No. 65 / 2188-2189 / 21 - ब / छ.ग./ 2025-26.- भारत के संविधान के अनुच्छेद 233 सहपठित अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए , छत्तीसगढ़ के राज्यपाल , छत्तीसगढ़ उच्च न्यायालय के परामर्श से , एतद्वारा , छत्तीसगढ़ उच्चतर न्यायिक सेवा ( भर्ती तथा सेवा शर्तें) नियम , 2006 में निम्नलिखित और संशोधन करते हैं, अर्थात्ः-

उक्त नियमों में, -
1. नियम 5 के उप-नियम ( 1 ) में, -
(क)
खण्ड (क) में, अंक एवं चिन्ह " 65 % " के स्थान पर, अंक एवं चिन्ह " 50 % " प्रतिस्थापित किया जाये;
खण्ड (ख ) में , -
(ख)
(एक) अंक एवं चिन्ह " 10 % " के स्थान पर, अंक एवं चिन्ह " 25 % " प्रतिस्थापित किया जाये;

(दो) अंक एवं शब्द " 5 वर्ष " के स्थान पर, अंक एवं शब्द " 3 वर्ष " प्रतिस्थापित किया जाये; तथा
शब्द " सेवा " के पश्चात्, शब्द " तथा व्यवहार न्यायाधीश ( कनिष्ठ श्रेणी ) और (तीन) व्यवहार न्यायाधीश (वरिष्ठ श्रेणी) के रूप में की गई कुल सेवा न्यूनतम 7 वर्ष होगी " अंतःस्थापित किया जाये ।
खण्ड (ग) में, -
(ग)
(एक) प्रथम परंतुक के स्थान पर, निम्नलिखित परंतुक प्रतिस्थापित किया जाये , अर्थात्ः- "परंतु यह कि , सामान्य श्रेणी के लिए न्यूनतम अर्हक अंक तथा कट- ऑफ अंक 60% होंगे और सन्दर्भित दिव्यांगजन के अभ्यर्थियों सहित सभी आरक्षित संवर्गो के मामले में 50% अंक होंगे और सफलता प्राप्त करने वाले अभ्यर्थी, वरियता क्रम से 1 : 3 के अनुपात में मौखिक परीक्षा के लिए पात्र होंगे । "
(दो) द्वितीय पंरतुक में, शब्द " पिछड़ा वर्ग " के पश्चात्, चिन्ह एवं शब्द "/पी.डब्ल्यू.बी.डी (सन्दर्भित दिव्यांगजन) " अंतःस्थापित किया जाये।
2. नियम 6 में, -
(क) शीर्षक "अनुसूचित जाति, अनुसूचित जनजाति तथा अन्य पिछड़ा वर्ग के पदों के लिये आरक्षण " के स्थान पर, शीर्षक " अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग, महिला तथा पी.डब्ल्यू.बी.डी. ( संदर्भित दिव्यांगजन) के पदों के लिये आरक्षण " प्रतिस्थापित किया जाये;
(ख)
उप-नियम ( 1 ) में, शब्द " अनारक्षित " के पश्चात्, शब्द एवं अंक " सन्दर्भित दिव्यांगजन से संबंधित रिक्तियों को छोड़कर , जो कि दिव्यांगजन अधिकार अधिनियम, 2016 (2016 का सं. 49) की धारा 34 की उप- धारा (2) के उपबंधों के अनुसरण में होंगी " अंतःस्थापित किया जाये ।
उप- नियम (2 ) के पश्चात्, निम्नलिखित अंतःस्थापित किया जाए , अर्थात्ः-
(ग)
" (3) दिव्यांगजन अधिकार अधिनियम, 2016 ( 2016 का सं. 49) की धारा 34 के अधीन निम्नलिखित व्यक्तियों के लिए चार प्रतिशत रिक्तियां आरक्षित होंगीः-
(क) 'अल्प दृष्टि' और ' दृष्टि बाधित' व्यक्तियों के लिए 1 % ;
(ख) 'बधिर' को छोड़कर ' श्रवण बाधित' व्यक्तियों के लिए 1 % ;
(ग) चलन निःशक्तता , कुष्ठ रोग से मुक्त, बौनापन, तेजाब आक्रमण से पीड़ित, प्रमस्तिष्कघात और पेशीय दुष्पोषण वाले व्यक्तियों के लिए 1 % ;
(घ) प्रत्येक दिव्यांगता के लिए पहचान किए गए पदों में खण्ड ( क) से ( ग ) के अधीन व्यक्तियों के बीच से स्वपरायणता और बहुदिव्यांगता वाले व्यक्तियों के लिए 1%;

64( 1) (ड. ) सेवा में भर्ती हेतु सन्दर्भित दिव्यांगजन व्यक्तियों के लिए दिव्यागंता का प्रतिशत, राज्य सरकार के द्वारा इस हेतु समय- समय पर जारी कार्यकारी निर्देशों /नियमों/ परिपत्रों के अनुसार होगा;
( च ) कुल पदों में से 4 % पद सन्दर्भित दिव्यांगजन अभ्यर्थियों हेतु आरक्षित रहेंगे और यह क्षैतिज आरक्षण होगाः
परंतु यह कि , जहाँ किसी भर्ती वर्ष में सन्दर्भित दिव्यांगजन वाले उपयुक्त व्यक्ति की अनुपलब्धता के कारण या किसी अन्य पर्याप्त कारण से , ऐसी रिक्ति भरी ना जा सके , तो ऐसी रिक्ति, पश्चातवर्ती भर्ती वर्ष में अग्रनित होगी और यदि पश्चातवर्ती भर्ती वर्ष मे उपयुक्त सन्दर्भित दिव्यांगजन उपलब्ध नहीं होते हैं, तो पहले यह चार प्रवर्गों में से अदला-बदली द्वारा भरी जा सकेगी और केवल जब उक्त वर्ष में भी उस पद के लिए कोई दिव्यांगजन उपलब्ध नहीं होता है, तो ऐसे पदों को " अनारक्षित " माना जाएगा। "
3. अनुसूची- एक के स्थान पर, निम्नलिखित अनुसूची प्रतिस्थापित की जाये, अर्थात्: -

NOTIFICATION
F. No. 65 / 2188-2189 / XXI - B / C.G. / 2025-26 . - In exercise of the powers conferred by Article 233 read with the proviso to Article 309 of the Constitution of India, the Governor of Chhattisgarh , in consultation with the High Court of Chhattisgarh , hereby , makes the following further amendment in the Chhattisgarh Higher Judicial Service ( Recruitment and Conditions of Service ) Rules , 2006 , namely : -
AMENDMENT
In the said rules , -
1. In sub - rule ( 1 ) of Rule 5 , -
(a) in clause (a) , for the figure and symbol " 65 % " , the figure and symbol " 50 % " shall be substituted ;
( b) in clause ( b ) , -
(i) for the figure and symbol " 10 % " , the figure and symbol " 25 % " shall be substituted ;
(ii ) for the figure and word " 5 years " , the figure and word " 3 years" shall be substituted ; and
( iii ) after the word " service " the words , " and the total service rendered as Civil Judge ( Junior Division) and Civil Judge (Senior Division) shall be minimum 7 years " shall be inserted .
(c) in clause ( c ), -
(i ) for the first proviso , the following proviso shall be substituted , namely: - छत्तीसगढ़ राजपत्र, दिनांक 16 जनवरी 2026
64(3) "Provided that the minimum qualifying marks and cut- off marks would be 60 % for General Category and 50 % marks in case of all Reserved Categories including PwBD candidates , and successful candidates shall be eligible for viva- voce test in the ratio of 1 :3 in order of merit . "
(ii ) In second proviso , after the words " Backward Classes " , symbol and words " /PwBD ( Persons with Benchmark Disabilities ) " shall be inserted .
2. In Rule 6 , -
( a) for the heading " Reservation of posts for Scheduled Castes , Scheduled Tribes and Other Backward Classes " , the heading " Reservation of posts for Scheduled Castes , Scheduled Tribes , Other Backward Classes , Women and PwBD ( Persons with Benchmark Disabilities ) shall be substituted ;
(b) in sub - rule ( 1 ) , after the word "Unreserved " , the words and figure , " except the vacancies belonging to PwBD , following the provisions of sub - section ( 2 ) of Section 34 of the Rights of Persons with Disabilities Act , 2016 (No. 49 of 2016 ) " shall be inserted .
(c) After sub - rule (2 ) , the following shall be inserted , namely: -
" (3 ) Four percent of vacancies shall be reserved for the following persons under Section 34 of the Rights of Persons with Disabilities Act , 2016 (No. 49 of 2016) : -
( a) 1 % for the persons with " Low vision " and " blindness " ;

(b) 1% for the persons with " hard of hearing " excluding " deaf" ;
(c) 1% for the persons with Locomotor disability , Leprosy cured person , Dwarfism , Acid attack victims , Cerebral Palsy and muscular dystrophy ;
(d) 1 % for the persons with Autism and multiple disabilities from amongst persons under clauses ( a) to (c) in the posts identified for each disabilities ;
(e) Percentage of disabilities for persons with benchmark disabilities in the recruitment to the service shall be in accordance with the executive instruction/Rules /circulars of the State Government issued from time to time in this behalf.
( f) 4% of the total posts shall be reserved for PwBD candidates and the reservation shall be Horizontal :
Provided that where in any recruitment year any vacancy cannot be filled up due to non- availability of a suitable person with benchmark disability or for any other sufficient reason , such vacancy shall be carried forward in the succeeding recruitment year and if in the succeeding recruitment year also suitable person with benchmark disability is not available , it may first be filled by interchange among the four categories and only when there is no person with disability available for the post in that year, such posts shall be treated as " Unreserved " . " .
