सा.का.नि. 134.—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्तशक्तियों का प्रयोग करते हुए और आय-कर अपीलीय अधिकरण, स्टाफ कार ड्राइवर भर्ती नियम, 1984; आय-कर अपीलीय अधिकरण (समूह 'ग' पद) भर्ती नियम, 1984,जहां तक उनका संबंध आशुलिपिक श्रेणी-3; आय-कर अपीलीय अधिकरण, बहु-कार्य कर्मचारिवृन्द, समूह 'ग'पद भर्ती नियम, 2015 और आय-कर अपीलीय अधिकरण, लिपिकीय समूह 'ग'पद भर्ती नियम, 2019 से है,उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, आय-कर अपीलीय अधिकरण में उच्च श्रेणी लिपिक, आशुलिपिक श्रेणी-2, अवर श्रेणी लिपिक, स्टाफ कार ड्राइवर और बहु-कार्य कर्मचारिवृन्दके पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ.- (1) इन नियमों का संक्षिप्त नाम आय-कर अपीलीय अधिकरण (समूह 'ग'पद) भर्ती नियम, 2026 है।

2. लागू होना.-ये नियम, इन नियमों से उपाबद्ध अनुसूची के स्तंभ (1) में विनिदिष्ट पदों पर लागू होंगे ।
3. पदों की संख्या, वर्गीकरण और वेतन मैट्रिक्स में स्तर.-उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन मैट्रिक्स में स्तर वे होंगे, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2)सेस्तंभ (4)में विनिदिष्ट हैं।
4. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि.- उक्त पदों पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उनसे संबंधितअन्य बातें वेहोंगी जो उक्त अनुसूची के स्तंभ (5)से स्तंभ (13) में विनिदिष्ट हैं।
5. निरर्हता.- वह व्य़क्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या विवाह की संविदा है; या (ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है या विवाह की संविदा की है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा।
परन्तु यदि के न्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागूस्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छू ट दे सके गी।
6. शिथिल करने की शक्ति.- जहां के न्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सके गी।
7. व्यावृत्ति.- इन नियमों की कोई बात ऐसे आरक्षणों, आयु-सीमा में छू ट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका के न्द्रीय सरकार द्वारा इस संबंध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है।

| भर्ती की पद्धति: भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन पद्धतियोंद्वारा भरी जाने वाले रिक्तियों की प्रतिशतता। |

(i) 75 प्रतिशत पद ज्येष्ठता-सह-उपयुक्तता के आधार पर प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा; और (ii) 25 प्रतिशत पद सीमित विभागीय प्रतियोगी परीक्षा के आधार पर प्रोन्नति द्वारा ।
टिप्पण: विभागीय परीक्षा के लिए अर्हक सेवा, आयकर अपीलीय अधिकरण में अवर श्रेणी लिपिक के वर्ग में पांच वर्ष की नियमित सेवा होगी ।

| प्रोन्नति (i) वेतन मैट्रिक्स में स्तर-4 (25,500 रु–81,100 रु.)के ऐसे अवर श्रेणी लिपिक, जिन्होंने उक्त श्रेणी में आठ वर्ष नियमित स ेवा की है; (ii) सीमित विभागीय प्रतियोगी परीक्षा: सीमित विभागीय प्रतियोगी परीक्षा के लिए अर्हक सेवा, आय-कर अपीलीय अधिकरण में अवर श्रेणी लिपिक वर्ग में पांच वर्ष की नियमित सेवा होगी । टिप्पण1: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा है, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो। टिप्पण 2: प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी, 2006 से पहले या उस तारीख से जिससे छठे कें द्रीय वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधार पर की गई सेवा को उक्त वेतन आयोग की सिफारिशों पर आधारित विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी । प्रतिनियुक्ति : क े न्द्रीय सरकार के ऐसे अधिकारी जो,- (i) नियमित आधार पर सदृश पद धारण किए हुए हैं, या (ii) अवर श्रेणी लिपिक या समकक्ष जिसने उस श्रेणी में आठ वर्ष की नियमित सेवा की हो । टिप्पण1: पोषक प्रवर्ग के ऐसे विभागीयअधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार प्रतिनियुक्ति पर नियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । टिप्पण2: प्रतिनियुक्ति की अवधि, जिसके अंतर्गत के न्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीनवर्ष से अधिक नहीं होगी। टिप्पण3: प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । |

| (i) रिक्तियों के 10 प्रतिशत पद वेतन मैट्रिक्स में स्तर-1 (18,000 रु. - 56,900 रु.) के समूह 'ग'(बहुकार्य कर्मचारिवृन्द) क े ऐसे कर्मचारियों में से विभागीय अर्हता परीक्षा के आधार पर भरे जाएंगे, जिन्होंने मान्यताप्राप्त बोर्ड से 12वीं कक्षा उत्तीर्ण की हो और उस श्रेणी में तीन वर्ष की नियमित सेवा की हो । टिप्पण 1 : सामान्य अभ्यथियों के लिए परीक्षा की अर्हक अधिकतम आयु सीमा 45 वर्ष तक है और अनुसूचित जाति तथा अनुसूचित जनजाति के अभ्यथियों के लिए 50 वर्ष तक है । टिप्पण 2 : यदि ऐसे कर्मचारियों की संख्या जो परीक्षा में अर्हता प्राप्त कर लें, स्तंभ (10) के खंड (ii) के अधीन उपलब्ध रिक्तियों की संख्या से अधिक हो तो ऐसे अतिरिक्त संख्या वाले कर्मचारियों को बाद के वर्षों में उत्पन्न होने वाली रिक्तियों को भरने में विचार किया जाएगा जिससे पिछली परीक्षा में अर्हता प्राप्त कर्मचारियों को बाद की परीक्षा में अर्हता प्राप्त करने वालों से पहले विचार किया जाएगा । (ii) रिक्तियों के पांच प्रतिशत पद वेतन मैट्रिक्स में स्तर-1 (18,000रु.-56,900 रु.) के समूह 'ग'(बहुकार्य कर्मचारिवृन्द) के ऐसे कर्मचारी जो उस श्रेणी में तीन वर्ष की नियमित सेवा पूरी कर चुके हों, में से ज्येष्ठता-सह-उपयुक्तता के आधार पर भरे |

| 18 से 25 वर्ष के बीच आयु। (कें द्रीय सरकार द्वारा समय-समय पर जारी किए गए अनुदेशों या आदेशों के अनुसार विभागीय अभ्यथियों के लिए 40 वर्ष तक शिथिल की जा सके गी।) टिप्पण : आयु-सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यथियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । (न कि वह अंतिम तारीख जो असम, मेघालय, अऱुणाचल प्रदेश, मिजोरम, मणिपुर, नागालैंड, त्रिपुरा, सिक्किम, हिमाचल प्रदेश के लाहोल और स्पीति जिले तथा चंबा जिले के पांगी उपखंड, लद्दाख, अंदमान और निकोबार द्वीप या लक्षद्वीप संघ राज्यक्षेत्रों के अभ्यथियों के लिए विहित की गई है ।) *यदि सीधे भर्ती "सीधी खुली प्रतियोगी परीक्षा" के माध्यम से की जानी हो तो आयुसीमा 18 से 27 वर्ष के बीच होगी। |

| अनिवार्य अर्हताएं: (i) किसी मान्यता प्राप्त बोर्डसे 10वीं कक्षा उत्तीर्ण; (ii) मोटर कार चलाने का कम से कम तीन वर्ष का अनुभव; (iii)मोटर कार चलाने हेतु वैध चालक अनुज्ञप्ति धारक हो; और (iv) मोटर मैके निज्म का ज्ञान हो (अभ्यर्थी वाहन में उत्पन्न होने वाली छोटी-मोटी खराबी को दूर करने में सक्षम होना चाहिए); वांछनीय) : गृह रक्षक या सिविल स्वयंसेवक के रूप में तीन वर्ष की सेवा । टिप्पण 1:- अर्हताएं, अन्यथा सुअहित अभ्यथियों की दशा में सक्षम प्राधिकारी के विवेकानुसार, उनके लिए जो कारण हैं उन्हें लेखबद्ध करके शिथिल की जा सकती हैं । टिप्पण 2:- अनुभव संबंधी अर्हताएं सक्षम प्राधिकारी के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यथियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर सक्षम प्राधिकारी की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यथियों के पर्याप्त संख्या में |

| प्रतिनियुक्ति/आमेलन: आय-कर अपीलीय अधिकरण के ऐसे नियमित डिस्पैच राइडर (समूह 'ग') और 7वें कें द्रीय वेतन आयोग के वेतन स्तर-1 (18,000रु. -56,900रु.) में कार्यरत समूह 'ग' कर्मचारियों (बहु-कार्य कर्मचारिवृन्द) में से, जो मोटर कार चलाने हेतु वैध चालक अनुज्ञप्ति धारक हों, और मोटर कार चलाने की दक्षता का आकलन करने के लिए आयोजित चालन परीक्षण के आधार पर सक्षम हों; ऐसे कर्मचारी उपलब्ध न होने की स्थिति में, कें द्रीय सरकार के अन्य मंत्रालयों में नियमित आधार पर डिस्पैच राइडर के पद पर कार्यरत या 7वें कें द्रीय वेतन आयोग के वेतन स्तर-1 (18,000 रु. -56,900 रु.) में कार्यरत नियमित समूह 'ग' कर्मचारियों में से, जो स्तंभ (7) में उल्लिखित अपेक्षित अर्हताओं को पूरा करते हों । भूतपूर्व सैनिकों के लिए प्रतिनियुक्ति/पुननियोजन : सशस्त्र बल के ऐसे कामिकों के संबंध में भी विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत्त होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास अपेक्षित अनुभव और विहित अर्हताएं हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निबंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निमु र्क्त किया जाना है और तत्पश्चात् उन्हें पुननियोजन पर बने रहने दिया जा सकता है । टिप्पण : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत कें द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया 3 वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । |

G.S.R. 134.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Income-tax Appellate Tribunal, Staff Car Driver Recruitment Rules, 1984; the Income-tax Appellate Tribunal (Group ‗C' Posts) Recruitment Rules, 1984, in so far as they relate to the post of the Stenographer Grade III; the Income-tax Appellate Tribunal, Multi-Tasking Staff, Group ‗C' Post Recruitment Rules, 2015; the Income-tax Appellate Tribunal, Clerical Group ‗C' Posts Recruitment Rules, 2019, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Upper Division Clerk, Stenographer Grade II, Lower Division Clerk, Staff Car Driver and Multi-Tasking Staff, in the Income-tax Appellate Tribunal, namely :-
1. Short title and commencement.– (1) These rules may be called the Income-tax Appellate Tribunal (Group ‗C' Posts) Recruitment Rules, 2026.
(2) They shall come into force on the date of their publication in the official Gazette.
2. Application.- These rules shall apply to the posts as specified in column (1) of the Schedule annexed to these rules.
3. Number of posts, classification and level in pay matrix.- The number of the said posts, their classification and level in the pay matrix attached to the said posts shall be as specified in columns (2) to (4) of the said Schedule.
4. Method of recruitment, age-limit, qualifications, etc.- The method of recruitment, age-limit, qualifications and other matters relating to the said posts shall be as specified in columns (5) to (13) of the said Schedule.
5. Disqualification.- No person,-299 [भाग II—खण्ड 3(i)] भारत का राजपत्र : जुलाई, 25/ श्रावण 3,1948 a. who has entered into or contracted a marriage with a person having a spouse living; or
b. who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
6. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
7. Saving.- Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the ex-Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. Note 2: For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006 of the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding pay/pay scale extended based on the recommendation of the pay commission. Deputation: Officers of the Central Government, - (i) holding analogous posts on a regular basis; or (ii) with Eight years' regular service in the grade of Lower Division Clerk or equivalent Note 1: The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appointment by promotion. Note 2: The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceed three years. Note 3: The maximum age-limit for appointment by deputation shall be not exceeding fifty-six years as on the closing date of receipt of applications.
