवा के सदस्यसेवा के सदस्यसेवा के सदस्य.—(1) सेवा के सदस्य निम्निलखित Sयक्ति होंगे:-

(क) िनयम 7 के अधीन कर्तSय पदों पर नियुक्त किए गए Sयक्ति; और

(ख) िनयम 8 के अधीन कर्तSय पदों पर नियुक्त किए गए Sयक्ति ।

(2) उप िनयम (1) खंड (क) के अधीन नियुक्त किया गया कोई Sयक्ति, ऐसी नियुक्ति पर, अनुसूची-1 और अनुसूची-2 में उसको लागू समुचित Dेणी में सेवा के सदस्य समझे जायेंगे ।

(3) उप िनयम (1) के खंड (ख) के अधीन नियुक्त किया गया कोई Sयक्ति ऐसी नियुक्ति की तारीख से अनुसूची-1 और अनुसूची-2 में उसको लागू समुचित Dेणी में सेवा का सदस्य होगा ।

7. सेवासेवासेवासेवा का आरंिभक गठनका आरंिभक गठनका आरंिभक गठनका आरंिभक गठन.—(1) इन नियमों के प्रारंभ की तारीख को सशस्त्र बल मुख्यालय सिविल सेवा में िनयिमत आधार पर समूह 'क' और समूह 'ख' कर्तSय पदों को धारण कर रहे सभी विद्यमान आफिसर तत्संबंधी Dेणियों में सेवा के सदस्य होंगे ।

(2) इन नियमों के प्रारंभ के पूर्व, उप िनयम (1) में निTदष्ट आफिसरों की नियमित लगातार सेवा, सेवा में परिवीक्षा, सेवा में प्रोन्नित, पुष्टि के लिए अर्हक सेवा और पेंशन के प्रयोजन के लिए गणना में ली जाएगी ।

(3) उस सीमा तक जिस तक इस नियम के उपबंध के अनुसार विभिन्न Dेणियों में प्राधिकृ त संख्या भरने के िलए काडर नियंत्रण प्राधिकारी भरने में समर्थ नहm हैं, उन्हें इन नियमों के नियम 8 के उपबंधों के अनुसार भरा जाएगा ।

8. सेवा का भावी रखसेवा का भावी रखसेवा का भावी रखसेवा का भावी रख----रखावरखावरखावरखाव....————(1) अनुसूची-1 में निTदष्ट किसी भी Dेणी के रिक्त कर्तSय पद, िनयम 7 के अधीन आरंभिक गठन के पश्चात्, अनुसूची-4 में उपबंधित रीति से भरे जाएंगे ।

(2) प्रधान निदेशक, िनदेशक, संयुक्त िनदेशक, उप िनदेशक, अनुभाग अिधकारी और सहायक अनुभाग अधिकारी के पदों पर प्रोन्नति के लिए आफिसरों का चयन पिछले निम्नतर Dेणी के ऐसे आफिसरों में से चयन के आधार पर किया जाएगा जिन्होंने अनुसूची-4 में यथाविनिTदष्ट न्यूनतम अर्हक सेवा कर ली है ।

(3) प्रधान निदेशक, िनदेशक, संयुक्त निदेशक और उप निदेशक की Dेणियों के पदों पर प्रोन्नति के प्रयोजन के िलए चयन सूची, सरकार द्वारा समय-समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार तैयार की जाएगी ।

(4) अनुभाग अधिकारी की Dेणी के पदों पर प्रोन्नति के उद्देश्य के िलए चयन सूची ऐसी रीति से तैयार की जाएगी जिसे सरकार समय समय पर विद्यमान और अनुमानित रिक्तियों को ध्यान में रखते !ए अवधारित करे और वे निम्नलिखित में से अनुसूची-4 के -म संख्या 5(ii) के स्तंभ (3) के पैरा (i) एवं (ii) में वhणत अनुपात में होंगी :

(क) सेवा के ऐसे सहायक अनुभाग अधिकारी जिन्होंने उस Dेणी में उनकी ज्येष्ठता के -म में छ: वर्ष से अन्यून अनुमोदित सेवा कर ली है; और

(ख) सेवा के सहायक अनुभाग अिधकारी िजनका समय-समय पर इस प्रयोजन के लिए आयोग द्वारा ली गयी सीमित विभागीय प्रतियोगिता परीक्षा के परिणामस्वरूप चयन !आ हो, उनके गुणागुण के -म में ।

(5) चयन सूची में शामिल किए जाने वाले दो प्रवगs के tक्तियों को प्रवर्ग (क) एवं (ख) में से 4:1 के अनुपात और इसी -म में शामिल किये जाएंगे और यदि ऊपर प्रवर्ग (ख) में चयन किए गए tक्ति अपेक्षित संख्या में उपलब्ध नहm हैं तो इस कमी को प्रवर्ग (क) में आने वाले tक्तियों में से पूरा किया जायेगा।

(6) प्रत्येक ऑफिसर जब तक वह छु Mी पर या अन्यथा किसी अन्य कारण से जिसे लिखित रूप में अिभिलिखत किया जायेगा कर्तt पद धारण करने के लिए उपलब्ध न हो सेवा की समुचित Dेणी के कर्तt पद पर तैनात किया जायेगा।

(7) प्रत्येक कर्तt पद जब तक कि उसे सेवा से अपवhजत न घोषित किया गया हो या किसी कारण से अस्थगित न किया गया हो, साधरणतः समुचित Dेणी के ऑफिसर द्वारा भरा जाएगा ।

9. प्रतिनियुक्ति पर कर्त7 पदों का भरा जानाप्रतिनियुक्ति पर कर्त7 पदों का भरा जानाप्रतिनियुक्ति पर कर्त7 पदों का भरा जानाप्रतिनियुक्ति पर कर्त7 पदों का भरा जाना....————िनयम 8 में अन्तhवष्ट किसी बात के होते !ए भी, जहां सरकार कि यह राय है कि ऐसा करना आवश्यक या समीचीन है वहाँ वह ऐसे कारणों से जो लिखित रूप में अभिलिखित किए जाएँगे और आयोग के परामर्श से, किसी Dेणी में किसी कर्तt पद को तीन वर्ष कि अवधि के लिए प्रतिनियुक्ति द्वारा भर सके गी जिसे विशेष परिस्थितियों में पाँच वर्ष तक बढ़ाया जा सके गा। इन नियमों के अधीन सेवा के किसी Dेणी में नियुक्ति के लिए अर्हता, अनुभव और पात्रता सेवा, सरकार द्वारा प्रत्येक अवसर पर, आयोग के परामर्श से विनिyित कि जायेगी ।

10. ज्येष्ठताज्येष्ठताज्येष्ठताज्येष्ठता....———— (1) इन नियमों के प्रारंभ पर सेवा के सदस्यों कि सापेक्ष ज्येष्ठता उनकी अपनी अपनी Dेणियों कि वह सापेक्ष ज्येष्ठता होगी जो इन नियमों के पूर्व अवधारित कि गई हो:

परन्तु यदि सेवा के किसी सदस्य कि ज्येष्ठता इन नियमों के प्रारम्भ के पूर्व विनिTदष्ट रूप से अवधारित नहm कि गई थी, तो वह सरकार द्वारा अवधारित कि जाएगी ।

(2) इन नियमों के प्रारम्भ के पyात सेवा कि विभिन्न Dेणियों में नियुक्त किए गए tक्तियों की ज्येष्ठता, सरकार द्वारा समय-समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार अवधारित की जाएगी ।

(3) अनुभाग अिधकारी और सहायक अनुभाग अिधकारी की Dेणी में सीधे भर्ती द्वारा और प्रोन्नति द्वारा नियुक्त tक्तियों की सापेक्ष ज्येष्ठता सरकार द्वारा समय-समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार अवधारित की जाएगी ।

11. ((((IIII)))) परिवीक्षापरिवीक्षापरिवीक्षापरिवीक्षा,,,, पुष्टि या परिवीक्षा पर आफिसरों पुष्टि या परिवीक्षा पर आफिसरों पुष्टि या परिवीक्षा पर आफिसरों पुष्टि या परिवीक्षा पर आफिसरों का का का का बने रहनाबने रहनाबने रहनाबने रहना....————(1) सेवा के उप िनदेशक, अनुभाग अिधकारी की Dेणी या सहायक अनुभाग अिधकारी की Dेणी मे नियुक्ति पर प्रत्येक tक्ति दो वर्ष की अवधि के लिए परिवीक्षा पर होगा :

परन्तु नियुक्ति प्राधिकारी सरकार द्वारा समय-समय पर जारी किए गए अनुदेशों के अनुसार परिवीक्षा की अवधि बढ़ा सके गा ।

परन्तु यह और कि परिवीक्षा कि अवधि बढाई जाने के लिए कोई विनिyित समान्यतः पूर्व परिवीक्षा कि अवधि के अवसान के पyात आठ सप्ताह के भीतर किया जाएगा और सम्बW आफिसर को ऐसा करने के लिए लिखित रूप में कारण सहित उक्त अवधि के भीतर संसूचित किया जायेगा ।

(2) परिवीक्षा या उसके किसी विस्तार के पूरा होने पर आफिसर, यदि उपयुक्त समझा जाता है तो उस Dेणी में पुष्ट किया जायेगा यदि पहले से ही प्रवेश Dेणी में पुष्टि नहm कि गई है ।

परन्तु कोई आफिसर ऐसे समय तक परिवीक्षा पर बने रहेंगे जब तक कि परिवीक्षा से उसको हटाया जाने या Dेणी में उसकी पुष्टि के लिए, जैसी भी स्थिति हो, विनिTदष्ट आदेश नियुक्ति प्राधिकारी द्वारा जारी नहm किए जाते ।

(3) यदि परिवीक्षा कि अवधि या उसके किसी विस्तार के दौरान, जैसी भी स्थिति हो, नियुक्ति प्राधिकारी की यह राय है कि आफिसर स्थाई नियुक्ति के लिए उपयुक्त नहm है तो वह यथास्थिति सेवा के सम्बW Dेणी उसकी नियुक्ति के पूर्व उसके द्वारा धारित पद पर उसे प्रत्यावhतत कर सके गा या निमु र्क्त कर सके गा।

(4) परिवीक्षा कि अवधि या उसके किसी विस्तार के दौरान आफिसर से ऐसे प्रशिक्षण और अनुदेश पा{-म पूरा करने के िलए और ऐसी परीक्षा तथा परीक्षण पास करने के लिए, जो ठीक समझा जाए, परिवीक्षा के समाधानप्रद पूरा होने कि एक शर्त के रूप में, अपेक्षा कि जा सके गी ।

(5) परिवीक्षा से संबंधित किसी अन्य मामले के लिए सेवा के सदस्य, सरकार द्वारा, इस निमित्त समय-समय पर जारी किए गए अनुदेशों द्वारा शासित होंगे।

अनुभाग अिधकारी की Dेणी में नियुक्त किया गया कोई आफिसर, जिसका सरकार या किसी राज्य सरकार के अधीन किसी पद पर कोई धारणाधिकार नहm है, परिवीक्षा के दौरान, बिना कोई सूचना दिए किसी भी समय से निमु र्क्त किए जाने का दायी होगा, यदि –[भाग II—खण्ड 4] भारत का राजपत्रा : मई 5, 2018/वैशाख 15, 1940 103 (i) परिवीक्षा के दौरान उसके कार्य निष्पादन या आचरण के आधार पर उसे सेवा मे

प्रतिधारण के लिए अनुपयुक्त समझा जाता है; या

(ii) उसकी राष्ट्रीयता, आयु, स्वास्थ्य या पूर्ववृत या उसकी नियुक्ति से संगत किसी अन्य पक्ष से संबंधित किसी जानकारी के प्राप्त होने पर, नियुक्ति प्रािधकारी का समाधान हो जाता है कि वह सेवा का सदस्य बने रहने के लिए अपात्र या अन्यथा अनुपयुक्त है ।

(2) सेवा के अनुभाग अिधकारी या सहायक अनुभाग अिधकारी की Dेणी में नियुक्त किया गया कोई आफिसर जो सरकार या किसी राज्य सरकार के अधीन किसी पद पर धारणाधिकार रखता है, परिवीक्षा के दौरान किसी भी समय, उप नियम (1) मे विनिTदष्ट किसी भी परिस्थिति में उस पद पर प्रत्यावhतत किया जा सके गा ।

(3) सेवा के अनुभाग अिधकारी या सहायक अनुभाग अिधकारी की Dेणी में नियुक्त किया गया कोई आफिसर, जो िनयम 11(I) के उप िनयम (1) में विनिTदष्ट परिवीक्षा की अवधि या परिवीक्षा की बढ़ाई गयी अविध, यदि कोई है, के दौरान या उसकी समाप्ती पर पुष्टि के लिए या Dेणी में बने रहने के लिए उपयुक्त नहm समझा जाता है, यथास्थिति उप िनयम (1) या उप िनयम (2) के अनुसार निमु र्क्त या प्रत्यावhतत किया जाएगा ।

(4) किसी Dेणी में सीधे भर्ती किए गए tक्ति से भिन्न, परिवीक्षा पर, सेवा का कोई सदस्य जो नियम 11(I) के उप नियम (1) में विनिTदष्ट परिवीक्षा की अवधि या बढ़ाई गयी अविध, यदि कोई है, के दौरान या उसकी समाप्ति पर Dेणी में बने रहने के लिए उपयुक्त नहm समझा जाता है, यथास्थिति, सेवा के पिछली निम्नतर Dेणी में या सश~ बल मुख्यालय लिपिक सेवा में प्रत्यावhतत किया जाएगा ।

(i) ऐसी पूछताछ जो सरकार द्वारा उसकी उपयुक्तता के निर्धारण के लिए आवश्यक समझी जाए; और

(ii) tक्तियों का ऐसी किसी चिकित्सीय परीक्षा के पyात जो सरकार विहित करे किसी ऐसी मानसिक या शारीरिक खराबी से युक्त पाए जाएं जिससे सेवा के कर्तtों के निर्वहन मे हस्तक्षेप की संभावना हो ।

यदि ऐसी अपेक्षा की जाय, तो कर्तt पदों से भिन्न किसी पद पर भारत में कहm पर रक्षा सेवा में चार वर्ष से अन्यून अवधि के लिए सेवा करने का दायी होगा जिसके अंतर्गत रक्षा मंत्रालय या विभाग, जो भारत की रक्षा से सम्बW है, के पद भी हैं और सेवा के आफिसर से के न्Eीय सरकार के कार्यालयों और उप-मों में, जैसा सरकार द्वारा विनिश्चय किया जाए, अन्य समान पदों पर सेवा करने की अपेक्षा भी की जा सके गी :

परन्तु देश की किसी रक्षा सेवा में सेवा करने का दायित्व पचास वर्ष की आयु प्राप्त करने के पyात लागू नहm होगा ।

परन्तु यदि के न्Eीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे tक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनु€ेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी tक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

(2) किसी Dेणी में सीधी भर्ती किए गए tक्ति का वेतन, नियुक्ति प्राधिकारी के समाधान रूप में परिवीक्षा का प्रत्येक वर्ष पूरा करने पर और विहित कालिक परीक्षण, यदि कोई है, पास करने पर वेतन स्तर में एक प्र-म बढ़ाया जाएगा ।

परन्तु आयोग के कार्यक्षेत्र के अधीन आने वाले पदों के संबंध में किसी वर्ग या प्रवर्ग के tक्तियों या पदों की बावत कोई आदेश आयोग से परामर्श करने के पश्चात किया जाएगा, अन्यथा नहm ।

19. 19. 19. 19. 7ावृत्ति7ावृत्ति7ावृत्ति7ावृत्ति....————इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहm डालेगी, जिनका के न्Eीय सरकार द्वारा इस संबंध में समय-समय पर िनकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वगs, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के tक्तियों के लिए उपबंध करना अपेक्षित है ।

MINISTRY OF DEFENCE

New Delhi, the 1st May, 2018

S.R.O. 27.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Armed Forces Headquarters Civil Service Rules, 2001, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely:-

1. Short title and commencement.—(1) These rules may be called the Armed Forces Headquarters Civil Service Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—In these rules, unless the context otherwise requires,-

(a) "appointing authority" in relation to any grade means the authority empowered under the Central Civil Service (Classification, Control and Appeal) Rules, 1965 to make appointments to that grade;

(b) "approved service" in relation to any grade means :

(i) in respect of an officer recruited directly to that grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of January of the year, following the year of the examination for which direct recruitment was held;

(ii) in respect of an officer recruited to that grade through Departmental Examination, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of January of the year for which such examination was held;

(iii) in respect of an officer recruited to that grade on the basis of length of service in the lower grade, period or periods of regular service rendered in that grade, including period or periods of absence during which he would have held a post on regular basis in that grade but for being on leave or otherwise not being available to hold such post, from the first day of January of the year for which the recruitment was made;

(c) "direct recruit" means a persons recruited to the grade of Assistant Section Officer or the grade of Section Officer on the basis of competitive examination held by the Staff Selection Commission or the Commission as the case may be, for the purpose;

(d) "duty post" in relation to any grade means a post of that grade included in the service and shall, in relation to the grades of Principal Director, Director and Joint Director, include the posts specified in Schedule-III; and any additional posts as may be sanctioned by the Government from time to time in the grade concerned;

(e) "eligible officer" means an officer eligible to be considered for promotion to these posts of Principal Director, Director, Joint Director, Deputy Director, Section Officer or Assistant Section Officer, as the case may be, in accordance with rules 7 and 8 of these rules, as per the instructions issued by the Government from time to time;

(f) "field of selection" means the list of eligible officers, arranged in the order of their seniority, from which selections shall be made for inclusion in the Select List;

(g) "Government" means the Government of India;

(h) "grade" means any of the grades specified in rule 4;

(i) "long-term appointment" means appointment for an indefinite period as distinguished from a purely temporary, or adhoc appointment like appointment against leave or other local vacancies or unfilled direct recruitment quota vacancies of a duration not exceeding one year;

(j) "other backward classes" means the castes or communities notified by the Government from time to time for the purpose of reservation in civil services and posts in the Government of India;

(k) "permanent officer" of the service means a person who has been confirmed in the entry grade;

(l) "Schedule" means a Schedule to these rules;

(m) "Schedule Castes" and "Scheduled Tribes" shall have the same meaning as are assigned to them in clauses (24) and (25) respectively of article 366 of the Constitution of India;

(n) "rules" means the Armed Forces Headquarters Civil Service Rules, 2018;

(o) "Select list" in relation to the grades of Principal Director, Director, Joint Director, Deputy Director, Section Officer or Assistant Section Officer means the Select List prepared every year for promotion to the respective grades to fill the existing and anticipated vacancies likely to occur during the year and are decided to be filled by promotion;

(p) "Service" means the Armed Forces Headquarters Civil Service;

(q) "temporary officer" in relation to any grade means a person holding a temporary or officiating appointment in that grade on the basis of his being regularly approved for such appointment or an officer appointed to a grade who is yet to be removed from probation;

(r) "vacancy year" shall be as per the instructions issued by the Government from time to time;

(s) "Commission" means the Union Public Service Commission;

3. Application.—These rules shall apply to the persons holding the posts in any of the grades specified in Schedule-I in Integrated Headquarters of Ministry of Defence (Army, Navy, Air), Defence Staff Headquarters and Inter Service Organisations as specified in Schedule-II.

4. Composition of the Service.- (1) The Service shall comprise of the following six grades:

(a) Principal Director. (b) Director. (c) Joint Director. (d) Deputy Director. (e) Section Officer. (f) Assistant Section Officer.

(2) The posts of Principal Director, Director, Joint Director, Deputy Director shall be classified as Central Civil Service Group 'A'. The posts in the grade of Section Officer shall be classified as Central Civil Service Group 'B' Gazetted and the post in the grade of Assistant Section Officer shall be classified as Central Civil Service Group 'B', Non-Gazetted, Ministerial.

5. Authorised strength of the service and its review.- (1) The duty posts included in various grades of the Service, their numbers and the level in the pay matrix on the date of commencement of these rules shall be as specified in Schedule-I.

(2) Notwithstanding anything contained in sub-rule (1), the Government may-

(a) from time to time make temporary additions or alterations to the duty posts in various grades of the Service;

(b) in consultation with the Commission include in the Service such posts of the Integrated Headquarters of Ministry of Defence (Army, Navy, Air), Defence Staff Headquarters and Inter Service Organisations as can be deemed to be equivalent to the posts included in the service in status, grade, level in the pay matrix and professional content or exclude from the Service a duty post already included in the Service; and[भाग II—खण्ड 4] भारत का राजपत्रा : मई 5, 2018/वैशाख 15, 1940 115 (c) in consultation with the Commission, appoint an officer to a duty post included in the Service under clause (b) to the appropriate grade in a temporary capacity or in a substantive capacity and fix his seniority in the grade after taking into account continuous regular service in the analogous grade.

6. Members of the Service.- (1) The following persons shall be the members of the Service:-

(a) Persons appointed to duty posts under rule 7; and

(b) Persons appointed to duty posts under rule 8.

(2) A person appointed under clause (a) of sub-rule (1) shall, on such appointment, be deemed to be the member of the Service in the appropriate grade applicable to him in Schedule-I and Schedule-II.

(3) A person appointed under clause (b) of sub-rule (1) shall be the member of the Service in the appropriate grade applicable to him in Schedule-I and Schedule-II from the date of such appointment.

7. Initial Constitution of Service.—(1) All existing officers holding Group 'A' and 'B' duty posts on regular basis in the Armed Forces Headquarters Civil Service on the date of commencement of these rules shall be members of the Service in the respective grades.

(2) The regular continuous Service of officers referred to in sub-rule (1) before the commencement of these rules shall count for the purpose of probation, qualifying service for promotion, confirmation and pension in the Service.

(3) To the extent the cadre controlling authority is not able to fill authorised strength of various grades in accordance with the provisions of this rule, the same shall be filled in accordance with the provision of rule 8 of these rules.

8. Future Maintenance of the Service.—(1) The vacant duty posts in any of the grades referred to in Schedule-I after initial constitution under rule 7, shall be filled in the manner provided in Schedule-IV.

(2) The selection of officers for promotion to posts in the Principal Director, Director, Joint Director, Deputy Director, Section Officer and Assistant Section Officer shall be made by selection basis from amongst officers of the next lower grade having the minimum qualifying service as specified in Schedule-IV.

(3) For the purpose of promotion to posts in the grades of Principal Director, Director, Joint Director and Deputy Director the Select List shall be prepared in accordance with the general orders or instructions issued by the Government from time to time.

(4) For the purpose of promotion to posts in the grade of Section Officer a select list shall be made in such number as the Government may determine from time to time, keeping in view the existing and anticipated vacancies, and in proportion stated in para (i) and (ii) of column (3) against serial number 5 (ii) of Schedule-IV from-

(a) Assistant Section Officers of the service who have rendered not less than six years' approved service in the grade in the order of their seniority in that grade; and

(b) Assistant Section Officers of the service selected on the results of the Limited Departmental Competitive Examination held by the Commission for this purpose from time to time, in the order of their merit.

(5) Persons of the two categories being included in the select list in the ratio of 4:1 from category (a) and category (b) and so on in that order and in case required number of selected persons are not available in category (b) above, the deficiency shall be made up from the persons falling in category (a).

(6) Every officer shall, unless he is on leave or otherwise not available for holding a duty post or for any other reason to be recorded in writing, be posted against a duty post of the appropriate grade of the Service.

(7) Every duty post, unless declared to be excluded from the Service or held in abeyance for any reason, shall ordinarily be held by an officer of the appropriate grade.

9. Filling of duty posts by deputation.- Notwithstanding anything contained in rule 8, where the Government is of the opinion that it is necessary or expedient so to do, it may for reasons to be recorded in writing and in consultation with the Commission, fill a duty post in any grade by deputation for a period of three years, which can be extended in special circumstances up to five years. The qualification, experience and the eligibility service for appointment to any grade of the service under these rule shall be decided by the Government in consultation with the Commission on each occasion.

10. Seniority.—(1) The relative seniority of members of the Service on commencement of these rules shall be the relative seniority in their respective grades as determined before commencement of these rules:

Provided that if the seniority of any member of the Service had not been specifically determined before commencement of these rules, it shall be determined by the Government.

(2) The seniority of persons appointed to various grades of the Service after commencement of these rules shall be determined in accordance with the general orders or instructions issued by the Government from time to time.

(3) Relative seniority of direct recruits and promotees in the grade of Section Officer and Assistant Section Officer shall be determined in accordance with the general orders or instructions issued by the Government from time to time.

11. (I) Probation, confirmation or continuance of officers on probation.- (1) Every person on appointment to the grade of Deputy Director, Section Officer, or to the grade of Assistant Section Officer of the Service shall be on probation for a period of two years:

Provided that the appointing authority may extend the period of probation in accordance with the instructions issued by the Government from time to time:

Provided further that any decision for extension of probation period shall be taken ordinarily within eight weeks after expiry of the probation period and communicated in writing to the concerned officer, with the reasons for so doing within the said period.

(2) On completion of the probation or any extension thereof, officers shall, if considered fit, be confirmed in the grade, if not already confirmed in the entry grade:

Provided that an officer shall continue to remain on probation, till such time specific orders for his removal from probation, or confirmation in the grade, as the case may be, are issued by the appointing authority.

(3) If, during the period of probation, or any extension thereof, as the case may be, appointing authority is of the opinion that an officer is not fit for permanent appointment, it may discharge or revert the officer to the post held by him prior to his appointment in the concerned grade of the Service, as the case may be.

(4) During the period of probation, or any extension thereof, officers may be required to undergo such courses of training and instructions and to pass such examinations and tests, as it may deem fit, as a condition to satisfactory completion of the probation.

(5) For any other matter relating to probation, the members of the service shall be governed by the instructions issued by the Government in this regard from time to time.

(II) Discharge or reversion of officers on probation.-

(1) An officer appointed to the grade of Section Officer or Assistant Section Officer of the Service who has no lien on any post under the Government or any State Government shall while on probation, be liable to be discharged from the Service at any time without notice, if -

(i) on the basis of his performance or conduct during probation, he is considered unfit for retention in the Service; or[भाग II—खण्ड 4] भारत का राजपत्रा : मई 5, 2018/वैशाख 15, 1940 117 (ii) on the receipt of any information relating to his nationality, age, health or antecedents or any other aspect relevant to his appointment, the appointing authority is satisfied that he is ineligible or otherwise unfit for being a member of the Service.

(2) An officer appointed to the grade of Section Officer or Assistant Section Officer of the Service who holds a lien on a post under the Government or any State Government may, while on probation, be reverted to such post at any time in any of the circumstances specified in sub-rule (1).

(3) An officer appointed to the grade of Section Officer or Assistant Section Officer of the Service who is not considered suitable for confirmation or continuance in the grade during or at the end of the period of probation specified in sub-rule (1) of rule 11(I) or the extended period of probation, if any, shall be discharged or reverted in accordance with sub-rule (1) or sub-rule (2), as the case may be.

(4) A member of the Service, other than a direct recruit, on probation in any grade who is not considered suitable for continuance in his grade during or at the end of the period of probation specified in sub-rule (1) of Rule 11(I) or the extended period, if any, shall be reverted to the next lower grade in the Service or the Armed Forces Headquarters Clerical Service, as the case may be.

12. Appointment to the Service.—(1) All appointments of direct recruits in the grades of Section Officer and Assistant Section Officer of the Service shall be subject to the following conditions:-

(i) Such enquiry as may be considered necessary by the Government to assess their suitability; and

(ii) persons found to be free from any mental or physical defect, after such medical examination as the Government may specified, which is likely to interfere with the discharge of the duties of the Service.

13. Liability to serve Defence Services or posts connected with Defence.—Any officer appointed to the Service, if so required, shall be liable to serve in any Defence Service anywhere in India or post other than duty posts including the post in Ministry of Defence or Departments connected with the defence of India for a period of not less than four years and Officers of the service may also be required to serve in any other similar posts in Central Government offices and undertakings as decided by the Government:

Provided that the liability to serve in any Defence Service of the country shall not be applicable after attaining the age of fifty years.

14. Disqualification.—(1) No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the Service :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

15. Regulation of Pay.—(1) The pay and increments of officers of various grades shall be regulated in accordance with the Fundamental Rules or other Rules relating to pay for the time being in force.

(2) The pay of a direct recruit in a grade may, on his completing each year of probation to the satisfaction of appointing authority and passing the specified periodical tests, if any, be raised by one stage in the pay level.

16. Composition of Departmental Promotion Committee and Departmental Confirmation Committee.— The composition of Departmental Promotion Committee and Departmental Confirmation Committee for various grades of the service shall be as specified in Schedule-V.

17. Residuary matters.—In regard to matters not specifically covered by these rules or orders made or issued thereunder, the members of the Service shall be governed by the rules, regulations and orders applicable to the Central Civil Service in general.

18. Power to relax.—Where the Government is of the opinion that it is necessary or expedient so to do, it may, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons or posts :

Provided that, in relation to posts falling within the purview of the Commission, no order in respect of a class or category of persons or posts shall be made except after consultation with the Commission.

19. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

20. Interpretation.—If any question relating to the interpretation of these rules arises, it shall be referred to the Government for its decision.

SCHEDULE-I

[See rule 5 (1)]

The authorised cadre strength of the Service.- (1) The authorised strength of the various Grades of the Armed Forces Headquarters Civil Service shall be as specified in Table below:-

*Subject to variation dependent on workload or encadrement or cadre re-structuring etc.

(2) There shall be a Deputation Reserve of twenty percent, Leave Reserve of three percent and Training Reserve of one percent of the sanctioned strength of officers of Deputy Director and above.

(3) The percentage of posts referred to under sub-rule (2) of Schedule-I of this rule shall be in addition to the sanctioned strength indicated under Column (3) of the Table referred to in sub-rule (1) of Schedule-I in respect of posts mentioned against Serial number (i) to (iv).

SCHEDULE-II

Method of recruitment, field of promotion and minimum qualifying service in the next lower grade for

appointment of officers by promotion to duty posts included in various grades of the Armed Forces

Headquarters Civil Service:

Note 1 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.

Note 2: The procedure and conditions including Educational Qualifications for the competitive examinations referred to under Column 3 clause (iii) relating to the grade of Section Officer and under Column 3 clause (ii) relating to the grade of Assistant Section Officer shall be as per the rules notified by the Government for the purpose from time to time.

Note 3: The age limit for direct recruitment to the grade of Assistant Section Officer shall be between twenty and thirty years.

Note 4 : The procedure and conditions for the Computer Proficiency Test shall be as approved or conducted by the Staff Selection Commission for the Competitive Examination referred to under column 3 clause (ii) relating to the grade of Assistant Section Officer.

SCHEDULE-V [See Rule 16]
