काकाकाका....िनिनिनिन....आआआआ.... 86868686....————के न्(cid:15)ीय सरकार नौसेना अिधिनयम, 1957 की धारा 7 की उप-धारा (2) के अन्तर्गत शक्तियों का प्रयोग करते (cid:26)ए, िनयिमत सेना अथवा वायु सेना के अफसरों जो अंडमान और िनकोबार सिहत एकीकृ त सेना संगठनों अथवा स्थापनाओं के कं माडर-इन-चीफ अथवा अफसर-इन-कमांड हैं और जिसमें सेना, नौसेना और वायुसेना अथवा इनमें से किन्ह, दो सेनाओं के सदस्य शािमल हैं, के िलए नौसेना अिधिनयम, 1957 (1957 का अिधिनयम 62) के अध्यधीन अंडमान और िनकोबार सिहत एकीकृ त सेना संगठनों के साथ सम्ब/ अथवा उनमें कार्यरत 1क्तियों, जिसमें सेना, नौसेना और वायुसेना अथवा इनमें से किन्ह, दो सेनाओं के सदस्य शािमल हैं, के ऊपर अनुशासनात्मक शक्तियों का प्रयोग करने की आवश्यकता को देखते (cid:26)ए, एतदद्वारा घोषणा करती है कि सक्षम प्राधिकारी द्वारा ऐसा अिधकार दिए जाने पर सेना और वायुसेना के उक्त अफसर नौसेना आिधिनयम, 1957 के अध्यधीन अंडमान और िनकोबार सिहत ऐसे एकीकृ त सेना संगठनों से सम्ब/ अथवा इनमें कार्यरत 1क्तियों, जिसमें सेना, नौसेना और वायुसेना अथवा इनमें से किन्ह, दो सेनाओं के सदस्य शािमल हैं, के ऊपर अनुशासनात्मक शक्तियों का प्रयोग करेंगे तथा सेना अिधिनयम, 1950 की धारा 3(xviii) के अन्तर्गत और वायुसेना अिधिनयम, 1950 की धारा 4(xxiii) के अन्तर्गत यथा परिभाषित उक्त अफसरों को नौसेना अिधिनयम, 1957 की धारा 3 (16) के अन्तर्गत यथा परिभाषित अफसर माना जाएगा।

S.R.O.... 86.—There being a necessity for officers of the regular Army and the Air Force who are Commander- in-Chief or the officer-in-Command of Unified Service Organizations or Establishments including the Andaman and Nicobar Command, comprising members of Army, Navy and Air Force or any two of them, to exercise Discipline over persons subject to the Navy Act, 1957 (Act 62 of 1957), who are attached to or are serving therein, the Central Government in exercise of powers under sub-sec (2) of Section 7 of Navy Act, 1957, hereby declare that the said officers of the Army and Air Force shall exercise disciplinary powers, whilst so empowered by the competent authority, over persons subject to the Navy Act, 1957 who are attached to or are serving in such Unified Service Organizations including the Andaman and Nicobar Command, comprising members of Army, Navy and Air Force or any two of them and that Officers of the regular Army as defined under section 3 (xviii) of the Army Act, 1950 and Officers of the Air Force as defined under section 4 (xxiii) of the Air Force Act, 1950, shall be deemed to be officers as defined under section 3 (16) of the Navy Act, 1957.

काकाकाका....िनिनिनिन....आआआआ.... 87878787.—राष्ट्रपति, संिवधान के अनुBछेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते (cid:26)ए रक्षा मंत्रालय इलेक्ट्रोनिक्स और यांत्रिक इंजीनियरों के कोर- प्रयोगशाला कर्मचारीवृन्द समूह "ग" भर्ती नियम, 2014 संशोधन करने के लिए निम्नलिखित नियम बनाते हैं। अर्थात:-
1. (1) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय इलेक्ट्रोनिक्स और यांत्रिक इंजीनियरों के कोर प्रयोगशाला कर्मचारीवृन्द (संशोधन) नियम, 2019 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. रक्षा मंत्रालय इलैकट्रोंनिक्स और यांत्रिकी इंजीनियरों के कोर प्रयोगशाला कर्मचारीवृन्द समूह "ग" भर्ती नियम, 2013 (जिसमें इसके पYात उक्त नियम कहा गया है) में, नियम 2 के स्थान पर निम्नलिखित नियम रखा जाएगा अर्थात:-
"2. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर- पदों की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स में स्तर वह होगा जो इन नियमों से उपाब/ अनुसूची के स्तंभ (2) से स्तंभ (4) में विनि[र्दष्ट है";
3. उक्त नियमों में, अनुसूची में –
(क) प्रयोगशाला निदर्शक/प्रारूप के पद के सामने -
(i) प्रयोग स्तंभ (4) में, स्तंभ शीर्षक और इससे संबंिधत प्रवष्टियों के स्थान पर निम्नलिखित स्तंभ शीर्षक और प्रविष्टियां रखी जाएगी, अर्थात:-

S. R. O. 87.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Ministry of Defence Corps of Electronics and Mechanical Engineers Group 'C' Laboratory Staff Recruitment Rules, 2014, namely:-
1. These rules may be called the Ministry of Defence Corps of Electronics and Mechanical Engineers Group 'C' Laboratory Staff Recruitment (Amendment) Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Ministry of Defence Corps of Electronics and Mechanical Engineers, Group 'C' Laboratory Staff Recruitment Rules, 2014 (hereinafter referred to as the said rules), for rule 2, the following rule shall be substituted, namely:-
"2. Number of posts, classification level in pay matrix.- Number of posts, classification and the level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the schedule.";
3. In the said rules, in the Schedule,-
(a) against the post relating to Laboratory Demonstrator,-
(i) in column (4), for the column heading and the entries relating thereto, the following column heading and entries shall be substituted, namely:-

काकाकाका. िनिनिनिन.आआआआ. 88.—राष्ट्रपति, संिवधान के अनुBछेद 309 के परन्तुक द्वारा प्रदत्त् शक्तियों का प्रयोग करते (cid:26)ए, और रक्षा मंत्रालय [चित्रकार और कक्ष आर्डर्ली समूह 'ग' पद] भर्ती नियम 2014 को, उन बातों के सिवाय अधिcांत करते (cid:26)ए, जिन्हें ऐसे अधिcमण से पूर्व किया गया है या करने का लोप किया गया है, सेना की निम्नतर विरचनाओं में चित्रकार और कक्ष आर्डर्ली समूह 'ग' अराजपत्रित, अननुसचिवीय पदों पर भर्ती की प/ति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नामसंक्षिप्त नाम और प्रारंभऔर प्रारंभऔर प्रारंभऔर प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय (चित्रकार और कक्ष आर्डर्ली समूह 'ग' पद) भर्ती नियम, 2019 है ।
(2) ये राजपत्र में उन के प्रकाशन की तारीख को प्रवृत्त होंगे ।

4. निरर्हतानिरर्हतानिरर्हतानिरर्हता.—वह 1क्ति—
(क) जिसने ऐसे 1क्ति से जिसका पति या जिसकी पeी जीिवत है, विवाह किया है या विवाह की संविदा की है; या
(ख) जिसने अपने पति या अपनी पeी के जीवित रहते (cid:26)ए किसी 1क्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्र नह, होगा :
परन्तु यदि के न्(cid:15)ीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे 1क्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुfेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी 1क्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
5. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति.—जहां के न्(cid:15)ीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब/ करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के 1क्तियों की बाबत, आदेश द्वारा िशिथल कर सके गी।

S.R.O. 88.— In exercise of the powers conferred by the provision to article 309 of the constitution, and in supersession of the Ministry of Defence (Group 'C' posts Painter and Room Orderly) Recruitment Rules 2014, except as things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group 'C' non-Gazetted, Non-Ministerial posts of Painter and Room Orderly in the lower formations of the Army in the Ministry of Defence, namely:-
1. Short title and commencement.—(a) These rules may be called the Ministry of Defence (Group 'C' posts Painter and Room Orderly) Recruitment rules 2019.
(b) They shall come into force from the date of their publication in the Official Gazette.
2. Number of posts, classification and level in the pay matrix .— The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in column (2) to (4) of the schedule annexed to these rules.
3. Method of recruitment, age-limit qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating to the said post, shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.—No person,—
(a) Who has entered into or contracted a marriage with a person having a spouse living; or
(b) Who, having a spouse living, has entered into or contracted marriage with any person,
shall be eligible for appointment to any of the said posts:
Provided that Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.— Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
