सा.का.नि.28.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सरदार वल्लभभाई पटेल राष्ट्रीय पुलिस अकादमी, हैदराबाद (कैमरामैन, ज्येष्ठ प्रयोगशाला सहायक, कनिष्ठ सहायक और स्टूडियो परिचर) भर्ती नियम, 1988 को जहाँ तक उनका संबंध कनिष्ठ प्रयोगशाला सहायक से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के अधीन सरदार वल्लभभाई पटेल राष्ट्रीय पुलिस अकादमी, हैदराबाद में कनिष्ठ प्रयोगशाला सहायक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ.—
(i) इन नियमों का संक्षिप्त नाम सरदार वल्लभभाई पटेल राष्ट्रीय पुलिस अकादमी, (कनिष्ठ प्रयोगशाला सहायक ) भर्ती नियम, 2020 है।
(ii) ये, राजपत्र में उनकेें प्रकाशन की तारीख को प्रवृत्त होंगे ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं, आदि .— भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं।
4. निरर्हता.—वह व्यक्ति -
(क) जिसने ऐसे व्यक्ति, जिसका पति या पत्नी जीवित है, से विवाह किया है या विवाह की संविदा की है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति .—जहाँ केन्द्रीय सरकार की राय है कि ऐसा करना आवश्यक या समीचीन है, वहाँ वह कारण को लेखबद्ध कर इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।
6. व्यावृत्ति.— इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

New Delhi, the 13th February, 2020
G.S.R. 28 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Sardar Vallabhbhai Patel National Police Academy, Hyderabad (Cameraman, Senior Laboratory Assistant, Junior Assistant and Studio Attendant) Recruitment Rules, 1988, in so far as they relate to the post of Junior Laboratory Assistant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Junior Laboratory Assistant in the Sardar Vallabhbhai Patel National Police Academy, Hyderabad under the Ministry of Home Affairs, namely :-
1. Short title and commencement.— (1) These rules may be called the Sardar Vallabhbhai Patel National Police Academy, Hyderabad (Junior Laboratory Assistant) Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in the pay matrix.— The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.—No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, and that there are grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for the reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-servicemen, the Other Backward class and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

G.S.R. 29.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Police Training College (Non-gazetted Staff) Recruitment Rules, 1959, in so far as they relate to the post of Compounder except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Pharmacist in the Sardar Vallabhbhai Patel National Police Academy, Hyderabad, under the Ministry of Home Affairs, namely :-
1. Short title and commencement.— (1) These rules may be called the Sardar Vallabhbhai Patel National Police Academy (Pharmacist) Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification and level in the pay matrix.—The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. Disqualification.—No person,-
(c) who has entered into or contracted a marriage with a person having a spouse living; or
(d) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage, and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, ex-servicemen, other backward classes and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

2. पद की संख्या, वर्गीकरण, वेतन मैट्रिक्स में स्तर.—पद की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स में स्तर वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से (4) में विनिर्दिष्ट हैं।

5. शिथिल करने की शक्ति .—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध कर, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी।

G.S.R. 31.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Serologist Department, Kolkata (Class III and Class IV posts) Recruitment (Amendment) Rules, 1973, in so far as they relates to the post of Senior Laboratory Technician, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Laboratory Technician in Ministry of Health and Family Welfare, Institute of Serology, Kolkata, namely:-
1. Short title and commencement. — (1) These rules may be called the Ministry of Health and Family Welfare, Institute of Serology, Kolkata, Senior Laboratory Technician (Group 'C' Post) Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classification, level in pay matrix.— The number of the said post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications, etc.— The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification. — No person, —
(a) who has entered into or contracted a marriage with a person having a spouse living ; or (b) who, having a spouse living, has entered into or contracted a marriage with any person.

सा.का.नि. 32 .—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और कें द्रीय सरकार स्वास्थ्य योजना (प्रशासनिक अधिकारी) समूह 'ख' राजपत्रित पद भर्ती नियम, 2002 को उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, स्वास्थ्य एवं परिवार कल्याण मंत्रालय, कें द्रीय सरकार स्वास्थ्य योजना में प्रशासनिक अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते है, अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ.— (1) इन नियमों का संक्षिप्त नाम स्वास्थ्य और परिवार कल्याण मंत्रालय, के न्द्रीय सरकार स्वास्थ्य योजना संगठन (प्रशासनिक अधिकारी) भर्ती नियम, 2020 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. पद संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर .— उक्त पद की संख्या, उनका वर्गीकरण और उनसे संबद्ध वेतन मैट्रिक्स में स्तर वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ (2) से (4) में विनिर्दिष्ट हैं।
3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि.—उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम् भ (5) से (13) में विनिर्दिष्ट हैं।
4. निरर्हता .— वह व्यक्ति –
(क) जिसने किसी ऐसे व्यक्ति से विवाह किया है अथवा विवाह की संविदा की है जिसका पति या पत्नी जीवित है, या
(ख) जिसने एक पति/एक पत्नी के जीवित रहते हुए किसी व्यक्ति के साथ विवाह किया है अथवा विवाह की संविदा की है, उक्त पद पर नियुक्ति का पात्र नहीं होगा:
परंतु यदि कें द्रीय सरकार इससे सहमत है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार पर लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
5. शिथिल करने की शक्ति.—जहां कें द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबन्ध को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।
6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के द्रीय सरकार द्वारा इस संबंध में सयम-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| वर्ष की सेवा की है; और ख. जिनके पास निम् नलिखित शैक्षिक अर्हता और अनुभव है :- (i) मान् यताप्राप् त विश् वविद्यालय या संस् था से डिग्री । (ख) सरकारी कार्यालय या सार्वजनिक क्षेत्र क े उपक्रम या स्वायत्त निकाय या कानूनी निकाय में लेखा, प्रशासन, स् थापना में दो वर्ष का अनुभव। टिप्पण:- जहां ऐसे कनिष् ठ व् यक्तियों के संबंध में, जिन् होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन् नति के लिए विचार किया जा रहा हो, वहां उनसे वरिष् ठ व् यक्तियों के संबंध में भी विचार किया जाएगा बशर्तें कि उनके पास कनिष् ठ व् यक्तियों से कम अथवा दो वर्ष से कम अर्हक या पात्रता सेवा, इनमें से जो भी कम हो, न हो और उन् होंने अपने ऐसे कनिष् ठ व् यक्तियों सहित जिन् होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच् चतर श्रेणी में प्रोन् नति की अपनी परिवीक्षा अवधि सफलतापूर्वक पूरी कर ली हो। प्रतिनियुक्ति की अवधि, जिसके अंतर्गत क ें द्रीय सरकार के उसी या किसी अन् य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारिता किसी अन् य संवर्ग बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी। प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु-सीमा आवेदन प्राप् त होने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। पोषक प्रवर्ग श्रेणी के ऐसे विभागीय अधिकारी जो प्रोन् नति की सीधी पंक्ति में है प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार, प्रतिनियुक् त व् यक्ति प्रोन् नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। |

The maximum age limit for appointment by deputation shall not be exceeding 56 years as on the last date of receipt of applications. The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. 1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम स्वास्थ्य एवं परिवार कल्याण मंत्रालय, डॉ. राम मनोहर लोहिया अस्पताल, नई दिल्ली दर्जी, (समूह 'ग' पद), भर्ती नियम, 2020 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद की संख्या, वर्गीकरण, वेतन मैट्रिक्स में स्तर.—पद की संख्या, उसका वर्गीकरण, वेतन मैट्रिक्स में स्तर वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट है ।
3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं, आदि .— भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं ।
4. निरर्हता.—वह व्यक्ति –
(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है या विवाह की संविदा की है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है;
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
5. शिथिल करने की शक्ति.—जहॉं के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।
6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R.33.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the erstwhile Willingdon Hospital and Nursing Home (Class IV) Recruitment Rules, 1973, in so far as they relate to the post of Tailor, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Tailor in the Ministry of Health and Family Welfare, Dr. Ram Manohar Lohia Hospital and Nursing Home, New Delhi, namely:-
1. Short title and commencement.— (1) These rules may be called the Ministry of Health and Family Welfare, Dr. Ram Manohar Lohia Hospital, New Delhi, Tailor (Group 'C' Posts), Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of post, classifications, level in the pay matrix.—The number of the said posts, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.
3. Method of recruitment, age-limit, qualifications, etc.—The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
4. Disqualification.—No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of person in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 34 .—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कें द्रीय हिंदी निदेशालय और वैज्ञानिक तथा तकनीकी शब्दावली आयोग, समूह "क" और समूह "ख" राजपत्रित तथा अराजपत्रित पदों के भर्ती नियम,1995 को, जहाँ तक उनका संबंध सहायक निदेशक (भाषा) के पद से है, उन बातों के सिवाए अधिक्रांत करते हुए जिन्हें[भाग II—खण्ड 3(i)] भारत का राजपत्र : फरवरी 22, 2020/फाल्गुन 3, 1941 203 अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, कें द्रीय हिंदी निदेशालय, उच्चतर शिक्षा विभाग, मानव संसाधन विकास मंत्रालय में सहायक निदेशक (भाषा) के पद पर भर्ती पद्धति का विनियम करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :

G.S.R.34.—In exercise of powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Hindi Directorate and Commission for Scientific and Technical Terminology, Group (A) and Group (B) Gazetted and Non-Gazetted posts Recruitment Rules, 1995, in so far as they relate to the post of the Assistant Director (Language) , except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Director (Language) in Central Hindi Directorate, Department of Higher Education, Ministry of Human Resource Development, namely :-
1. Short title and commencement .— (1) These rules may be called the Ministry of Human Resource Development, Department of Higher Education, Central Hindi Directorate, New Delhi, Group 'A ' Recruitment Rules, 2020.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. Number of post, classification and level in pay matrix.—The number of post, its classification and the level in pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit and qualification etc.— The method of recruitment to the said post, age- limit, educational qualifications and other matters connected therewith shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.— No person ;
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.—where the Central Government is of the opinion that it is necessary or expedient so to do, by order for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving.—Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, other backward classes, Ex-Service personnel and other special categories of persons in accordance with the orders issued by the Central Government from time to time in the regard.

Desirable :(i) Experience of lexicographical work involving use of Hindi from a Government organisation; (ii) studied one Indian Language other than Hindi and one foreign language other than English in 10th standard or any higher level. Note 1 :The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. Note 2 : The period of deputation including period of deputation in another ex-cadre post held immediately preceeding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not exceed three years. सा.का.नि. 35.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और के न्द्रीय भूमिगत जल बोर्ड, (वैज्ञानिक समूह 'क' पद) भर्ती नियम, 1995 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है, या करने का लोप किया गया है, के न्द्रीय भूमिगत जल बोर्ड में वैज्ञानिक समूह 'क' के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते है, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम जल शक्ति मंत्रालय, जल संसाधन, नदी विकास और गंगा संरक्षण विभाग, के न्द्रीय भूमिगत जल बोर्ड, (वैज्ञानिक समूह 'क' पद) भर्ती नियम, 2020 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. परिभाषाएँ .—इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो :
(क) "आयोग" से संघ लोक सेवा आयोग अभिप्रेत है;
(ख) "नियंत्रक प्राधिकारी" से भारत सरकार के जल शक्ति मंत्रालय , जल संसाधन , नदी विकास और गंगा संरक्षण विभाग अभिप्रेत है ;
(ग) "विभागीय प्रोन्नति समिति" से किसी भी श्रेणी में प्रोन्नति / पुष्टि के संबंध में विचार करने के लिए गठित समिति अभिप्रेत है;
(घ) "सरकार" से भारत सरकार अभिप्रेत है ।
(ङ) "अनुसूची" से इन नियमों से उपाबद्ध अनुसूची अभिप्रेत है।
(च) किसी श्रेणी के संबंध में "नियमित सेवा" से इन नियमों के अधीन चयन और नियुक्ति के पश्चात उस श्रेणी में की गई सेवा की अवधि या अवधियाँ अभिप्रेत है और जिसके अंतर्गत कोई ऐसी अवधि या अवधियाँ भी है;
(i) जिनकी गणना सेवा के प्रारम्भिक गठन के समय नियुक्त व्यक्तियों की दशा में ज्येष्ठता के प्रयोजन के लिए की गई है;
[भाग II—खण्ड 3(i)] भारत का राजपत्र : फरवरी 22, 2020/फाल्गुन 3, 1941 209(ii) जिसके दौरान कोई अधिकारी उस श्रेणी में पद धारण करता किन्तु छु ट्टी पर होने के कारण या ऐसा पद धारण करने के लिए अन्यथा उपलब्ध नहीं होने के कारण उसने पद धारण नहीं किया;
(छ) "अनुसूचित जाति" और "अनुसूचित जनजाति" के वही अर्थ होंगे जो उनको संविधान के अनुच्छेद 366 के क्रमशः खंड (24) और (25) में है;
3. लागू होना.—ये नियम अनुसूची के स्तम्भ (1) में विनिर्दिष्ट पदों को लागू होंगे।
4. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.—उक्त पदों की संख्या, उनका वर्गीकरण और वेतन मैट्रिक्स में स्तर, नियम 8 में जैसा उपबंधित है वही होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं ।
5. भर्ती की विधि, आयु-सीमा और अन्य अर्हताएं, आदि.—भर्ती की पद्धति, आयु सीमा, अर्हताएँ और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तम्भ (13) में विनिर्दिष्ट हैं।
6. सुनम्य कोटिपूरक योजना (एफसीएस) के अधीन स्वस्थाने प्रोन्नति के लिए प्रक्रिया -
(i) वैज्ञानिक 'ख' से वैज्ञानिक 'ग' और वैज्ञानिक 'ग' से वैज्ञानिक 'घ' के पद पर स्वस्थाने प्रोन्नति कार्मिक और प्रशिक्षण विभाग के कार्यालय ज्ञापन संख्या एबी-14-17 / 37/2008-स्थापना (आरआर) दिनांक 10.09.2010, यथा संशोधित द्वारा जारी मार्गनिर्देशों के अनुसार की जाएगी । सुनम्य कोटिपूरक योजना के अधीन स्वस्थाने प्रोन्नति के वल समूह 'क' वैज्ञानिक पदों पर ही लागू होता है। विभागों या मंत्रालयों में प्रबंधन या प्रशासनिक कार्य करने वाले वैज्ञानिकों या तकनीकी विशेषज्ञों पर सुनम्य कोटिपूरक योजना के अधीन उन्नयन के लिए विचार नहीं किया जाना चाहिए, उन्हें के वल आश्वस्त वृत्ति प्रोन्नति योजना (एमएसीपी) के अधीन उन्नयन का लाभ दिया जाना चाहिए।
(ii) सुनम्य कोटिपूरक योजना के अधीन सम्मिलित सभी पदों के वेतन मैट्रिक्स, पदनाम और पालन से जुड़ी न्यूनतम रेजीडेन्सी अवधि समान स्तर पर निम्नलिखित होंगी ।

(iii) मूल्यांकन के दो स्तर होंगे, पहला स्तर स्क्रीनिंग उद्देश्यों के लिए आंतरिक स्तर पर होगा और अगला स्तर चयन के लिए बाह्य मूल्यांकन उद्देश्यों के लिए होगा । इस उद्देश्य के लिए निम्नलिखित प्रक्रिया होगी:
(क) (i) सुनम्य कोटिपूरक योजना के अधीन स्क्रीनिंग समिति द्वारा वर्ष में दो बार - 1 जनवरी से पहले और 1 जुलाई से पहले प्रोन्नति की पुनर्विलोकन की जाएगी ।
(ii) मूल्यांकन बोर्ड द्वारा वर्ष में दो बार अर्थात प्रत्येक वर्ष की 1 जनवरी और 1 जुलाई से पहले ऐसे सभी उम्मीदवारों की प्रोन्नति की पुनर्विलोकन की जाएगी जिन्होंने रेज़िडेन्सी की विहित अवधि पूरी कर ली है ।
(iii) सुनम्य कोटिपूरक योजना के अधीन जनवरी से जून के दौरान परिपक्व होने वाले प्रोन्नति के मामलों की पुनर्विलोकन उसी वर्ष जुलाई के माह में की जाएगी तथा जुलाई से दिसंबर के दौरान परिपक्व होने वाले प्रोन्नति के मामलों का पुनर्विलोकन अगले वर्ष जनवरी माह में की जाएगी ।
(ख) यदि कोई पात्र अधिकारी की भारत या विदेश में विदेश सेवा या अध्ययन अवकाश पर है, उसके मामले पर विचार किया जाएगा और यदि ऐसे व्यक्ति को सुनम्य कोटिपूरक योजना के अधीन अगली उच्चतर श्रेणी के लिए स्वस्थाने प्रोन्नति का अनुमोदन दिया गया है, तो ऐसी स्थिति में प्रोन्नति की तारीख कें द्रीय भूजल बोर्ड में कार्यभार ग्रहण करने की तारीख से प्रभावी होगी और वित्तीय लाभ भी उसी तारीख से प्राप्त होगा तथा साक्षात्कार में भाग लेने के लिए कोई यात्रा भत्ता या महंगाई भत्ता प्रदान नहीं किया जाएगा;
210 THE GAZETTE OF INDIA : FEBRUARY 22, 2020/PHALGUNA 3, 1941 [PART II—SEC. 3(i)](ग) उत्कृ ष्ट श्रेणी प्राप्त करने वाले असाधारण मेधावी उम्मीदवारों को रेज़िडेन्सी की अवधि में छू ट दी जाएगी, यह छू ट एक अवसर पर एक वर्ष से अधिक नहीं होगी तथा पूरे कै रियर के दौरान यह छू ट दो अवसर तक ही सीमित होगी। सुनम्य कोटिपूरक योजना के अधीन अगली श्रेणी के लिए मूल्यांकन के वल तीन बार किया जाएगा और तत्पश्चात वैज्ञानिक को संशोधित आश्वस्त कै रियर उन्नयन योजना (एमएसीपी) के प्रावधानों के अनुसार इस योजना में सम्मिलित किया जाएगा ।
यदि किसी वैज्ञानिक को एमएसीपी योजना के अधीन कोई श्रेणी में स्वीकृ त किया गया है तो सुनम्य कोटिपूरक योजना के अधीन अगली श्रेणी के लिए उन पर विचार किया जा सकता है।
(घ) सुनम्य कोटिपूरक योजना के अधीन वैज्ञानिकों के उच्चतर श्रेणी में प्रोन्नति के लिए अनुसंधान और विकास में क्षेत्र अनुभव और / या ऐसी वैज्ञानिक परियोजनाओं के कार्यान्वयन में अनुभव अनिवार्य है।
(iv) आंतरिक स्क्रीनिंग का पहला चरण अनुसूची के स्तम्भ (12) में विनिर्दिष्ट स्क्रीनिंग समिति द्वारा किया जाएगा, जो सुनम्य कोटिपूरक योजना के अधीन उन्नयन के लिए मापदंड के अनुसार वार्षिक कार्य रिपोर्ट का मूल्यांकन करेगी । संशोधित सुनम्य कोटिपूरक योजना के प्रावधान के अनुसार सभी पात्र वैज्ञानिक और जो कार्मिक और प्रशिक्षण विभाग द्वारा समय-समय पर जारी निर्देशानुसार बेंचमार्क को पूरा करते हैं, को आईएससी में सम्मिलित किया जाएगा, जो वैज्ञानिकों द्वारा किए गए कार्य की वैज्ञानिक सामग्री पर रिपोर्ट करेंगे । आंतरिक स्क्रीनिंग समिति वैज्ञानिकों द्वारा किए गए कार्य की वैज्ञानिक सामग्री की निम्नलिखित रिपोर्टिंग प्रारूप में रिपोर्ट करेगी और इसे बाह्य मूल्यांकन समिति को उपलब्ध कराया जाएगा ।
आंतरिक स्क्रीनिंग समिति की रिपोर्ट:
1. रिपोर्ट की गई वैज्ञानिक और तकनीकी सामग्री का श्रेणीकरण:

आंतरिक स्क्रीनिंग समिति के सदस्यों के हस्ताक्षर
(v) अनुसूची के स्तम्भ (12) में विनिर्दिष्ट अनुमोदन प्राधिकारी (स्क्रीनिंग), आंतरिक स्क्रीनिंग समिति द्वारा अनुशंसित सभी मामलों पर विचार कर इसको अनुमोदित करेगा और यदि यह निर्णय लिया जाता है कि कोई अधिकारी आकलन बोर्ड द्वारा प्रोन्नति हेतु विचार के लिए अर्हता प्राप्त नहीं करता है तो बोर्ड द्वारा उसके मामले को आंतरिक स्क्रीनिंग समिति के विचार के लिए एक वर्ष के पश्चात आंतरिक स्क्रीनिंग समिति के समक्ष रखा जाएगा और स्क्रीनिंग के लिए उप नियम (iv) में विनिर्दिष्ट प्रक्रिया का पुनः पालन किया जाएगा।
(vi) बाह्य मूल्यांकन के दूसरे चरण के उद्देश्य के लिए (बाह्य):
(क) स्वस्थाने प्रोन्नति के लिए वैज्ञानिकों की उपयुक्तता का मूल्यांकन करने के लिए; सभी वैज्ञानिक जिनकी आंतरिक स्क्रीनिंग समिति द्वारा मूल्यांकन और अनुशंसित किया गया है [ और अनुमोदन प्राधिकरण (स्क्रीनिंग) द्वारा अनुमोदित किया गया है ] का अनुसूची के स्तम्भ (12) में विनिर्दिष्ट मूल्यांकन बोर्ड द्वारा मूल्यांकन किया जाएगा ;
(ख) मूल्यांकन बोर्ड प्रत्येक वैज्ञानिक की उपलब्धियों का उनके कार्य के संदर्भ में मूल्यांकन करेगा और उच्चतर श्रेणी पर उनकी प्रोन्नति के लिए उनकी उपयुक्तता की सिफारिश करेगा । इसके अतिरिक्त बोर्ड विचाराधीन अवधि के दौरान ऐसे अधिकारी की[भाग II—खण्ड 3(i)] भारत का राजपत्र : फरवरी 22, 2020/फाल्गुन 3, 1941 211 उपलब्धियों के साथ –साथ अपने संव्ययसाय के लक्ष्यों को प्राप्त करने में अधिकारी की निष्ठा और उत्सुकता तथा वैज्ञानिक गतिविधियों और सेवाओं तथा विकासात्मक क्षमताओं, प्रबंधन और नेतृत्व गुणों सहित उच्चतर उत्तरदायित्व लेने की क्षमता पर भी विचार करेगा ।
(ग) प्रत्येक वैज्ञानिक के पालन और योग्यता पर विचार करने के पश्चात मूल्यांकन बोर्ड सुनम्य कोटिपूरक योजना के अधीन वैज्ञानिक पर विचार करने की योग्यता के औचित्य में विनिर्दिष्टत: एक पृष्ठ के सार के माध्यम से वैज्ञानिक द्वारा किए गए कार्यों की विशिष्ट सामग्री का उल्लेख करेगा । मूल्यांकन बोर्ड विशेष रूप से यह प्रमाणित करेगा कि सिफ़ारिश किए गए उक्त वैज्ञानिक द्वारा सुनम्य कोटिपूरक योजना के अधीन स्वस्थाने उन्नयन संबंधी समस्त मापदंड पूरे कर लिए गए हैं।
(घ) इस मूल्यांकन के आधार पर, मूल्यांकन बोर्ड निम्नलिखित में से किसी एक की सिफारिश कर सकता है: -
(i) अधिकारी की अगली उच्चतर श्रेणी में प्रोन्नति या;
(ii) यथास्थिति अर्थात श्रेणी में कोई परिवर्तन नहीं;
(ङ) ऐसे अधिकारी, जिन्हें मूल्यांकन बोर्ड द्वारा यथास्थिति की सिफारिश की गई है, एक वर्ष की अवधि के पश्चात उनके संतोषजनक प्रदर्शन पर आंतरिक स्क्रीनिंग समिति द्वारा पुनः उनके मामले में विचार किया जाएगा ।
(च) ऐसे वैज्ञानिक जो छु ट्टी या प्रतिनियुक्ति या विदेश सेवाओं के कारणों से मूल्यांकन के लिए व्यक्तिगत रूप से उपस्थित होने में विफल रहते हैं, वे स्वस्थाने प्रोन्नति के लिए पात्र नहीं होंगे।
(vii) मूल्यांकन बोर्ड द्वारा की गई सिफारिशों पर अनुसूची के स्तम्भ (12) में विनिर्दिष्ट अनुमोदन प्राधिकरण (मूल्यांकन) द्वारा विचार किया जाएगा और प्रत्येक मामले पर उसका निर्णय अंतिम होगा।
7. प्रत्येक शाखा में पदों की संख्या निम्नानुसार होगी:
जलभू विज्ञान शाखा :
(क) जलभू विज्ञान शाखा में पदों की कु ल संख्या 290 होगी, जिसमें कार्यभार के आधार पर परिवर्तन किया जा सकता है। ये पद वैज्ञानिक 'ख' या वैज्ञानिक 'ग' या वैज्ञानिक 'घ' में से किसी भी श्रेणी में हो सकते हैं। जलभू विज्ञान शाखा में 290 अधिकारियों की कु ल स्वीकृ त संख्या में एक वर्ष में होने वाली रिक्ति वैज्ञानिक 'ख' ( जलभू विज्ञान शाखा) के स्तर पर उस विशेष वर्ष में उत्पन्न होने वाली रिक्तियां होंगी जो 174 से अधिक नहीं हो सकती।
भू-भौतिकी शाखा
(ख) भू-भौतिकी शाखा में पदों की संख्या 31 होंगी । इसमें कार्यभार के आधार पर परिवर्तन किया जा सकता है। ये पद वैज्ञानिक 'ख' या वैज्ञानिक 'ग' या वैज्ञानिक 'घ' में से किसी भी श्रेणी में हो सकते हैं । भू-भौतिकी शाखा में 31 अधिकारियों की कु ल स्वीकृ त संख्या में एक वर्ष में होने वाली रिक्ति वैज्ञानिक 'ख' के स्तर पर उस विशेष वर्ष में उत्पन्न होने वाली रिक्तियां होगी, परंतु यह कि कु ल वैज्ञानिक 'ख' (भू-भौतिकी) के श्रेणी में पदों की संख्या 25 से अधिक नहीं हो सकती ।
रासायनिक शाखा
(ग) रासायनिक शाखा में पदों की कु ल संख्या 32 होंगी । इसमें कार्यभार के आधार पर परिवर्तन किया जा सकता है। ये पद वैज्ञानिक 'ख' या वैज्ञानिक 'ग' या वैज्ञानिक 'घ' में से किसी भी श्रेणी में हो सकते हैं । रासायनिक शाखा में 32 अधिकारियों की कु ल स्वीकृ त संख्या में एक वर्ष में होने वाली रिक्ति वैज्ञानिक 'ख' के स्तर पर उस विशेष वर्ष में उत्पन्न होने वाली रिक्तियां होगी, परंतु यह कि वैज्ञानिक 'ख' (रसायन ) की श्रेणी में पदों की संख्या 23 से अधिक नहीं हो सकती ।

जलोल्का विज्ञान शाखा
(ङ) जलोल्का विज्ञान शाखा में पदों की कु ल संख्या नौ होंगी । इन नौ पदों की कु ल संख्या में कार्यभार के आधार पर परिवर्तन किया जा सकता है। ये पद वैज्ञानिक 'ख' या वैज्ञानिक 'ग' या वैज्ञानिक 'घ' में से किसी भी श्रेणी में हो सकते हैं । एक वर्ष में होने वाली रिक्ति जलोल्का विज्ञान शाखा के नौ अधिकारियों की कु ल स्वीकृ त संख्या में वैज्ञानिक 'ख ' के स्तर पर उस विशेष वर्ष में उत्पन्न होने वाली रिक्तियां होगी ।
(च) स्वस्थाने प्रोन्नति के लिए सुनम्य कोटिपूरक योजना को विभागीय वैज्ञानिकों की वैज्ञानिक 'ख' से वैज्ञानिक 'ग' और वैज्ञानिक 'ग' से वैज्ञानिक 'घ' श्रेणी में प्रोन्नति के लिए अपनाया जाएगा । इन श्रेणियों में किसी भी प्रकार के प्रतिबंध के बिना पूर्ण रूप से अंतर- परिवर्तनशीलता होगी , परंतु यह कि प्रत्येक शाखा की कु ल पदों की संख्या उस शाखा की स्वीकृ त पदों की संख्या से अधिक न हो, जिसमे कार्यभार के आधार पर परिवर्तन किया जा सकता है।
8 निरर्हता - वह व्यक्ति-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या विवाह की संविदा की है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है,
उक्त पदों में से किसी पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।
9. प्रोन्नति या किसी वैज्ञानिक द्वारा त्यागपत्र देने या सेवानिवृत्ति या मृत्यु के कारण उत्पन्न होने वाली रिक्तियों को भरना:
(1 ) मूल्यांकन के पश्चात स्वस्थाने प्रोन्नति वैज्ञानिक द्वारा धारित पद वैज्ञानिक के पास ही रहेगा और परिणामस्वरूप कोई रिक्ति नहीं होगी ।
(2 ) जब किसी वैज्ञानिक द्वारा सेवानिवृत्ति या स्वैच्छिक सेवानिवृत्ति या त्यागपत्र देने या मृत्यु के परिणामस्वरूप पद रिक्त हो जाता है तो उस पद को, जल विज्ञान शाखा को छोड़कर, उनसे संबंधित शाखाओं में वैज्ञानिक 'ख' के स्तर पर भरा जाएगा। जल विज्ञान शाखा के मामले में ऐसी रिक्ति को वैज्ञानिक 'ग' के स्तर पर सीधी भर्ती या प्रोन्नति के रोस्टर के अनुसार भरा जाएगा।
10. भारत के किसी भी भाग या बाह्य सेवा का दायित्व : उक्त पदों पर नियुक्त अधिकारी पर भारत में या बाह्य सेवा करने का दायित्व होगा ।
11. शिथिल करने की शक्ति : जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।
12. व्यावृत्ति: इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ी जतियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 35 .—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Central Ground Water Board (Scientific Group 'A' Posts) Recruitment Rules, 1995, except as respects things done or omitted to be done before such supersession, the President is hereby makes the following rules regulating the method of recruitment of Scientific Group 'A' posts in the Central Ground Water Board, namely:-
1. Short-title and commencement.— (1) These rules may be called the Ministry of Jal Shakti, Department of Water Resources, River Development and Ganga Rejuvenation, Central Ground Water Board (Scientific Group 'A' Posts) Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Definitions.— In these rules unless, the context otherwise requires:
(a) "Commission" means the Union Public Service Commission;

(c) "Departmental Promotion Committee" means a Committee constituted to consider promotion or confirmation in any grade;
(d) "Government" means the Government of India;
(e) "Schedule" means the Schedule annexed to these rules;
(f) "Regular Service" in relation to any grade means the period or periods of service in that grade rendered after selection and appointment thereto under these rules and includes any period or periods-
(i) taken into account for the purpose of seniority in the case of those appointment at the initial constitution of the service;
(ii) during which an officer would have held a duty post in that grade but for being on leave or otherwise not being available for holding such post;
(g) "Scheduled Castes" and "Scheduled Tribes" shall have the same meaning as assigned to them in clauses (24) and (25) respectively of article 366 of the Constitution;
3. Application .—These rules shall apply to the posts specified in column (1) of the Schedule.
4. Number of posts, classification and level in pay matrix.— The number of the said posts, their classification and the level in the pay matrix attached thereto shall, save as provided in rule 8, be as specified in columns (2) to (4) of the Schedule.
5. The method of recruitment, age-limit and other qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the Schedule.
6. Procedure for in-situ Promotion under Flexible Complementing Scheme (FCS).-
(i) In situ promotion from Scientist 'B' to Scientist 'C' and Scientist 'C' to Scientist 'D' will be done as per guideline issued by the DoP&T OM No.AB-14-17/37/2008-Estt (RR) dated 10.09.2010 and as amended from time to time. In-situ promotion under Flexible Complementing Scheme is applicable to Group 'A' Scientist posts only. Scientists or Technical experts doing management or administrative work in the Departments or Ministries should not be considered for up gradation under Flexible Complementing Scheme, they should only be given benefits of up gradation under Modified Assured Progression Scheme.
(ii) All the posts covered under Flexible Complementing Scheme shall carry the following uniform level in the pay matrix, designation and the minimum residency period linked to performance.

(iii) There shall be two level of assessment, the first level shall be at internal level for screening purposes and the next level shall be for external assessment purposes for selection and for this purpose:
(a) (i) The review for promotion under Flexible Complementing Scheme by the Screening Committee shall be done twice in a year, before 1st January and 1st July of every year.
(ii) All candidates who have completed the prescribed period of residency shall be reviewed for promotion by the Assessment Board twice a year namely before the 1st January and the 1st July of every year.
(iii) The cases maturing for promotion under Flexible Complementing Scheme during January to June of the year shall be taken up for review in the month of July of that year and the cases maturing for promotion during July to December of a year shall be taken up for review in the month of January of the next year.
(b) Where an eligible officer is on foreign service or study leave in India or abroad, his or her case shall be considered and if such person has been approved for in-situ promotion under the Flexible Complementing Scheme to the next higher grade, the effective date of such promotion shall be from the date of resumption of duty in the Central Ground Water Board and financial benefit shall accrue from the same date and no travelling allowance or dearness allowance shall be provided to attend the interview;
[भाग II—खण्ड 3(i)] भारत का राजपत्र : फरवरी 22, 2020/फाल्गुन 3, 1941 227(c) The exceptionally meritorious candidates with all outstanding grading may be granted relaxation in the residency period, the relaxation being not more than one year on any single occasion, limited to a maximum of two occasions in their entire career. The assessment under the Flexible Complementing Scheme for next grade shall only be three times and thereafter, the Scientist would be covered under Modified Assured Career Progression (MACP) Scheme according to provision of that scheme and the Scientists who have been granted any grade under Modified Assured Career Progression Scheme may be considered for next grade under Flexible Complementing Scheme.
(d) Field experience in research and development and/ or experience in implementation of such scientific projects is compulsory for promotion of Scientists to higher grades under the Flexible Complementing Scheme.
(iv) The First level of Internal Screening shall be done by the screening committee specified in column (12) of Schedule, which shall evaluate the annual work reports in accordance within the criteria for up gradation under the Flexible Complementing Scheme. All eligible Scientists according to the provision of Modified Flexible Complementing Scheme and who meet the benchmark as per instruction of Department of Personnel and Training from time to time, shall be screened in the Internal Screening Committee (ISC) would report on the scientific content of work done by the Scientists in. The Internal Screening Committee shall report on the scientific content of work done by the Scientists in following reporting format and same shall be made available to the external assessment committee.

Signatures of the Members of the Internal Screening Committee
(v) The Approving Authority (Screening), specified in column (12) of Schedule shall consider all cases recommended by the Internal Screening Committee and approve the same and in case it decides that any officer does not qualify for consideration for promotion by the Assessment Board, his or her case shall be placed before the Internal Screening Committee after one year for its consideration and the procedure for Screening as specified in sub rule (iv) shall be followed again.
(vi) For the purpose of second level of external assessment (external):
(a) for evaluating suitability of Scientists for in-situ promotion; all Scientists who have been screened-in and recommended by the Internal Screening Committee [and approved by the Approving Authority (Screening)] shall be assessed by the Assessment Board specified in Column (12) of Schedule;
(b) the Assessment Board shall evaluate the accomplishments of each Scientist in terms of their work and recommend his or her suitability for promotion to the higher grade and the said Board shall, apart from the accomplishments of such officer during the period under consideration, also keep in mind the keenness exhibited by such officer in the pursuit of his or her profession and ability to take up higher responsibilities including scientific activities and services and development capabilities, managerial or leadership qualities.
(c) The Assessment Board after taking into consideration performance and merit of each Scientist shall, document specifically through one page summary, the specific content of the work done justifying the merit for consideration under the Flexible Complementing Scheme. The Assessment Board shall specifically certify that the Scientists so recommended met with all the criteria for in situ up-gradation under the Flexible Complementing Scheme.
(d) On the basis of its assessment, the Assessment Board may recommend any one of the following:-
(i) Promotion of the Officer to the next higher grade; or
(ii) Status quo-i.e. no change in the grade;

(f) The Scientists who fail to appear physically for the Assessment for the reasons of leave or deputation or Foreign Services shall not be eligible for in-situ promotion.
(vii) The recommendations made by the Assessment Board shall be considered by the Approving Authority (Assessment) specified in Column (12) of Schedule and its decision on each case shall be final.
7. Number of Posts in each discipline will be as under:
Hydrogeology Discipline:
(a) The total number of posts in the Hydrogeology discipline shall be 290, which is subject to variation depending on workload. These posts can be in any of the grades of Scientist 'B' or Scientist 'C' or Scientist 'D'. The shortfall occurring in a year in the total strength of 290 officers in the Hydrogeology discipline shall be the vacancies arising in that particular year at the level of Scientist 'B' (Hdrogeology discipline) cannot exceed 174.
Geophysics Discipline:
(b) The number of posts in the Geophysics discipline shall be 31. This total number of 31 posts is subject to variation depending on workload. These posts can be in any of the grades of Scientist 'B' or Scientist 'C' or Scientist 'D'. The shortfall occurring in a year in the total strength of 31 officers in the Geophysics discipline shall be the vacancies arising in that particular year at the level of Scientist 'B' provided that total no. of posts in the grade of Scientist 'B' (Geophysics) cannot exceed 25.
Chemical Discipline:
(c) The number of posts in the Chemical discipline shall be 32. This total number of 32 posts is subject to various depending on workload. These posts can be in any of the grades of Scientist 'B' or Scientist 'C' or Scientist 'D'. The shortfall occurring in a year in the total strength of 32 officers in the Chemical discipline shall be the vacancies arising in that particular year at the level of Scientist 'B' provided that total no. of posts in the grade of Scientist 'B' (Chemical) cannot exceed 23.
Hydrology Discipline:
(d) The number of posts in the Hydrology discipline shall be eight. This total number of eight posts is subject to various depending on workload. These posts can be in any of the grades of Scientist 'C' or Scientist 'D'. The shortfall occurring in a year in the total strength of eight officers in the Hydrology discipline shall be the vacancies arising in that particular year at the level of Scientist 'C' provided that total no. of posts in the grade of Scientist 'C' cannot exceed seven.
Hydrometeorology Discipline:
(e) The total number of posts in the Hydrometeorology discipline shall be nine. This total number of nine posts is subject to variation depending on workload. These posts can be in any of the grades of Scientist 'B' or Scientist 'C' or Scientist 'D'. The shortfall occurring in a year in the total strength of nine officers in the Hydrometeorology discipline shall be the vacancies arising in that particular year at the level of Scientist 'B'.
(f) Flexible Complementing Scheme for in situ promotion shall be followed in respect of Departmental Scientists, from the grades of Scientists 'B' to Scientist 'C' and Scientist 'C' to Scientist 'D' and there shall be complete interchangeability in these grades without any restriction except the total number of officers taken together in each discipline shall not exceed the total number of sanctioned posts in that discipline, which are subject to change depending on workload.
8. Disqualification.- No person, -
(a) who has entered into or contracted a marriage with a person having a spouse living, or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to any of the said posts :
Provided that the Central Government may, if satisfied that such a marriage is permissible under the personal law applicable to such person and other party to the marriage and there are other grounds for so doing exempt any person from the operation of this rule.
9. Filling up of vacancies arising due to promotion or vacation of the post by a Scientist due to resignation or
retirement or death:
(1) A Scientist promoted in-situ after a review shall carry the post with him and consequently no vacancy is caused.

In case of Hydrology discipline, such vacancy shall be filled in at the level of Scientist 'C' in accordance with the roster for direct recruitment or promotion.
10. Liability for Service in any part of India or outside: Officers appointed to the said posts shall be liable to serve anywhere in India or outside.
11. Power to relax-: where Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, and for reason to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
12. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 36.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और जल संसाधन, नदी विकास और गंगा संरक्षण मंत्रालय, कें द्रीय जल आयोग (समूह 'क' और समूह 'ख') वैज्ञानिक पद भर्ती नियम, 2013 को, उन बातो के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, जल शक्ति मंत्रालय, जल संसाधन, नदी विकास और गंगा संरक्षण विभाग के अधीन कें द्रीय जल आयोग में अनुसंधान अधिकारी, सहायक अनुसंधान अधिकारी और ज्येष्ठ अनुसंधान सहायक के पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-
1. संक्षिप्त नाम और प्रारंभ.— (1) इन नियमों का संक्षिप्त नाम जल शक्ति मंत्रालय, जल संसाधन, नदी विकास और गंगा संरक्षण विभाग, कें द्रीय जल आयोग (समूह 'क' और समूह 'ख') वैज्ञानिक पद भर्ती नियम, 2020 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।
2. लागू होना.— ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में विनिर्दिष्ट पदों पर लागू होंगे।
3. पद-संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.— उक्त पदों की संख्या, उनका वर्गीकरण और उनका वेतन मैट्रिक्स में स्तर या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।
4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.— उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं।

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, या विवाह की संविदा की है उक्त पद पर नियुक्ति का पात्र नहीं होगा।
परंतु यदि कें द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
6. शिथिल करने की शक्ति.— जहां कें द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

G.S.R.36.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Water Resources, Central Water Commission (Group 'A' and Group 'B') Scientific Posts Recruitment Rules, 2013, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Research Officer, Assistant Research Officer and Senior Research Assistant in the Central Water Commission under the Department of Water Resources, River Development and Ganga Rejuvenation, Ministry of Jal Shakti, namely:-
1. Short title and commencement.— (1) These rules may be called the Ministry of Jal Shakti, Department of Water Resources, River Development and Ganga Rejuvenation, Central Water Commission (Group 'A' and Group 'B') Scientific Posts Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.
3. Number of posts, classification and Level in the Pay Matrix.—The number of the said posts, their classification and the Level in the Pay Matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
4. Method of recruitment, age limit and other qualifications, etc.— The method of recruitment to the said posts, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
5. Disqualification.— No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving.— Nothing in these rules shall affect reservations, relaxation of the age-limit and other concessions required to be provided for the Scheduled Caste, the Scheduled Tribes, Other Backward Classes, ex-Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि.37.— राष्ट्रपति, अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए नागर विमानन मंत्रालय के अंतर्गत रेल संरक्षा आयोग में रेलवे निरीक्षणालय सेवा में वरिष्ठ निरीक्षक (तकनीकी) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात:-
1. संक्षिप्त नाम और प्रारंभ.— (1) इन नियमों का संक्षिप्त नाम रेलवे निरीक्षणालय सेवा [वरिष्ठ निरीक्षक ( तकनीकी )] भर्ती नियम, 2020 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. पदों की संख्या, वर्गीकरण तथा वेतन मैट्रिक्स में लेवल.—उक्त पदों की संख्या, उनका वर्गीकरण और उन वेतन मैट्रिक्स में लेवल वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।
3. भर्ती की पद्धति, आयु–सीमा और अर्हताएं इत्यादि.— उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं।
4. निरर्हता.—वह व्यक्ति,
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, उक्त पद पर नियुक्ति का पात्र नहीं होगा:

5. शिथिल करने की शक्ति.—जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण है, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्ति या पद के बाबत, आदेश द्वारा शिथिल कर सके गी।
6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्य पिछड़े वर्गो और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

G.S.R. 37.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following Rules regulating the method of recruitment to the post of Senior Inspector (Technical) in the Railway Inspectorate Service in the Commission of Railway Safety in the Ministry of Civil Aviation, namely :-
1. Short title and commencement.— (1) These rules may be called the Railway Inspectorate Service [Senior Inspector(Technical)] Recruitment Rules, 2020.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts, Classification and level in the pay matrix.— The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Method of recruitment, age-limit, qualifications etc.— The method of recruitment, age-limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.
4. Disqualification.— No person,-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
5. Power to relax.— Where the Central Government is of the opinion that it is necessary or expedient so to do it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of person.
6. Saving.— Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex-servicemen, the other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note1: The period of deputation (including short-term contract) including period of deputation (including short-term contract) in another ex-cadre post held immediately preceding this appointment in the same or some other organization or department of the Central Government shall ordinarily not to exceed three years. Note 2: The Maximum age-limit for appointment by deputation (including short-term contract) shall be not exceeding fifty-six years as on the last date of receipt of applications. |
