सा.का.िन.सा.का.िन.सा.का.िन.सा.का.िन. 136136136136....————राष्ट्रपित, संविधान के अनु(cid:24)छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते $ए और विपणन एवं निरीक्षण निदेशालय (प्रधान लिपिक) भर्ती नियमावली, 1978, जहां तक वे सहायक के पद से हैं, उन बातों के सिवाय अधि3ांत करते $ए, जिन्हें ऐसे अधि3मण से पूर्व किया गया है, या करने का लोप किया गया है, कृ षि एवं किसान कल्याण मंत्रालय के अधीन कृ षि, सहकारिता एवं किसान कल्याण विभाग में उक्त पद पर भर्ती की प>ति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

4.4.4.4. निरर्हतानिरर्हतानिरर्हतानिरर्हता....————वह Mयक्ति,-
(क) जिसने ऐसे Mयक्ति से जिसका पति या पत्नी जीिवत है, विवाह किया है, या विवाह किया हो, जिसका पति / पत्नी हो, अथवा
(ख) जिसने अपने पति या पत्नी के रहते $ए किसी Mयक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहO होगा:
परंतु यदि के न्Pीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस Mयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुRेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी Mयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
5. िशिथ5. िशिथ5. िशिथ5. िशिथल करने की शक्तिल करने की शक्तिल करने की शक्तिल करने की शक्ति....————जहां के न्Pीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखब> करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Mयक्तियों की बाबत, आदेश द्वारा िशिथल कर सके गी ।
6666. 0या. 0या. 0या. 0यावृितवृितवृितवृित....————इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छू ट और अन्य रियायतों पर प्रभाव नहO डालेगी, जिनका के न्Pीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवगW के Mयक्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R. 136.—In exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Directorate of Marketing and Inspection (Head Clerks) Recruitment Rules, 1978, in so far as they relate to the post of Assistant, except as respect things done or omitted to be done before such supersession, the President818 THE GAZETTE OF INDIA : MAY 5, 2018/VAISAKHA 15, 1940 [PART II—SEC. 3(i)] hereby makes the following rules regulating the method of recruitment to the said post in the Directorate of Marketing and Inspection under the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Co-operation and Farmers Welfare, namely :-
1. Short title and commencement.—(1) These rules may be called the Ministry of Agriculture and Farmers Welfare, Department of Agriculture, Cooperation and Farmers Welfare, Directorate of Marketing and Inspection (Assistant) Recruitment Rules, 2018.
(2) They shall come into force on the date of their publication in the Officials Gazette.
2. Number of posts, classification and level in the pay matrix.—The number of the said post, its classifications and the level in the pay matrix shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age limit, qualification.—The method of recruitment, age limits, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualifications.—No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with Union Public Service Commission relax any of the provisions of these rules with respect of any class or category of person.
6. Saving.—Nothing in these rules shall affect reservations and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
