NOTIFICATION
New Delhi , the 12th October , 1972
S.O. 661 ( E ) . The Central Government , having considered the application for re- newal of recognition made under section 3 of the Securities Contracts ( Regulation ) Act , 1956 (42 of 1956 ) read with rule 7 of the Securities Contracts (Regulation ) Rules , 1957 , by the Madras Stock Exchange Ltd. , Madras ( hereinafter referred to as the Exchange ) , and being satisfied that it would be in the interest of the trade and also in the public interest so to do , hereby grants , in exercise of the powers conferred by section 4 of the said Act , recognition to the Exchange , under section 4 of the said Act , for a further period of five years commencing on the 15th October , 1972 , and ending with the 14th October , 1977. in respect of contracts in securities , subject to the conditions stated herein below and such other conditions as may be prescribed or imposed hereafter :
Conditions
(1) The articles of association of the Exchange shall be suitably amended to give effect to the following , namely :-
(a) the President and Vice -President of the Exchange shall be nominated by the Central Government from among those elected as members of the

Council of Management of the Exchange through the normal process of the articles of association of the Exchange ;
(b) the power of the Council of Management to constitute committees , sub- committees and standing concommittees shall be restrictedted to Arbitration Committee and Defaults Committee and that any other committee , sub- committee or standing committee may be constituted by the Council of Management only with the previous approval of the Central Govern- ment ; and
(c) the Executive Director shall have exclusive powers in matters which con- cern disciplining of trading and the members ' activities including en- forcement of articles of association , bye - laws and regulations of the Exchange in such matters .
(2) The articles of association of the Exchange shall be amended for the purposes aforesaid as early as possible but In no case later than a period of one year from the 15th October , 1972 .

का ० श्र ० 661 ( श्र) . केन्द्रीय सरकार , प्रतिभूति संविदा ( विनियमन ) नियमावली , 1957 के नियम 7 के साथ पठित, प्रतिभूति संविदा ( विनियमन ) अधिनियम, 1956 ( 1956 का 42वां ) की धारा 3 के अन्तर्गत मद्रास स्टाक एक्सचेंज लिमिटेड , मद्रास ( जिसे बाद में एक्सचेंज कहा गया है ) द्वारा मान्यता के नवीकरण के लिए दिए गए आवेदन-पत्र पर विचार करने और इस बात की तसल्ली कर लेने के बाद कि ऐसा करना व्यापार तथा लोक हित में होगा , एतद्वारा उक्त अधिनियम की धारा 4 के अन्तर्गत प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 4 के अन्तर्गत एक्सचेंज को 15 अक्टूबर , 1972 से शुरू होने वाली और 14 अक्टूबर , 1977 को समाप्त होने वाली पांच वर्ष की भग्रेतर अवधि के लिए , प्रतिभूतियों के सविदाओं के सम्बन्ध में नीचे दी गई शर्तों और एतद्भश्चात् निर्धारित की जाने वाली अथवा लगायी जाने वाली शर्तों के साथ मान्यता प्रधान करती है :
( 1 ) एक्सचेंज की अन्र्तानयमावली को समुचित रूप से संशोधित किया जायगा ताकि निम्न- लिखित को कार्यरूप दिया जा सके , अर्थात्: -
( क) एक्सचेंज के अध्यक्ष और उपाध्यक्ष को केन्द्रीय सरकार द्वारा , एक्सचेंज की अन्त- नियमावली की सामान्य प्रक्रिया द्वारा चुने गये एक्सचेंज की प्रबन्ध परिषद के सदस्यों में से नामजद किया जाएगा ;
(ख) समितियां , उप -समितियां और स्थायी समितियां गठित करने की एक्सचेंज की समिति की शक्ति मध्यस्थता समिति और बाकीदार समिति तक सीमित होगी और प्रबन्ध THE GAZETTE OF INDIA EXTRAORDINARY

परिषद द्वारा किसी अन्य समिति , उप- समिति अथवा स्थायी समिति का गठन केन्द्रीय सरकार के पूर्वानुमोदन से ही किया जाएगा , और
(ग) कार्यकारी निदेशक को उन मामलों में , जिनका सम्बन्ध व्यापार को अनुशासित करने और सदस्यों की गतिविधियों से हो , जिनमें इन मामलों में एक्सचेंज की अन्त- नियमावली, उप - नियमों और विनियमों का लागू किया जाना शामिल है , अनन्य शक्तियां प्राप्त होगीं ।
( 2 ) उपर्युक्त प्रयोजनों के लिए एक्सचेंज की अन्तनियमावली में यथासम्भव शीघ्र संशोधन कर दिए जाएंगे जो हर हालत में 15 अक्टूबर , 1972 से लेकर एक वर्ष तक की अवधि के अन्दर - अन्दर कर दिए जाएंगे ।
