सा.का.नि. 54.—के न्द्रीय सरकार, सशस्त्र सीमा बल अधिनियम, 2007 (2007 का 53) की धारा 155 की उपधारा (2) के खंड (क) और खंड (ग) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सशस्त्र सीमा बल योधक संचार सेवा समूह 'ख' पद भर्ती नियम, 2010 को और सशस्त्र सीमा बल योधक संचार सेवा ('ख' एवं 'ग' पद) भर्ती नियम 2018 को, जहां तक उनका संबंध सब-इंस्पेक्टर (संचार) पद से हैं, उन बातों के सिवाय अधिक्रान्त करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, गृह मंत्रालय, सशस्त्र सीमा बल में निरीक्षक (संचार) और उप-निरीक्षक (संचार) के पदों पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाती है, अर्थात:-

(341)342 THE GAZETTE OF INDIA : MAY 18 2024/VAISAKHA 28, 1946 [PART II—SEC. 3(i)] 1. संक्षिप्त नाम और प्रारंभ.- (1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय, सशस्त्र सीमा बल, योधक, संचार काडर, निरीक्षक (संचार) और उप-निरीक्षक (संचार), समूह 'ख' पद भर्ती नियम, 2024 है।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. लागू होना.- ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में यथा विनिदिष्ट पदों को लागू होंगे।

3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.– उक्त पदों की संख्या, उनका वर्गीकरण और वेतन मैट्रिक्स में उनका स्तर वह होगा, जो इन नियमों से उपाबद्ध उक्त अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिदिष्ट हैं।

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं, आदि.- उक्त पदों पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिदिष्ट हैं।

5. निरर्हता.- वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

6. चिकित्सक दृष्टया योग्यता.- इन नियमों में अन्तविष्ट किसी बात के होते हुए भी, के वल वे व्यक्ति जो चिकित्सा प्रवर्ग 'शेप-1' में हैं, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे।

स्पष्टीकरण:- इस नियम के प्रयोजन के लिए, 'शेप-1' से निम्नानुसार विनिदिष्ट चिकित्सा प्रवर्ग अभिप्रेत है, अर्थात्:

(क) कोड अक्षर शेप (एस.एच.ए.पी.ई.), जो निम्नलिखित कृ त्यों का वर्णन करते हैं, द्वारा उपदशित दिए गए घटकों के अधीन अधिकारी की योग्यता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सीय वर्गीकरण :-

एस - मनोवैज्ञानिक;

एच - श्रवण शक्ति;

ए - उपांग (अपैन्डेजेस) ;

पी - शारीरिक क्षमता; और

ई - दृष्टि शक्ति।

(ख) प्रत्येक घटक के अधीन, किसी अधिकारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के समाने अंक 1 से 5 द्वारा गिरती कार्य क्षमता उपदशित करते हुए दर्शाई जायगी और कोड अक्षर के पश्चात् अंक लिखे जाएगें, सिवाय उसके जहाँ कोई अधिकारी सभी घटकों में श्रेणी-1 में है, वहाँ उसका प्रवर्ग एस1, एच1, ए1, पी1, ई1 लिखने के बजाय, शेप-1 लिखकर दर्शाया जा सके गा और इन अंको का सामान्य मूल्यांकन निम्नानुसार है अर्थातः–

(i) भारत में कहीं भी सभी कर्तव्यों के लिए योग्य।

(ii) सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों और ऑखों की श्रवण शक्ति या दृष्टि की तीक्ष्णता की मांग अंतर्वलित है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों अनुसार परिसीमाएं हो सकती हैं;

(iii) "एस" घटक के सिवाय, नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंड़े क्षेत्रो या पहाड़ी भूखण्डो पर लम्बें कर्तव्यों भार के लिए नियोजन योग्यता की परिसीमाएं हो सकती है ;

(iv) अस्पताल में भर्ती या बीमारी की छु ट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ; और (v) कर्तव्यों के लिए स्थायी रूप से अयोग्य ।

7. अन्यदेशीय अपात्रता.- कोई व्यक्ति, जो भारत का नागरिक नहीं है, लिखित में के न्द्रीय सरकार की पूर्व अनुमति के सिवाय, इन नियमों के अधीन नियुक्त नहीं किया जाएगाः

परन्तु इस नियम में अंतविष्ट कोई बात बल में नेपाल या भूटान की प्रजा की नियुक्ति या नियोजन को वजित नहीं करेगी ।

8. अधिवषिता.- इन नियमों के अधीन नियुक्त किया गया प्रत्येक कामिक उस मास के , जिसमें वह साठ वर्ष की आयु अभिप्राप्त करता है, अंतिम दिन के अपराह्न में सेवानिवृत होगा।

परन्तु ऐसा व्यक्ति जिसकी जन्म की तारीख किसी मास की पहली तारीख है, तो उस माह के , जिसमें वह साठ वर्ष की आयु प्राप्त करता है, पूर्व मास की अंतिम तारीख के अपराह्न में सेवानिवृत होगा ।

9. सेवा का दायित्व.– उक्त नियमों की अनुसूची के स्तंभ (1) में यथा विनिदिष्ट अधीन उक्त पदों पर नियुक्त कोई व्यक्ति भारत या विदेश में कहीं भी सेवा करने का दायी होगा।

10. शिथिल करने की शक्ति.- जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके और संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

11. व्यावृति.- इन नियमों की कोई बात ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंघ में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडें वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

MINISTRY OF HOME AFFAIRS

New Delhi, the 1st May, 2024

G.S.R. 54.—In exercise of the powers conferred by clauses (a) and (c) of sub-section (2) of section 155 of the Sashastra Seema Bal Act, 2007 (53 of 2007) and in supersession of the Sashastra Seema Bal Combatised Telecommunication Cadre Group ‗B' Posts Recruitment Rules, 2010; and the Sashastra Seema Bal, Combatised Communication Service (Group ‗B' and ‗C' posts) Recruitment Rules, 2018, in so far as they relate to the post of Sub- Inspector (Communication), except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Inspector (Communication) and Sub-Inspector (Communication) in the Sashastra Seema Bal, Ministry of Home Affairs, namely:-

1. Short title and commencement.- (1) These rules may be called the Ministry of Home Affairs, Sashastra Seema Bal, Combatised, Communication Cadre, Inspector (Communication) and Sub-Inspector (Communication), Group ‗B' Posts, Recruitment Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.- These rules shall apply to the posts as specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification and level in pay matrix.- The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification .- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Medical fitness.- Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-1, shall be eligible for appointment under the provisions of these rules.

Explanation.- For the purposes of this rule, ―SHAPE-I‖ means medical category specified as follows, namely:-

(a) Medical classification done by medical officer after assessing fitness of the officer under the given factors indicated by the code letters SHAPE, which represent the following function, namely: -348 THE GAZETTE OF INDIA : MAY 18 2024/VAISAKHA 28, 1946 [PART II—SEC. 3(i)] S - Psychological;

H - Hearing;

A - Appendages;

P - Physical Capacity; and

E - Eye-Sight.

(b) functional capacity of an officer under each factor shall be denoted by numeral one to five against each code letter, indicating declining functional efficiency and the numerals will be written next to the code letter, except where that an officer is in Grade-I in all factors, his category may be denoted by writing SHAPE-I, instead of writing S1H1A1P1E1 and general evaluation of these numerals are as under, namely:-

(i) fit for all duties anywhere in India;

(ii) fit for all duties but may have limitations as to type of duties and area of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears and eyes, respectively;

(iii) excepting ―S‖ factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments;

(iv) temporarily unfit for duties on account of hospitalisation or sick leave; and

(v) permanently unfit for duties.

7. Ineligibility of Aliens.- No person who is not a citizen of India shall, except with the prior permission of the Central Government in writing, be appointed under these rules:

Provided that nothing contained in this rule shall debar the appointment or employment of a citizen of a subject of Nepal or Bhutan in the Force.

8. Superannuation.- Every personnel appointed under these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of sixty years:

Provided that a person whose date of birth is on the first day of the month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of superannuation.

9. Liability of service.- Any person appointed to the said posts as specified in column (1) of the Schedule to the said rules shall be liable to serve anywhere in India or abroad.

10. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing and consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

11. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons in accordance with the order issued by the Central Government from time to time in this regard.

SCHEDULE

Note.– Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

By deputation:

Officer of the Central Government or State Governments or Union territory Administrations having medical category SHAPE-1,-

(a)(i) holding analogous post on a regular basis in the parent cadre or Department; or

(ii) with six years regular service in the grade of Assistant Sub-Inspector (Communication) in level-5 in the pay matrix (Rs.29200-92300) in the parent cadre or Department; and

(b) possessing the following educational qualifications and experience,–

Bachelor's degree in Electronics and Communication or Computer Science or Information Technology Engineering or Science with Physics, Chemistry and Mathematics from a recognised University or institution.

Note 1.– The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion.

Note 2.– The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not exceed three years.

Note 3.– The maximum age-limit for appointment by deputation shall not be exceeding fifty-six years, as on the closing date of receipt of applications.

Re-employment:

(i) Re-employment of the Ex-servicemen who have held the same or equivalent rank in the Armed Forces and possessing educational qualifications prescribed for direct recruits under column (7).

(ii) the Armed Forces personnel due to retire or who are to be transferred to reserve within a period of one year and having the requisite experience and qualification prescribed, shall also be considered for deputation. Such person shall be given deputation terms upto the date on which they are due to release from the Armed Forces, thereafter, they may be continued on re-employment.

(iii) the candidates shall be in the medical category SHAPE-1.

Note .– The re-employed officers shall have to successfully qualify senior basic communication course on their joining in the Sashastra Seema Bal.

सा.का.नि. 55.—के न्द्रीय सरकार, सशस्त्र सीमा बल अधिनियम, 2007 (2007 का 53) की धारा 155 की उपधारा (2) के खंड (क) और खंड (ग) के साथ पठित उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सशस्त्र सीमा बल, समूह 'ख' योधक (अराजपत्रित) पायनियर काडर पद भर्ती नियम, 2011 और गृह मंत्रालय, सशस्त्र सीमा बल, योधक ड्राफ्टसमैन काडर (समूह 'ख' पद) भर्ती नियम, 2013 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हे ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया है, गृह मंत्रालय, सशस्त्र सीमा बल में निरीक्षक (ड्राफ्ट्समैन), निरीक्षक (पायनियर), उप-निरीक्षक (ड्राफ्ट्समैन) और उप-निरीक्षक (पायनियर) के पदों पर भर्ती की पद्धति को विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात:-

1. संक्षिप्त नाम और प्रारंभ.– (1) इन नियमों का संक्षिप्त नाम गृह मंत्रालय, सशस्त्र सीमा बल, योधक इंजीनियरिग काडर, निरीक्षक (ड्राफ्ट्समैन), निरीक्षक (पायनियर), उप-निरीक्षक (ड्राफ्ट्समैन) और उप-निरीक्षक (पायनियर) , समूह 'ख' पद भर्ती नियम, 2024 है।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

2. लागू होना.–ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में विनिदिष्ट पदों को लागू होंगे।

3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.– उक्त पदों की संख्या, उनका वर्गीकरण और इससे संलग्न वेतन मैट्रिक्स में स्तर वे होंगे, जो उक्त अनुसूची के स्तंभ (2) से स्तंभ (4) में विनिदिष्ट हैं।

4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.– उक्त पदों पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी, जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विनिदिष्ट हैं।

5. निरर्हता.– वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा की है या,

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

उक्त पदों पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

6. चिकित्सक दृष्टया योग्यता.– इन नियमों में अंतविष्ट किसी बात के होते हुए भी, के वल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप-1 में हैं, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे।

स्पष्टीकरण.– इस नियम के प्रयोजन के लिए, "शेप-1" से निम्नानुसार विनिदिष्ट चिकित्सा प्रवर्ग अभिप्रेत है:-

(i) कोड अक्षर शेप एस एच ए पी ई, जो निम्नलिखित कृ त्य का प्रतिनिधित्व करते हैं, द्वारा उपदशित दिए गए कारकों के अधीन अधिकारी की उपयुक्त्ता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण, अर्थातः–

एस - मनोवैज्ञानिक

एच - श्रवण शक्ति353 [भाग II—खण्ड ³(i)] भारत का राजपत्र: मई ¹⁸, ²⁰²⁴/वैशाख ²⁸, ¹⁹⁴⁶ ए - उपांग (अपैन्डेजेस)

पी - शारीरिक क्षमता

ई - दृष्टि शक्ति

(ii) प्रत्येक कारक के अधीन किसी अधिकारी की कार्यात्मक क्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 की कार्यक्षमता उपदशित करते हुए दर्शाई जायगी और कोड अक्षर के पश्चात् अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी कारकों में श्रेणी-1 में है वहां उसका प्रवर्ग एस1, एच1, ए1, पी1, ई1 लिखने के बजाय शेप-1 लिखकर दर्शाया जा सके गा, इन अंको का साधारण मूल्यांकन निम्नानुसार है:-

(क) भारत में कहीं भी सभी कर्तव्यों के लिए योग्य;

(ख) सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों और ऑखों की श्रवण शक्ति/ दृष्टि की तीक्ष्णता की मांग अन्तग्र्रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती है;

(ग) 'एस' कारक को छोडकर नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंड़े क्षेत्रों या पहाड़ी भूखंडों पर और दीर्घ कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती है ;

(घ) अस्पताल में भर्ती या बीमारी की छु ट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ;

(ड़) कर्तव्यों के लिए स्थायी रूप से अयोग्य ।

7. अन्यदेशीय अपात्रता.– कोई व्यक्ति, जो भारत का नागरिक नहीं है, लिखित में के न्द्रीय सरकार की पूर्व अनुमति के सिवाय, इन नियमों के अधीन नियुक्त नहीं किया जाएगा ।

परन्तु ऐसा व्यक्ति जिसकी जन्म की तारीख किसी मास की पहली तारीख होगी, साठ वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम तारीख के अपराह्न में सेवानिवृत होगा ।

(2) किसी व्यक्ति को उपनियम (1) में विनिदिष्ट सेवानिवृति की आयु से परे सेवा में विस्तार मंजूर नहीं किया जाएगा।

9. सेवा का दायित्व.- उक्त नियमों की अनुसूची के स्तंभ (1) में विनिदिष्ट पद पर नियुक्त व्यक्ति भारत में कहीं भी या विदेश में सेवा करने का दायी होगा ।

10. शिथिल करने की शक्ति.– जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी ।

G.S.R. 55.—In exercise of the powers conferred by sub-section (1) read with clauses (a) and (c) of sub-section (2) of section 155 of the Sashastra Seema Bal Act, 2007 (53 of 2007) and in supersession of the Sashastra Seema Bal Group ‗B' Combatised (Non-Gazetted) Pioneer Cadre, posts Recruitment Rules, 2011; and the Ministry of Home Affairs, Sashastra Seema Bal, Combatised Draughtsman Cadre (Group ‗B' posts) Recruitment Rules, 2013, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Inspector (Draughtsman), Inspector (Pioneer), Sub- Inspector (Draughtsman) and Sub-Inspector (Pioneer) in the Sashastra Seema Bal, Ministry of Home Affairs, namely:-

1. Short title and commencement.-(1) These rules may be called the Ministry of Home Affairs, Sashastra Seema Bal, Combatised Engineering Cadre, Inspector (Draughtsman), Inspector (Pioneer), Sub-Inspector (Draughtsman) and Sub-Inspector (Pioneer), Group ‗B' Posts, Recruitment Rules, 2024.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.-These rules shall apply to the posts as specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification and level in pay matrix.-The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age-limit, qualifications, etc.-The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

5. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Medical fitness.– Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE-1, shall be eligible for appointment under the provisions of these rules.

Explanation.- For the purposes of this rule, ‗SHAPE-1' means medical category specified as following, namely:-

(i) medical classification made by medical officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE, which represent the following functions, namely:-

S – Psychological;

H – Hearing;

A – Appendages;

P– Physical Capacity; and

E – Eyesight.

(ii) functional capacity of an officer under each factor shall be denoted by numerals 1 to 5 against each code letter, indicating declining functional efficiency and the numerals will be written next to the code letter, except where an officer is in Grade-1 in all factors, his category may be denoted by writing SHAPE-I, instead of writing S1H1A1P1E1 and general evaluation of these numerals is given as under:-

(A) Fit for all duties anywhere in India;

(B) Fit for all duties but may have limitations as to the type of duties and the area of employability depending on whether the duties involve severe stress or demand acuity of hearing or vision of both ears or eyes, respectively;

(C) Excepting ‗S' factor, fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters) extreme cold areas or hilly terrain and for long assignments;

(D) Temporarily unfit for duties on account of hospitalisation or sick leave; and

(E) Permanently unfit for duties.

7. Ineligibility of Aliens.- No person, who is not a citizen of India shall, except with the prior permission of the Central Government in writing, be appointed or employed under these rules:

Provided that nothing contained in this rule shall debar the appointment or employment of a subject of Nepal or Bhutan in the Force.

8. Superannuation.- (1) Every person appointed under these rules shall retire from service on the afternoon of the last day of the month in which he or she attains the age of sixty years or as prescribed by the Central Government from time to time:

Provided that a person whose date of birth is on the first day of a month, shall retire from service on the afternoon of the last day of the preceding month on attaining the age of superannuation.

(2) No person shall be granted extension in service beyond the age of retirement on superannuation as specified in sub-rule (1).

9. Liability of service.- Any person appointed to the said post as specified in column (1) of the Schedule to the said rules shall be liable to serve anywhere in India or abroad.

11. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

5. चिकित्सीय दृष्यता योग्यता.– इन नियमों में किसी बात के अंतविष्ट होते हुए भी के वल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप-1 में हैं, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।

स्पष्टीकरणः इन नियम के प्रयोजनों के लिए 'शेप-1' से निम्नलिखित रूप में विनिदिष्ट चिकित्सा प्रवर्ग अभिप्रेत हैः– (i) किसी चिकित्सा अधिकारी द्वारा दिए गए कारकों के अधीन अधिकारी की योग्यता का निर्धारण करने के पश्चात् किया गया ऐसा चिकित्सा वर्गीकरण, जो कोड अक्षर शेप द्वारा उपदशित है, निम्नलिखित का प्रतिनिधित्व करता है, अर्थातः– एस - मनोवैज्ञानिक;

एच - श्रवण शक्ति;

ए - उपांग (अपैन्डेजेस) ;

पी - शारीरिक क्षमता; और

ई - दृष्टि शक्ति।

(ii) प्रत्येक घटक के अधीन, किसी अधिकारी की कार्यक्षमता, प्रत्येक कोड अक्षर के सामने अंक 1 से 5 द्वारा, गिरती कार्यक्षमता उपदशित करते हुए दर्शाई जाएगी और कोड अक्षर के पश्चात् अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी घटकों में श्रेणी-1 में हैं, वहां उसका प्रवर्ग एस1एच1ए1पी1ई1 लिखने के बजाय शेप-1 लिखकर दर्शाया जा सके गा ।

इन अंकों का साधारण निर्धारण निम्ननुसार है, अर्थातः–

(क) भारत में कहीं भी सभी कर्तव्यों के लिए योग्य ;

(ख) सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों और ऑखों की श्रवण शक्ति या दृष्टि की तीक्ष्णता की मांग अंतर्वलिव है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों अनुसार परिसीमाएं हो सकती है;

(ग) "एस" घटक के सिवाय, नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंड़े क्षेत्रो या पहाड़ी भूखण्डो पर दीर्घ कर्तव्यों भारो के लिए नियोजन योग्यता की परिसीमाएं हो सकती है ;

(घ) अस्पताल में भर्ती या बीमारी की छु ट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य ;

(ड.) कर्तव्यों के लिए स्थायी रूप से अयोग्य ।

6. अधिवषिता.- इन नियमों के अधीन नियुक्त किया गया कोई व्यक्ति उस मास के , जिसमें वह साठ वर्ष की आयु प्राप्त करता है, अंतिम दिन के अपराह्न में सेवानिवृत होगा:

परन्तु ऐसा व्यक्ति जिसकी जन्म की तारीख किसी मास की पहली तारीख होगी, साठ वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराह्न में सेवानिवृत होगा ।

7. सेवा का दायित्व.- इन नियमों के अधीन उक्त पद पर नियुक्त कोई व्यक्ति, भारत में कहीं भी या विदेश में सेवा करने का दायी होगा।

shall be eligible for appointment to the said post:

Saving.--Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-Servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
