In exercise of the powers conferred by the proviso to Article 309 of the constitution of India, the Governor of chhattisgarh, hereby, makes the following rules, relating to the recruitment and conditions of service of the Chhattisgarh Medical Edueation (elass-IV) Services, namely:-

RULES i

1. Short title and commencement.- (1) These rules may be called the Qhhattisgarh Medical Education (Class-IV) Service Recruitment Rules, 20 ¹⁹.

(21 These rules shall come into force from the date of its publication in the Official Gazette'

2. Application.- These rules shall apply to the posts specified in column (2) of the Schedule-I, as appended to these rules' g. Definitions. - In these rules, unless the context otherwise requires,-

(a) "Appointing Authority" in iespeCt of the service means an Authority as specified in column (⁶) of Schedule-I;

(b) "Committee" mea.ns a Selection Committee as specified in column (6) of Schedule-Ill for direct recruitment;

(c) "Departmental Promotion Committee" means Committee specified in column (5) of Schedule-IV;

s the Government of Chhattisgarh;

(e) "Other Baclnrard Classes" means the Other Backward Classes of citizens as specified by the State Government vide Notification No. F-8-5, XXV-4-84, dated ²⁶th December, Lg84, as €unended from time to time;

(0 ,,schedule" means a schedule appended to these rules;

(g) ,,scheduled castes" means the scheduled castes as specified in relation to this State under Article ³⁴ tr of the Constitution of India;

(h) "scheduled Tribes" means the Scheduled Tribes as specified in relation to this State under Article 342 of the Constitution of India;

(i) osenrice" means the Chhattisgarh Medical Education (Class-IV) Service;

ti) "State" means the State of Chhattisgarh.

5. Resenration.- (1) Reservation, for the posts of direct recruitment, shall be made in accordance with the provisions of the Chhattisgarh Lok Seva (Anusuchit Jati, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargaon Ke Liye Arakshan) Adhiniyann, !99a (No.2 I of 19941.

(2) Reservation in promotion for the candidates of Scheduled Castes and Scheduled Tribes shall be made in accordance with the provisions of the Chhattisgarh Civil Services (Promotion) Rules, 2003.

(3) Reservation for women candidates shall be made in accordance with the provisions of the Chhattisgarh Civil Service (Special Provision for Appointment ' of Women) Ru1es, L997 .

6. Method of recruitment.- (1) Recruitment to the service, after the commencement of these rules, shall be made by the following methods, namely: -

(a) by direct recruitment, through selection on merit basis and interview;

t2l The number of persons to be recruited under clause (a) or (b) of sub-rule (1) shall, at any time, not exceed the percentage shown in schedule-Il of the number of duty posts specified in Schedule-I of these rules.

(3) Subject to the provisions of these rules, the method or methods of recruitment to be adopted for the purpose of filling any pafticular vacancy or vacancies in the service, as may be required to be filled during any particular period of recruitment and the number of persons to be recruited by such method, shall be determined on each occasion by the Appointing Authority in consultation with the Government' 7. Saving.- Nothing contained in these rules shall effect reservation and other conditions required to be provided for Scheduled Castes, Scheduled Tribes, Other Backward classes, Ex-servicemen, compassionately appointment to the one member of the family of the Government employees, who dies during service period, disabled persons and Other persons belonging to other categories and shall be regulated in accordance with the rules made or orders issued by the state Government, from time to time, in this regard'

g. Relaxation. - Nothing in these rules shall be construed to limit or abridge the power of the Governor to deal with the case of any person to whom these rules apply in such manner, as may appear to him to be just and proper:
