अधिसूचना
क्रमांक एफ-10-12/2017/16. छत्तीसगढ़ दुकान एवं स्थापना (नियोजन एवं सेवा की शर्तों का विनियमन) अधिनियम, 2017 (क्र. 21 सन् 2018 ) की धारा 28 द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए राज्य सरकार छत्तीसगढ़ दुकान एवं स्थापना (नियोजन एवं सेवा की शर्तों का विनियमन) नियम, 2021 में संशोधन का निम्नलिखित प्रारूप बनाना प्रस्तावित करती है और उक्त अधिनियम के द्वारा अपेक्षित किए गए अनुसार उन समस्त व्यक्तियों, जिनके कि इससे प्रभावित होने की संभावना है , की जानकारी के लिए एतद्वारा प्रकाशित किया जाता है तथा एतद्वारा सूचित किया जाता है कि उक्त प्रारूप पर इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से 30 दिवस के अवसान के पश्चात विचार किया जावेगा ।
कोई आपत्ति या सुझाव , जो उक्त प्रारूप के संबंध में किसी व्यक्ति से विनिर्दिष्ट कालावधि के पूर्व सचिव/ उप सचिव, श्रम विभाग , छ.ग. शासन, महानदी भवन, मंत्रालय, नवा रायपुर , अटल नगर के कार्यालय में कार्यालयीन समय में प्राप्त हो, पर छ.ग. शासन द्वारा विचार किया जावेगा ।
संशोधन प्रारूप
नियम 07 को निम्नवत् प्रतिस्थापित किया जावे :-
रात्रि पाली में महिला कर्मकारों का नियोजन एवं शर्तें -
(1) किसी दुकान या स्थापना या नियोजकों के वर्गों, जिस पर यह अधिनियम लागू होता है, में महिला कर्मकारों को रात्रि 09 बजे से सुबह 06 बजे तक निम्नलिखित शर्तों के अध्यधीन नियोजित किया जा सकेगा :-
(i) रात्रिकालीन नियोजन हेतु महिला कर्मकार की सहमति प्ररूप 6 में लिया जाना आवश्यक होगा । ( ii) रात्रि पाली में कम से कम 03 महिला कर्मचारी का नियोजन किया जाना आवश्यक होगा ।
(iii) रात्रि पाली में नियोजित महिला कर्मकारों को कार्यस्थल से उनके निवास तक सुरक्षित रूप से पहुंचाने हेतु सुरक्षा गार्ड के साथ समुचित वाहन व्यवस्था की जायेगी । पुलिस द्वारा सत्यापित वाहन, वाहन चालक एवं सुरक्षा गार्ड का विवरण इत्यादि तथा अन्य अपेक्षित जानकारी नियोजक द्वारा रखा जायेगा ।
(iv) प्रत्येक नियोजक महिला कर्मकारों हेतु एक शिकायत पेटी रखेगा ।
(v) प्रत्येक नियोजक दुकान / स्थापना के सहजगोचर स्थान पर स्थानीय पुलिस थाना , पुलिस कंट्रोल रूम एवं महिला सहायता केन्द्र का फोन नंबर प्रदर्शित करेगा ।

(vi) प्रत्येक नियोजक अथवा नियोजकों के समूह द्वारा दुकान / स्थापना में महिला कर्मियों के लिए पृथक से मूत्रालय एवं शौचालय की व्यवस्था की जायेगी , जिसके दरवाजे में केवल अंदर की ओर से सुरक्षा सिटकनी की व्यवस्था होगी । शौचालय , विश्राम कक्ष और पेयजल की सुविधा कार्यस्थल के भीतर होनी चाहिये , जहां ऐसी महिला कर्मचारी नियोजित हों । (vii ) किसी महिला को कार्यस्थल पर ठेकेदार द्वारा मातृत्व हितलाभ अधिनियम, 1961 ( 1961 का सं. 53) के प्रावधानों के विरूद्ध नियोजित नहीं किया जावेगा ।
(viii )नियोजक द्वारा प्रत्येक कार्यस्थल में पर्याप्त प्रकाश , हवा के साथ - साथ स्वास्थ्य अनुकूल वातावरण उपलब्ध कराया जावेगा ।
(ix) कार्यस्थल, जहां कि कर्मकारों से लगातार खड़े होकर कार्य की अपेक्षा की जाती हो वहां प्रत्येक कर्मकार के लिए पृथक से बैठने की व्यवस्था नियोजक द्वारा की जायेगी , जिससे कि कर्मकार नियत अन्तराल में आवश्यकतानुरूप बैठ सके ।
(x) प्रत्येक नियोजक अग्नि से सुरक्षा संबंधी समुचित प्रावधान का पालन करेगा ।
(xi ) कार्यस्थल पर महिलाओं का लैंगिक उत्पीड़न (निवारण , प्रतिषेध एव प्रतितोष ) अधिनियम, 2013 (2013 का सं. 14) , जो स्थापनाओं पर लागू हो, के उपबंधों का अनुपालन किया जावेगा।
(2) नियोजक द्वारा महिला श्रमिकों के रात्रि पाली में नियोजन की सूचना उनके नियोजन के पूर्व प्रपत्र-7 में श्रम विभाग के वेब पोर्टल में ऑनलाईन माध्यम से दिया जायेगा ।

मुझे यह भी ज्ञात है कि उक्त संस्थान में कार्यस्थल पर महिलाओं का लैंगिक उत्पीड़न (निवारण , प्रतिषेध एवं प्रतितोषण ) अधिनियम, 2013 के तहत् कुमारी / श्रीमती की अध्यक्षता में समिति का गठन किया गया है ।

NOTIFICATION
No. 10-12 /2017/16 . The following draft of amendment in the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Rules , 2021 , which the State Government hereby propose to make in exercise of the power conferred by Section 28 of the Chhattisgarh Shops and Establishments (Regulation of Employment and Conditions of Service) Act , 2017 (No. 21 of 2018) is hereby published as required by the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft shall be taken into consideration after the expiry of thirty days from the date of publication of this notification in the Official Gazette:
Any objection or suggestions regarding the said draft received from any person before the specified period, in office hours in office of the Secretary /Deputy Secretary , Department of Labour , Government of Chhattisgarh , Mahanadi Bhawan , Mantralaya , Nawa Raipur , Atal Nagar shall be considered by the Government ofChhattisgarh .
DRAFT AMENDMENT
The rule 7 shall be substituted namely: -
Employment and Conditions of the Women Workers in night shift.-
(1) Any shop or establishment or class of employers on which this Act applies can employ women workers from 09:00 pm to 06:00 am subject to the following conditions : -
(i) The consent of woman worker for night shift shall be in Form - 6 .
(ii) It is necessary to have at least 3 women workers employed in night shift .
(iii ) Arrangements of security guards alongwith suitable vehicles will be made for the women workers employed in the night shift to pick - up and drop to their residence from the workplace safely . Details of the vehicle , driver and security guard etc verified by the police and other required details will be kept by the employer .
(iv) Every employer shall keep a complaint box for women workers .
(v) Every employer shall display the phone number or local police station , police control room and women's help center at an easily visible place of the shops and establishments .
(vi) Every employer will arrange separate urinals and toilets for women workers in the shop/ establishment where the doors will have safety lache only from inside . The toilet, washroom and drinking facilities should be within the workplace where such women employees are employed .
(vii) No women worker shall be employed against the maternity benefit provisions laid down under the Maternity Benefit Act , 1961 (No. 53 of 1961) .
(viii) Employer shall provide adequate light , air as well as healthfriendly environment at every workplace.
(ix) Every workplace where workers are expected to stand continuously for work, arrangements for sitting separately for each worker shall be made by the employer so that the workers can sit in required intervals .
(x) Every employer shall comply with the relevant provisions of fire protection .
(xi) The provisions of the Sexual Harassment of Women at workplace ( Prevention , Prohibition and Redressssssal ) Act, 2013 ( 14 of 2013 ) , as applicable to the establishments , shall be complied.
(1) Information regarding employment of women workers in night shifts shall be given by the employer in Form-7 through online on the web portal of the Labour Department before their employment .
