अधिसूचना

क्रमांक PROJ-41016/95/2026-LABOUR.  यतः, पहचान स्थापित करने के लिए आधार संख्या का उपयोग, व्यक्तियों को सुविधाजनक और निर्बाध तरीके से सब्सिडी, लाभ और सेवाएं प्राप्त करने में सक्षम बनाता है, पहचान स्थापित करने हेतु अनेक प्रकार के दस्तावेजों की आवश्यकता को समाप्त करता है, प्रक्रियाओं को सरल बनाता है तथा पारदर्शिता एवं दक्षता को बढ़ावा देता है;

और यत:, छत्तीसगढ़ श्रम कल्याण मण्डल (जो इसमें इसके पश्चात् उक्त अभिकरण के रूप में निर्दिष्ट है) छत्तीसगढ़ शासन (जो इसमें इसके पश्चात् उक्त सरकार के रूप में निर्दिष्ट है) के श्रम विभाग (जो इसमें इसके पश्चात् उक्त मंत्रालय या उक्त विभाग, यथास्थिति, के रूप मे निर्दिष्ट है) के प्रशासनिक नियंत्रण के अधीन, परिशिष्ट के अनुसार योजनाओं (जो इसमें इसके पश्चात् उक्त योजना के रूप में निर्दिष्ट है) का संचालन कर रहा है;

और यत:, उक्त योजना और उससे संबंधित जारी निर्देशों एवं दिशा निर्देंशों के अधीन पंजीकृ त संगठित श्रमिकों और उनके परिवार के सदस्यों (जो इसमें इसके पश्चात् लाभार्थियों के रूप में निर्दिष्ट है) को योजना का लाभ (नकद/वस्तु/दोनों) (जो इसमें इसके पश्चात् लाभ के रूप में निर्दिष्ट है) दिया जाता है;

और यत:, उक्त योजना पर होने वाला व्यय, छत्तीसगढ़ राज्य की समेकित निधि से किया जाता है;

और यतः उक्त अभिकरण इच्छु क है कि, सरकार उक्त लाभार्थी की पहचान स्थापित करने के उद्देश्य से उक्त लाभ प्राप्त करने की शर्त के रूप में यह अपेक्षा करे कि ऐसा लाभार्थी प्रमाणीकरण कराए या आधार संख्या रखने का प्रमाण प्रस्तुत करे अथवा ऐसे व्यक्ति के मामले में जिसे आधार संख्या आवंटित नहीं की गई है, नामांकन हेतु आवेदन प्रस्तुत करे;

अतएव, आधार (वित्तीय एवं अन्य सहायिकीयों (सब्सिडी), प्रसुविधाओं और सेवाओं का लक्षित परिदान) अधिनियम, 2016 (2016 का सं. 18) (जो इसमें इसके पश्चात् उक्त अधिनियम के रूप में निर्दिष्ट है) की धारा 7 के प्रावधानों के अनुसरण में, छत्तीसगढ़ शासन, एतद्द्वारा, निम्नलिखित अधिसूचित करती है, अर्थात्ः-

1. (1) उक्त योजना के तहत् उक्त प्रसुविधाओं का उपयोग करने के इच्छु क व्यक्ति को अधिप्रमाणन करवाना होगा या आधार नंबर होने का सबूत देना होगा।

(2) ऐसे व्यक्ति की दशा में, जिसे आधार नंबर नहीं दिया गया है, तो उसे नामांकन के लिए आवेदन करना होगा:

परंतु यदि वह व्यक्ति बालक/बालिका है, तो ऐसा आवेदन सिर्फ़ उसके माता-पिता या विधिक संरक्षक की सहमति से ही किया जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियमन, 2016 के विनियम 12 के प्रावधानों के अनुसार, उक्त श्रम विभाग यह सुनिश्चित करेगा कि ऐसे लाभार्थियों जिनका अभी तक नामांकन नहीं हुआ है, उनका नामांकन किया जाए या वे उचित उपायों से अपने आधार संबंधी ब्यौरों को अद्यतन करें, जिसमें रजिस्ट्रार के साथ समन्वय करना और सुविधाजनक स्थानों पर नामांकन के न्द्र स्थापित करना या रजिस्ट्रार द्वारा स्वयं नामांकन सुविधाएं प्रदान करवाना है:

परंतु जब तक ऐसे लाभार्थी को आधार नंबर नहीं मिल जाता, तब तक वह उक्त लाभ उठाने के लिए अपनी पहचान साबित करने के लिए निम्नलिखित दस्तावेज पेश कर सकता है, जिनके लिए वह हकदार है और जो पेश करने के समय वैध हैं या यदि उक्त श्रम विभाग (सीजीएलडब्ल्यूबी) द्वारा ऐसे पहचान के लिए प्रदान किया गया या अधिकृ त सॉफ्टवेयर, ऐसे दस्तावेज की सामग्री को साबित करने वाली जानकारी को उन प्राधिकरण के डेटाबेस से इलेक्ट्रॉनिक रूप से प्राप्त करने में सक्षम है, जो उन्हें तैयार करने या बनाए रखने का काम करती हैं, तो वह ऐसा करने के लिए अपनी सहमति दे सकता है, अर्थात्ः-

18 वर्ष से कम आयु के बालक/बालिका, जिसे आधार नंबर नहीं मिला है:

(अ) नामांकन के न्द्र पर ऑपरेटर द्वारा प्रदान की गई, लाभार्थी के नामांकन प्रक्रिया से गुज़रने की अभिस्वीकृ ति, जिसमें नामांकन ID (EID) हो; और

(ब) यह साबित करने के लिए कि लाभार्थी 18 वर्ष से कम आयु का बच्चा है, नीचे दिए गए दस्तावेजों में से कोई एक, अर्थात:-

(एक) जन्म और मृत्यु पंजीकरण अधिनियम, 1969 (क्र. 18 सन् 1969) के तहत्

दिया गया जन्म प्रमाण पत्र, जैसा कि लाभार्थी के जन्म के संबंध में जन्म

रजिस्टर में की गई प्रविष्टि से लिया गया है;

(दो) भारतीय पासपोर्ट;

(तीन) किसी मान्यता प्राप्त स्कू ल शिक्षा बोर्ड द्वारा जारी मैट्रिकु लेशन या 10वीं

कक्षा या हायर सेकें डरी या 12वीं कक्षा का प्रमाणपत्र या अंकसूची;

(चार) देखभाल और सुरक्षा की आवश्कता वाले बच्चे या ''कानून से संघर्षरत''

बालक/बालिका के मामले में, जो किशोर न्याय (बच्चों की देखभाल और

संरक्षण) अधिनियम, 2015 (2016 का 2) के तहत् संबंधित राज्य सरकार

द्वारा बनाए गए नियमों के तहत् पंजीकृ त बाल देखभाल संस्थान में

रहते हैं, उस संस्थान के प्रभारी व्यक्ति, अधीक्षक (सुपरिटेंडेंट), बाल

कल्याण अधिकारी या परिवीक्षा (प्रोबेशन) अधिकारी द्वारा जारी किया

गया जन्म तिथि बताने वाला प्रमाण पत्र; या

(पाँच) किसी विदेशी नागरिक के संबंध में,-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का

प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण

कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान

का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती

शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास

विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या

समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक

वीज़ा होना चाहिए; या

(स) लाभार्थी की तस्वीर वाले निम्नलिखित में से कोई एक दस्तावेज, जिससे माता- पिता या विधिक संरक्षक के साथ उसका रिश्ता साबित हो, जैसेः-

(एक) राशन कार्ड;

(दो) राज्य सरकार के एक राजपत्रित अधिकारी, जो कार्यकारी मजिस्ट्रेट या

तहसीलदार के पद से निम्न रैंक का राजस्व अधिकारी न हो, द्वारा जारी

किया गया जाति प्रमाण पत्र या अधिवास प्रमाण पत्र;

(तीन) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवानिवृत्त या

सेवारत सरकारी कर्मचारी या उसके परिवार के सदस्य को जारी किया

गया मेडिकल या बीमा पहचान पत्र;

(चार) भारतीय पासपोर्ट;

(पाँच) किसी मान्यता प्राप्त स्कू ल शिक्षा बोर्ड द्वारा जारी मैट्रिक या 10वीं कक्षा

या उच्चतर माध्यमिक या 12वीं कक्षा का प्रमाण पत्र या अंकसूची;

(छ:) देखभाल और सुरक्षा की आवश्यकता वाले बालक/बालिका या कानून से

संघर्षरत बालक/बालिका के संबंध में, जो किशोर न्याय (बच्चों की

देखभाल और संरक्षण) अधिनियम, 2015 (2016 का 2) के तहत् राज्य

सरकार द्वारा बनाए गए नियमों के तहत् संबंधित राज्य सरकार के साथ

पंजीकृ त बाल देखभाल संस्थान में रहता है, ऐसे संस्थान के प्रभारी

व्यक्ति, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा

जारी जन्म तिथि निर्दिष्ट करने वाला प्रमाण पत्र; या

(सात) किसी विदेशी नागरिक के संबंध में,-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का

प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण

कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान

का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती

शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास

विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या

समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक

वीज़ा होना चाहिए; या

(आठ) जिस लाभार्थी का कोई विधिक संरक्षक है, उसके संबंध में, गोद लेने का

आदेश या विधिक संरक्षक होने का सबूत देने वाला कोई अन्य दस्तावेज़,

जो गार्डियंस एंड वाड्र्स एक्ट, 1890 (1890 का 8), जुवेनाइल जस्टिस

(के यर एंड प्रोटेक्शन ऑफ चिल्ड्रन) एक्ट, 2015 (2016 का 2), नेशनल

ट्रस्ट फॉर वेलफे यर ऑफ पर्सन्स विद ऑटिज्म, सेरेब्रल पाल्सी, मेंटल

रिटार्डेशन एंड मल्टीपल डिसेबिलिटीज एक्ट, 1999 (1999 का 44) या

राइट्स ऑफ पर्सन्स विद डिसेबिलिटीज एक्ट, 2016 (2016 का 49)

और उक्त अधिनियमों के तहत् बनाए गए लागू नियमों और विनियमों के

तहत् किसी न्यायालय या सक्षम प्राधिकारी द्वारा जारी किया गया हो;

या

(नौ) कोई अन्य दस्तावेज़, जैसा कि उक्त श्रम विभाग निर्दिष्ट कर सकता है। जिन लाभार्थियों की आयु 18 वर्ष या उससे अधिक है और जिन्हें आधार नंबर नहीं मिला है, उनके लिएः

(अ) नामांकन के न्द्र पर ऑपरेटर द्वारा प्रदान की गई, लाभार्थी के नामांकन प्रक्रिया से गुज़रने की अभिस्वीकृ ति, जिसमें नामांकन ID (EID) हो; और

(ब) लाभार्थी की तस्वीर वाले नीचे दिए गए दस्तावेजों में से कोई एक, जैसेः-

(एक) भारत निर्वाचन आयोग द्वारा जारी किया गया मतदाता फोटो पहचान पत्र;

(दो) राशन कार्ड;

(तीन) राज्य सरकार के एक राजपत्रित अधिकारी, जो कार्यकारी मजिस्ट्रेट या तहसीलदार के पद से निम्न रैंक का राजस्व अधिकारी न हो, द्वारा जारी किया गया जाति प्रमाण पत्र या अधिवास प्रमाण पत्र;

(चार) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवानिवृत्त या सेवारत सरकारी कर्मचारी या उसके परिवार के सदस्य को जारी किया गया मेडिकल या बीमा पहचान पत्र;

(पाँच) भारतीय पासपोर्ट;

(छ:) किसी मान्यता प्राप्त विद्यालय शिक्षा बोर्ड द्वारा जारी मैट्रिकु लेशन या 10वीं कक्षा या उच्चतर माध्यमिक या 12वीं कक्षा का प्रमाणपत्र या अंकों का विवरण;

(सात) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवारत या सेवानिवृत्त लोक सेवक को जारी किया गया पहचान पत्र या अन्य पहचान दस्तावेज;

(आठ) दिव्यांगजन अधिकार नियम, 2017 के अंतर्गत अधिसूचित चिकित्सा प्राधिकारी द्वारा जारी दिव्यांगता प्रमाणपत्र, या भारत सरकार के दिव्यांगजन सशक्तिकरण विभाग द्वारा जारी विशिष्ट दिव्यांगता पहचान (यूडीआईडी) पत्र;

(नौ) भारत में जारी चालन अनुज्ञप्ति (ड्राइविंग लाइसेंस);

(दस) देखभाल और संरक्षण की आवश्यकता वाले बालक/बालिका या विधि से संघर्षरत बालकों के संबंध में, जिन्हें किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015 (2016 का 2) के अंतर्गत उसके द्वारा बनाए गए नियमों के अंतर्गत संबंधित राज्य सरकार के साथ पंजीकृ त बाल देखभाल संस्थान में रखा जाता है, ऐसे संस्थान के प्रभारी व्यक्ति, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा जारी उसकी जन्मतिथि निर्दिष्ट करने वाला प्रमाणपत्र; या

(ग्यारह) किसी विदेशी नागरिक के संबंध में-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक वीज़ा होना चाहिए; या

(बारह) जिस लाभार्थी का कोई विधिक संरक्षक है, उसके संबंध में, गोद लेने का आदेश या विधिक संरक्षक होने का सबूत देने वाला कोई अन्य दस्तावेज़, जो गार्डियंस एंड वाड्र्स एक्ट, 1890 (1890 का 8), जुवेनाइल जस्टिस (के यर एंड प्रोटेक्शन ऑफ चिल्ड्रन) एक्ट, 2015 (2016 का 2), नेशनल ट्रस्ट फॉर वेलफे यर ऑफ पर्सन्स विद ऑटिज्म, सेरेब्रल पाल्सी, मेंटल रिटार्डेशन एंड मल्टीपल डिसेबिलिटीज एक्ट, 1999 (1999 का 44) या राइट्स ऑफ पर्सन्स विद डिसेबिलिटीज एक्ट, 2016 (2016 का 49) और उक्त अधिनियमों के तहत् बनाए गए लागू नियमों और विनियमों के तहत् किसी न्यायालय या सक्षम प्राधिकारण द्वारा जारी किया गया हो; या

(तेरह) कोई अन्य दस्तावेज़, जैसा कि उक्त श्रम विभाग (सीजीएलडब्ल्यूबी) निर्दिष्ट कर सकता है।

(4) इस संबंध में उक्त श्रम विभाग द्वारा नामित अधिकारी, खण्ड (3) के तहत् पेश किए गए दस्तावेज़ों या उनकी सामग्री को साबित करने वाली जानकारी के संबंध में जाँच करेंगे, -

(अ) myAadhaar पोर्टल (https://myaadhaar.uidai.gov.in/portal) पर EID जमा करके नामांकन निवेदन (रिक्वे स्ट) की प्रास्थिति की जाँच करें, ताकि इसकी पुष्टि हो सके कि EID वैध है और नामांकन निवेदन (रिक्वे स्ट) अस्वीकृ त नहीं हुआ है; और

(ब) दूसरे दस्तावेज और इस प्रयोजन के लिए, किसी भी सरकारी संस्था या प्राधिकरण की मदद ले सकते हैं और उनके साथ जानकारी बांट सकते हैं, जो ऐसे दस्तावेजों में मौजूद जानकारी को तैयार करने या बनाए रखने का काम करती है। 2. लाभार्थियों को उक्त लाभ आसानी से मिल सके , इसके लिए मंत्रालय, मीडिया के माध्यम से व्यापक प्रचार करने के लिए सभी आवश्यक कदम उठाए जाएंगे, ताकि लाभार्थियों को इस योजना के तहत् आधार नंबर की आवश्यकता के संबंध में जानकारी हो सके ।

3. ऊपर अंतर्विष्ट किसी भी बात के होते हुए भी,-

(अ) उक्त योजना के अंतर्गत लाभ से किसी बालक/बालिका को वंचित नहीं किया जाएगा- (एक) प्रमाणीकरण द्वारा अपनी पहचान स्थापित करने में या आधार संख्या होने का प्रमाण प्रस्तुत करने में असफल रहने की स्थिति में; या

(दो) नामांकन के लिए आवेदन प्रस्तुत करने की स्थिति में, जहाँ उसे आधार संख्या नहीं दी गई है; और

(ब) इस योजना के तहत् लाभ ऐसे बालक/बालिका को उसकी पहचान का सत्यापन करके और पैराग्राफ 1 के खण्ड (3) के प्रावधान में बताई गई रीति से उसके माता-पिता या विधिक संरक्षक के साथ उसके रिश्ते को साबित करके दिया जाएगा; और

(स) जहाँ खण्ड (ख) के तहत् लाभ दिया जाता है, वहाँ उसका एक रिकॉर्ड रखा जाएगा, श्रम विभाग द्वारा जिसकी समय-समय पर समीक्षा और अंके क्षण किए जाएंगे।

4. यह सुनिश्चित करने के क्रम में 18 वर्ष या उससे अधिक आयु के वास्तविक हकदार लोगों को उक्त योजना के तहत् मिलने वाले लाभ से वंचित न किया जाए, श्रम विभाग (सीजीएलडब्ल्यूबी) डायरेक्ट बेनिफिट ट्रांसफर मिशन, कै बिनेट सेक्रे टेरिएट, भारत सरकार के ऑफिस मेमोरेंडम क्र.D- 26011/04/2017-DBT, तारीख 19 दिसंबर, 2017 में विनिर्दिष्ट एक्सेप्शन हैंडलिंग मैके निज्म को फॉलो करेगा (जो https:@@dbtbharat-gov.in पर उपलब्ध है)।

5. यह अधिसूचना राजपत्र में इसके प्रकाशन की तारीख से लागू होगी।

NOTIFICATION

No. PROJ-41016/95/2026-LABOUR.— Whereas the use of Aadhaar number to establish identity enables individuals to receive subsidies, benefits and services in a convenient and seamless manner, obviates the need for multiplicity of documents to establish identity, simplifies processes and promotes transparency and efficiency:

And whereas Chhattisgarh Labour Welfare Board (hereinafter referred to as the said agency) under the administrative purview of the Labour Department (hereinafter referred to as the said Ministry or the said Department, as the case may be) in the Government of Chhattisgarh (hereinafter referred to as the said Government) is administering schemes as per Annexure (hereinafter referred to as the said scheme):

And whereas scheme benefit (cash/kind/both) (hereinafter referred to as the said benefit) is given to the registered organised labourers and their family (hereinafter referred to as the beneficiaries) under the said scheme and the instructions and guidelines issued in respect thereof:

And whereas expenditure for the said scheme is incurred from the Consolidated Fund of Chhattisgarh State:

And whereas the said Chhattisgarh Labour Welfare Board (CGLWB) is desirous that the Government, for the purpose of establishing identity of a beneficiary as a condition for the receipt of the said benefit, require that such beneficiary undergo authentication, or furnish proof of possession of Aadhaar number or in the case of an individual to whom no Aadhaar number has been assigned, make an application for enrolment:

Now, therefore, in pursuance of the provisions of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (No. 18 of 2016) (hereinafter referred to as the said Act), the Government of Chhattisgarh hereby notifies the following, namely:—

1. (1) An individual desirous of availing of the said benefit under the said scheme shall be required to undergo authentication, or furnish proof of possession of Aadhaar number.

(2) In case such an individual has not been assigned an Aadhaar number, he shall be required to make an application for enrolment:

Provided that if that individual is a child, such application shall be made only with the consent of his parent or legal guardian.

(3) In accordance with the provisions of regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the said Labour Department shall ensure enrolment of such beneficiaries who are yet to be enrolled, or update their Aadhaar details through appropriate measures, including coordination with Registrars and setting up enrolment centres at convenient locations or providing enrolment facilities by becoming a Registrar itself:

Provided that till such time an Aadhaar number is assigned to such beneficiary, he may establish his identity to avail of the said benefit, by presenting the following documents to which he is entitled and which are valid at the time of presentation, or, in case the software provided or authorised by the said Labour Department (CGLWB) such identification supports electronic obtaining of information evidencing the contents of such documents from the database of the authorities dealing with the preparation or maintenance thereof, by giving his consent for so obtaining, namely:—

For a child below 18 years of age to whom an Aadhaar number has not been assigned:

(A) The acknowledgement of the beneficiary having undergone the process of enrolment, provided by the operator at the enrolment centre, containing the Enrolment ID (EID); and

(B) Any one of the following documents to evidence that the beneficiary is a child below 18 years of age, namely:-

(i) Certificate of birth given under the Registration of Births and Deaths Act, 1969, as extracted from the entry made in the register of births regarding the birth of the beneficiary;

(ii) Indian passport;

(iii) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(iv) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in-charge, superintendent, child welfare officer or probation officer of such institution; or

(v) In respect of a foreign national,-

(a) if he is an Overseas Citizen of India Cardholder, Overseas Citizen of India Card;

(b) if he is a Tibetan refugee, registration certificate issued by a Foreigners Regional Registration Office;

(c) if he is a national of Nepal or Bhutan, passport of Nepal or Bhutan;

(d) if he is other than a Overseas Citizen of India Cardholder, Tibetan refugee or a national of Nepal or Bhutan, either an Indian visa along with foreign passport or a Long Term Visa to India along with currently valid or expired foreign passport; or

(C) Any one of the following documents, having the photograph of the beneficiary, to evidence his relationship with the parent or legal guardian, namely:

(i) Ration card;

(ii) Caste certificate or domicile certificate, issued by a Gazetted officer who is an Executive Magistrate or a revenue officer of the State Government, not below the rank of Tahsildar;

(iii) Medical or insurance identity card issued by a government entity or public sector enterprise to a retired or serving public servant or his family member;

(iv) Indian passport;

(v) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(vi) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in- charge, superintendent, child welfare officer or probation officer of such institution; or (vii) In respect of a foreign national,-

(a) if he is an Overseas Citizen of India Cardholder, Overseas Citizen of India Card;

(b) if he is a Tibetan refugee, registration certificate issued by a Foreigners Regional Registration Office;

(c) if he is a national of Nepal or Bhutan, passport of Nepal or Bhutan;

(d) if he is other than a Overseas Citizen of India Cardholder, Tibetan refugee or a national of Nepal or Bhutan, either an Indian visa along with foreign passport or a Long Term Visa to India along with currently valid or expired foreign passport; or

(viii) In respect of a beneficiary who has a legal guardian, adoption order or other document to evidence legal guardianship, which is issued by a court of law or competent authority under the Guardians and Wards Act, 1890 (No. 8 of 1890), the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (No. 44 of 1999) or the Rights of Persons with Disabilities Act, 2016 (No. 49 of 2016) and the applicable rules and regulations made under the said Acts; or

(ix) Any other document as the said Labour Department may specify.

For beneficiaries aged 18 years or more to whom an Aadhaar number has not been assigned:

(A) The acknowledgement of the beneficiary having undergone the process of enrolment, provided by the operator at the enrolment centre, containing the Enrolment ID (EID); and

(B) Any one of the following documents, having the beneficiary's photograph, namely:—

(i) Elector's Photo Identity Card issued by the Election Commission of India;

(ii) Ration card;

(iii) Caste certificate or domicile certificate, issued by a Gazetted officer who is an Executive Magistrate or a revenue officer of the State Government, not below the rank of Tahsildar;

(iv) Medical or insurance identity card issued by a government entity or public sector enterprise to a retired or serving public servant or his family member;

(v) Indian passport;

(vi) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(vii) Identity card or other identity document issued to serving or retired public servant by a government entity or a public sector enterprise;

(viii) Disability certificate issued by notified medical authority under Rights of Persons with Disabilities Rules, 2017, or Unique Disability Identification (UDID)card issued by the Department of Empowerment of Persons with Disabilities (Divyangjan), Government of India;

(ix) Driving licence issued in India:

(x) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in-charge, superintendent, child welfare officer or probation officer of such institution; or

(xii) In respect of a beneficiary who has a legal guardian, adoption order or other document to evidence legal guardianship, which is issued by a court of law or competent authority under the Guardians and Wards Act, 1890 (No. 8 of 1890), the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (No. 44 of 1999) or the Rights of Persons with Disabilities Act, 2016 (No. 49 of 2016) and the applicable rules and regulations made under the said Acts; or

(xiii) Any other document as the said Labour Department (CGLWB) may specify: Annexure (4) Officer designated by the said Labour Department in this behalf shall check in respect of the documents presented or the information evidencing the contents thereof under clause (3),—

(A) the status of the enrolment request by submitting the EID on myAadhaar portal (https://myaadhaar.uidai.gov.in/portal) to confirm that the EID is valid and that the enrolment request does not stand rejected; and

(B) the other documents, and for this purpose, may take the assistance of and share the information presented with any government entity or an authority that deals with the preparation or maintenance of the information contained in such documents.

2. In order to enable beneficiaries to avail of the said benefits conveniently, the Ministry shall make all necessary steps to ensure wide publicity through media to make the beneficiaries aware of the requirement of Aadhaar number under the said scheme.

3. Notwithstanding anything contained hereinabove,—

(A) benefit under the said scheme shall not be denied to a child—

(i) in case of failure to establish his identity by undergoing authentication or to furnish proof of possession of Aadhaar number; or

(ii) in case of production of an application for enrolment where he has not been assigned an Aadhaar number; and

(B) benefit under the said scheme shall be given to such a child by verifying his identity and establishing his relationship with his parent or legal guardian in the manner specified in the proviso to clause (3) of paragraph 1; and

(C) where benefit is given under clause (b), a record shall be maintained in respect of the same, which shall be reviewed and audited periodically by the Labour Departmenti.

4. In order to ensure that Bonafide beneficiaries who are aged 18 years or more are not deprived of the benefit due to them under the said scheme, the Labour Department (CGLWB) shall follow the exception handling mechanism specified in the Office Memorandum no. D-26011/04/2017-DBT, dated the 19th December, 2017of the Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India (available on https://dbtbharat.gov.in).

5. This notification shall be effective from the date of its publication in the official Gazette.

SCHEMES OF CHHATTISGARH LABOUR WELFARE BOARD

क्रमांक PROJ-41016/95/2026-LABOUR.  यतः, पहचान स्थापित करने के लिए आधार संख्या का उपयोग, व्यक्तियों को सुविधाजनक और निर्बाध तरीके से सब्सिडी, लाभ और सेवाएं प्राप्त करने में सक्षम बनाता है, पहचान स्थापित करने हेतु अनेक प्रकार के दस्तावेजों की आवश्यकता को समाप्त करता है, प्रक्रियाओं को सरल बनाता है तथा पारदर्शिता एवं दक्षता को बढ़ावा देता है;

और यत:, छत्तीसगढ़ असंगठित कर्मकार राज्य सामाजिक सुरक्षा मण्डल (जो इसमें इसके पश्चात् उक्त अभिकरण के रूप में निर्दिष्ट है) छत्तीसगढ़ शासन (जो इसमें इसके पश्चात् उक्त सरकार के रूप में निर्दिष्ट है) के श्रम विभाग (जो इसमें इसके पश्चात् उक्त मंत्रालय या उक्त विभाग, यथास्थिति, के रूप में निर्दिष्ट है) के प्रशासनिक दायरे के अधीन, परिशिष्ट के अनुसार योजनाओं (जो इसमें इसके पश्चात् उक्त योजना के रूप में निर्दिष्ट है) का संचालन कर रहा है;

और यत:, उक्त योजना और उससे संबंधित जारी निर्देशों एवं दिशा निर्देंशों के अधीन पंजीकृ त असंगठित कर्मकार और उनके परिवार के सदस्यों (जो इसमें इसके पश्चात् लाभार्थियों के रूप में निर्दिष्ट है) को योजना का लाभ (नकद/वस्तु/दोनों) (जो इसमें इसके पश्चात् लाभ के रूप में निर्दिष्ट है) दिया जाता है;

और यत:, उक्त योजना पर होने वाला व्यय, छत्तीसगढ़ राज्य की समेकित निधि से किया जाता है;

और यतः उक्त अभिकरण इच्छु क है कि, सरकार उक्त लाभार्थी की पहचान स्थापित करने के उद्देश्य से उक्त लाभ प्राप्त करने की शर्त के रूप में यह अपेक्षा करे कि ऐसा लाभार्थी प्रमाणीकरण कराए या आधार संख्या रखने का प्रमाण प्रस्तुत करे अथवा ऐसे व्यक्ति के मामले में जिसे आधार संख्या आवंटित नहीं की गई है, नामांकन हेतु आवेदन प्रस्तुत करे;

अतएव, आधार (वित्तीय एवं अन्य सहायिकीयों (सब्सिडी), प्रसुविधाओं और सेवाओं का लक्षित परिदान) अधिनियम, 2016 (2016 का सं. 18) (जो इसमें इसके पश्चात् उक्त अधिनियम के रूप में निर्दिष्ट है) की धारा 7 के प्रावधानों के अनुसरण में, छत्तीसगढ़ शासन, एतद्द्वारा, निम्नलिखित अधिसूचित करती है, अर्थात्ः-

1. (1) उक्त योजना के तहत् उक्त प्रसुविधाओं का उपयोग करने के इच्छु क व्यक्ति को अधिप्रमाणन करवाना होगा या आधार नंबर होने का सबूत देना होगा।

(2) ऐसे व्यक्ति की दशा में, जिसे आधार नंबर नहीं दिया गया है, तो उसे नामांकन के लिए आवेदन करना होगा:

परंतु यदि वह व्यक्ति बालक/बालिका है, तो ऐसा आवेदन सिर्फ़ उसके माता-पिता या विधिक संरक्षक की सहमति से ही किया जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियमन, 2016 के विनियम 12 के प्रावधानों के अनुसार, उक्त श्रम विभाग यह सुनिश्चित करेगा कि ऐसे लाभार्थियों जिनका अभी तक नामांकन नहीं हुआ है, उनका नामांकन किया जाए या वे उचित उपायों से अपने आधार संबंधी ब्यौरों को अद्यतन करें, जिसमें रजिस्ट्रार के साथ समन्वय करना और सुविधाजनक स्थानों पर नामांकन के न्द्र स्थापित करना या रजिस्ट्रार द्वारा स्वयं नामांकन सुविधाएं प्रदान करवाना है:

परंतु जब तक ऐसे लाभार्थी को आधार नंबर नहीं मिल जाता, तब तक वह उक्त लाभ उठाने के लिए अपनी पहचान साबित करने के लिए निम्नलिखित दस्तावेज पेश कर सकता है, जिनके लिए वह हकदार है और जो पेश करने के समय वैध हैं या यदि उक्त श्रम विभाग (सीजीयूओडब्ल्यू) द्वारा ऐसे पहचान के लिए प्रदान किया गया या अधिकृ त सॉफ्टवेयर, ऐसे दस्तावेज की सामग्री को साबित करने वाली जानकारी को उन प्राधिकरण के डेटाबेस से इलेक्ट्रॉनिक रूप से प्राप्त करने में सक्षम है, जो उन्हें तैयार करने या बनाए रखने का काम करती हैं, तो वह ऐसा करने के लिए अपनी सहमति दे सकता है, अर्थात्ः-

18 वर्ष से कम आयु के बालक/बालिका, जिसे आधार नंबर नहीं मिला है:

(अ) नामांकन के न्द्र पर ऑपरेटर द्वारा प्रदान की गई, लाभार्थी के नामांकन प्रक्रिया से गुज़रने की अभिस्वीकृ ति, जिसमें नामांकन ID (EID) हो; और

(ब) यह साबित करने के लिए कि लाभार्थी 18 वर्ष से कम आयु का बच्चा है, नीचे दिए गए दस्तावेजों में से कोई एक, अर्थात:-

(एक) जन्म और मृत्यु पंजीकरण अधिनियम, 1969 (क्र. 18 सन् 1969) के तहत्

दिया गया जन्म प्रमाण पत्र, जैसा कि लाभार्थी के जन्म के संबंध में जन्म

रजिस्टर में की गई प्रविष्टि से लिया गया है;

(दो) भारतीय पासपोर्ट;

(तीन) किसी मान्यता प्राप्त स्कू ल शिक्षा बोर्ड द्वारा जारी मैट्रिकु लेशन या 10वीं

कक्षा या हायर सेकें डरी या 12वीं कक्षा का प्रमाणपत्र या अंकसूची;

(चार) देखभाल और सुरक्षा की आवश्कता वाले बच्चे या ''कानून से संघर्षरत''

बालक/बालिका के मामले में, जो किशोर न्याय (बच्चों की देखभाल और

संरक्षण) अधिनियम, 2015 (2016 का 2) के तहत् संबंधित राज्य सरकार द्वारा बनाए गए नियमों के तहत् पंजीकृ त बाल देखभाल संस्थान में रहते

हैं, उस संस्थान के प्रभारी व्यक्ति, अधीक्षक (सुपरिटेंडेंट), बाल कल्याण

अधिकारी या परिवीक्षा (प्रोबेशन) अधिकारी द्वारा जारी किया गया जन्म

तिथि बताने वाला प्रमाण पत्र; या

(पाँच) किसी विदेशी नागरिक के संबंध में,-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का

प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण

कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान

का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती

शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास

विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या

समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक

वीज़ा होना चाहिए; या

(स) लाभार्थी की तस्वीर वाले निम्नलिखित में से कोई एक दस्तावेज, जिससे माता- पिता या विधिक संरक्षक के साथ उसका रिश्ता साबित हो, जैसेः-

(एक) राशन कार्ड;

(दो) राज्य सरकार के एक राजपत्रित अधिकारी, जो कार्यकारी मजिस्ट्रेट या

तहसीलदार के पद से निम्न रैंक का राजस्व अधिकारी न हो, द्वारा जारी

किया गया जाति प्रमाण पत्र या अधिवास प्रमाण पत्र;

(तीन) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवानिवृत्त या

सेवारत सरकारी कर्मचारी या उसके परिवार के सदस्य को जारी किया

गया मेडिकल या बीमा पहचान पत्र;

(चार) भारतीय पासपोर्ट;

(पाँच) किसी मान्यता प्राप्त स्कू ल शिक्षा बोर्ड द्वारा जारी मैट्रिक या 10वीं कक्षा

या उच्चतर माध्यमिक या 12वीं कक्षा का प्रमाण पत्र या अंकसूची;

(छ:) देखभाल और सुरक्षा की आवश्यकता वाले बालक/बालिका या कानून से

संघर्षरत बालक/बालिका के संबंध में, जो किशोर न्याय (बच्चों की

देखभाल और संरक्षण) अधिनियम, 2015 (2016 का 2) के तहत् राज्य

सरकार द्वारा बनाए गए नियमों के तहत् संबंधित राज्य सरकार के साथ

पंजीकृ त बाल देखभाल संस्थान में रहता है, ऐसे संस्थान के प्रभारी

व्यक्ति, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा

जारी जन्म तिथि निर्दिष्ट करने वाला प्रमाण पत्र; या

(सात) किसी विदेशी नागरिक के संबंध में,-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का

प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण

कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान

का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती

शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास

विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या

समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक

वीज़ा होना चाहिए; या

(आठ) जिस लाभार्थी का कोई विधिक संरक्षक है, उसके संबंध में, गोद लेने का

आदेश या विधिक संरक्षक होने का सबूत देने वाला कोई अन्य दस्तावेज़,

जो गार्डियंस एंड वाड्र्स एक्ट, 1890 (1890 का 8), जुवेनाइल जस्टिस

(के यर एंड प्रोटेक्शन ऑफ चिल्ड्रन) एक्ट, 2015 (2016 का 2), नेशनल

ट्रस्ट फॉर वेलफे यर ऑफ पर्सन्स विद ऑटिज्म, सेरेब्रल पाल्सी, मेंटल

रिटार्डेशन एंड मल्टीपल डिसेबिलिटीज एक्ट, 1999 (1999 का 44) या

राइट्स ऑफ पर्सन्स विद डिसेबिलिटीज एक्ट, 2016 (2016 का 49)

और उक्त अधिनियमों के तहत् बनाए गए लागू नियमों और विनियमों के

तहत् किसी न्यायालय या सक्षम प्राधिकारी द्वारा जारी किया गया हो;

या

(नौ) कोई अन्य दस्तावेज़, जैसा कि उक्त श्रम विभाग निर्दिष्ट कर सकता है। जिन लाभार्थियों की आयु 18 वर्ष या उससे अधिक है और जिन्हें आधार नंबर नहीं मिला है, उनके लिएः

(अ) नामांकन के न्द्र पर ऑपरेटर द्वारा प्रदान की गई, लाभार्थी के नामांकन प्रक्रिया से गुज़रने की अभिस्वीकृ ति, जिसमें नामांकन ID (EID) हो; और

(ब) लाभार्थी की तस्वीर वाले नीचे दिए गए दस्तावेजों में से कोई एक, जैसेः-

(एक) भारत निर्वाचन आयोग द्वारा जारी किया गया मतदाता फोटो पहचान पत्र;

(दो) राशन कार्ड;

(तीन) राज्य सरकार के एक राजपत्रित अधिकारी, जो कार्यकारी मजिस्ट्रेट या तहसीलदार के पद से निम्न रैंक का राजस्व अधिकारी न हो, द्वारा जारी किया गया जाति प्रमाण पत्र या अधिवास प्रमाण पत्र;

(चार) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवानिवृत्त या सेवारत सरकारी कर्मचारी या उसके परिवार के सदस्य को जारी किया गया मेडिकल या बीमा पहचान पत्र;

(पाँच) भारतीय पासपोर्ट;

(छ:) किसी मान्यता प्राप्त विद्यालय शिक्षा बोर्ड द्वारा जारी मैट्रिकु लेशन या 10वीं कक्षा या उच्चतर माध्यमिक या 12वीं कक्षा का प्रमाणपत्र या अंकसूची;

(सात) किसी सरकारी संस्था या सार्वजनिक क्षेत्र के उद्यम द्वारा सेवारत या सेवानिवृत्त लोक सेवक को जारी किया गया पहचान पत्र या अन्य पहचान दस्तावेज;

(आठ) दिव्यांगजन अधिकार नियम, 2017 के अंतर्गत अधिसूचित चिकित्सा प्राधिकारी द्वारा जारी दिव्यांगता प्रमाणपत्र, या भारत सरकार के दिव्यांगजन सशक्तिकरण विभाग द्वारा जारी विशिष्ट दिव्यांगता पहचान (यूडीआईडी) पत्र;

(नौ) भारत में जारी चालन अनुज्ञप्ति (ड्राइविंग लाइसेंस);

(दस) देखभाल और संरक्षण की आवश्यकता वाले बालक/बालिका या विधि से संघर्षरत बालकों के संबंध में, जिन्हें किशोर न्याय (बालकों की देखभाल और संरक्षण) अधिनियम, 2015 (2016 का 2) के अंतर्गत उसके द्वारा बनाए गए नियमों के अंतर्गत संबंधित राज्य सरकार के साथ पंजीकृ त बाल देखभाल संस्थान में रखा जाता है, ऐसे संस्थान के प्रभारी व्यक्ति, अधीक्षक, बाल कल्याण अधिकारी या परिवीक्षा अधिकारी द्वारा जारी उसकी जन्मतिथि निर्दिष्ट करने वाला प्रमाणपत्र; या

(ग्यारह) किसी विदेशी नागरिक के संबंध में-

(क) यदि वह भारत का प्रवासी नागरिक कार्डधारक है, तो भारत का प्रवासी नागरिक कार्ड;

(ख) यदि वह तिब्बती शरणार्थी है, तो विदेशी क्षेत्रीय पंजीकरण कार्यालय द्वारा जारी पंजीकरण प्रमाणपत्र;

(ग) यदि वह नेपाल या भूटान का नागरिक है, तो नेपाल या भूटान का पासपोर्ट;

(घ) यदि वह भारत का प्रवासी नागरिक कार्डधारक, तिब्बती शरणार्थी या नेपाल या भूटान का नागरिक नहीं है, तो उसके पास विदेशी पासपोर्ट के साथ भारतीय वीज़ा या वतर्मान में वैध या समाप्त हो चुके विदेशी पासपोर्ट के साथ भारत का दीर्घकालिक वीज़ा होना चाहिए; या

(तेरह) कोई अन्य दस्तावेज़, जैसा कि उक्त श्रम विभाग निर्दिष्ट कर सकता है।

(4) इस संबंध में उक्त श्रम विभाग द्वारा नामित अधिकारी, खण्ड (3) के तहत् पेश किए गए दस्तावेज़ों या उनकी सामग्री को साबित करने वाली जानकारी के संबंध में जाँच करेंगे, - (अ) myAadhaar पोर्टल (https://myaadhaar.uidai.gov.in/portal) पर EID जमा करके नामांकन निवेदन (रिक्वे स्ट) की प्रास्थिति की जाँच करें, ताकि इसकी पुष्टि हो सके कि EID वैध है और नामांकन निवेदन (रिक्वे स्ट) अस्वीकृ त नहीं हुआ है; और

(ब) दूसरे दस्तावेज और इस प्रयोजन के लिए, किसी भी सरकारी संस्था या प्राधिकरण की मदद ले सकते हैं और उनके साथ जानकारी बांट सकते हैं, जो ऐसे दस्तावेजों में मौजूद जानकारी को तैयार करने या बनाए रखने का काम करती है। 2. लाभार्थियों को उक्त लाभ आसानी से मिल सके , इसके लिए मंत्रालय, मीडिया के माध्यम से व्यापक प्रचार करने के लिए सभी आवश्यक कदम उठाए जाएंगे, ताकि लाभार्थियो को इस योजना के तहत् आधार नंबर की आवश्यकता के संबंध में जानकारी हो सके ।

3. ऊपर अंतर्विष्ट किसी भी बात के होते हुए भी,-

(अ) उक्त योजना के अंतर्गत लाभ से किसी बालक/बालिका को वंचित नहीं किया जाएगा- (एक) प्रमाणीकरण द्वारा अपनी पहचान स्थापित करने में या आधार संख्या होने का प्रमाण प्रस्तुत करने में असफल रहने की स्थिति में; या

(दो) नामांकन के लिए आवेदन प्रस्तुत करने की स्थिति में, जहाँ उसे आधार संख्या नहीं दी गई है; और

(ब) इस योजना के तहत् लाभ ऐसे बालक/बालिका को उसकी पहचान का सत्यापन करके और पैराग्राफ 1 के खण्ड (3) के प्रावधान में बताई गई रीति से उसके माता-पिता या विधिक संरक्षक के साथ उसके रिश्ते को साबित करके दिया जाएगा; और

(स) जहाँ खण्ड (ख) के तहत् लाभ दिया जाता है, वहाँ उसका एक रिकॉर्ड रखा जाएगा, श्रम विभाग द्वारा जिसकी समय-समय पर समीक्षा और अंके क्षण किए जाएंगे।

4. यह सुनिश्चित करने के क्रम में 18 वर्ष या उससे अधिक आयु के वास्तविक हकदार लोगों को उक्त योजना के तहत् मिलने वाले लाभ से वंचित न किया जाए, श्रम विभाग डायरेक्ट बेनिफिट ट्रांसफर मिशन, कै बिनेट सेक्रे टेरिएट, भारत सरकार के ऑफिस मेमोरेंडम क्र.D-26011/04/2017-DBT, तारीख 19 दिसंबर, 2017 में विनिर्दिष्ट एक्सेप्शन हैंडलिंग मैके निज्म को फॉलो करेगा (जो https:@@dbtbharat-gov.in पर उपलब्ध है)।

NOTIFICATION

No. PROJ-41016/95/2026-LABOUR.— Whereas the use of Aadhaar number to establish identity enables individuals to receive subsidies, benefits and services in a convenient and seamless manner, obviates the need for multiplicity of documents to establish identity, simplifies processes and promotes transparency and efficiency:

And whereas Chhattisgarh Unorganised Workers State Social Security Board (hereinafter referred to as the said agency) under the administrative purview of the Labour Department (CGUOW) (hereinafter referred to as the said Ministry or the said Department, as the case may be) in the Government of Chhattisgarh (hereinafter referred to as the said Government) is administering schemes as per Annexure (hereinafter referred to as the said scheme):

And whereas scheme benefit (cash/kind/both) (hereinafter referred to as the said benefit) is given to the registered Unorganised labourers and their family (hereinafter referred to as the beneficiaries) under the said scheme and the instructions and guidelines issued in respect thereof:

And whereas expenditure for the said scheme is incurred from the Consolidated Fund of Chhattisgarh State:

And whereas the said Chhattisgarh Unorganised Workers State Social Security Board is desirous that the said Government, for the purpose of establishing identity of a beneficiary as a condition for the receipt of the said benefit, require that such beneficiary undergo authentication, or furnish proof of possession of Aadhaar number or in the case of an individual to whom no Aadhaar number has been assigned, make an application for enrolment:

Now, therefore, in pursuance of the provisions of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (No. 18 of 2016) (hereinafter referred to as the said Act), the Government of Chhattisgarh hereby notifies the following, namely:—

1. (1) An individual desirous of availing of the said benefit under the said scheme shall be required to undergo authentication, or furnish proof of possession of Aadhaar number.

(2) In case such an individual has not been assigned an Aadhaar number, he shall be required to make an application for enrolment:

Provided that if that individual is a child, such application shall be made only with the consent of his parent or legal guardian.

(3) In accordance with the provisions of regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the said Labour Department shall ensure enrolment of such beneficiaries who are yet to be enrolled, or update their Aadhaar details through appropriate measures, including coordination with Registrars and setting up enrolment centres at convenient locations or providing enrolment facilities by becoming a Registrar itself:

Provided that till such time an Aadhaar number is assigned to such beneficiary, he may establish his identity to avail of the said benefit, by presenting the following documents to which he is entitled and which are valid at the time of presentation, or, in case the software provided or authorised by the said Labour Department (CGUOW) for such identification supports electronic obtaining of information evidencing the contents of such documents from the database of the authorities dealing with the preparation or maintenance thereof, by giving his consent for so obtaining, namely:—

For a child below 18 years of age to whom an Aadhaar number has not been assigned:

(A) The acknowledgement of the beneficiary having undergone the process of enrolment, provided by the operator at the enrolment centre, containing the Enrolment ID (EID); and

(B) Any one of the following documents to evidence that the beneficiary is a child below 18 years of age, namely:

(i) Certificate of birth given under the Registration of Births and Deaths Act, 1969 (No. 18 of 1969), as extracted from the entry made in the register of births regarding the birth of the beneficiary;

(ii) Indian passport;

(iii) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(iv) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in-charge, superintendent, child welfare officer or probation officer of such institution; or

(v) In respect of a foreign national,-

(a) if he is an Overseas Citizen of India Cardholder, Overseas Citizen of India Card;

(b) if he is a Tibetan refugee, registration certificate issued by a Foreigners Regional Registration Office;

(c) if he is a national of Nepal or Bhutan, passport of Nepal or Bhutan;

(d) if he is other than a Overseas Citizen of India Cardholder, Tibetan refugee or a national of Nepal or Bhutan, either an Indian visa along with foreign passport or a Long Term Visa to India along with currently valid or expired foreign passport; or

(C) Any one of the following documents, having the photograph of the beneficiary, to evidence his relationship with the parent or legal guardian, namely:

(i) Ration card;

(ii) Caste certificate or domicile certificate, issued by a Gazetted officer who is an Executive Magistrate or a revenue officer of the State Government, not below the rank of Tahsildar;

(iii) Medical or insurance identity card issued by a government entity or public sector enterprise to a retired or serving public servant or his family member;

(iv) Indian passport;

(v) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(vi) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in- charge, superintendent, child welfare officer or probation officer of such institution; or (vii) In respect of a foreign national, -

(e) if he is an Overseas Citizen of India Cardholder, Overseas Citizen of India Card;

(f) if he is a Tibetan refugee, registration certificate issued by a Foreigners Regional Registration Office;

(g) if he is a national of Nepal or Bhutan, passport of Nepal or Bhutan;

(h) if he is other than a Overseas Citizen of India Cardholder, Tibetan refugee or a national of Nepal or Bhutan, either an Indian visa along with foreign passport or a Long Term Visa to India along with currently valid or expired foreign passport; or

(viii) In respect of a beneficiary who has a legal guardian, adoption order or other document to evidence legal guardianship, which is issued by a court of law or competent authority under the Guardians and Wards Act, 1890 (No. 8 of 1890), the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (No. 44 of 1999) or the Rights of Persons with Disabilities Act, 2016 (No. 49 of 2016) and the applicable rules and regulations made under the said Acts; or

(ix) Any other document as the said Labour Department may specify.

For beneficiaries aged 18 years or more to whom an Aadhaar number has not been assigned:

(A) The acknowledgement of the beneficiary having undergone the process of enrolment, provided by the operator at the enrolment centre, containing the EID; and

(B) Any one of the following documents, having the beneficiary's photograph, namely:—

(i) Elector's Photo Identity Card issued by the Election Commission of India;

(ii) Ration card;

(iii) Caste certificate or domicile certificate, issued by a Gazetted officer who is an Executive Magistrate or a revenue officer of the State Government, not below the rank of Tahsildar;

(iv) Medical or insurance identity card issued by a government entity or public sector enterprise to a retired or serving public servant or his family member;

(v) Indian passport;

(vi) Certificate or statement of marks of matriculation or 10th class or higher secondary or 12th class, issued by a recognised board of school education;

(vii) Identity card or other identity document issued to serving or retired public servant by a government entity or a public sector enterprise;

(viii) Disability certificate issued by notified medical authority under Rights of Persons with Disabilities Rules, 2017, or Unique Disability Identification (UDID)card issued by the Department of Empowerment of Persons with Disabilities (Divyangjan), Government of India;

(ix) Driving licence issued in India:

(x) In respect of a child in need of care and protection or a child in conflict with law, who is housed by Child Care Institution registered as such with the State Government concerned under the rules made by it under the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), certificate specifying his date of birth issued by the person-in-charge, superintendent, child welfare officer or probation officer of such institution; or

(xi) In respect of a foreign national, -

(a) if he is an Overseas Citizen of India Cardholder, Overseas Citizen of India Card;

(b) if he is a Tibetan refugee, registration certificate issued by a Foreigners Regional Registration Office;

(c) if he is a national of Nepal or Bhutan, passport of Nepal or Bhutan;

(d) if he is other than a Overseas Citizen of India Cardholder, Tibetan refugee or a national of Nepal or Bhutan, either an Indian visa along with foreign passport or a Long Term Visa to India along with currently valid or expired foreign passport; or

(xii) In respect of a beneficiary who has a legal guardian, adoption order or other document to evidence legal guardianship, which is issued by a court of law or competent authority under the Guardians and Wards Act, 1890 (No. 8 of 1890), the Juvenile Justice (Care and Protection of Children) Act, 2015 (No. 2 of 2016), the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 (No. 44 of 1999) or the Rights of Persons with Disabilities Act, 2016 (No. 49 of 2016) and the applicable rules and regulations made under the said Acts; or

(xiii) Any other document as the said Labour Department (CGUOW) may specify: Annexure (4) An officer designated by the said Labour Department in this behalf shall check in respect of the documents presented or the information evidencing the contents thereof under clause (3),—

(A) the status of the enrolment request by submitting the EID on my Aadhaar portal (https://myaadhaar.uidai.gov.in/portal) to confirm that the EID is valid and that the enrolment request does not stand rejected; and

(B) the other documents, and for this purpose, may take the assistance of and share the information presented with any government entity or an authority that deals with the preparation or maintenance of the information contained in such documents.

2. In order to enable beneficiaries to avail of the said benefits conveniently, the Ministry shall make all necessary steps to ensure wide publicity through media to make the beneficiaries aware of the requirement of Aadhaar number under the said scheme.

3. Notwithstanding anything contained hereinabove,—

(A) benefit under the said scheme shall not be denied to a child—

(i) in case of failure to establish his identity by undergoing authentication or to furnish proof of possession of Aadhaar number; or

(ii) in case of production of an application for enrolment where he has not been assigned an Aadhaar number; and

(B) benefit under the said scheme shall be given to such a child by verifying his identity and establishing his relationship with his parent or legal guardian in the manner specified in the proviso to clause (3) of paragraph 1; and

(C) where benefit is given under clause (b), a record shall be maintained in respect of the same, which shall be reviewed and audited periodically by the Labour Department.

4. In order to ensure that Bonafide beneficiaries who are aged 18 years or more are not deprived of the benefit due to them under the said scheme, the Labour Department shall follow the exception handling mechanism specified in the Office Memorandum no. D-26011/04/2017-DBT, dated the 19th December, 2017 of the Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India (available on https://dbtbharat.gov.in).

5. This notification shall be effective from the date of its publication in the Official Gazette.
