सा.का.िन. सा.का.िन. सा.का.िन. सा.का.िन. 370370370370....———— राष्ट्रपति, संविधान के अनु(cid:30)छेद 309 के परंतुक और अनु(cid:30)छेद 148 के खंड (5) द्वारा प्रदत्त शक्तियों का प्रयोग करते 2ए तथा भारतीय लेखा परीक्षा और लेखा विभाग में सेवारत 9क्तियों के संबंध में भारत के नियंत्रक महालेखा परीक्षक से परामर्श करने के प=ात, मूल नियम, 1922 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. (1) इन नियमों का संक्षिप्त नाम मूल (संशोधन) िनयम, 2018 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. मूल नियम, 1922 में नियम 22 के उपनियम (I) के खंड (क) में उपखंड (1) के स्थान पर निम्नलिखित उपखंड रखा जाएगा, अर्थात् :-

"(1) जहां किसी अधिष्ठायी या अस्थाई या स्थानापन्न हैसियत में सावधिक पद से भिन्न कोई पद धारण करने वाला कोई सरकारी सेवक, यथास्थिति, अधिष्ठायी, अस्थाई या स्थानापन्न हैसियत में ऐसी पात्रता शतP को पूरा करने के अधीन रहते 2ए जो सुसंगत भर्ती नियमों में विहित की जाएं, किसी ऐसे अन्य पद पर प्रोन्नत या नियुक्त किया जाता है जिसके कर्त9 और उत्तरदायित्व उसके द्वारा धारित पद से संबंधित कर्त9ों और दायित्वों से अधिक महत्वपूर्ण हैं, वहां समय वेतनमान में उसका प्रारंभिक वेतन उस स्तर में जिससे सरकारी सेवक की प्रोन्नति 2ई है, एक वेतनवृUि देकर नियत किया जाएगा और उसे प्रोन्नत या नियुक्त किए गए पद के स्तर में समान अंक वाले सैल में रखा जाएगा और यदि प्रोन्नत या नियुक्त किए गए पद के स्तर में कोई ऐसा सैल उपलब्ध नहW है, तो उसे उस स्तर में अगले उXतर सैल में रखा जाएगा ।

काडर बाY पद पर प्रतिनियुक्ति पर या तदर्थ आधार पर या सीधी भर्ती के आधार पर किसी पद पर नियुक्ति के मामलों के सिवाय, सरकारी सेवक को यह विकल्प प्राप्त होगा जिसका वह, यथास्थिति, प्रोन्नति या नियुक्ति की तारीख से एक मास के भीतर प्रयोग कर सके गा कि वह इस नियम के अधीन वेतन को ऐसी प्रोन्नति या नियुक्ति की तारीख से नियत कराए या वेतन को आरंभ में ही जिस पर वह नियमित आधार पर प्रोन्नत किया गया है उस पद के स्तर में अगले उXतर सैल में नियत कराए और तत्प=ात् उस पद के स्तर में, जिससे सरकारी सेवक की प्रोन्नति 2ई है, अगली वेतनवृUि उ[भूत होने की तारीख को, उसका वेतन पुनः नियत किया जाएगा और उस स्तर में जिससे सरकारी सेवक की प्रोन्नति 2ई है, दो वेतन वृUियां (पहली वा]र्षक वेतनवृUि के कारण उ[भूत तथा दूसरी प्रोन्नति के कारण उ[भूत) दी जाएगW और उसे उस पद पर, जिस पर वह प्रोन्नत किया गया है, के स्तर पर समान अंक वाले सैल में रखा जाएगा और यदि उस पद, जिस पर वह प्रोन्नत किया गया है, के स्तर में कोई ऐसा सैल उपलब्ध नहW है, तो उसे उस स्तर में अगले उXतर सैल में रखा जाएगा ।

ऐसे मामलों में जहाँ तदर्थ प्रोन्नति के प=ात् बिना किसी 9वधान के नियमित नियुक्ति कर दी जाती है, वहां विकल्प प्रारंभिक नियुक्ति या प्रोन्नति की तारीख से 'ाY होगा जिसका प्रयोग ऐसी नियमित नियुक्ति की तारीख के एक मास के भीतर किया जाएगा:

ऐसे मामलों में जहाँ कोई अधिकारी उस पद पर नियमित होने से पूर्व तदर्थ रूप में सेवानिवृत्त हो गया है और तत्प=ात् उसका नियमितीकरण की प्रbिया के दौरान निर्धारण किए जाने पर सक्षम प्राधिकारी द्वारा उसे उसके ऐसे कनिष्ठों के साथ ठीक पाया गया है, जो अभी भी सेवा में हैं तथा उस तारीख से जिसको सेवानिवृत्त कर्मचारी भी सेवा में था, विकल्प की सुविधा लेने के लिए पात्र हैं, वहां विकल्प की वही सुविधा सेवानिवृत्त कर्मचारी के लिए भी उस तारीख से, जब उसके कनिष्ठ विकल्प की सुविधा का उपभोग करने के लिए पात्र हो गए थे, तीन मास के भीतर प्रयोग करने के लिए विस्तारित की जाएगी और उन मामलों में जहाँ ऐसा सेवानिवृत्त कर्मचारी स्वयं कनिष्ठतम था, वहां वह उस तारीख से, जिसको उसका आसन्न ज्येष्ट विकल्प की सुविधा पाने के लिए पात्र हो गया था, तीन मास के भीतर विकल्प सुविधा का प्रयोग कर सके गा:

परंतु जहां कोई सरकारी सेवक किसी उXतर पद पर नियमित आधार पर अपनी प्रोन्नति या नियुक्ति के ठीक पूर्व निम्नतर पद के स्तर का अधिकतम वेतन ले रहा है, वहां उXतर पद के स्तर में उसका प्रारंभिक वेतन नियमित आधार पर उसके द्वारा धारित निम्नतर पद की बाबत उसका वेतन निम्नतर पद के स्तर में अंतिम वेतनवृUि के बराबर रकम को बढ़ाकर उसे प्रोन्नत या नियुक्त किए गए पद के स्तर में समान अंक वाले सैल में नियत किया जाएगा, और यदि उस स्तर में, जिसमें उसे प्रोन्नत या नियुक्त किया गया है, ऐसा कोई सैल उपलब्ध नहW है, तो उसे उस स्तर में अगले उXतर सैल में रखा जाएगा।"

New Delhi, the 19th November, 2018

G.S.R.370.— In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely:-

1. (1) These rules may be called the Fundamental (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Fundamental Rules, 1922, in rule 22, in sub-rule (I), in clause (a), for sub-clause (1), the following sub- clause shall be substituted, namely:-

"(1) where a Government servant holding a post, other than a tenure post, in a substantive or temporary or officiating capacity is promoted or appointed in a substantive, temporary or officiating capacity, as the case may be, subject to the fulfillment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties and responsibilities of greater importance than those attaching to the post held by him, his initial pay in the time-scale shall be fixed by giving one increment in the level from which the Government servant is promoted and he or she shall be placed at a cell equal to the figure so arrived at in the level of the post to which promoted or appointed and if no such cell is available in the level to which promoted or appointed, he shall be placed at the next higher cell in that level.

Save in cases of appointment on deputation to an ex cadre post, or to a post on ad hoc basis or on direct recruitment basis, the Government servant shall have the option, to be exercised within one month from the date of promotion or appointment, as the case may be, to have the pay fixed under this rule from the date of such promotion or appointment or to have the pay fixed initially at the next higher cell in the level of the post to which he or she is promoted on regular basis and subsequently, on the date of accrual of next increment in the level of the post from which Government Servant is promoted, his pay shall be re-fixed and two increments (one accrued on account of annual increment and the second accrued on account of promotion) shall be granted in the level from which the Government Servant is promoted and he or she shall be placed, at a cell equal to the figure so1932 THE GAZETTE OF INDIA : NOVEMBER 24, 2018/AGRAHAYANA 3, 1940 [PART II—SEC. 3(i)] arrived, in the level of the post to which he or she is promoted; and if no such cell is available in the level to which he or she is promoted, he or she shall be placed at the next higher cell in that level.

In cases where an ad hoc promotion is followed by regular appointment without break, the option is admissible from the date of initial appointment or promotion, to be exercised within one month from the date of such regular appointment.

In cases where an officer has retired as ad hoc before being regularised to that post and later on has been assessed during the process of regularisation and found fit by the competent authority along with his or her juniors, who are still in service and are eligible to avail of the option facility from a date on which the retired employee was still in service, the same option facility shall also be extended to the retired employee, to be exercised within three months from the date when his or her junior became eligible to avail of option facility and in cases where such retired employee was himself the junior most, he or she may exercise the option facility within three months from the date when his or her immediate senior became eligible to avail of option facility:

Provided that where a Government servant is, immediately before his promotion or appointment on regular basis to a higher post, drawing pay at the maximum of the level of the lower post, his initial pay in the level of the higher post shall be fixed at the cell equal to the figure so arrived at in the level of the post to which promoted or appointed by increasing his pay in respect of the lower post held by him on regular basis by an amount equal to the last increment in the level of the lower post and if no such cell is available in the level to which he is promoted or appointed, he shall be placed at the next higher cell in that level."

परन्तु यदि कें uीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस 9क्ति और विवाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुkेय है और ऐसा करने के िलए अन्य आधार हैं तो वह किसी 9क्ति को इस नियम के प्रवर्तन से छू ट दे सके गी |

5. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति....———— जहां के न्uीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखबU करके , तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के 9क्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

6. 5ावृत्ति5ावृत्ति5ावृत्ति5ावृत्ति....———— इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहW डालेगी, जिनका के न्uीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के 9क्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 371 .— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Environment and Forests, National Museum of Natural History Senior Audio-Visual Assistant (Group 'B') Recruitment Rules, 1988, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Audio Visual Assistant in the National Museum of Natural History, Ministry of Environment, Forest and Climate Change, namely:-

1. Short title and commencement.—(1)These rules may be called the Ministry of Environment, Forest and Climate Change, National Museum of Natural History, Senior Audio Visual Assistant, Group 'B' Post Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix.—The number of the said post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification.—No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall effect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
