सासासासा....काकाकाका....िनिनिनिन ....340340340340((((अअअअ).).).).————राष्ट्रपति संिवधान के अनु(cid:20)छेद 309 के तहत प्रदत्त शक्तियों का प्रयोग करते (cid:31)ए और अधीक्षक, सीमा- शुल्क (निवारक), समूह 'ख' भर्ती नियम, 1983 को उन बातों के सिवाय अधि+ांत करते (cid:31)ए जिन्हें ऐसे अधि+मण से पहले किया गया है या करने का लोप किया गया है एत4ारा कें 5ीय अप्रत्यक्ष कर एवं सीमा-शुल्क बोर्ड, राजस्व विभाग, वित्त मंत्रालय में अधीक्षक, सीमाशुल्क (िनवारक), समूह 'ख'राजपत्रित के पद पर भर्ती की प<ति को विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात:-

(i) कोलकाता सीमा-शुल्क सदन संवर्ग, जिसमें कोलकाता (पत्तन) और कोलकाता (विमानपत्तन) सीमा-शुल्क आयुक्तालय के सीमा-शुल्क (निवारक) के अधीक्षक आयेंगे ;
(ii) मुम्बई सीमा-शुल्क सदन संवर्ग, जिसमें मुम्बई-I मुम्बई-II,मुम्बई-IIIसीमा-शुल्क जोन और गोवा सीमा-शुल्क सदन (िनवारक) के अधीक्षक आयेंगे ।
(iii) चेन्नई सीमा-शुल्क सदन संवर्ग, जिसमें चेन्नई सीमा-शुल्क जोन के चेन्नई कस्टम सदन और चेन्नई सीमाशुल्क (निवारक) के अधीक्षक आयेंगे ।
(iv) कोYीन सीमा-शुल्क सदन संवर्ग, जिसमें कोYीन सीमा-शुल्क सदन और कोYीन सीमा-शुल्क (निवारक) आयुक्तालय के सीमाशुल्क (निवारक) के अधीक्षक आयेंगे ।
(v) विशाखापZनम सीमा-शुल्क सदन संवर्ग, जिसमें विशाखापZनम कस्टम सदन के और विशाखापZनम सीमा-शुल्क सदन(निवारक) के सीमाशुल्क (निवारक) के अधीक्षक आयेंगे ।

(क)(क)(क)(क) जिसने ऐसे Kक्ति से जिसका पति या प_ी जीवित है, िववाह किया है, या विवाह की संविदा की है; या
(ख)(ख)(ख)(ख) जिसने अपने पति या अपनी प_ी के जीवित रहते (cid:31)ये किसी Kक्ति से विवाह किया है या विवाह की संविदा की है,उक्त पद पर नियुक्ति का पात्र नह[ होगा:
परंतु यदि के न्5ीय सरकार, का यह समाधान हो जाता है कि ऐसा विवाह उस Kक्ति और विवाह के अन्य विवाह के दूसरे पक्षकार की स्वीय विधि के अंतर्गत अनु'ेय है और ऐसा करने के लिये अन्य आधार हैं तो वह ऐसे किसी भी Kक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
7.7.7.7. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति....————जहां कें 5ीय सरकार की यह राय हो कि ऐसा करना आवश्यक और समाचीन है, वहां उसे िलए जो कारण है लेखब< करते (cid:31)ए तथा संघ लोक सेवा आयोग के साथ परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के Kक्तियों की बाबत आदेश द्वारा शिथिल कर सके गी।
8.8.8.8. AावृतिAावृतिAावृतिAावृति....————इन नियमों की कोई बात,ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नह[ डालेगी, जिनका कें 5ीय सरकार द्वारा इस संबंध में जारी किए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के Kक्तियों के लिए उपबंध करना अपेक्षित है।

New Delhi, the 13th November, 2019
G.S.R. 340.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Superintendent of Customs (Preventive), Group 'B' Recruitment Rules, 1983 except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulate the method of recruitment to the post of Superintendent of Customs (Preventive), Group 'B' Gazetted in the Central Board of Indirect Tax and Customs, Department of Revenue, Ministry of Finance, namely:-
1. Short title and commencement.— (1) These rules may be called the Superintendent of Customs (Preventive) Recruitment Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.

These rules shall apply to persons appointed to the posts of Superintendent of Customs (Preventive) specified in column(1) of the Schedule annexed in these rules.
3. Number of post, classification and level in the pay matrix.—The number of said post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
4. Cadre.—
The said posts shall be divided into five cadres namely:
(i) Kolkata Custom House cadre comprising Superintendents of Customs (Preventive) of Kolkata (Port) and Kolkata (Airport) Customs Commissionerates;
(ii) Mumbai Custom House Cadre comprising Superintendents of Customs (Preventive) of Mumbai-I, Mumbai-II, Mumbai-III Customs Zones and Goa Custom House;
(iii) Chennai Custom House cadre comprising Superintendents of Chennai Custom House and Customs (Preventive) of Chennai Customs Zone;
(iv) Cochin Custom House cadre comprising Superintendents of Customs (Preventive) of Cochin Custom House and Cochin Customs (Preventive) Commissionerate;
(v) Vishakhapatnam Custom House cadre comprising Superintendents of Vishakhapatnam Custom House and Customs (Preventive) of Vishakhapatnam Custom House.
5. Method of recruitment, age limit, qualification, etc.— The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the aforesaid Schedule.
6. Disqualification.— No person,—
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
8. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

(क) जिसने ऐसे zयक्ति से, जिसका पति या जिसकी पत्नी जीिवत है, विवाह किया है या विवाह की संविदा की है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते (cid:31)ए किसी zयक्ति से विवाह किया है या विवाह की संविदा की है;

परन्तु यदि के न्5ीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे zयक्ति के अन्य पक्षकार को लागू स्वीय िविध के अधीन अनु'ेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी zयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
5. शिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्तिशिथिल करने की शक्ति ....————जह{ के न्5ीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके िलए जो कारण हैं, उन्हें लेखब< करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के zयक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

KयाKयाKयाKयावृत्तिवृत्तिवृत्तिवृत्ति....————इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नह[ डालेगी, जिनका के न्5ीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य िपछडे वगT, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के zयक्तियों के लिए उपबंध करना अपेक्षित है ।

Sucheta Kriplani Hospital, New Delhi, namely:-
1. Short title and commencement.— (1) These rules may be called the Lady Hardinge Medical College and Smt. Sucheta Kriplani Hospital , New Delhi, (Haveldar),Group-'C' post, Recruitment Rules, 2019.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in pay matrix.—The number of the post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications etc.—The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.—No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard.

(क) जिसने ऐसे zयक्ति से जिसका पति या जिसकी पत्नी जीिवत है, विवाह किया है या विवाह की संविदा की है ; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते (cid:31)ए किसी zयक्ति से विवाह किया है या विवाह की संविदा की है, उक्त पद पर िनयुक्ति का पात्र नह[ होगा।
परन्तु यदि कें 5ीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे zयक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनु'ेय है और ऐसा करने के लिए अन्य आधार हैं, तो वह किसी zयक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule.

Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Savings.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concession required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
