Decision of the Govern ment

A. GENERAL PROCEDURE & POLICY

Under consideration 1. An expert committee should be appointed at the time of exten- sion of the present term of the Imports & Exports Control Act, which expires in 1966 , to examine the question whether the existing method by which the objectives of import control are achieved is the best available method and other questions like nationalisation of import business , creation of an auto- nomous organization for the issue of licences , auctioning of licences , participation of the trade in the distribution of licences etc.

Accepted

2. As a guiding principle , nothing of interest or relevance to the trade should be kept back from publication in the Import Trade Control Policy Book or the Hand book of Rules and Procedure on Import Trade Control and the General Licens- ing Instructions issued by the Chief Controller of Imports and Exports should indicate only thethe foreign exchange ceilings and the formula , if any , for calculating the entitlement of various categories of importers as also such other depart- mental instructions for the guidance of the licensing autho- rities with which the trade and applicants are not normally concerned .

B. ACTUAL USERS

I. Small Scale Industries

Accepted

3. The Actual Users in the small scale sector should make their applications for import licences through the sponsoring authority concerned in a revised application - cum - recom- mendation form .

Accepted

4. The monetary cellings for import of raw materials , components should be and spares earmarked for small scale industries shou allocated to the States on a prescribed basis to enable the Directors of Industries and other sponsoring authorities to fit in their unit- wise allocations within the over - all ceiling in- timated to them .

Accepted

5. The right authority to evolve a basis and to make actual State- wise allocations each year is the Development Commis- sioner, Small Scale industries . For an equitable basis , the distribution of ceilings to the States will ultimately have to be based on the installed capacity to be assessed on a uni- form basis on an all India norm by the DS ( SSI ) and the Directors of Industries jointly . So long as this is not done , an ad hoc formula is necessary which should take into account the need to maintain the tempo of industrial pro- duction already attained in different States and also the special development needs of backward areas .

Accepted

6. In the first year , the allocation of available foreign exchange should be made in proportion to the average of licences Issued to each State for the last three yearly licensing periods by taking, say Rs . 12 crores as the " core " allocation , i.e. if the allocation in 1965-66 is Rs . 12 , crores or less , the State- wise allocation may be made on the basis of a ratio arrived at by takng three years ' average . If the allocation is more than Rs . 12 crores , the first Rs . 12 crores should be allocated in the same ratio . Out of the balance , 50 % should be allo- cated to different States in the same ratio to meet the require- ments of normal growth . The remaining 50 % should be allocated keeping in view the special development needs of various States . The allocations for the subsequent years should be according to the same formula except that instead ofRs . 12 crores , the allocation of the preceding year should be taken as the ' core' figure . The Inter - State ratio , will be based on the preceding year's State- wise allocation.

7. Before the commencement of each licensing period, the DC (SSI) may issue general instructions for the guidance of the Directors of Industries about restrictions on new units in crowded sectors , priority attention to the needs of selected industries of national importance and so on .

Accepted , subject to the modification that in- stead of having a Re- stricted Industries List , as recommended by the Study Team, there will be a list of banned in- dustries whose growth is not to be encouraged .

The holders of licences valued upto Rs . 5,000/ - should be allowed to utilise their licences in one lot without any cut or endorse- ment there on for the second half year of the licensing period . However, in the case of licences valued over Rs . 5,000/ - , it may be laid down that even though a party can enter into commitment for the full amount of the licence even during the first half of the period , remittances will have to be spaced in such a way as to have 50 per cent falling in the first half and the remaining in the second half of the period .

Accepted in principle .

10. The ceilings for small scale industries should be allocated in advance in the beginning of April on the basis of the best available data at that time .

12. The new procedure for processing and disposal of applications for licences should be clearly spelt out and the role of the DC, SSI , the Directors of Industries and the licensing authorities defined in specific terms . The outline of the new procedure should be as suggested by the Study Team .

Accepted subject to the modification that in- stead of the list of res- tricted industries a8 recommended by the Study Team, there will be a list of banned in- dustries in respect of which new growth is to be discouraged.

13. A time-table should be prescribed for various stages of pro- cessing ofapplications for licences so as to finish the licensing work in the SSI sector latest by the 30th September .

23 An industrial undertaking in the scheduled sector should , for Accepted . each industry be handled by it , make consolidated applica- tions covering its annual requirements of raw materials , components and spare parts , but excluding non- ferrous and ferrous metals . The applicant should also furnish an extra copy of the list of goods applied for , which should be returned to him by the DGTD with such amendments as he may make .

24 The CCI & E's organisation may make suitable adjustment in the filing number and indexing system to mesh with the processing of import applications on the code numbers allot- ted by the DGTD to scheduled units . Accepted.

25 A delayed application received from the DGTD with his re- commendation should be accepted by the CCI & E unless the contrary is indicated by the DGTD . Accepted.

Accepted subject to the availability of foreign exchange ceiling in time.

26 A time table should be devised whereby all applications are received by DGTD by 15th May , its recommendations sent to the CCI & E by the 31st August and all licensing completed by 30th September . If foreign exchange allocation can be made earlier than 30th June , the time - table will be advanced accordingly .

27 The necessity of requiring the party to get a non - availability Accepted certificate can be entirely done away with by allowing a cer- tain percentage of the assessed requirement of an item out right and considering further import only when the DGTD is satisfied that the demand cannot be met from the indigenous sources . The list of indigenous manufacturers should be published by the DGTD in consultation with the DC , SSI , simultaneously with the Red Book .
