No.157 / 2185,2186,2187 /XXI - B / C.G./2025-26.- भारत के संविधान के अनुच्छेद 234 सहपठित अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों को प्रयोग में लाते हुए, छत्तीसगढ़ के राज्यपाल, छत्तीसगढ़ के उच्च न्यायालय तथा छत्तीसगढ़ लोक सेवा आयोग के परामर्श से, एतद्वारा , छत्तीसगढ़ निम्नतर न्यायिक सेवा (भर्ती तथा सेवा शर्ते) नियम, 2006 में निम्नलिखित और संशोधन करते हैं , अर्थात्ः-
संशोधन
उक्त नियमों में,
1. नियम 5 के उप - नियम (1 ) के द्वितीय परंतुक में, शब्द " पिछड़ा वर्ग " के पश्चात्, शब्द तथा चिन्ह "/ पीडब्ल्यूबीडी (सन्दर्भित दिव्यांगजन) " अंतःस्थापित किया जाए ।
2. नियम 5 के उप - नियम (1 ) के प्रथम परंतुक के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जाए, अर्थात् : - "परंतु यह और कि प्रारम्भिक और मुख्य परीक्षा (लिखित) दोनों में न्यूनतम अर्हक अंक के साथ ही कट-ऑफ अंक सामान्य श्रेणी के लिए 60 % एवं आरक्षित श्रेणियों के मामले में 50 % अंक और पीडब्ल्यूबीडी अभ्यर्थियों के मामले में 45% अंक होंगे । "
3. नियम 5 के उप- नियम (2 ) के स्थान पर , निम्नलिखित प्रतिस्थापित किया जाए , अर्थात्: -
" (2) नियम 3 के उप- नियम (2) के प्रवर्ग (क ) में नियुक्ति, निम्नानुसार की जाए:-
(क) 90% पद पर चयन एवं पदोन्नति द्वारा उन व्यवहार न्यायाधिशों ( कनिष्ठ श्रेणी ) से, जिन्होंने 5 वर्ष की न्यूनतम सेवा पूर्ण कर ली हों, योग्यता- सह - वरिष्ठता के आधार परः
रिक्तियों की संख्या तथा पदोन्नति के लिए विचारण क्षेत्र में आने वाले अधिकारियों का अनुपात 1 : 3 होगा तथा अधिकारियों की उपयुक्तता का अनुसूची- दो में विहित मानदंडों के अनुसार परीक्षण किया जायेगा ।

(ख) 10% पद अनुसूची- तीन के अनुसार उच्च न्यायालय द्वारा आयोजित सीमित प्रतियोगी परीक्षा में सर्वथा योग्यता के आधार पर व्यवहार न्यायाधीश ( कनिष्ठ श्रेणी) , जिन्होंने 3 वर्ष की न्यूनतम सेवा पूर्ण कर ली हो, की पदोन्नति द्वाराः
परंतु, खण्ड (ख ) के अंतर्गत सीमित प्रतियोगी परीक्षा के माध्यम से पदोन्नति के लिए उपस्थित होने वाले अभ्यर्थियों को लिखित परीक्षा में न्यूनतम 50 % अंक अर्जित करना अनिवार्य होगाः
परंतु यह और कि खण्ड (ख) के अधीन अभ्यर्थी उपलब्ध न होने की स्थिति में, रिक्तियां खण्ड (क) के अधीन रिक्तियां मानी जाएंगी तथा उन्हें खण्ड (क) के अनुसार उस विशिष्ट वर्ष में भरा जएगा । "
4. नियम 7 के उप - नियम (1 ) के खण्ड (ख) के तृतीय पंरतुक के पश्चात्, निम्नलिखित परंतुक अंतःस्थापित किया जाए, अर्थात्: -
" परंतु यह और भी कि सभी छूटों सहित अधिकतम आयु सीमा 45 वर्ष से अधिक नहीं होगी । "
5. नियम 7 के उप- नियम (1 ) के खण्ड (ग) के पश्चात्, निम्नलिखित खण्ड जोड़ा जाए , अर्थात्ः-
" (गग ) नियुक्ति के लिए आवेदन बुलाये जाने के वर्ष के जनवरी माह के प्रथम दिवस को न्यूनतम 3 वर्ष की अवधि के लिए विधि व्यवसाय पूर्ण किया गया होः
परंतु व्यवहार न्यायाधीश (कनिष्ठ श्रेणी) के पद के लिए परीक्षा में उपस्थित होने के इच्छुक अभ्यर्थी द्वारा विधि व्यवसाय में पूर्ण किए गए वर्षों की गणना , संबंधित राज्य विधिक परिषद् में उनके प्राविधिक नामांकन / पंजीयन के दिनांक से की जाएगीः
परंतु यह और कि अभ्यर्थी द्वारा इस आशय का प्रमाण पत्र प्रस्तुत किया जाएगा, जो संबंधित न्यायालय के छत्तीसगढ़ राजपत्र , दिनांक 11 फरवरी 2026
152( 1) प्रधान न्यायिक अधिकारी अथवा संबंधित न्यायालय में न्यूनतम 10 वर्षों से विधि व्यवसायरत् अधिवक्ता द्वारा विधिवत प्रमाणित हो , जिसे ऐसे जिले के प्रधान न्यायिक अधिकारी अथवा उस न्यायालय के प्रधान न्यायिक अधिकारी द्वारा विधिवत अनुमोदित किया गया हो । जो अभ्यर्थी उच्च न्यायालय अथवा उच्चतम न्यायालय में विधि व्यवसाय कर रहे हैं को न्यूनतम 10 वर्षों से विधि व्यवसायरत् अधिवक्ता द्वारा विधिवत रूप से प्रमाणित प्रमाण पत्र, जिसे संबंधित उच्च न्यायालय अथवा उच्चतम न्यायालय द्वारा नामित अधिकारी द्वारा विधिवत रूप से अनुमोदित किया गया हो , प्रस्तुत करेंगे । विधि व्यवसाय के कुल वर्षों की गणना में, देश के कोई भी न्यायाधीश अथवा न्यायिक अधिकारी के साथ विधि लिपिक के रूप में कार्य करते हुए, अभ्यर्थियों के अनुभव को भी विचार में लिया जाएगा । "
6. नियम 13 के उप - नियम (3 ) के स्थान पर, निम्नलिखित उप- नियम प्रतिस्थापित किया जाए, अर्थात्ः-
" (3) इन नियमों के प्रारम्भ होने के पश्चात्, सीधी भर्ती द्वारा सेवा में नियुक्त किये गये व्यक्तियों का परस्पर रैंक, चयन सूची में रखे गये मेरिट के क्रम में होगा । "
7. नियम 13 के उप- नियम (3) के पश्चात्, निम्नलिखित उप- नियम जोड़े जाएं, अर्थात्ः-
"(4) इन नियमों के प्रारंभ होने के पश्चात्, नियम 5 के उप-नियम (2) के प्रवर्ग में संवर्ग पद, नियम 5 के उप- नियम (2) के खण्ड (क) एवं (ख ) में निर्धारित कोटे के आधार पर चक्रानुक्रम द्वारा भरे जायेंगे । इस प्रकार, रोस्टर बिंदु में प्रथम 09 पद व्यवहार न्यायाधीश (कनिष्ठ श्रेणी) से पदोन्नत सदस्यों के लिए आरक्षित रहेंगे , 01 पद व्यवहार न्यायाधीश (कनिष्ठ श्रेणी ) की सीमित प्रतियोगी परीक्षा के माध्यम से पदोन्नत सदस्य के लिए आरक्षित रहेगा । इस प्रकार निर्धारित कोटे के अनुसार पद को भरने के लिए उसी प्रकार से चक्रानुक्रम का पालन किया जाएगा । (5) उन व्यक्तियों की वरिष्ठता , जिनका प्रकरण उप - नियम (1 ) , (2), (3) एवं (4) के अंतर्गत नहीं है , छत्तीसगढ़ सिविल सेवायें 152 ( 2)

(सेवा की सामान्य शर्तें) नियम , 1961 के प्रावधानों के अनुसार निर्धारित की जायेगी । "
8. अनुसूची- दो में, शब्द, अंक एवं चिन्ह " नियम 5 (2) देखिये " के पश्चात्, तथा चिन्ह " } " के पूर्व, चिन्ह एवं शब्द " (क) " अंतःस्थापित किया जाए । 9. अनुसूची-दो के पश्चात्, निम्नलिखित अनुसूची जोड़ी जाए , अर्थात्ः-

(अधिकतम अंक -40) (3) दस्तावेजों के प्रदर्शन तथा साक्ष्यों के अभिलेखन से संबंधित विधि.

NOTIFICATION
F. No. 157 / 2185,2186,2187 / XXI - B / C.G. / 2025-26 .- In exercise of the powers conferred by Article 234 read with the proviso to Article 309 of the Constitution of India, the Governor of Chhattisgarh, in consultation with the High Court of Chhattisgarh and Chhattisgarh Public Service Commission, hereby, makes the following further amendment in the Chhattisgarh Lower Judicial Service (Recruitment and Conditions of Service) Rules , 2006 , namely: -
AMENDMENT
In the said rules , -
1. In the second proviso of sub -rule (1 ) of Rule 5, after the words , "Backward Classes " the words and symbol , " /PwBD (Persons with Benchmark Disabilities ) " shall be inserted.
2. After first proviso of sub - rule ( 1 ) of Rule 5, the following proviso shall be inserted, namely: -
"Provided further that the minimum qualifying marks as well as cut - off marks would be 60% for General Category , and 50 % marks in case of Reserved Categories and 45% marks in case of PwBD candidates in both Preliminary and Mains Examination (Written) . " 3. For sub- rule (2) of Rule 5 , the following sub - rule shall be substituted, namely: -
"(2) . Appointment to category (a) of sub -rule (2) of Rule 3 shall be made as under: -
(a) 90% by selection and promotion from amongst Civil Judge (Junior Division) having completed minimum 5 years of छत्तीसगढ़ राजपत्र , दिनांक 11 फरवरी 2026

service on the basis of merit- cum- seniority:
The number of vacancies and the officers to be brought under the zone of consideration for promotion shall be in the ratio of 1 : 3 and the suitability of the officers shall be tested in accordance with norms prescribed in Schedule - II.
(b) 10% by promotion from amongst Civil Judge (Junior Division ) having completed minimum 3 years of service strictly on the basis of merit through limited competitive examination to be held by the High Court as per Schedule - III : Provided that a candidate appearing for promotion through limited competitive examination under clause (b) shall be required to secure minimum 50 % marks in the written examination:
Provided further that in the event of non - availability of candidates under clause (b ) , the vacancy shall be deemed as a vacancy under clause (a) and the same shall be filled in accordance with clause (a) in that particular year . "
4. After third proviso of clause (b) of sub- rule ( 1 ) of Rule 7, the following proviso shall be inserted, namely : -
"Provided further more that the maximum age limit including all the relaxations shall not exceed 45 years .
5. After clause ( c ) of sub - rule ( 1 ) of Rule 7, the following clause shall be added , namely: -
"(cc) has practiced for a minimum period of 3 years on the first day of January of the year in which applications for appointment are invited:
Provided that the number of years of practice completed by a candidate desirous of appearing in the examination for the post of Civil Judge (Junior छत्तीसगढ़ राजपत्र , दिनांक 11 फरवरी 2026
152( 5) Division) shall be calculated from the date of their provisional enrollment /registration with the concerned State Bar Council:
Provided further that the candidate shall produce a Certificate to that effect duly certified either by the Principal Judicial Officer of the concerned Court or by an advocate of the concerned Court having a minimum standing of 10 years duly endorsed by the Principal Judicial Officer of such a District or a Principal Judicial Officer at such a station . Insofar as the candidates who are practicing before the High Courts or Supreme Court , they shall produce a certificate duly certified by an advocate who has a minimum standing of 10 years duly endorsed by an officer designated by the concerned High Court or Supreme Court . The experience of the candidates while working as Law Clerks with any of the Judges or Judicial Officers in the country shall also be considered while calculating the total number of years of practice . "
6. For sub- rule (3 ) of Rule 13 , the following sub - rule shall be substituted , namely: -
"(3 ) Persons appointed to the service by direct recruitment after commencement of these rules shall be ranked inter se in the order of merit they are placed in select list . "
7. After sub - rule (3 ) of rule 13 , the following sub- rule shall be added, namely: -
"(4) After the commencement of these rules , the cadre post in category of sub-rule (2) of rule 5 shall be filled- up by the rotation based on the quota fixed in clauses ( a) and (b) of sub - rule (2) of rule 5. Thus , in छत्तीसगढ़ राजपत्र , दिनांक 11 फरवरी 2026

the roster point first 09 posts shall be reserved for the promotees from the Civil Judge ( Junior Division ) , 01 post shall be reserved for a member promoted through limited competitive examination of Civil Judge ( Junior Division) , The same rotation shall be followed to fill- up the post according to quota so fixed.
(5) The seniority of persons , whose cases are not covered under sub -rule ( 1) , (2) , (3 ) and (4) shall be determined in accordance with the provisions of the Chhattisgarh Civil Services ( General Conditions of Service) Rules , 1961. "
8. In Schedule - II , after the words , figures and symbol ' See Rule 5 (2) ' and before the symbol ' } ' , the symbol and letter " ( a) " shall be inserted.
9. After Schedule - II , the following Schedule shall be added, namely: -
