MINISTRY OF DEFENCE

New Delhi, the 1st August, 2018

S.R.O. 118.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Defence, Headquarters Integrated Defence Staff, the National Defence Academy, (Administrative Officer) Group 'A' Post Recruitment Rules, 2010, namely: -

1. Short title and commencement.- (1) These rules may be called the Ministry of Defence, Headquarters Integrated Defence Staff, the National Defence Academy, (Administrative Officer) Group 'A' Post Recruitment (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence, Headquarters Integrated Defence Staff, the National Defence Academy, (Administrative Officer), Group 'A' post Recruitment Rules, 2010,-

(a) for rule 2, the following rule shall be substituted, namely :-

"2. Number of posts, Classification and Level in Pay Matrix. – The number of said post, its classification and the Level in the Pay Matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules."

(b) the Schedule,-

(i) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely :-

(ii) in column (12),-

(A) for the words, figures and letters "the pay band - 2 of Rs. 9300-34800 with grade pay of Rs. 4800", "the pay band - 2 of Rs. 9300-34800 with grade pay of Rs. 4600", the words, figures, brackets and letters "level 8[भाग II—खण्ड 4] भारत का राजपत्रा : दिसम्बर 22, 2018/पौष 1, 1940 441 (Rs. 47600-151100) in the pay matrix" and "level – 7 (Rs. 44900-142400) in the pay matrix" shall respectively be substituted;

(B) in Note 1, for the words, letters and figures "in the Scale of Pay Band-2 of Rs. 9300-34800 with grade pay of Rs. 4600", the words, letters and figures "Level 7 (Rs. 44900-142400) in the Pay Matrix shall be substituted;

(C) Note 3 and Note 4 and the entries relating thereto, under sub-heading "Promotion or Deputation (ISTC)" shall be omitted.

(2) ये नियम राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. रक्षा मंत्रालय, मुख्यालय एकीकृ त रक्षा स्टाफ के अधीन स्थापन(समूह ''''ख'''' पद स्थापना अधिकारी एवं कार्यालय अधीक्षक) भर्ती िनयम 2016 में, -

(क) नियम 2 के स्थान पर, निम्नलिखित नियम रखा जाएगा, अर्थात्::::-

S.R.O. 119.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'B' Posts of Establishment Officer and Office Superintendent) Recruitment Rules, 2016, namely: - 1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'B' Posts of Establishment Officer and Office Superintendent) Recruitment (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'B' posts of Establishment Officer and Office Superintendent) Recruitment Rules, 2016,-

(a) for rule 2, the following rule shall be substituted, namely :-

"2. Number of posts, classification and level in pay matrix. – The number of said posts, their classification and the Level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules."

(b) in the Schedule,-

(1) against serial number 1, relating to the post of Establishment Officer,-

(i) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely :-

1. Short title and commencement.— (1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff,(Group 'C' posts) Recruitment (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'C' posts) Recruitment Rules, 2013,-

(a) for rule 3, the following rule shall be substituted, namely :-

"3. Number of posts, classification and level in pay matrix. – The number of said posts, its classification and the Level in the Pay Matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules."

(b) in the Schedule,-

(1) against serial number 1, relating to the post of Upper Division Clerk, -

(i) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely :-

(ii) in column (11),-

(A) for the words, figures and letters "the pay band -1, Rs.5200-20200 plus grade pay Rs. 1900", the words, figures, brackets and letters "level-2 (Rs.19900-63200) in the pay matrix" shall be substituted;

(B) Note 2 and the entries relating thereto shall be omitted.

(2) against serial number 2, relating to the post of Lower Division Clerk , -

(i) in column (4), for the entries, the following entries shall be substituted, namely :-

"Level 2 (Rs.19900-63200) in pay matrix" ;

S.R.O. 121.— In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'C') posts, Recruitment Rules, 2012, namely: -[भाग II—खण्ड 4] भारत का राजपत्रा : दिसम्बर 22, 2018/पौष 1, 1940 451 1. Short title and commencement.Ñ(1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'C') posts, Recruitment (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'C') posts, Recruitment Rules, 2012,-

(a) for rule 3, the following rule shall be substituted, namely :Ñ

"3.Number of posts, classification and level in pay matrix. –The number of said posts, their classification and the Level in the Pay Matrix attached thereto, shall be as specified in columns (2) to (4) of the said Schedule." 3. In the Schedule to the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, (Group 'C') posts Recruitment Rules, 2012.-

(1) against serial number 1, relating to the post of Artist,-

(i) in column (4), for the column heading and the entries, the following column heading and entries shall be substituted, namely :-

1. Short title and commencement. - (1) These rules may be called the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, Group 'C' post Stenographer Grade II, Recruitment (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Ministry of Defence, Establishments under Headquarters Integrated Defence Staff, the Group 'C' post Stenographer Grade II, Recruitment Rules, 2011,-

(a) for rule 2, the following rule shall be substituted, namely :-

"2. Number of posts, classification and level in pay matrix. – The number of posts, their classification and the Level in the Pay Matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.";

S.R.O. 127.— In exercise of the powers conferred by the proviso to article 309 of the constitution, and in supersession of the Navy (Civilian Gazetted Scientific Officers Posts) Recruitment Rules, 2003, the President hereby makes the following rules regulating the method of recruitment to certain Group 'A' and Group 'B' Posts in the Scientific Officers Cadre in the Indian Navy, Recruitment namely:-

1. Short Title and Commencement.- (1) These rules may be called the Ministry of Defence, Indian Navy, Scientific Officers Group 'A' and Group 'B' posts Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of post, classification and Level in Pay Matrix.- The number of said posts, their classification and the Level in the Pay Matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed hereto.

4. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the said posts, age limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons of posts.

7. Saving.- Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribe, Other Backward classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

S.R.O.128.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Integrated Headquarters, Ministry of Defence (Navy) Group 'B', (Scientific Staff posts) Recruitment Rules, 2014, namely:Ñ

1. (1) These rules may be called the Integrated Headquarters, Ministry of Defence (Navy) Group 'B', (Scientific Staff Recruitment)(Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Integrated Headquarters, Ministry of Defence(Navy) Group 'B', (Scientific Staff posts) Recruitment Rules, 2014 (hereinafter referred to as the said rules), for rule 3, the following rule shall be substituted, namely:

"3. Number of posts, classification and Level in the Pay matrix. Number of posts, classification and level in the Pay Matrix attached thereto, shall be as specified in columns [2] to [4] of the schedule.";

3. In the said rules, in the Schedule,- (I) against the post of Senior Scientific Assistant at serial 1,-

(a) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely:

(b) in column (11), for the entry "the scale of pay of Rs. 9300-34800 with Grade Pay of Rs. 4200 in PB-2", the entry "Level-6 (Rs. 35400-112400) in the pay matrix" shall be substituted;

(II) against the post of Scientific Assistant at serial 2,- (a) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely:

(b) in column 9, against the entry, the following shall be substituted:-

"two years"; (c) in column (11), for the entry "the scale of pay of Rs. 5200-20200 with Grade Pay of Rs. 2800 in PB-1", the entry "Level-5 (Rs. 29200-92300) in the pay matrix" shall be substituted.

काकाकाका....िनिनिनिन....आआआआ....129.129.129.129.————राष्ट्रपति, संिवधान के अनु(cid:18)छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:31)ए और रक्षा मंत्रालय रक्षा अनुसंधान तथा िवकास संगठन, प्रशासनिक समूह 'क' और 'ख' पदों के भर्ती िनयम, 2012 को उन बातों के िसवाय जो प्रशासनिक अधिकारी के पद से संबंधित हैं, का अधिUान्त करते (cid:31)ए जिन्हें ऐसे अधिUमण से पहले किया गया है या करने से पहले लोप किया गया है, प्रशासनिक अिधकारी पद का िविनमय करने के िलए निम्नलिखित िनयम बनाते हैं, अर्थात् :-

1.1.1.1. संक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भसंक्षिप्त नाम और प्रारम्भ ....————(1) इन नियमों का नाम रक्षा मंत्रालय,रक्षा अनुसंधान तथा विकास संगठन, प्रशासनिक अधिकारी (समूह 'ख' पदों) भर्ती नियम, 2018 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

3333. भर्तीभर्तीभर्तीभर्ती कीकीकीकी प&तिप&तिप&तिप&ति, , , , आयुआयुआयुआयु----सीमासीमासीमासीमा औरऔरऔरऔर अर्हताएंअर्हताएंअर्हताएंअर्हताएं आदिआदिआदिआदि....————भर्ती की पHति, आयु-सीमा, अर्हताएं और उनसे संबंिधत अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिJदष्ट हैं ।

4444.... निरर्हतानिरर्हतानिरर्हतानिरर्हता....————कोई भी {क्ति,-

(क) िजसने ऐसे {क्ति से िजसका पित या जिसकी प|ी जीिवत है, िववाह किया है;या

(ख) िजसने अपने पित या अपनी प|ी के जीिवत रहते (cid:31)ए किसी {क्ति से िववाह किया है, उक्त पदों में से किसी पद पर नियुक्ति का पात्र नहZ होगा :

परन्तु यदि के न्nीय सरकार का यह समाधान हो जाता है कि ऐसा िववाह उस {क्ति और िववाह के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनुxेय है और ऐसा करने के िलए अन्य आधार हैं तो वह किसी {क्ति को इस िनयम के प्रवर्तन से छू ट दे सके गी ।

5555.... िशिथलिशिथलिशिथलिशिथल करनेकरनेकरनेकरने कीकीकीकी शक्तिशक्तिशक्तिशक्ति....————जहां के न्nीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखबH करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के {क्तियों की बाबत, आदेश द्वारा िशिथल कर सके गी ।

6666.... .ावृत्ति.ावृत्ति.ावृत्ति.ावृत्ति....————इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहZ डालेगी, िजनका के न्nीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूिचत जातियों, अनुसूिचत जनजातियों, अन्य पिछड़े वगY, भूतपूर्व सैनिकों और अन्य िवशेष प्रवर्ग के {क्तियों के िलए उपबंध करना अपेक्षित है ।

S.R.O. 129.— In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Defence, Defence Research and Development Organisation, Administrative Group 'A' and 'B' posts Recruitment Rules, 2012, in so far as they relate to the post of Administrative Officer, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulate the post of Administrative Officer, namely:-

1. Short title and commencement.—(1) These rules may be called the Ministry of Defence, Defence Research and Development Organisation, Administrative Officer (Group 'B' Posts) Recruitment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, level in pay matrix or pay scale.—The number of the said posts, its classification and level in the pay matrix or pay scale attached thereto shall be specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualifications.—No person,-

(a) Who, has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.— Whether the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
