सा.का.नि. 141.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक और अनुच्छेद 148 के खंड(5) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और भारतीय लेखा परीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक महालेखापरीक्षक से परामर्श करने के पश्चात्, सामान्य भविष्य निधि (कें द्रीय सेवाएं) नियम, 1960 में और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:–

1. संक्षिप्त नाम और प्रारंभ :- (1) इन नियमों का संक्षिप्त नाम सामान्य भविष्य निधि (कें द्रीय सेवाएं)संशोधन नियम, 2022 है।

2. सामान्य भविष्य निधि (कें द्रीय सेवाएं) नियम, 1960 में,-

(I) नियम 2 के , उप-नियम (1) में, खंड (घ) के पश्चात्, निम्नलिखित खंडों को अंत: स्थापित किया जाएगा:

(घ)(क) "विभागाध्यक्ष" से वित्तीय शक्तियों का प्रत्यायोजन नियम, 1978 की अनुसूची I में विनिर्दिष्ट प्राधिकारी अभिप्रेत है, और इसके अंतर्गत ऐसे अन्य प्राधिकारी या व्यक्ति आते हैं जिन्हें राष्ट्रपति, आदेश द्वारा विभागाध्यक्ष के रूप में विनिर्दिष्ट करें;

(घ)(ख) "कार्यालयाध्यक्ष" से वित्तीय शक्तियों का प्रत्यायोजन नियम, 1978 के नियम 14 के अधीन घोषित राजपत्रित अधिकारी और इसके अंतर्गत ऐसे अन्य प्राधिकारी या व्यक्ति सम्मिलित हैं, जिन्हें सक्षम प्राधिकारी आदेश द्वारा कार्यालयाध्यक्ष के रूप में विनिर्दिष्ट करे;

(II) नियम 12, उपनियम (1) और (1क) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्-

''(1) कार्यालय अध्यक्ष किसी अभिदाता को अग्रिम संदाय,जिसमे कु ल धनराशि,जो पूर्णांकित रूपये में हो और बारह मास के वेतन की रकम से अधिक न हो या क्रे डिट पर रकम का तीन-चौथाई, जो भी कम हो, सम्मिलित है, निम्नलिखित एक या एक से अधिक प्रयोजनों के करने की मंजूरी दे सकता है, अर्थात्:

(i) बीमारी (प्रसवावस्था) या किसी प्रकार की नि:शक्तता जिसमें जहां आवश्यक हो, अभिदाता और उसके परिवार के सदस्यों या उस पर वस्तुत: आश्रित किसी व्यक्ति के यात्रा व्यय भी सम्मिलित है; से संबंधित व्यय करने के लिए;

(ii) सभी स्ट्रीम और शैक्षणिक संस्थानों का समावेश करते हुए प्राथमिक, माध्यमिक या उच्च शिक्षा और जहां आवश्यक हो, अभिदाता और उसके परिवार के सदस्यों या उस पर वस्तुत: आश्रित किसी व्यक्ति के यात्रा व्यय भी सम्मिलित है; की लागत को पूरा करने के लिए;

(iii) सगाई या विवाह, अंत्येष्टि या अन्य समारोहों से संबंधित अनिवार्य व्यय करने के लिए;

(iv) अभिदाता, उसके परिवार के किसी सदस्य या वास्तव में उस पर आश्रित किसी व्यक्ति द्वारा या उसके विरुद्ध संस्थित कानूनी कार्यवाही की लागत को पूरा करने के लिए, इस मामले में उपलब्ध अग्रिम किसी अन्य सरकारी स्रोत से इसी प्रयोजन के लिए अनुज्ञेय किसी अग्रिम के अतिरिक् त होगा;

(v) अभिदाता के बचाव की लागत को पूरा करने के लिए जहां वह अपनी ओर से किसी आरोपित शासकीय कदाचार के संबंध में किसी जांच में स्वयं का बचाव करने के लिए विधि-व्यवसायी को नियुक्त करता है;

(vi) टेलीविजन, वाशिंग मशीन, रसोई गैस,गीजर और कं प्यूटर जैसी उपभोक्ता वस्तुओं को खरीदने के लिए;

(vii) किसी यात्रा और पर्यटन संबंधी गतिविधियों सहित तीर्थ यात्रा और प्रमुख स्थानों के दर्शनार्थ होने वाले व्यय को करने के लिए;

(1क) विभागाध्यक्ष, विशेष परिस्थितियों में, किसी अभिदाता को अग्रिम संदाय की मंजूरी दे सकता है यदि उसका यह समाधान हो जाता है कि संबंधित अभिदाता को उप-नियम (1) में उल्लिखित कारणों के अलावा अन्य कारणों से अग्रिम की आवश्यकता है।

(1ख) उप-नियम (I)और(Iक)के अधीन अग्रिम संस्वीकृ त किया जा सके गा और अग्रिम के लिए आवेदन जमा करने की तारीख से पंद्रह दिनों के भीतर इसका संदाय किया जाएगा:

परंतु, अभिदाता या उसके परिवार के किसी सदस्य या उस पर वस्तुत: आश्रित किसी व्यक्ति की बीमारी जैसी आकस्मिक परिस्थितियों में, इस उप-नियम के अधीन अग्रिम मंजूर किया जा सके गा और अग्रिम के लिए आवेदन जमा करने की तारीख से सात दिनों के भीतर इसका संदाय किया जाएगा:

(1ग) उप-नियम (1) और (1क) के अधीन अभिदाता द्वारा अग्रिम मांगने के कारणों का स्पष्टीकरण देते हुए दी गई घोषणा के आधार पर अग्रिम संस्वीकृ त किया जाएगा, और इस प्रयोजन के लिए उसके द्वारा कोई दस्तावेजी प्रमाण प्रस्तुत करना अपेक्षित नहीं होगा।''

(III) नियम 13 में, उपनियम (1) के स्थान पर निम्नलिखित उप-नियम प्रतिस्थापित किया जाएगा, अर्थात्:-

''(1)(क) अभिदाता से उतनी बराबर मासिक किस्तों में अग्रिम की वसूली की जाएगी जैसा कि मंजूरी देने वाला प्राधिकारी निर्देश दे:

परंतु ऐसी संख्या बारह से कम नहीं होगी जब तक कि अभिदाता ऐसा चयन न करे, और साठ से अधिक नहीं होगी:

परंतु यह और कि अभिदाता अपने विकल्प पर, एक महीने में एक से अधिक किस्त चुका सकता है;

(ख) प्रत्येक किश्त पूर्णांकित रुपये की संख्या होगी, ऐसी किश्तों के निर्धारण को स्वीकार करने के लिए, यदि आवश्यक हो, तो अग्रिम की राशि को बढ़ाया या घटाया जा रहा है।''

(IV) नियम 15 में,-

(i)उप-नियम (1) के स्थान पर निम्नलिखित उप-नियम रखा जाएगा, अर्थात्:-

''(1) नियम 16 में विनिर्दिष्ट शर्तों के अध्यधीन, विभागाध्यक्ष द्वारा किसी भी समय निकासी संस्वीकृ त की जा सके गी- (क)किसी अभिदाता की दस वर्ष की सेवा (सेवा की व्यवधान अवधिसहित,यदि कोई हो) पूरी होने के पश्चात या अधिवर्षिता पर उसकी सेवानिवृत्ति की तारीख से पूर्व दस वर्ष के भीतर, जो भी पहले हो,उसके खाते में जमा राशि से निम्नलिखित में से एक या अधिक प्रयोजनों के लिए, अर्थात्:-

(क) सभी स्ट्रीम और शैक्षणिक संस्थानों को कवर करते हुए प्राथमिक, माध्यमिक या उच्च शिक्षा अभिदाता और उसके परिवार के सदस्यों या उस पर वस्तुत: आश्रित किसी व्यक्ति के आवश्यकतानुसार, यात्रा व्यय भी शामिल है; की लागत को पूरा करने के लिए;

(ख) अभिदाता और उसके परिवार के सदस्यों या उस पर आश्रित किसी अन्य संबंधीकी सगाई या विवाह, अंत्येष्टि या अन्य समारोहों से संबंधित अनिवार्य व्यय करने के लिए;

(ग) बीमारी (प्रसवावस्था) या किसी भी प्रकार की नि:शक्तता से संबंधित व्यय करने के लिए अभिदाता और उसके परिवार के सदस्यों या उस पर आश्रित किसी व्यक्ति के आवश्यकतानुसार,यात्रा व्यय भी शामिल है;

(घ) टेलीविजन,वाशिंग मशीन, रसोई गैस,गीजर और कं प्यूटर जैसी उपभोक्ता वस्तुओं को खरीदने के लिए;

(ख) अभिदाता की सेवा के दौरान उसके खाते में जमा राशि से निम्नलिखित में से एक या अधिक प्रयोजनों के लिए, अर्थात्:-

(क) साइट की लागत या दिल्ली विकास प्राधिकरण, राज्य आवास बोर्ड या हाउस बिल्डिंग सोसाइटी द्वारा प्लॉट या फ्लैट के आवंटन के लिए किसी संदाय सहित अपने आवास के लिए एक उपयुक्त गृह के निर्माण या अधिग्रहण करने या तैयार फ्लैट खरीदने के लिए;

(ख) अपने आवास के लिए एक उपयुक्त गृह का निर्माण करने या अधिग्रहण करने या तैयार फ्लैट खरीदने के लिए स्पष्ट रूप से लिए गए ऋण के कारण बकाया राशि को चुकाने के लिए;

(ग) अपने आवास के लिए घर बनाने के लिए साइट खरीदने या इस प्रयोजन के लिए स्पष्ट रूप से लिए गए ऋण के कारण किसी बकाया राशि को चुकाने के लिए;

(घ) किसी अभिदाता के स्वामित्व वाले या अधिग्रहीत गृह या फ्लैट में पुननिर्र्माण या परिवर्धन या परिवर्तन करने के लिए;

(ङ) पैतृक गृह या सरकार से लिए ऋण की सहायता से बनाए गए गृह के नवीनीकरण, परिवर्धन या परिवर्तन या रखरखाव करने के लिए;

(च) खंड (ग) के अधीन खरीदी गई जमीन पर घर बनाने के लिए;

(ग) किसी अभिदाता की दस वर्ष की सेवा (सेवा की व्यवधान अवधियों सहित, यदि कोईहो) पूरी होने के पश्चात्उसके खाते में जमा राशि सेनिम्नलिखित में से एक या अधिक प्रयोजनों के लिए, अर्थात्:-

(क) मोटर कार या मोटर साइकिल या स्कू टर खरीदने के लिए, या इस प्रयोजन के लिए पहले से लिए गए ऋण को चुकाने के लिए;

(ख) मोटर कार की व्यापक मरम्मत या पूरी मरम्मत, मोटर कार या मोटर साइकिल या स्कू टर, मोपेड बुक करने के लिए डिपोजिट जमा करने के लिए;

(घ) अभिदाता के अधिवर्षिता पर सेवानिवृत्तिकी तारीख से दो वर्ष के भीतर किसी भी प्रयोजनके बिना खाते में जमा राशि निकालने के लिए।

टिप्पणी 1:- किसी अभिदाता को निम्न से अनधिक राशि की प्रत्याहरण करने की अनुमति दी जा सके गी-

(i) खंड (क) के उप-खंड (क), (ख) और (घ) के अधीन खाते में जमा राशि का तीन-चौथाई और खंड (क) के उप-खंड (ग) के अधीन खाते में जमा राशिकानब्बे प्रतिशत से अधिक रकम नहीं;

(ii) खंड (ख) के अधीन, खाते में जमा राशि का नब्बे प्रतिशत;

(iii) खंड (ग) के अधीन, खाते में जमा राशि का तीन-चौथाई या वाहन की लागत, जो भी कम हो;

(iv) खंड (घ) के अधीन, खाते में जमा राशि का नब्बे प्रतिशत;

टिप्पणी 2:- इस नियम के अधीन प्रत्याहरण की मंजूरी दी जा सके गी और निकासी के लिए आवेदन जमा करने की तारीख से पंद्रह दिनों के भीतर संदाय किया जाएगा। तथापि, अभिदाता या उसके परिवार के किसी सदस्य या वस्तुत: उस पर आश्रित किसी व्यक्ति की बीमारी जैसी आकस्मिक परिस्थितियों में, इस नियम के अधीन प्रत्याहरण की मंजूरी दी जा सके गी और प्रत्याहरणके लिए आवेदन जमा करने की तारीख से सात दिनों के भीतर संदाय किया जाएगा।

टिप्पणी 3:- आवास के प्रयोजन के लिए किए गए प्रत्याहरण को गृह निर्माण अग्रिम नियमों के अधीन निर्धारित सीमा से नहीं जोड़ा जाएगा।

टिप्पणी 4:- इस नियम के अधीन अभिदाता द्वारा प्रत्याहरण के कारणों का स्पष्टीकरण देते हुए दी गई घोषणा के आधार पर प्रत्याहरण की मंजूरी दी जाएगी, और इस प्रयोजन के लिए उसके द्वारा कोई दस्तावेजी प्रमाण प्रस्तुत करना अपेक्षित नहीं होगा।

टिप्पणी 5:- खंड (ख) के उप-खंड (ख) के अधीन मंजूर प्रत्याहरण की रकम, पिछली प्रत्याहरण की रकम घटाकर,उप-खंड (क) के अधीन पिछली प्रत्याहरण की रकम के साथ आवेदन की तारीख को शेष रकम के नब्बे प्रतिशत से अधिक नहीं होगी। सूत्रहोगा, 90/100 x (दिनांक को खाते में जमा शेष रकम और विचाराधीन गृह के लिए की गई पिछली प्रत्याहरणकी रकम) से पिछली प्रत्याहरण की रकम घटाएं।

टिप्पणी 6:- खंड (ख) के उप-खंड (क) या (घ) के अधीन प्रत्याहरण की अनुमति गृह या गृह निर्माण साइट पत्नी या पति के नाम होने पर भी दी जाएगी, परंतु यदि वह अभिदाता द्वारा किए गए नामनिर्देशन में भविष्य निधि की रकम प्राप्त करने वाला पहला नामनिर्देशिती है।

टिप्पणी 7:- इस नियम के अधीन समान प्रयोजन के लिए के वल एक प्रत्याहरण करने की अनुमति होगी। किं तुपृथक संतान की शादी अथवा शिक्षा अथवा अलग-अलगहालातों पर बीमारी या गृह या फ्लैट में परिवर्धन या परिवर्तन को समान प्रयोजन नहीं समझा जाएगा। एक संतान की शिक्षा की लागत को पूरा करने के लिए वार्षिक आधार पर प्रत्याहरणकी अनुमति तब तक दी जा सके गी जब तक कि संबंधित संतान पाठ्यक्रम जारी रखता है। खंड (ख) के उपखंड (क) या (च) के अधीन एक ही घर को पूरा करने के लिए दूसरी या उत्तरवर्तीप्रत्याहरण की अनुमति टिप्पणी 3 में दी गई निर्धारित सीमा तक दी जाएगी।

टिप्पणी 8:- यदि समान प्रयोजन के लिए और समान समय में नियम 12 के अधीन अग्रिम मंजूर किया जा रहा है, तो इस नियम के अधीन प्रत्याहरण की मंजूरी नहीं दी जाएगी।

(ii) उप-नियम (2) में, 'अध्यक्ष' शब्द के स्थान पर, 'विभागाध्यक्ष' शब्दरखा जाएगा।''

(V) नियम 16 में,-

(i) उप-नियम (1) के स्थान पर निम्नलिखित को रखा जाएगा, अर्थात्:-

''(1) किसी अभिदाता द्वारा किसी एक समय में नियम 15 में विनिर्दिष्ट एक या अधिक प्रयोजनों के लिए खाते में जमा रकम से किया गया कोई प्रत्याहरण उसमें विनिर्दिष्ट सीमा से अधिक नहीं होगी।

टिप्पणी 1:- नियम 15 के उप-नियम (1) के खंड (क) के उप-खंड (क) के अधीन अभिदाता की संबंधित संतान के पाठ्यक्रम जारी रखने तक वार्षिक प्रत्याहरण की अनुमति दी जाएगी।

टिप्पणी 2:- अभिदाता द्वारा किसी साइट या खरीदे गए घर या फ्लैट या दिल्ली विकास प्राधिकरण या राज्य आवास बोर्ड, हाउस बिल्डिंग को-ऑपरेटिव सोसाइटी द्वारा निर्मित घर या फ्लैट के लिए किस्तों में संदाय करने की दशा में,उसे जब कभी किसी किस्त का संदाय करने के लिए कहा जाए, तो प्रत्याहरण की अनुमति दी जाएगी। ऐसे प्रत्येक संदाय को नियम 16 के उप-नियम (1) के प्रयोजनों के लिए एक पृथक प्रयोजन के लिए संदाय समझा जाएगा।'';

(ii) उप-नियम (2) में, 'अध्यक्ष' शब्द के स्थान पर,'विभागाध्यक्ष' शब्द रखा जाएगा;

(iii) उप-नियम (3) में,-

(क) खंड (क) में,'अध्यक्ष' शब्द के स्थान पर,'विभागाध्यक्ष' शब्द रखा जाएगा;

(ख) खंड (ग) का लोप किया जाएगा।

(VI) पांचवी अनुसूची का लोप किया जाएगा।

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS

(Department of Pension and Pensioners' Welfare)

New Delhi, the 22nd September, 2022

G.S.R. 141.—In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor-General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the General Provident Fund (Central Services) Rules, 1960, namely:-

1. Short title and commencement.- (1) These rules may be called the General Provident Fund (Central Services) Amendment Rules, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the General Provident Fund (Central Services) Rules, 1960,-

(I) in rule 2, in sub-rule (1), after clause (d), the following clauses shall be inserted:

"(da) "Head of Department" means an authority specified in Schedule I to the Delegation of Financial Powers Rules, 1978, and includes such other authority or person whom the President may, by order, specify in this behalf as Head of a Department;

(db) "Head of Office" means a Gazetted Officer declared as such under rule 14 of the Delegation of Financial Powers Rules, 1978, and includes such other authority or person whom the competent authority may, by order, specify in this behalf as Head of Office."

(II) in rule 12, for sub-rules (1) and (1A), the following sub-rules shall be substituted, namely:-

"(1) The Head of Office may sanction the payment to any subscriber of an advance consisting of a sum of whole rupees and not exceeding amount of twelve months of pay or three-fourth of the amount at credit, whichever is less, for one or more of the following purposes namely:-

(i) to pay expenses in connection with the illness (confinement) or any disability, including where necessary, the travelling expenses of the subscriber and members of his family or any person actually dependent on him;

(ii) to meet the cost of primary, secondary or higher education covering all streams and educational institutions and including where necessary, the travelling expenses of the subscriber and members of his family or any person actually dependent on him;

(iii) to pay obligatory expenses in connection with betrothal or marriages, funerals or other ceremonies;

(iv) to meet the cost of legal proceedings instituted by or against the subscriber, any member of his family or any person actually dependent upon him, the advance in this case being available in addition to any advance admissible for the same purpose from any other Government source;

(v) to meet the cost of the subscriber's defence where he engages a legal practitioner to defend himself in an enquiry in respect of any alleged official misconduct on his part;

(vi) to purchase consumer durables such as Television, washing machines, cooking range, geysers and computers;

(vii) to meet the expenses on pilgrimage and for visiting places of eminence including any travel and tourism related activities;

(1A) The Head of Department may, in special circumstances, sanction the payment to any subscriber of an advance if he is satisfied that the subscriber concerned requires the advance for reasons other than those mentioned in sub-rule (1).

(1B) An advance under sub-rules (I) and (IA) shall be sanctioned and paid not later than fifteen days from the date of submission of the application of advance:

Provided that, in emergent circumstances like illness of the subscriber or a member of his family or any person actually dependent on him, an advance under this sub-rule shall be sanctioned and paid not later than seven days from the date of submission of the application of advance.

(IC) An advance under sub-rules (1) and (1A) shall be sanctioned on the basis of a declaration by the subscriber explaining the reasons for seeking the advance and no documentary proof would be required to be furnished by him for this purpose."

(III) in rule 13, for sub-rule (1), the following sub-rule shall be substituted, namely:-

"(1)(a) an advance shall be recovered from the subscriber in such number of equal monthly installments as the sanctioning authority may direct:

Provided that such number shall not be less than twelve unless the subscriber so elects, and not more than sixty:

Provided further that a subscriber may, at his option, repay more than one installment in a month;

(b) each installment shall be a number of whole rupees, the amount of the advance being raised or reduced, if necessary, to admit the fixation of such installments."

(IV) in rule 15,-

(i) for sub-rule (1), the following shall be substituted, namely:-

"(1) Subject to the conditions specified in rule 16, withdrawals may be sanctioned by the Head of the Department, at any time-

(A) after the completion of ten years of service (including broken periods of service, if any) of a subscriber or within ten years before the date of his retirement on superannuation, whichever is earlier, from the amount standing to his credit in the Fund, for one or more of the following purposes, namely:-

(a) meeting the cost of primary, secondary or higher education covering all streams and educational institutions including, where necessary, the travelling expenses of the subscriber and members of his family or any person actually dependent on him;

(b) meeting the obligatory expenses in connection with betrothal or marriage, funeral or other ceremony of the subscriber, his family member or any other relation dependent on him;

(c) meeting the expenses in connection with the illness (confinement) or any disability, including, where necessary, the travelling expenses of the subscriber and members of his family or any person dependent on him;

(d) meeting the cost of consumer durables such as Television, washing machines, cooking range, geysers and computers;

(B) during the service of a subscriber from the amount standing to his credit in the Fund for one or more of the following purposes, namely:-

(a) building or acquiring a suitable house or ready-built flat for his residence including the cost of the site or any payment towards allotment of a plot or flat by the Delhi Development Authority, State Housing Board or a House Building Society;

(b) repaying an outstanding amount on account of loan expressly taken for building or acquiring a suitable house or ready-built flat for his residence;

(c) purchasing a house-site for building a house thereon for his residence or repaying any outstanding amount on account of loan expressly taken for this purpose;

(d) reconstructing or making additions or alterations to a house or a flat already owned or acquired by a subscriber;

(e) renovating, additions or alterations or upkeep of an ancestral house or a house built with the assistance of loan from Government;

(f) constructing a house on a site purchased under clause (c);

(C) after the completion of ten years of service of a subscriber (including broken periods of service, if any) from the amount standing to his credit in the Fund for one or more of the following purposes, namely:-

(a) purchase of motor car or motor cycle or scooter, or repayment of loan already taken for the purpose;

(b) extensive repairs or overhauling of motor car, making deposit to book a motor car or motor cycle or scooter, moped;

(D) within two years before the date of subscriber's retirement on superannuation from the amount standing to the credit in the Fund, without linking to any purpose.

Note 1.- A subscriber may be permitted to withdraw an amount not exceeding-

(i) three-fourth of the amount standing at credit, under sub-clauses (a), (b) and (d) of clause (A) and an amount not exceeding ninety per cent. of the amount standing at credit under sub-clause (c) of clause (A);

(ii) ninety per cent. of the amount standing at credit, under clause (B);

(iii) three-fourth of the amount standing at credit or cost of the vehicle, whichever is less, under clause (C); (iv) ninety per cent. of the amount standing at credit under clause (D).

Note 2.- A withdrawal under this rule shall be sanctioned and paid not later than fifteen days from the date of submission of the application for withdrawal. However, in emergent circumstances like illness of the subscriber or a member of his family or any person actually dependent on him, a withdrawal under this rule shall be sanctioned and paid not later than seven days from the date of submission of the application for withdrawal.

Note 3.- A withdrawal for housing purpose will not be linked with the limits prescribed under House Building Advance rules.

Note 4.- A withdrawal under this rule shall be sanctioned on the basis of a declaration by the subscriber explaining the reasons for seeking the withdrawal and no documentary proof shall be required to be furnished by him for this purpose.

Note 5:- The amount of withdrawal sanctioned under sub-clause (b) of clause (B) shall not exceed ninety percent of the balance on date of application together with the amount of previous withdrawal under sub-clause (a), reduced by the amount of previous withdrawal. The formula shall be, 90/100 x (balance as on date plus amount of previous withdrawal(s) for the house in question) minus the amount of the previous withdrawal(s).

Note 6:- Withdrawal under sub-clause (a) or (d) of clause (B) shall also be allowed where the house-site or house is in the name of wife or husband, provided she or he is the first nominee to receive Provident Fund money in the nomination made by the subscriber.

Note 7:- Only one withdrawal shall be allowed for the same purpose under this rule. But marriage or education of different children or illness on different occasions or a further addition or alteration to a house or flat shall not be treated as the same purpose. Withdrawal for meeting the cost of education of a child may be allowed on annual basis till the concerned child continues to pursue the course. Second or subsequent withdrawal under sub-clause (a) or (f) of clause (B) for completion of the same house shall be allowed up to the limit laid down under Note 3.

Note 8:- A withdrawal under this rule shall not be sanctioned if an advance under rule 12 is being sanctioned for the same purpose and at the same time.

(ii) in sub-rule (2), for the word 'President' wherever it occurs, the words 'Head of the Department' shall be substituted."

(V) in rule 16,-

(i) for sub-rule (1), the following shall be substituted, namely:-

"(1) Any sum withdrawn by a subscriber at any one time for one or more of the purposes specified in rule 15 from the amount standing to his credit in the Fund shall not exceed the limit specified therein.

Note l.- A withdrawal to a subscriber under sub-clause (a) of clause (A) of sub-rule (1) of rule 15, may be permitted annually so long as the concerned child of the subscriber continues to pursue the course.

Note 2.- In cases where a subscriber has to pay in installments for a site or a house or flat purchased, or a house or flat constructed through the Delhi Development Authority or a State Housing Board, a House Building Co-operative Society, he shall be permitted to make a withdrawal as and when he is called upon to make a payment in any installment. Every such payment shall be treated as a payment for a separate purpose for the purposes of sub-rule (1) of rule 16.";

(ii) in sub-rule (2), for the word 'President', the words 'Head of the Department' shall be substituted;

(iii) in sub-rule (3),-

(a) in clause (a), for the word 'President' the words 'Head of the Department' shall be substituted;

(b) clause (c) shall be omitted.

(VI) the Fifth Schedule shall be omitted.

G.S.R. 142.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules to amend the Central Institute of Horticulture, Medziphema, Director (Group `A' Post) Recruitment Rules, 2021, namely:-

1. Short title and commencement.– (1) These rules may be called the Central Institute of Horticulture, Medziphema, Director (Group `A' Post) Recruitment (Amendment) Rules, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Central Institute of Horticulture, Medziphema, Director (Group `A' Post) Recruitment Rules, 2021, in column (11), under the heading "Deputation (including short-term contract)", in sub-items (i) and (ii) of item (a), after the words "or Department", the word "or" shall be inserted.

3. भर्ती की पद्धति, आयु सीमा और अर्हताएं आदि. – उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं ।

4. निरर्हता. - वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:-

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता हैं कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. शिथिल करने की शक्ति. - जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्धारा शिथिल कर सके गी।

6. व्यावृति.- इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

4. Disqualification. – No person, –

(a) who has entered into or contracted a marriage with the person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person;

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reason to be recorded in writing, and in consultation with the Union Public Service Commission, by order and for reason to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारंभ. - (1) इन नियमों का संक्षिप्त नाम कृ षि और किसान कल्याण मंत्रालय, कृ षि और किसान

कल्याण विभाग, कें द्रीय कृ षि उद्यान संस्थान, मेडज़ीफ़े मा परिसर, दीमापुर,

नागालैंड, पोस्ट हार्वेस्ट प्रौद्यौगिकीविद और ज्येष्ठ फार्म प्रबंधक (समूह 'क' पद)

भर्ती नियम, 2022 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या, वर्गीकरण, वेतन मैट्रिक्स में स्तर. - उक्त पद की संख्या, उसका वर्गीकरण और वेतन मैट्रिक्स में उसका स्तर वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं।

3. भर्ती की पद्धति, आयु सीमा और अर्हताएं आदि. - भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिर्दिष्ट हैं ।

4. निरर्हता. - वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:-

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता हैं कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. शिथिल करने की शक्ति. - जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

6. व्यावृति. - इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

1. Short title and commencement. – (1) These rules may be called the Ministry of Agriculture and Farmers Welfare, Department of Agriculture and Farmers Welfare, Central Institute of Horticulture, Medziphema, Campus, Dimapur, Nagaland, Post Harvest Technologist and Senior Farm Manager, (Group 'A' posts), Recruitment Rules, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix. - The number of said post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age-limit, qualifications, etc. – The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the Schedule annexed to these rules.

4. Disqualification. – No person, –

(a) who has entered into or contracted a marriage with the person, having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person;

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reason to be recorded in writing, and in consultation with the Union Public Service Commission, by order and for reason to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. – Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

1. संक्षिप्त नाम और प्रारम्भ – (1) इन नियमों को 'राष्ट्रीय अनुसूचित जनजाति आयोग', आशुलिपिक समूह 'ग' भर्ती नियमावली, 2022' कहा जाएगा।

(2) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से प्रवृत्त होंगे।

2. पदों की संख्या, वेतन मैट्रिक्स में वर्गीकरण तथा स्तर (लेवल) - उक्त पद की संख्या, तत्संबंधी संबद्ध वेतन मैट्रिक्स में उनका वर्गीकरण और स्तर वह होगा जो इन नियमों के साथ सलंग्न अनुसूची के कॉलम (2) से (4) में विनिर्दिष्ट है।

3. भर्ती की पद्धति, आयु सीमा तथा अर्हताएं आदि - उक्त पद पर भर्ती की पद्धति, आयु सीमा, योग्यताएं (अर्हताएं) और उससे संबंधित अन्य बातें वे होंगी जो उपयु र्क्त अनुसूची के कॉलम (5) से (13) में विनिर्दिष्ट हैं।

4. प्रारंभिक संरचना - (1) नियमित आधार पर आशुलिपिक के पद धारण करने वाले पदधारियों को इन नियमों के प्रावधानों के अनुसार नियुक्त किया गया समझा जाएगा।

(2) इन नियमों के प्रारंभ होने से पहले उप नियम (1) में निर्दिष्ट पदधारियों की नियमित निरंतर सेवा को परिवीक्षा, वरिष्ठता, पदोन्नति के लिए अर्हक सेवा, स्थायीकरण और सेवा में पेंशन के प्रयोजनों के लिए गिना जाएगा।

5. अयोग्यता (अपात्रता) – कोई भी व्यक्ति -

(क) जिसने ऐसे किसी व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है जिसकी पत्नी/पति जीवित है, अथवा (ख) जिसकी पत्नी/पति जीवित है, ने किसी भी व्यक्ति के साथ विवाह किया है या विवाह का अनुबंध किया है, उपरोक्त पद पर नियुक्ति के लिए पात्र नहीं होगा:

बशर्ते कि के न्द्रीय सरकार, यदि संतुष्ट है कि ऐसा विवाह ऐसे व्यक्ति और विवाह वाले अन्य पक्ष के लिए लागू सवीय विधि (पर्सनल लॉ) के तहत अनुज्ञेय है और उस व्यक्ति के द्वारा ऐसा करने के अन्य कारण हैं तो किसी व्यक्ति को इस नियम के लागू होने में छू ट प्रदान कर सकती है।

6. शिथिल करने की शक्ति – जहां कें द्रीय सरकार का यह विचार है कि ऐसा करना आवश्यक अथवा समीचीन है, तो आदेशानुसार, कारणों को लिखित में दर्ज करते हुए किसी भी वर्ग या श्रेणी के व्यक्तियों के संबंध में इन नियमों के किसी भी प्रावधान के तहत शिथिल कर सके गी।

7. व्यावृत्ति (अपवाद) – इन नियमों में से कोई भी नियम इस संबंध में कें द्र सरकार द्वारा समय-समय पर जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, पूर्व सैनिकों और अन्य विशेष श्रेणी के व्यक्तियों के लिए प्रदान किए जाने वाले आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों को प्रभावित नहीं करेगा।

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, level in pay matrix. - The number of post, its classification and the level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications etc.- The method of recruitment to the said post, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule.

4. Initial Constitution. - (1) The incumbents holding the posts of Stenographer on regular basis, shall be deemed to have been appointed in accordance with the provisions of these rules.

(2) The regular continuous service of incumbents referred to in sub rule (1) prior to the commencement of these rules shall count for the purposes of probation , seniority, qualifying service for promotion, confirmation and pension in the service.

5. Disqualification . – No person, -

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt such person from the operation of this rule.

6. Power to relax. – Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. - Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

सा.का.नि. 149.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और प्रकाशन विभाग (वर्ग 3 पद) भर्ती नियम, 1968 को, जहाँ तक उनका संबंध विक्रय सहायक के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, प्रकाशन प्रभाग, सूचना और प्रसारण मंत्रालय में विक्रय सहायक समूह 'ग' के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. संक्षिप्त नाम और प्रारंभ :(1) इन नियमों का संक्षिप्त नाम प्रकाशन विभाग, विक्रय सहायक (समूह 'ग' पद) भर्ती

नियम, 2022 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स मे स्तर : उक्त पद की संख्या, उसका वर्गीकरण और इससे संलग्नं वेतन मैट्रिक्स में स्तर या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिर्दिष्ट हैं

3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि- भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ (5) से (13) में विनिर्दिष्ट हैं ।

4. निरर्हता - वह व्यक्ति

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह उस व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. शिथिल करने की शक्ति - जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

6. व्यावृत्ति - इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

G.S.R. 149.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Publications Division (Class III) posts Recruitment Rules, 1968, in so far as they relate to the post of Sales Assistant, except as respect things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Sales Assistant, Group 'C' Post in the Publications Division, Ministry of Information and Broadcasting, namely :-

1. Short title and commencement.- (1) These rules may be called the Publications Division, Sales Assistant (Group 'C' Post) Recruitment Rules, 2022.

(2) They shall come into force on the date of their publication in the official Gazette.

2. Number of posts, classification and level in pay matrix.- The number of the said post, its classification and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं इत्यादि - भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य मामले उक्त अनुसूची के स्तम्भ (5) से (13) में विनिर्दिष्ट अनुसार होंगे।

5. निरर्हता - कोई व्यक्ति, -[भाग II—खण्ड 3(i)] भारत का राजपत्र : अक्तूबर 8, 2022/आश्विन 16, 1944 935 (क) जिसने ऐसे व्यक्ति से विवाह किया है या विवाह का अनुबंध किया है, जिसका पति या जिसकी पत्नी जीवित है; या (ख) जिसने अपने पति या पत्नी के जीवित रहते हुए, किसी व्यक्ति से विवाह किया है या विवाह का अनुबंध किया है, कथित पद पर नियुक्ति का पात्र नहीं होगा।

परंतु कें द्रीय सरकार की यह राय है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के दूसरे पक्ष पर लागू स्वीय विधि के अधीन अनुज्ञेता और ऐसा करने के लिए अन्य आधार हैं, तो किसी भी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

6. शिथिल करने की शक्ति -जहां कें द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को, किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिलकर सके गी।

7. व्यावृत्ति –इन नियमों की कोई बात ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समयपर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ा वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियोंके लिए उपबंध करना अपेक्षित है।
