का.नि.आ. 7.— राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और सेना आयुध कोर (समूह 'ग', और समूह 'घ' औद्योगिक) भर्ती नियम 1980 को, जहां तक वे ब्रोज़ियर, साइकिल फिटर, टेंट मेंडर, लिस्टर ड्राइवर, वीक्षक समूह 'ग' और 'घ', बॉयलरमैन, हैमरमैन/ब्लैक स्मिथ स्ट्राइकर, वेब मरम्मत करने वाला/चौक्लर, रस्सी कार्यकर्ता, लांड्री ऑपरेटर, रेस्पिरेटर ऑपरेटर, वल्के नाइजर, मार्क र और चेकर/पॉलिसर/क्लीनर के पदों से संबंधित हैं को उन बातों के सिवाय जिन्हें ऐसे अधिक्रमण से पहले किया गया हैं या करने का लोप किया गया है, रक्षा मंत्रालय सेना आयुध कोर में समूह 'ग' ट्रेड्समैन (र्अर्द्कु शल) के पद पर भर्ती की र्पद्ति को विनियमित करने वाले निम्नलिखित नियम बनाती है, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ : (1) इन नियमों का संक्षिप्त नाम रक्षा मंत्रालय, सेना आर्युद् कोर, ट्रेड्समैन (र्अर्द्कु शल), समूह 'ग' पद भर्ती नियम, 2025 है।

2. पद-संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर : उक्त पद की संख्या, उनका वर्गीकरण और उनका वेतन मैट्रिक्स में स्तर वे होंगा, जो इन नियमों से उपार्बद् अनुसूची के स्तंभ (2) से स्तंभ (4) में विर्निर्दष्ट हैं।

3. भर्ती की र्पद्ति, आयु-सीमा, अर्हताएं, आदि : भर्ती की र्पद्ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13) में विर्निर्दष्ट हैं।

4. निरर्हता : वह व्यक्ति -

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है;

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है

उक्त पदों पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि के न्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।

5. शिथिल करने की शक्ति - जहां के न्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखर्बद् करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

6. व्यावृत्ति - इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्रीय सरकार द्वारा इस संबंध में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों अन्य पिछडे वगों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

अनुसूची

विभागीय अभ्र्यर्थयों के लिए चालीस वर्ष तक और अनुसूचित जातियों तथा अनुसूचित जनजातियों के लिए पैंतालीस वर्ष तक शिथिल की जा सकती है)।

टिप्पण 1 :- आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्र्यर्थयों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी न कि वह अंतिम तारीख जो असम, मेघालय, अरुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिमिि, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चम्बा-जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप, लद्दाख या लक्षद्वीप संघ राज्यक्षेत्र के अभ्र्यर्थयो के लिए विहित की गई है;

टिप्पण 2 :- अगर रोजगार कार्यालय के द्वारा भर्ती की जाती है तो इस अवस्था मे आयु सीमा को अवधारित करने की अंतिम तारिख रोजगार कार्यालय द्वारा नाम जमा करने कि लिए कहा जाए वो होगी।

वाले व्यक्तियों के लिए विहित शैक्षणिक अर्हता धारण करते हैं।

1. एकीकृ त मुख्यालय रक्षा मंत्रालय (सेना), नई दिल्ली र्आर्डनेंस सेवा के महानिदेशक द्वारा नामित ब्रिगेडियर रैंक का एक अधिकारी - अध्यक्ष;

2. एकीकृ त मुख्यालय रक्षा मंत्रालय (सेना), नई दिल्ली र्आर्डनेंस सेवा के महानिदेशक द्वारा नामित कर्नल या लेटिटनेंट कर्नल के रैंक के अधिकारी - सदस्य;

3. सेना र्आर्डनेंस कोर के सिवाय थल सेना या सेवाओं के कर्नल या लेटिटनेंट कर्नल रैंक का एक अधिकारी - सदस्य;

4. एकीकृ त मुख्यालय रक्षा मंत्रालय (सेना), नई दिल्ली र्आर्डनेंस सेवा के महानिदेशक द्वारा नामित, र्आर्डनेंस सेवा (कार्र्मक) के कर्नल/लेटिटनेंट कर्नल/संयुक्त निदेशक/उप निदेशक के रैंक का एक अधिकारी - सदस्य।

(कें रीय सरकार द्वारा समय-समय पर जारी किए गये अनुदेशो या आदेशों के अनुसार साधारण अभ्र्यर्थयों के मामले में विभागीय अभ्र्यर्थयों के लिए चालीस वर्ष तक और अनुसूचित जातियों तथा अनुसूचित जनजातियों के लिए पैंतालीस वर्ष तक शिथिल की जा सकती है)।

NOTIFICATION

New Delhi, the 9th January, 2025

S.R.O. 7.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Army Ordnance Corps (Group 'C' and Group 'D' Industrial ) Recruitment Rules 1980, in so far as they relate to the posts of Brazier, Cycle Fitter, Tent Mender, Lister Driver, Viewer Grade 'C', Boilerman, Hammerman/Black Smith Striker, Web Repairer/Chuckler, Rope Worker, Laundry Operator, Respirator Operator, Vulcaniser, Viewer Grade 'D', Marker and Checker, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group 'C' posts Tradesman (Semi Skilled), in the Army Ordnance Corps, Ministry of Defence, namely:-

1. Short title and commencement.–(1) These rules may be called the Ministry of Defence, Army Ordnance Corps, Tradesman (Semi Skilled), Group 'C' Posts Recruitment Rules, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification and level in pay matrix. –The number of the said posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age-limit, qualifications, etc.– The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.

4. Disqualification.– No person,-

(a) who, has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said posts:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.– Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.– Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the ex-50 THE GAZETTE OF INDIA : MARCH 15, 2025/PHALGUNA 24, 1946 [PART II—SEC. 4] servicemen, and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

SCHEDULE

Two years.

Note .– There shall be a mandatory induction training of at least two weeks duration for successful completion of probation as prescribed by the Central Government.

Manipur, Nagaland, Tripura, Sikkim, Lahaul and Spiti District and Pangi Sub-Division of Chamba District of Himachal Pradesh and the Union territories of Ladakh, Anadaman and Nicobar Islands and Lakshadweep.

Note 2 .– In case of recruitment made through the employment exchange the crucial date for determining the age limit shall be the last date upto which the employment exchange is asked to submit the names.

का.नि.आ. 8.—ऱाष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सशस्त्र बल मुख्यालय आशुलिपिक (समूह 'ग') सेवा नियम, 2004 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया या करने का लोप किया गया है, निम्नलिखित नियम बनाती हैं, अर्थात्:-

1. संक्षिप्त नाम और प्रारंभ. - (1) इन नियमों का संक्षिप्त नाम सशस्त्र बल मुख्यालय आशुलिपिक (समूह 'ग'68 THE GAZETTE OF INDIA : MARCH 15, 2025/PHALGUNA 24, 1946 [PART II—SEC. 4] पद) सेवा नियम, 2025 है ।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

       2.        परिभाषाएं.- इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,-
       (क)       ''नियुक्ति प्राधिकारी'' से किसी श्रेणी के  संबंध में के न्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील)
नियम, 1965 के  अधीन इन नियमों के  अधीन किसी पद पर नियुक्ति करने के  लिए सशक्त प्राधिकारी अभिप्रेत है;
       (ख)       "अनुमोदित सेवा" से किसी श्रेणी के  संबंध में आशुलिपिक श्रेणी में सीधे भर्ती किये गए किसी अधिकारी के
दशा में,  उस वर्ष की पहली जनवरी से जो उस परीक्षा वर्ष के  बाद वाले वर्ष की जिसके  लिए सीधी भर्ती की गयी थी,  उस
श्रेणी में की गयी नियमित सेवा की अवधि या अवधियां,  जिनके  अंतर्गत अनुपस्थिति की वह अवधि या अवधियां भी हैं,
जिसके  दौरान उसने नियमित आधार पर पद धारण किया होता यदि वह छु ट्टी पर न होता या ऐसा पद धारण करने के  लिए
अन्यथा उपलब्ध होता;
       टिप्पण :- जहां उपरोक्त उल्लिखित दशा में नियुक्ति पर पद ग्रहण करने में नब्बे दिन से अधिक का विलम्ब हुआ है
वहां ऐसा विलम्ब संर्बद् अधिकारी के  कारण नहीं है |
       (ग)       "प्राधिकृ त संख्या"  से उस श्रेणी में जिसके  प्रति नियुक्तियां नियमित आधार पर की जा सकें गी,  पदों की
संख्या अभिप्रेत है;
       (घ)       "आयोग" से कर्मचारी चयन आयोग अभिप्रेत है;
       (ङ)       "सीधी  भर्ती"  से  अधिकथित  प्रक्रियाओं  के   अनुसार  कर्मचारी  चयन  आयोग  द्वारा  आयोजित  प्रतियोगी
परीक्षा के  आधार पर आशुलिपिक श्रेणी में भर्ती किया गया कोई व्यक्ति अभिप्रेत है;
       (च)       "कर्तव्य पद" से सशस्त्र बल मुख्यालय आशुलिपिक सेवा में सम्मिलित उस श्रेणी का कोई पद अभिप्रेत है;
       (छ)       "सरकार" से भारत सरकार अभिप्रेत है;
       (ज)       "श्रेणी" से नियम 3 में विर्निर्दष्ट श्रेणी अभिप्रेत है;
       (झ)       सेवा का "स्थाई अधिकारी" से ऐसा व्यक्ति अभिप्रेत है जिसकी प्रवेश श्रेणी में पुष्टि हो गई है;
       (ञ)       "नियमों" से सशस्त्र बल मुख्यालय आशुलिपिक (समूह 'ग' पद), सेवा नियम, 2025 अभिप्रेत है;
       (ट)       ''अनुसूची'' से इन नियमों की अनुसूची अभिप्रेत है;
       (ठ)       "अनुसूचित  जातियों  और  अनुसूचित  जनजातियों"  का  अर्थ  वही  होगा  जो  उनका  क्रमशः  भारत  के
संविधान के  अनुच्छेद  366 के  क्रमशः खंड (24) और खंड (25) में है;
       (ड)       "सेवा से" सशस्त्र बल मुख्यालय आशुलिपिक सेवा अभिप्रेत है;
       (ढ)       "अन्य पिछड़ा वर्ग" से भारत सरकार की सिविल सेवाओं और पदों में आरक्षण के  प्रयोजन के  लिए समय-
समय पर सरकार द्वारा अधिसूचित जातियां या समुदाय अभिप्रेत है;
       (ण)       "अस्थायी  अधिकारी"  किसी  श्रेणी  के   संबंध  में  अस्थायी  अधिकारी  से  इन  नियमों  के   सुसंगत  उपबंध  के
अनुसार उस श्रेणी में अस्थायी या स्थानापन्न नियुक्ति धारण करने वाला व्यक्ति या किसी श्रेणी में नियुक्त ऐसा अधिकारी
जिसे परिवीक्षा  से अभी हटाया जाना है, अभिप्रेत है;
       3.        सेवा  गठन.  –  (1)    आशुलिपिक  श्रेणी,  अराजपत्रित,  अनुसचिवीय  होगी  और  कें रीय  सिविल  सेवा
समूह 'ग' के  रूप में वर्गीकृ त की जाएंगी |
       (2)       इन नियमों के  प्रारंभ के  पूर्व विद्यमान आशुलिपिक श्रेणी के  सभी पदों, श्रेणी के  कर्तव्य पदों में संपरिर्वर्तत
किए गए समझे जाएंगे |
       4.        सेवा की प्राधिकृ त संख्या और उसका पुर्नर्वलोकन-

(1) इन नियमों के प्रारंभ की तारीख को सेवा की आशुलिपिक श्रेणी में सम्मिलित कर्तव्य पद, उनकी संख्या और वेतन मैट्रिक्स में स्तर वही होंगे जो अनुसूची-1 में विर्निर्दष्ट है |

(2) उपनियम (1) में किसी बात के होते हुए भी, सरकार-

(क) समय-समय पर सेवा के कर्तव्य पदों में अस्थायी रूप से परिवर्धन या परिवर्तन कर सके गी;

(ख) सशस्त्र बल मुख्यालय और अंतर सेवा संगठनों के ऐसे पदों को जिन्हें प्रास्थिति, श्रेणी, वेतन मैट्रिक्स में स्तर और व्यावसायिक तत्व में सेवा में सम्मिलित पदों के समतुल्य समझा जा सकता हो सेवा में सम्मिलित कर सके गी या सेवा में पहले से सम्मिलित किसी कर्तव्य पद को सेवा से अपर्वर्जत कर सके गी |

5. सेवा के सदस्य.- (1) निम्नलिखित व्यक्ति सेवा के सदस्य होंगे.-

(क) नियम छह के अधीन कर्तव्य पदों पर नियुक्त व्यक्ति; और

(ख) ऐसी नियुक्ति की तारीख से नियम 7 के अधीन कर्तव्य पदों पर नियुक्त व्यक्ति |

6. सेवा का आरंभिक गठन.- (1) इन नियमो के प्रारंभ की तारीख को सशस्त्र बल मुख्यालय आशुलिपिक सेवा में नियमित आधार पर अनुसूची-2 में विर्निर्दष्ट संगठनों में समूह 'ग' कर्तव्य पद धारण करने वाले सभी विद्यमान अधिकारी सेवा के सदस्य होंगे |

(2) इन नियमों के प्रारंभ से पूर्व उपनियम (1) में र्निर्दष्ट अधिकारियों के नियमित निरंतर सेवा परिवीक्षा, प्रोन्नति, सेवा में पुष्टि के प्रयोजन के लिए संगणित की जाएगी |

7. भर्ती के र्पद्ति और सेवा का भावी अनुरक्षण.- (1) अनुसूची-1 में र्निर्दष्ट श्रेणी में रिक्त कर्तव्य पद अनुसूची-4 में उपबंधित रीति में भरे जाए |

(2) प्रत्येक अधिकारी जब तक कि वह छु ट्टी पर या अन्यथा किसी अन्य कारण से जिसे लिखित रूप में अभिलिखित किया जायेगा कर्तव्य पद धारण करने के लिए उपलब्ध न हो सेवा की समुचित श्रेणी के कर्तव्य पद पर तैनात किया जाएगा |

(3) प्रत्येक कर्तव्य पद जब तक कि सेवा से अपर्वर्जत या किसी कारण से आस्थगित घोषित न किया जाए, श्रेणी के अधिकारी द्वारा सामान्य रूप से धारित किया जाएगा |

8. प्रतिनियुक्ति द्वारा कर्तव्य पदों का भरा जाना.- नियम 7 में किसी बात के होते हुए भी जहां सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है वहां ऐसे कारणों से जो लिखित रूप में अभिलिखित किए जा सकें गे और तीन वर्ष की अवधि जो विशेष परिस्थितियों में पांच वर्ष तक विस्तारित की जा सके गी, के लिए प्रतिनियुक्ति द्वारा किसी श्रेणी में कर्तव्य पद भर सके गी | इस नियम के अधीन आशुलिपिक श्रेणी में नियुक्ति के लिए अर्हता, अनुभव और पात्रता सेवा सरकार द्वारा विनितिि की जाएंगी |

9. ज्येष्ठता.- (1) इन नियमों के प्रारंभ पर सेवा के सदस्यों की सापेक्ष ज्येष्ठता उनकी अपनी श्रेणियों की वह सापेक्ष ज्येष्ठता होगी जो इन नियमों के पूर्व अवधारित की गई हो ।

परंतु सेवा के किसी सदस्य की ज्येष्ठता इन नियमों के प्रारंभ से पूर्व विर्निर्दष्ट रूप से अवधारित नहीं की गई थी, तो वह सरकार द्वारा अवधारित की जाएगी ।

(2) इन नियमों के प्रारंभ के पाित आशुलिपिक श्रेणी में नियुक्त व्यक्तियों की ज्येष्ठता, सरकार द्वारा समय- समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार अवधारित की जाएगी ।

10. परिवीक्षा, पुष्टि या अधिकारियों का परिवीक्षा पर बना रहना.- (1) आशुलिपिक श्रेणी में नियुक्ति पर प्रत्येक व्यक्ति दो वर्ष की अवधि के लिए परिवीक्षा पर रहेगा;

परन्तु नियुक्ति प्राधिकारी सरकार द्वारा समय-समय पर जारी किए गए साधारण आदेशों या अनुदेशों के अनुसार परिवीक्षा की अवधि का विस्तार कर सके गा।

(2) परिवीक्षा या उसके किसी विस्तार की समाप्ति पर, यदि अधिकारियों की प्रवेश श्रेणी में पहले से पुष्टि नहीं की गई है, तो यदि योग्य समझा जाता है तो उस श्रेणी में पुष्टि की जाएगी।

(3) यदि यथास्थिति, परिवीक्षा अवधि या उसके विस्तार की अवधि के दौरान नियुक्ति प्राधिकारी की यह70 THE GAZETTE OF INDIA : MARCH 15, 2025/PHALGUNA 24, 1946 [PART II—SEC. 4] राय है कि अधिकारी स्थायी नियुक्ति के लिए योग्य नहीं है तो वह अधिकारी यथास्थिति सेवोन्मुक्त या आशुलिपिक श्रेणी में उसकी नियुक्ति से पूर्व उसके द्वारा धारित पद पर प्रतिर्वर्तत कर दिया जा सके गा ।

(4) परिवीक्षा की अवधि या उसके किसी विस्तार के दौरान अधिकारी से ऐसे प्रशिक्षण और अनुदेश पाठ्यक्रम पूरा करने के लिए और ऐसी परीक्षा तथा परीक्षण उत्तीर्ण करने के लिए, जो ठीक समझा जाए, परिवीक्षा के समाधानप्रद पूरा होने की एक शर्त के रूप में, अपेक्षा की जा सके गी;

परन्तु काडर नियंत्रक प्राधिकारी का यह समाधान हो जाता है कि ऐसा करने के लिए पर्याप्त और विधिमान्य कारण हैं इस नियम के प्रवर्तन से अधिकारी को छू ट दे सके गा |

(5) आशुलिपिक श्रेणी में नियुक्त ऐसा अधिकारी जिसका सरकार या किसी राज्य सरकार के अधीन किसी पद पर कोई धारणाधिकार नहीं है या धारणाधिकार है बिना परिवीक्षा के दौरान ही बिना सूचना के किसी भी समय यथास्थिति सेवा से सेवोन्मुक्त या धारणाधिकार पद पर प्रतिर्वर्तत किए जाने का दायी होगा, यदि-

(i) परिवीक्षा के दौरान उसके कार्य निष्पादन या आचरण के आधार पर सेवा में आगे प्रतिधारित करने के लिए अयोग्य समझा जाता है; या

(ii) उसकी राष्ट्रीयता, आयु, स्वास्थ्य या पूर्ववृत या उसकी नियुक्ति से सुसंगत किसी अन्य पहलू से संबंधित कोई सूचना की प्राप्ति पर नियुक्ति प्राधिकारी का यह समाधान हो जाता है कि वह सेवा का सदस्य होने के लिए अपात्र या अन्यथा अयोग्य है |

(6) परिवीक्षा से संबंधित किसी अन्य विषय के लिए, सेवा के सदस्य भारत सरकार द्वारा समय-समय पर इस संबंध में जारी किए गए अनुदेशों या आदेशों द्वारा शासित होंगे |

11. सेवा में नियुक्ति.- (1) आशुलिपिक श्रेणी में सभी कर्तव्य पदों के लिए सभी नियुक्तियां नियुक्ति प्राधिकारी द्वारा की जाएगी ।

(2) सेवा के आशुलिपिक श्रेणी में सीधे भर्ती किए गए व्यक्तियों की नियुक्ति निम्नलिखित शतों के अधीन रहते हुए होगी,-

(क) ऐसी जांच जो उनकी उपयुक्तता निर्धारित करने के लिए सरकार द्वारा आवश्यक समझी जाए; और

(ख) व्यक्ति किसी ऐसी मानसिक या शारीरिक त्रुटि से जिससे सेवा के कर्तव्यों के निर्वहन में बाधा उत्पन्न होने की संभावना हो ऐसी चिकित्सीय परीक्षा के पाित् जो सरकार विहित करे मुक्त होना चाहिए ।

12. रक्षा से संर्बद् पदों में सेवा के दायित्व.- सेवा में नियुक्त कोई अधिकारी, यदि ऐसा अपेक्षित हो, रक्षा मंत्रालय या भारत की रक्षा से संर्बद् विभाग में कर्तव्य पद से भिन्न पदों में भारत में कहीं भी चार वर्ष से अनधिक की अवधि के लिए किसी रक्षा सेवा में सेवा करने के लिए पचास वर्ष की आयु तक दायी होगा। अधिकारियों से यदि सरकार ऐसा विनियि करती है तो किसी के न्रीय सरकार के कार्यालयों या पब्लिक सेक्टर उपक्रम में किसी अन्य वैसे ही पदों में सेवा करने के लिए भी अपेक्षा की जा सके गी ।

13. निरर्हता.- वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या विवाह की संविदा की है; या

(ख) जिसने अपने पति या पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,

सेवा में नियुक्ति के लिए पात्र नहीं होगा :

परंतु यदि के न्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी ।

14. वेतन का विनियमन.- श्रेणी के अधिकारियों का वेतन और वेतन र्वृद्यिां मूल नियमों या वेतन से संबंधित प्रवृत अन्य नियमों के अनुसार विनियमित की जाएंगी ।

15. विभागीय पुष्टि समिति की संरचना.- पुष्टि के लिए विभागीय पुष्टि समिति की संरचना अनुसूची 3 में यथा उपर्दर्शत होगी ।

16. अवशिष्ट मामले.- ऐसे मामलों के संबंध में जो इन नियमों के अंतर्गत विर्निर्दष्ट रूप से नहीं आते हैं सेवा के सदस्य साधारणतः के न्रीय सिविल सेवा को लागू नियम और आदेशों द्वारा शासित होंगे।

17. शिथिल करने की शक्ति.- जहां के न्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखर्बद् करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।

18. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों या अनुसूचित जनजातियों, अन्य पिछ्ड़े वगों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

19. निर्वचन.-यदि इन नियमों के निर्वचन के संबंध में कोई प्रश्न उद्भूत होता है तो वह सरकार द्वारा विनितिि किया जाएगा ।

NOTIFICATION

New Delhi, the 10th March, 2025

S.R.O. 8.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Armed Forces Headquarters Stenographers' (Group 'C' post) Service Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules, namely:-

1. Short title and commencement.- (1)These rules may be called the Armed Forces Headquarters Stenographers' (Group 'C' post) Service Rules, 2025.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- In these rules, unless the context otherwise requires,-

(a) "appointing authority" means the authority empowered under the Central Civil Service (Classification, Control and Appeal) Rules, 1965 to make appointments to the post under these rules;

(b) "approved service" in relation to any grade means in respect of an officer recruited directly to Stenographers' grade, period or periods of regular Service rendered in the grade, including period or periods of absence during which he would have held a post on a regular basis in that grade but for his being on leave or otherwise not being available to hold such post, from the first day of January of the year, following the year of the examination for which direct recruitment was held;

Note.- Where there is a delay of more than ninety days in joining an appointment in the case mentioned above such delay is not attributable to the officer concerned.

(c) "authorised strength" means the strength of post in the grade against which appointments may be made on regular basis;

(d) "Commission" means the Staff Selection Commission;

(e) "direct recruit" means a person recruited to Stenographer grade on the basis of competitive examination held by the Staff Selection Commission in accordance with the procedure laid down;

(f) "duty post" means a post of the grade included in the Armed Forces Headquarters Stenographers Service;

(g) "government" means the Government of India;

(h) "grade" means the grade specified in rule (3);

(i) "permanent officer" of the service means a person who has been confirmed in the entry grade;

(j) "rules" means the Armed Forces Headquarters Stenographers' (Group 'C' Post) Service Rules, 2025;

(k) "Schedule" means a Schedule to these rules;

(l) "Scheduled Castes" and "Scheduled Tribes" shall have the same meaning as are assigned to them in clauses (24) and (25) respectively of article 366 of the Constitution;

(m) "Service" means the Armed Forces Headquarters Stenographers' Service;

(n) "other backward classes" means the castes or communities notified by the Government from time to time for the purpose of reservation in civil services and post in the Government of India; and

(o) "temporary officer" means a person holding a temporary or officiating appointment in that grade in accordance with relevant provision of these rules or an officer appointed to a grade who is yet to be removed from probation.

3. Composition of Service.- (1) The grade of Stenographer shall be Non-Gazetted, Ministerial and shall be classified as Central Civil Service, Group 'C'.

(2) All the posts in the Stenographer grade existing before commencement of these rules shall be deemed to have been converted into duty post of the grade.

4. Authorised strength of the Service and its review.-

(1) The duty post included in Stenographer grade of the Service, its numbers and level in the pay matrix on the date of commencement of these rules shall be as specified in Schedule I.

(2) Notwithstanding anything contained in sub-rule (1), the Government may-

(a) from time to time make temporary additions or alterations to the duty post of the Service;

(b) include in the Service such posts of the Armed Forces Headquarters and Inter Service Organisations as can be deemed to be equivalent to the posts included in the Service in status, grade, level in the pay matrix and professional content or exclude from the Service a duty post already included in the Service.

5. Members of Service. – (1) The following persons shall be the members of the Service,-75 [भाग II—खण्ड 4] भारत का राजपत्र : मार्च 15, 2025/फाल्गुन 24, 1946 (a) persons appointed to duty posts under rule 6; and

(b) persons appointed to duty posts under rule 7 from the date of such appointment.

6. Initial constitution of Service.- (1) All existing officers holding Group 'C' duty posts in the organisations specified in Schedule II on a regular basis in the Armed Forces Headquarters Stenographers' Service on the date of commencement of these rules shall be members of the Service.

(2) The regular continuous Service of officers referred to in sub-rule (1) before the commencement of these rules shall count for the purpose of probation, promotion, confirmation in the Service.

7. Method of recruitment and future maintenance of Service.- (1) The vacant duty posts in the grade referred to in Schedule I shall be filled in the manner provided in Schedule IV.

(2) Every officer shall, unless he is on leave or otherwise not available for holding a duty post or for any other reason to be recorded in writing, be posted against a duty post of the grade of the Service.

(3) Every duty post, unless declared to be excluded from the Service or held in abeyance for any reason, shall ordinarily be held by an officer of the grade.

8. Filling of duty posts by deputation.- Notwithstanding anything contained in rule 7, where the Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, fill a duty post in the grade by deputation for a period of three years which can be extended in special circumstances up to five years. The qualifications, experience and the eligibility Service for appointment to the Stenographers grade under this rule shall be decided by the Government.

9. Seniority.- (1) The relative seniority of members of the Service on commencement of these rules shall be the relative seniority in the Stenographers grade as determined before commencement of these rules:

Provided that if the seniority of any member of the Service had not been specifically determined before commencement of these rules, it shall be determined by the Government.

(2) The seniority of persons appointed to Stenographer grade after commencement of these rules shall be determined in accordance with the general orders or instructions issued by the Government from time to time.

10. Probation, confirmation or continuance of officers on probation.- (1) Every person on appointment to the grade of Stenographer shall be on probation for a period of two years:

Provided that the appointing authority may extend the period of probation in accordance with the general instructions or orders issued by the Government from time to time.

(2) On completion of the probation or any extension thereof, officers shall, if considered fit, be confirmed in the grade, if not already confirmed in the entry grade.

(3) If, during the period of probation or its extension thereof, as the case may be, appointing authority is of the opinion that an officer is not fit for permanent appointment, the officer may be discharged from the service or reverted to the post held by him prior to his appointment in the Stenographer grade, as the case may be.

(4) During the period of probation, or any extension thereof, officers may be required to undergo such courses of training and instructions and to pass such examinations and tests, as it may deem fit, as a condition to satisfactory completion of the probation:

Provided that the cadre controlling authority, if satisfied that there are sufficient and valid reasons for so doing, may exempt an officer from operation of this rule.

(5) An officer appointed to the grade of Stenographer who has no lien or has lien on any post under the Government or any State Government shall while on probation, be liable to be discharged from the Service or reverted to the lien post as the case may be at any time without notice, if,-

(i) On the basis of his performance or conduct during probation, he is considered unfit for further retention in the Service; or76 THE GAZETTE OF INDIA : MARCH 15, 2025/PHALGUNA 24, 1946 [PART II—SEC. 4] (ii) On the receipt of any information relating to his nationality, age, health or antecedents or any other aspect relevant to his appointment, the appointing authority is satisfied that he is ineligible or otherwise unfit for being a member of the Service.

(6) For any other matter relating to probation, the members of the Service shall be governed by the instructions or orders issued by the Government in this regard from time to time.

11. Appointment to Service.- (1) All appointments shall be made by the appointing authority for all the duty posts in Stenographer grade.

(2) Appointment of direct recruits in the grade of Stenographer of the Service shall be subject to the following conditions,-

(a) such enquiry as may be considered necessary by the Government to assess their suitability; and

(b) persons shall be free from any mental or physical defect, after such medical examination as the Government may prescribe, which is likely to interfere with the discharge of the duties of the Service.

12. Liability to serve in posts connected with Defence.- Any officer appointed to the service, if so required, shall be liable upto the age of fifty years to serve in any Defence Service anywhere in India in posts other than the duty post in the Ministry of Defence or Department connected with the Defence of India, for a period of not exceeding four years. The officers may also be required to serve in any other similar posts in the Central Government offices or public sector undertakings, if the Government so decides.

13. Disqualification.- No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the Service :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

14. Regulation of pay.- The pay and increments of officers of grade shall be regulated in accordance with the fundamental rules or other rules in force relating to pay.

15. Composition of Departmental Confirmation Committee.- The composition of Departmental Confirmation Committee for confirmation shall be as shown in Schedule III.

16. Residuary matters.- In regard to matters not specifically covered by these rules the members of the Service shall be governed by the rules and orders applicable to the Central Civil Service in general.

17. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

18. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex- servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

19. Interpretation.-If any question arises relating to the interpretation of these rules, it shall be decided by the Government.
