S. 121 (E ) , In exercise of the powers conferred by sub - section ( 1 ) of section 83 of the Mines Act , 1952 ( 35 of 1952 ) the Central Government hereby exempts all mines from such provisions of the Coal Mines Regulations 1957 and the Metalliferous Mines Regulations , 1961 which require the appointment of a person holding the qualificatiors specified in column (1) of the Schedule hereto annexed subject to the condition that persons holding the qualifications specified in the corresponding entry in column (2 ) are appointed instead

Qualifications required to be possessed under Conditions of exemption -qualifications the Coal Mines Regulations , 1957 and Metallifcrous Mines Regulations , 1961 , from which exemtption is granted the which should be possessed by the person .

FOR DEGREE HOLDERS .
1. FIRST CLASS MA- NAGER'S CERTIFI- CATE .
A Dgrree in Mining or an equivalent qualification from al reco- znised University or Institution ;
A Certificate from the Head of the Institution / University which awarded the degree in mining or equivalent qualification of from the Board of Mining Examinations to the effect that he has passed the qualfying test'as detailed in the explanation given below ; and

3. At least two years service after becoming eligible for exemption from possession of a second classclass managers certificate, in a са- pacity, which accroding to the Coal Mines Regulations , 1957 or the Metalliferous Mines Regulations , 1961 , requires the possesion of a Second Class Manager / Overman /Foreman's certificate as the minimum qualification .
A. FOR DEGREE HOLDERS .
2. SECOND CLASS MANAGER'S CERTI - 1 . FICATE
A Degree in Mining or an equivalent qualification from a recog- nised University or Institution.
2. A Certificate from the Head of the Institution/ University which awarded the degree or equivalent qualification or by the Board of Mining Examinations to the effect that he has passed a gastesting cxamination conducted by the Board or University Institution as the case may be .
3. At least two years experience as a " Post- Graudate - Trainee" under the Directorate of Practical Training in Mining , or equi- valent training approved by the Board of Mining Examinations in this behalf.
B. FOR DIPLOMA HOLDERS .
1. A Diplonta/ Merit Certificate in Mining or an equivalent quali- fication from a recognised institution .
2. A Certificate from the Head of the Institution which awarded the diploma or from the Board of Mining Examinations to the effect that he has passed the qualifying test as detailed in the explanation given below .
3. At least one year's experience as a " Post - diploma - Trainee" under the Directorate of Practical Training in Mining, or equivalent training approved by the Board in this behalf or in a capacity requiring the possession of Sirdar's / Mate's certificate .
4. At least three years service as a permit manager or as an Overman/ Foreman/ Sirdar/ Mate , Shotfirer Blaster .
C. FOR POST - GRADUATE ETC.
1. A Master's degree or Doctorate in Mining obtained after a degr in Mining Engineering from a recognised University or Institut approved by the Central Government in this behalf, and ,
Post-Graduate trainee under 2. At least one year's experience as a Post - Gra the Directorate of Practical Training in Mining , or equivalent training approved by the Board in this behalf.
3. MANAGER'S PER- MIT .
1. A Degree or Diploma in Mining or an equivalent qualificatior from a recognised Institution / University .
2. At least one ycar's experience in any capacity requiring the po- ssession of a certificate of competence other then Gastesting and Winding Engine driver's certificate or as a Post- graduate or Post- Diploma - traince under the Directorate of Practical Training in Mining or equivalent training approved by the Board of Mining Examinations in this behalf.
1. A Degree in Mining or an equivalent qualification from a re- cognised University or Institution . OR
4. OVERMAN'S / FORE- MAN'S / SIRDAR'S ' MATE'S AND SHOT- FIRER'S / BLASTER'S CERTIFICATE . I. A Diploma /Merit certificate in Mining or an equivalent qua- lification from a recognised Institution.

2. At least one year's experience as a " Post Diploma - trainee " under the Directorate of Practical Training in Mining , or in a ca- pacity requiring the possession of Sirdar's / Mate's or Shotfirer's / Blasters Certificate .
5. SURVEYOR'S CERTIFICATE .
1. A degree in mining or an equivalent qualification from a recoo- nised Institution , and
2. At least six month's experience in Surveying in a mine .
OR
2. A diploma/ Merit certificate in mining or an equivalent quali- fication from a recognised Institution , and
2. At least one year's experience in Surveying in a mine .
PROVISOS
All the foregoing requirements will be subject to the following conditions and exceptions :-
1. In order to be eligible for appointment in any capacity in coal mines having workings below round at least 6 months out of the total experience specified in the foregoing clauses shall be in coal mines having workings belowground and similary for appointment in any capacity in metalliferous mines having workings belowground , at least six months such experience shall be in metalliferous mincs having workings belowground .
2. In order to be eligible for appointment as manager of a first class ' a second class or a permit mine , having workings belowground, the experience referred to in proviso I shall be in the following capacity:
(a) for appointment as manager of first class mine the experience shall be gained in a subordinate capacity which according to the Coal Mines Regulations , 1957 , or the Metalliferous Mines Regulations , 1961 , requires the possession of a second class manager's certificate of competency as the minimum qualification .
appointm (b) for appointment as manager of a second class mine the experience shall be gained in a subordinate capacity which according to the Coal Mines Regulations , 1957 or the Metal- liferous Mines Regulations , 1961 , requires the possession of an Overman's Foreman's certificate of competency as the minimum qualification .
(c) for appointment as manager of a permit mine the experience shall be gained in a capacity which according to the Coal Mines Regulations 1957 , or the Metalliferous Mines Regu- lations , 1961 , requires the possession of a Sirdar's Mate's Certificate as minimum qualification .
3. In order to be eligible for appointment as surveyor of any mine having workings belogw ground at least six months of experience in surveying shall be obtained in the workings below ground of a mine of the type ( Coal or metalliferous ) for which the exemp- tion is sought .
EXPLANATION . 1. Qualifying test for both degree and diploma holders referred to above means an examination conducted by the Institution /Uni- versity which awarded the degree or diploma , as the case may be, by appointing two External Examiners or by the Board of Mining Examinations constituted under the Coal Mines Regu- lations , 1957, or the Metalliferous Mines Regulations , 1961 in the following two subjects each having one paper :-
(a) Winning and Working inc.uding assessment of candidate's ability to test for gas , and
(b) Mine Management , Legislation and General Safety- each paper having two parts , written and oral , wherein a candidate has to secure at least 50 % of the marks in the aggregate and at least 40 % marks in each part to pass the test .

The external examination for both degree and diploma holders for the purpose of qualifying test referred to above would be appointed on the recommendations of the Board of Mining - Examinations .
For the purpose of these exemptions :-
(i) Degree in Mining means the degree approved by the Centra- Government for the purpose of the proviso to sub - regula- tion ( 1 ) of Regulation 16 of Coal Mines Regulations , 1957, or for proviso (a) to sub - regulation ( 1 ) of Regulation 16 of Metalliferous Mines Regulations 1961 ;
( ii) Diploma in Mining means the diploma approved by the Central Government for the purpose of clause ( a ) of Noti- fication No. S.O. 2361 dated 23rd July , 1962 , in respect of Coal Mines or approved for the purpose of Regulation 18 ( 1) of the Metalliferous Mines Regulations , 1961 .

का ० श्र ०721 ( श्र ) .खान अधिनियम , 1952 ( 1952 का 35) की धारा 83की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा कोयला खान विनियम, 1957 और धातुत्पादक खान विनियम , 1961 के उन उपबन्धों को सभी खानों में लागू न होने की छूट देती है जिनके अनुमार निम्नलिखित अनुसूची के स्तम्भ ( 1 ) में णित योग्यता वाले व्यक्तियों की नियुक्ति अपेक्षित है , इस शर्त के अध्यधीन कि स्तंभ ( 2 ) में की तत्स्थानी प्रविष्टियों में विनिर्दिष्ट अर्हताएं वाले व्यक्ति नियुक्त किए जाएं ।
अनसूची
कोयला खान विनियम , 1957 तथा व्यक्ति की योग्यता जिस पर छूट की शर्त मंजूर की जा सकती है ।

1. प्रथम वर्ग प्रबंधक प्रमाणपत्र । डिग्री प्राप्त व्यक्तियों के लिए
1. किसी भी मान्यताप्राप्त विश्वविद्यालय या संस्थान से खनन में डिग्री या सम्तुल्य योग्यता;

2. जिस विश्वविद्यालय / संस्थान ने खनन में डिग्री या समतुल्य योग्यता प्रदान की हो उसके अध्यक्ष या खनन परीक्षा बोर्ड से इस आशय का प्रमाणपत्र कि परीक्षार्थी ने निम्नलिखित स्पष्टीकरण के अनुरूप अर्हक परीक्षण उत्तीर्ण कर लिया है ; तथा
3. द्वितीय वर्ग प्रबंधक प्रमाणपत्त्र न रखने की योग्यता से छूट प्राप्त करने के पात्र होने के बाद कम से कम वी वर्षों तक ऐसी हैसियत में काम करने का अनुभव जिसके लिए कोयला खान विनियम , 1957 या धातूत्पादक खान विनियम , 1961 के अनुसार द्वितीय वर्ग प्रबंधक/ श्रओभरमैन/ फोरमैन/ प्रमाणपत्र की न्यूनतम योग्यता अपेक्षित हो ।
2. द्वितीय वर्ग प्रबंधक प्रमाणपत्र ।
क. डिग्री प्राप्त व्यक्तियों के लिए
1. किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से खनन में डिग्री या समतुल्य योग्यता ।
2. जिस संस्थान/ विश्वविद्यालय ने डिग्री या समतुल्य अर्हता प्रदान की हो उसके अध्यक्ष से या खनन परीक्षा बोर्ड से इस आशय का प्रमाणपत्र कि उसने यथास्थिति बोर्ड या विश्वविद्यालय/ संस्थान द्वारा ली गई गैस परीक्षण परीक्षा उत्तीर्ण कर ली है ।
3. खनन में व्यावहारिक प्रशिक्षण के निदेशालय से कम से कम दो वर्षों के "स्नातकोत्तर शिक्षु" के रूप में अनुभव या इम निमित्त खनन परीक्षा बोर्ड द्वारा श्रनुमोदित समतुल्य प्रशिक्षण ।
ख . डिप्लोमा प्राप्त व्यक्तियों के लिए
1. किसी मान्यता प्राप्त संस्थान से खनन में डिप्लोमा/ मैरिट प्रमाण पत्र या समतुल्य योग्यता ।
2. जिस संस्थान ने डिप्लोमा प्रदान किया है उसके अध्यक्ष से या खनन परीक्षा बोर्ड से इस आशय का प्रमाणपत्र कि उसने निम्नलिखित स्पष्टीकरण के अनुरूप अर्हक परीक्षण उत्तीर्ण कर लिया है ।
3. खनन में व्यावहारिक प्रशिक्षण के निदेशालय के अधीन कम से कम एक वर्ष का " डिप्लोमा के पश्चात् शिक्षु" के रूप में अनुभव या इस निमित्त बोर्ड द्वारा अनुमोदित समतुल्य प्रशिक्षण या ऐसी हैसियत में काम का अनुभव जिसमें सरदार/ मैट के प्रमाणपत्र अपेक्षित हो ।

4. अनुज्ञापन प्रबंधक के रूप में या ओभरमैन/फोरमैन/ मरदार/मेट , शाटफायरर / ब्लास्टर के रूप में कम से कम तीन वर्ष की सेवा
ग . स्नातकोत्तर आदि योग्यता प्राप्त व्यक्तियों के लिए
1. किसी मान्यता प्राप्त विश्वविद्यालय या केन्द्रीय सरकार द्वारा इस निमित्त अनुमोदित किसी संस्थान से खनन इंजीनियरिंग में डिग्री प्राप्त करने के पश्चात्, खनन में मास्टर की डिग्री या डाक्टरेट की उपाधि , तथा
2. खनन में व्यावहारिक प्रशिक्षण के निदेशालय के अधीन कम से कम एक वर्ष का स्नातकोत्तर शिक्षु के रूप में अनुभव या इस निमित्त बोर्ड द्वारा अनुमोदित समतुल्य प्रशिक्षण ।
3. अनुज्ञापत्न प्रबंधक
1. किसी मान्यताप्राप्त संस्थान/ विश्वविद्यालय से य में डिग्री या डिप्लोमा या समतुल्य योग्यता ।
2. जिस पद के लिए गैस परीक्षण तथा वाईन्डिग इंजिन चालक प्रमाणपत्त्र को छोड़कर अन्य सक्षमता प्रमाणपत्न की योग्यता अपेक्षित हो , ऐसी किसी हैसियत में कम से कम एक वर्ष का अनुभव या खनन में व्यावहारिक प्रशिक्षण के निदेशालय के अधीन कम से कम एक वर्ष का स्नातकोत्तर या डिप्लोमा के पश्चात् शिक्षु या खनन परीक्षा बोर्ड द्वारा इस निमित्त अनुमोदित समतुल्य प्रशिक्षण ।
1. किसी भी मान्यता प्राप्त विश्वविद्यालय या संस्थान में खनन में डिग्री या समतुल्य योग्यता या
4. श्रोभरमैन/फोरमैन/ सरदार/मेट तथा शाटफायरर / ब्लास्टर का प्रमाण पत्र 1
किसी भी मान्यता प्राप्त संस्थान से खनन में डिफ्लोमा/ मेरिट प्रमाण पत्र या समतुल्य योग्यता ।
2. खनन में व्यावहारिक प्रक्षिक्षण के निदेशालय के अधीन " डिप्लोमा के पश्चात् णिक्षु" के रूप में कम से कम एक वर्ष का अनुभव या ऐसी हैसियत में, जिसमें सरदार/ मेट या शाटफायरर/ ब्लास्टर प्रमाण- पत्न अपेक्षित हो , अनुभव ।
5. मर्वेक्षक प्रमाणपत्र
1. किसी भी मान्यता प्राप्त संस्थान से खनन में डिग्री या समतूल्य योग्यता , तथा SEC . 3 ( ii ) ]

2. किमी खान में सर्वेक्षक का कम से कम छह महीनों का अनुभव ।
या
1. किसी भी मान्यता प्राप्त संस्थान से खनन में डिप्लोमा/ मेरिट प्रमाणपत्त्र या समतुल्य योग्यता , तथा
2. किमी भी खान में सर्वेक्षक का कम से कम एक वर्ष का अनुभत्र ।
परम्तुक
पूर्ववर्ती सभी अपेक्षाएं निम्नलिखित शर्तों और अपवादों के अध्यधीन लागू होंगी : --
1. भूमि के नीचे कर्मस्थल वाली कोयला खान में किसी भी पद पर नियुक्ति के लिए पूर्वत्रर्ती खण्डों में विनिर्दिष्ट पूर्ण अनुभव के कम से कम 6 मास ऐसे कोयला खान में होंगे जहां भूमि के नीचे खनन में होंगे जहां भूमि के नीचे खनन होता हो, और इसी प्रकार किमी धातु उत्पादक खान में किमी भी पद पर नियुक्ति के लिये कम से कम 6 मास ऐसे धातूत्पादक खान में होंगे जहां भूमि के नीचे खनन होता हो ।
2. भूमि के नीचे खनन करने वाले प्रथम वर्ग , द्वितीय वर्ग या अनुज्ञापत्त्र खान में प्रबंधक के पद पर नियुक्ति का पात्न होने के लिए परन्तुक ( 1 ) में निर्दिष्ट अनुभव निम्नलिखित पदों पर काम करने का होगा :-
(क) प्रथम वर्ग खान के प्रबंधक की नियुक्ति के लि ऐसे अधीनस्थ पद पर कार्य करने का अनुभव प्राप्त करना होगा जिसके लिए कोयला खान विनियम , 1957 या धातूत्पादक खान विनियम , 1961 के अनुसार सक्षमता का द्वितीय वर्ग प्रबंधक प्रमाणपत्त्र न्यूनतम योग्यता के रूप में होना अपेक्षित हो ।
(ख ) द्वितीय वर्ग खान के प्रबंधक की नियुक्ति के लिए वैमे अधीनस्थ पद पर कार्य करने का अनुभब प्राप्त करना होगा जिस के लिए कोयला खान विनियम, 1957 या धातूत्पादक खान विनियम , 1961 के अनुसार ओभरमैन/ फोरमैन का मक्षमता का प्रमाणपत्र न्यूनतम योग्यता के रूप में अपेक्षत हो ।

( ग ) अनुज्ञापन खान के प्रबंधक की नियुक्ति के लिए वैसे पद पर कार्य करने का अनुभव प्राप्त करना होगा जिसके लिए कोयला खान विनियम, 1957 या धातूत्पादक खान विनियम , 1961 के अनुसार 'सरकार/मेट का प्रमाणपत्त्र न्यूनतम योग्यता के रूप में अपेक्षित हो ।
3. किसी भी भूमि के नीचे खनन करने वाली खान में सर्वेक्षक के पद पर नियुक्ति के पात्र होने के लिए उसी प्रकार की ( कोयला या धातुत्पादक ) खान में , जिसके लिए छूट मांगी गई हो , में भूमि के नीचे खनन करने बाली खान का कम से कम छह मास का सर्वेक्षक का अनुभव होगा ।
स्पष्टीकरण
1. डिग्री या डिप्लोमा देने के लिए उपर्युक्त दणित श्रईंक परीक्षा का अर्थ वैसी परीक्षा से है जिसमें यथास्थिति डिग्री या डिप्लोमा प्रदान करने वाले संस्थान/विश्व- विद्यालय ने दो बाह्य परीक्षक नियुक्त किए हों या कोयला ब्रान विनियम , 1957 या धातूल्पादक खान विनियम , 1961 के अन्तर्गत गठित खनन परीक्षा बोर्ड द्वारा ली गई निम्नलिखित दो विषयों की परीक्षा , जिसमें प्रत्येक विषय में एक प्रश्नपत्र होगा :----
(क) खनन कार्य प्रणाली तथा परीक्षार्थी के गैस परीक्षण की योग्यता का मूल्यांकन तथा
(ख ) खान व्यवस्था, विधान और सामान्य सुरक्षा- प्रत्येक प्रश्नपत्न' के दो भाग , लिखित और मौखिक होंगे जिनमें से अभ्यार्थी को पूर्णांक के कम से कम 50 प्रतिशत अंक और प्रत्येक भाग में 40 प्रतिशत अंक उत्तीर्ण होने के लिए प्राप्त करने होंगे ।
डिग्री और डिप्लोमा दोनों प्राप्त करने के लिए उपर्युक्त निर्दिष्ट अर्हक परीक्षण के प्रपोज- नार्थ वा य परीक्षक , खनन परीक्षा बार्ड की सिफारिशों पर नियुक्त किए जाएंगे :

2. इन छूटों के लिए
(1) खनन् की डिग्री का अर्थ उस डिग्री से है जिसे केन्द्रीय सरकार ने कोयला खान विनियम , 1957 के विनियम16 के उप - विनियम ( 1 ) तथा धातूत्पादक ब्रान विनियम 1961 के विनियम 16 के उप- विनियम ( 1 ) के उपबन्ध ( क ) के प्रयोजनार्थ अनुमोदित किया हो ।
( 2 ) खनन डिप्लोमा का अर्थ उस डिप्लोमा से है जिसे केन्द्रीय सरकार ने कोयला खान के विषय में अधिसूचरा सं ० का ० श्रा ० 2361 तारीख 23 जुलाई 1962 के खण्ड ( क ) के प्रयोजनार्थ अनुमोदित किया हो या धातूत्पादक खान विनियम, 1961 के विनियम 18 ( 1 ) के प्रयोज- नार्थ अनुमोदित किया हो ।
