NOTIFICATION
New Delhi , the 16th November 1972
S.O. 715 ( E ) . In exercise of the powers conferred by sub - section ( 4 ) of section 9 of the Banking Companies ( Acquisition and Transfer of Undertakings ) Act , 1970 ( 5 of 1970 ) , the Central Government , after consultation with the Reserve Bank , hereby makes the followingving Scheme further to amend the Nationalised Banks (Management and Miscellaneous Provisions ) Scheme , 1970 , namely :-
1. ( 1 ) This Scheme may be ca'led the Nationalised Banks ( Management and Miscellaneous Provisions ) ( Fourth Amendment ) Scheme , 1972 .
( 2) It shall come into force on the date of its publication in the Official Gazette .
2. In the Nationalised Banks ( Management and Miscellaneous Provisions ) Scheme, 1970 ( hereinafter referred to as the said Scheme ) , in clause 3 , for the Explanation to sub -clause ( g ) . the following Explanation shall be substituted , namely:-
"Explanation . For the purposes of this sub - clause , ' an official of the Reserve Bank' includes an officer of the Reserve Bank who is deputed by that Bank under section 54AA of the Reserve Bank of India Act , 1934 (2 of 1934 ) to any institu- tion referred to therein . "

3. In clause 9 of the said Scheme, in sub -clause ( 1 ) ,
(a) in the opening paragraph , for the words " for a period of three years " , the words "for such term not exceeding three years as the Central Government may specify" shall be substituted;
(b) after the proviso , the following further proviso shall be inserted, namely:-
"Provided further that no such removal shall be made except after giving a reasonable opportunity to the Director of showing cause against the proposed action" .
4. In clause 11 of the said Scheme , in sub -clause ( 5 ) , for the words " for a period of three years " , the words " for such term not exceeding three years as the Central Government may specify and shall be eligible for reappointment " shall be substituted .

एस ० प्रो ० 715 ( प्र) . बैंककारी कम्पनी ( उपक्रमों का अर्जन और अन्तरण ) अधिनियम , 1970 ( 1970 का 5 ) की धारा 9 की उपधारा ( 4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, रिजर्व बैंक से परामर्श के पश्चात्, राष्ट्रीयकृत बैंक ( प्रबन्ध और प्रकीर्ण उपबन्ध स्कीम , 1970 में भौर संशोधन करने के लिए एतद्वारा निम्नलिखित स्कीम बनाती है , अर्थात् :-
1. ( 1 ) इस स्कीम का नाम राष्ट्रीयकृत बैंक ( प्रबन्ध और प्रकीर्ण उपबन्ध ) ( चतुर्थ संशोधन ) स्कीम, 1972 होगा ।
( 2 ) यह स्कीम राजपत्र में प्रकाशन की तारीख को प्रवृत्त होगी ।
2. राष्ट्रीयकृत बैंक ( प्रबन्ध और प्रकीर्ण उपबन्ध ) स्कीम , 1970 ( जिसे इसमें इसके पश्चात् उक्त स्कीम कहा गया है ) में , खण्ड 3 में , उपखण्ड ( छ ) के स्पष्टीकरण के स्थान पर , निम्न लिखित स्पष्टीकरण प्रतिस्थापित किया जायेगा, अर्थात्:--
"स्पष्ट करण: -इस उपखण्ड के प्रयोजनों के लिए , 'रिजर्व बैंक का पदाधिकारी' के अन्तर्गत रिजर्व बैंक का ऐसा अधिकारी भी है जो भारतीय रिजर्व बैंक अधिनियम, 1934 ( 1934का 2) की धारा 54 कक के अधीन उस बैंक द्वारा उसमें निर्दिष्ट किसी संस्था में प्रतिनियुक्त किया गया है । " ।
3. उक्त स्कीम के खण्ड 9 में , उपखण्ड ( 1 ) में, -
( क ) प्रारम्भिक पैरा में , "तीन बर्ष की कालावधि के लिए " शब्दों के स्थान पर , "तीन वर्ष से अनधिक ऐसी अवधि के लिए जो केन्द्रीय सरकार द्वारा बिनिदिष्ट की जाये " शब्द प्रतिस्थापित किये जायेंगे ;

(ख) परन्तुक के पश्चात्, निम्नलिखित और परन्तुक अन्तःस्थापित किया जायेगा , अर्थात्:--
"परन्तु यह और कि ऐसी कोई हटाये जाने की कार्रवाई , प्रस्तावित कार्रवाई के विरुद्ध हेतुक दर्शित करने का निदेशक को युक्तियुक्त अवसर दिये बिना नहीं की जायेगी । " ।
4. उक्त स्कीम के खण्ड 11 में , उपखण्ड ( 5 ) में , " तीन वर्ष की कालावधि के लिए " शब्दों के स्थान पर , "तीन वर्ष से अनधिक ऐसी अवधि के लिए जो केन्द्रीय सरकार द्वारा विनिर्दिष्ट की जाय पद धारण करेगा और पुनर्नियुक्ति का पात्र होगा " शब्द प्रतिस्थापित किये आयेंगे ।
