GOLD CONTROL
Naw Delhi , the 27th December 1972
S.O. (764 (E)-In exercise of the powers conferred by section 114 , read with sub-section (6) of section 27 , of the Gold ( Control ) Act, 1968 ( 45 of 1968 ) , the Central Govern- ment hereby makes the following rules to amend the Gold Control (Licensing of Dealers ) Rules . 1969 , namely :-
1. ( 1 ) These rules may be called the Gold Control (Licensing of Dealers ) Amendment Rules, 1972 .
(2) They shau come into force on the date of their publication in the Official Gazette .
2. In the Gold Control ( Licensing of Dealers ) Rules , 1969 (hereinafter referred to as the said rules) , in rule 2-
(a) after clause ( d) , the following clause shall be inserted , namely :-
" (dd) whether the applicant is a person who does not hold a valid licence to carry on business as a licensed dealer in his name or is a person who is not a part- ner of a firm which holds such licence;" ;

(b) to clause ( f) , the following proviso shall be added, namely :-
"Provided that nothing contained in this clause shall apply to an application for the issue of licence made by-
(a) ] a co- operative society, all the members of which are certified goldsmiths
(b) a certified goldsmith whose financial condition and educational backgroind are such that there are reasonable grounds to believe that he would bethat he would be able to discharge properly his obimations and functions as a Ncensed dealer and who in the opinion of the Administrator , would not be able to Lindle , without the aid of a paid employee , a turnover larger than the turnover re- corded in his entry book in the two calendar years immediately preceding the year in which the application is made ;
(c) A personerson who desires to export out of India articles or ornaments , or both , and who , having regard to his antecedents and experience in the export of goods out of India , is found by the Administrator . after making such en- quiry, if any , as he may consider necessary , to be suitable for grant of a licence, and who undertakes during a full calendar year after the grant of the licence, to sell only to persons outside India, articles , or ornaments , or both-
(i) the net total value of which is not less than one lakh rupees and
(ii ) the total net gold content of which is not less than the equivalent of one thousand grammes of pure gold ,
save that where any articles or ornaments , or both , are rejected by the per- son outside India on account of defect in manufacture or of quality , the person granted a licence under this proviso may sell such gold to other licensed dealers so, however , that the total pure gold content of the articles , or ornaments , or both , thus sold to other licensed dealers shall not be more than ten per cent of the total pure gold content of the articles or ornaments or both, sold to persons outside India .
Explanation I. For the purposes of item (a ) of this proviso , a co- operative society means a co - operative Society registered under the law relating to co - operative societies in force in any State.
Explanation II. For the purposes of item (b ) of this proviso , a turnover not exceeding five thousand grammes per annum , on the average , shall be deemed to be a turnover which a certified goldsmith will be able to handle without the aid of a paid employee ." .
3. In rule 3 of the said rules-
(i) after cla ase ( e ) , the following clause shall be inserted , nanely :-
"(ee) that the turnover of the applicant in the twelve months immediately pre- coding the date of application for rene val of the licence was too low;";
Explanation . For the purposes of this clause , low turnover means a turnover which is on the average , not more than fifty grammes per month except where the applicant satisfieds the Administrator that there are sufficient reasons for an average monthly turnover of lower than fifty grammes ." ;
(ii) after clause ( f) , the following clause shall be inserted , namely :-
"(g) that the applicant , if he was granted a licence unit item (c ) of the proviso to clause ( f) of rule 2, has not committed any breach or failure in the per- formance of any part of the conditions specified in the Bond executed by him ."

फा० प्रा ० 764 ( प्र) -स्वर्ण ( नियंत्रण ) अधिनियम , 1968 ( 1968 का 45 ) की , धारा 27 की उपधारा ( 6 ) के साथ पठित , धारा 114 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , स्वण नियंत्रण ( व्यवहारियों का अनुज्ञापन ) नियम, 1969 में संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्: --
1. ( 1 ) इन नियमों का नाम स्वर्ण नियंत्रण ( व्यवहारियों का अनुज्ञापन ) संशोधन नियम , 1972 है ।
( 2 ) ये नियम राजपत्नत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. स्वर्ण नियंत्रण ( व्यवहारियों का अनुज्ञापन ) नियम , 1969 ( जिसे इसमें इसके पश्चात् उक्त नियमों कहा गया है ) में , नियम 2 में ,
(क) खंड ( घ ) के पश्चात् निम्नलिखित खंड अन्तःस्थापित किया जाएगा , अर्थात्:-
" ( षध) क्या आवेदक ऐसा व्यक्ति है जिसके पास अनुज्ञप्त व्यवहारी के रूप में कारबार करने के लिए अपने नाम में विधिमान्य श्रनुज्ञप्ति नहीं है या वह ऐसा व्यक्ति है जो किसी ऐसी फर्म का भागीदार नहीं है जिसके पास ऐसी अनुज्ञप्ति है; ":
(ख) खंड ( च) के साथ निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात्: --
"परन्तु इस खंड में अन्तर्विष्ट कोई भी बात अनुज्ञप्ति जारी करने के लिए निम्नलिखित द्वारा किए गए आवेवन को लागू नहीं होगी:--
( क ) सहकारी सोसाइटी , जिसके सभी सदस्य प्रमाणित स्वर्णकार हैं ;
(ख ) प्रमाणित स्वर्णकार जिसकी वित्तीय दशा और शैक्षिक आधार ऐसे जहां यह विश्वास करने के युक्तियुक्त आधार हैं कि वह , अनुज्ञप्त व्यवहारी के रूप में में अपनी बाध्यताओं और कृत्यों का उचित रूप से निर्वहन कर सकेगा और जो, प्रशासक की राय में , सवेतन कर्मचारी की सहायता के बिना , उस आवर्त से अधिक आवर्त में व्यवहार नहीं कर सकेगा जो उस वर्ष के ठीक पूर्ववर्ती वो कलैण्डर वर्षों में जिसमें आवेदन किया गया है , उसकी प्रविष्टि पुस्तक में अभिलिखित है ;
( ग) व्यक्ति जो वस्तुओं या आभूषणों, या दोनों का भारत से बाहर निर्यात करना चाहता है , और जो, भारत से बाहर माल के निर्यात करने में अपने पूर्ववृत और अनुभव के आधार पर , प्रशासक द्वारा , ऐसी जांच , यदि कोई हो , करने के पश्चात्, जैसी कि वह श्रावश्यक समझे, किसी अनुज्ञप्ति की मंजूरी के लिए उपयुक्त पाया गया है , और जो , अनुज्ञप्ति की मंजूरी के पश्चात् किसी पूरे कलैण्डर वर्ष के [PART II- THE GAZETTE OF INDIA EXTRAORDINARY

दौरान ऐसी वस्तुओं , या श्राभूषणों , या दोनों को भारत से बाहर के व्यक्तियों को बेचने का बचनबंध करता है
(1 ) जिनका शुद्ध कुल मूल्य एक लाख रुपए से कम नहीं है और
( ।। ) जिनकी कुल शुद्ध स्वर्ण मात्रा एक हजार ग्राम शुद्ध स्वर्ण के समतुल्य से कम नहीं है,
तथापि जहां कोई वस्तु या श्रभूषण , या दोनों भारत से बाहर के व्यक्ति द्वारा विनिर्माण में त्रुटि या क्वालिटी के कारण नामंजूर कर दिए गए हों यहां ऐसा व्यक्ति , जिसको इस परन्तुक के अधीन अनुज्ञप्ति मंजूर की गई है, ऐसे स्वर्ण को अन्य अनुज्ञप्ति व्यवहारियों को बेच सकेगा, किन्तु अन्य अनुज्ञप्त व्यव- हारियों को इस प्रकार बेची गई बस्तुश्रों, या आभूषणों, या दोनों की कुल शुद्ध स्वर्ण मात्रा भारत से बाहर के व्यक्तियों को बेची गई वस्तुओं , या आभूषणों, या दोनों की कुल शुद्ध स्वर्ण मात्रा के दस प्रतिशत से अधिक नहीं होगी ।
स्पष्टीकरण 1.--इस परन्तुक की मद ( क ) के प्रयोजनों के लिए , सहकारी सोसाइटी से किसी राज्य में प्रक्त सहकारी सोसाइटियों से सम्बन्धित विधि के अधीन रजिस्ट्रीकृत सहकारी सोसाइटी अभिप्रेत है ।
स्पष्टीकरण 2 .-- इस परन्तुक की मद (ख ) के प्रयोजनों के लिए , औसतन पांच हजार ग्राभ प्रति वर्ष से अनधिक श्रावर्त ऐसा आवर्त समआ जाएगा जिसमें प्रमाणित स्वर्णकार किसी सबैतन कर्मचारी की सहायता के बिना व्यवहार कर सकेगा । "
3-- उक्त नियमों के नियम 3 में,--
(1 ) खंड ( ३० ) के पश्चात्, निम्नलिखित खंड अन्तःस्थापित किया जाएगा, अर्थात्:--
"(ड ०४० ) अनुज्ञप्ति के नवीकरण के लिए आवेदन की तारीख से ठीक पूर्ववर्ती बारह मास में आवेदक का आवर्त बहुत कम था ;
स्पष्टीकरण. इस खंड के प्रयोजनों के लिए , कम श्रावर्त से ऐसा भावर्त अभिप्रेत है जो भौसतन पचास ग्राम प्रतिमास से, उस दशा के सिवाय , अधिक नहीं है जहां आवेदक प्रशासक का यह समाधान कर देता है कि पचास ग्राम से कम भौसत मासिक प्रावर्त के लिए पर्याप्त कारण मौजूद हैं । " ;
(11 ) खंड ( च) के पश्चात्, निम्नलिखित खंड मन्तःस्थापित किया आएगा, श्रर्थात्:-
" (छ ) यदि प्रावेदक को नियम 2 के खंड ( च ) के परन्तुक की मद ( ग ) के अधीन कोई अनुज्ञप्ति मंजूर की गई थी , तो उसने अपने द्वारा निष्पावित बन्धपत्र में विनिदिष्ट शर्तों के किसी भाग का कोई भंग नहीं किया है या वह उसका अनु- पालन करने में असफल नहीं रहा है । " ।

S.O. 765 (E ) -In exercise of the powers conferred by section 114 of the Gold (Control ) Act, 1968 (45 of 1968 ) , the Central Government hereby makes the following rules further to amend the Gold Control ( Forms , Fees and Miscellaneous Matters ) Rules , 1968 , namely :T 1. ( 1 ) These rules may be called the Gold Control (Forms , Fees and Miscellaneous Mat- t ers) Amendment Rules , 1972 .
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In rule 5 of the Gold Control (Forms , Fees and Miscellaneous Matters ) Rules , 1968 ) (hereinafter referred to as the said rules ) :-
(a) in sub - rule ( 2 ) , to clause ( i ) , the following proviso shall be added , namely :-
"Provided that an application referred to in section 27 for grant of 1 coт се for the sale of articles , or ornaments , or both , to persons outside India shall be in form No. G.S. 6A . "
(b) in sub - rule (3 ) , in clause ( i ) , for the word , letters and figure " form No. G. S. 6 " the words , letters and figures " form No. G.S. 6 or form No. G.S. 6A, as the case may be shall be substituted .
3. To rule 6 of the said rules , in sub - rule ( 1 ) , for the words , letters and figure " in form No. G.S. 8 " , the following shall be substituted , namely :-
"where the articles , or ornaments , or both are to be sold within India , in form No. G.S. 8, and where the articles , or ornaments , or both , are to be sold only to persons outside India , in form No. G.S. 8A . "
4. After rule 15 of the said rules , the following rule shall be inserted . namely ;
" 15A . Bond to be executed in certain cases . Every person who is granted a licence under section 27 in form No. G.S. 8A to export out of India articles , or orname nta , or both , shall at the time of grant of such licence , execute a Bond form No. G.S. 24."
5. In the Appendix to the said rules-
(a) after form No. G.S. 6 , the following form shall be inserted , namely :-

4. This licence may be cancelled , or suspended , or its renewal may be refused , in accordance with the provisions of the Gold (Control ) Act , 1968 (45 of 1968) .
5. The grant of this licence shall be without prejudice to the rights of any other persons over the licensed business or the licensed premises to which such person may be entitled under any other law .

(ii) the total net gold content of which is not less than the equivalent of one thousand grammes of gold of 24 carat purity ( hereinafter referred to as pure gold ) ;
(b) that where anyany articles , or ornaments , or both , are rejected by the person outside India on account of defect in manufacture or of quality , they shall be disposed of in accordance with the provisions of the Gold ( Control ) Act , 1968 (45 of 1968 ) , and where such gold has to be sold, the same shall be sold only to other licensed dealers and the total pure gol d content of the articles , or ornaments , or both , thus sold shall not exceed ten per cent . by weight of the total pure gold content of the articles , or ornaments , or both, sold to the persons outside India .
If the conditions mentioned above are complied with , this obligation shall be vold . Other- wise, and on breach or failure in the performance of any part of this condition , the same shall be in full force .
And the President of India , shall , at his option , be competent to forfelt the amount of the guarantee deposit. I / We declare that this Bond is given undernder the orders of the Central Govern- ment for the performance of an act in which the public are interested.

2. स्वर्ण नियंत्रण ( प्ररूप , फीस और प्रकीर्ण विषय ) नियम, 1928 ( जिसे इसमे इसके पश्चात्उक्त नियमों कहा गया है ) के नियम 5 में,--
(क) उप-नियम ( 2 ) में, खण्ड ( 1 ) के साथ निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थात्ः- "परन्तु भारत से बाहर के व्यक्तियों को वस्तुओं, या आभूषणों या दोनों के विक्रय के लिए अनुज्ञप्ति की मंजूरी के लिए धारा 27 में निर्दिष्ट आवेदन प्ररूप सूं जी ० एस ० 6क में होगा " ;
( ख ) उप - नियम ( 3 ) में , खण्ड ( i ) में , " प्ररूप सं ० जी ० एस ० 6" शब्द अक्षरों और अंक के स्थान पर , " यथास्थित , प्ररूप से जी ० एस ० 6 या प्ररूप सं ० जी एस ० 6क " शब्द, अक्षर और अंक प्रतिस्थापित किए जाऐंगे ।
3. उक्त नियमों के नियम 6में , उपनियम ( 1 ) में , " प्ररूप" सं ० जी ० एस ०४ में" शब्दों, अक्षरों और अंकों के स्थान पर , निम्नलिखित प्रतिस्थापित किया जाएगा ; अर्थात्: --
"जहां वस्तुओं , या आभूषणों , या दोनों का भारत में विक्रय किया जाना हो वहां प्ररूप सं ० जी० एस ० 8 में , और जहां वस्तुओं, या आभूषणों या दोनों का केवल भारत से बाहर के व्यक्तियों को विक्रय किया जाना हो वहां प्ररूप सं ० जी ० एस ० 8 क में " ।
4. उक्त नियमों के नियम 15 के पश्चात्, निम्नलिखित नियम अन्त: स्थापित किया जाएगा , अर्थात्: --
" 15 क-कतिपय मामलों में निष्पादित किया जाने वाला बन्धपत्र- एसा प्रत्येक व्यक्ति जिसको वस्तुनों, आभूषणों या दोनों क भारत से बाहर निर्यात करने के लिए प्ररूप सं ० जी ० एस ० 8 क में धारा 27 के अधीन अनुज्ञप्ति मंजूर की गई है ऐसी अनुज्ञप्ति की मंजूरी के समय , प्ररूप सं ० जी ० नस ० 24 में बन्धपत्र निष्पादित करेगा " 5. उक्त नियमों के परिशिष्ट में, --
(क) प्ररूप सं ० जी ० एस ० 6 के पश्चात् निम्नलिखित प्ररूप अन्तःस्थापित किया जाएगा, अर्थात्: -

2. में/ हम एतद्वारा घोषणा करता हूं / करते हैं कि स्वर्ण में व्यवहार करने से सम्बधित परिसर की विशिष्टिषयां वे हैं जो नीचे की अनसूची में विनिदिष्टि की गई हैं ।
3. में/ इम स्त्रर्ण ( नियंत्रण ) अधिनियम , 1968 ( 1968 का 45) के उपबंधों और उसके अधीन जारी कि गये नियमों, आदेशों और निदेशों तथा ऐसी अनुज्ञप्ति के निबन्धनों और शर्तों को पालन करने के लिए महनत हूं / हैं जो मंजूर/ नवीकृत की जाए , और यह भी बचनबध करता हूं/ करते हैं अनुज्ञप्ति की मंजूरो के पश्चात किसी पूरे कलन्डर वर्ष के दौरान , हम केवल भारत से बाहर के व्यक्तियों को एसी वस्तुओं या आभूषणों या दोनों का विक्रय द्वारा व्ययन करूगा/ करेगे , :-
( 1 ) जिनका शुद्ध कुल मल्य एक लाख रुपये से कम नहीं है , और
( 11 ) जिनकी कुल शुद्ध स्वर्ण मात्रा एक हजार ग्राम शुद्ध स्वर्ण के समतुल्य से कम नहीं है,
तथापि जहां कोई वस्तु या आभूषण , या दोनों भारत से बाहर के व्यक्ति द्वारा विनिर्माण में त्रुटि या क्वालिटि के कारण नामंजूर कर दिये गये हों वहां में/ हम उनका व्ययन स्वर्ण ( नियंत्रण ) अधिनियम , 1968 ( 1968 का 45 ) के उपबन्धों के अनुसार करूंगा /करेंगे , और जहां एसे स्वर्ण का विक्रय किया जाना हो वहां वह केवल अन्य अनुज्ञप्त व्यवहारियों को बेचा जाएगा , और इस प्रका र बेची गई वस्तुओं या आभषणों , या दोनों की कुल स्वर्ण मात्रा भारत से बाहर के व्यक्तियों को बेची गई वस्तुओं, या आभुषणों , या दोनों की कुल शुद्ध मात्रा के दस प्रतिशत से अधिक नहीं होगी ।
4. मैंने/ हमने-- रुपए अनुज्ञप्ति/ नवीकरण फीस के संदाय में खजाना चालान संलग्न कर दिया है ।
5. में / हम एतद्वारा घोषणा करता हूं / करते हैं कि मेरे हमारे द्वारा पहले धारित कोई भी अनुज्ञप्त ऐसी नहीं है, जो भारत रक्षा नियम , 1962 के भाग 12 क, या स्वर्ण ( नियंत्रण अध्यादेश ) , 1968 ( 1968 का 6 ) या स्वर्ण ( नियंत्रण ) अधिनियम, 1968 ( 1968 का 45 ) के किसी उपबन्ध या उसके अधीन जारी किए गए नियमों , आदेशों या निर्देशों के भग की वजह से , प्रतिसंह त या निलम्बित की गई हो, या वह नवीकृत नहीं की जा सकती ।

स्थित उचित 7. में / हमके काबार में भी भागीडदार हूं / हैं या उसमें बित्तीय हित रखता हूं / रखते हैं । इस कारबार बाबत की अनज्ञप्ति ( यों ) के लिए अधिकारी को अलग से आवेदन किया जाएगा / किए जाऐंगे ।
8 मैंने/ हमने भारत से बाहर माल के निर्यात के सम्बन्ध में अपने पिछले अनुभव के सबूत में अपने द्वारा किये गये संव्यवहारों की दूरी विशिष्टिय । इसके साथ संलग्न कर दी हैं ।

13. कुल शुद्ध स्वैण माता के समतुल्य शुद्ध स्वर्ण कां भार , और निम्नलिखित को विक्रय द्वारा व्ययनित स्वर्ण का मूल्य--

: 1 , सभी प्रकार का स्वर्ण , उसकी शुद्धता और रूप थाहे कोई भी हो, आवेदन में सम्मिलित किया जाना चाहिए ।
2. यदि आवेदन, अनुज्ञप्ति जारी करने के लिए किया गया हो तो भारत से बाहर माल के निर्यात के लिए किए गए संभ्यवहारों की पूरी विशिष्टियों संलग्न की आनी चाहिए ।
3. स्वर्ण की शुद्धता कैरेटों । ( शतप्रतिशत शुद्धता 24 कैरट है ) या शुद्धता प्रति मिले के रूप में व्यक्त की जाना चाहिए । स्वर्ण की प्रत्येक वस्तु का वर्णन , भार और शुद्धता भ्रलग- अलग अभिलिखित की जानी चाहिए ।
4. शुद्ध स्वर्ण से 24 कैरट शुद्धता वाले स्वर्ण श्रभिप्रेत है । " ;

2 इस अनुज्ञप्ति द्वारा प्रदत्त विशेषाधिकार केवल स्वर्ण में व्यव्हार करने के लिए लागू होता है किन्तु जो इस शर्त के अधीन होगा कि इस अनुज्ञप्ति का/के धारक , श्रनुर्जात की मंजूरी के पश्चात् किसी पूरे कलेण्डर वर्ष के दौरान , एसी वस्तुओं , या आभूषणों, या दोनों का केवल भारत से बाहर के व्यक्तियों को विक्रय द्वारा व्ययन करेंगें ।

(i) जिनकी कुल शुद्ध स्वर्ण मात्रा एक हजार ग्राम शुद्ध स्वर्ण के समुतुल्य से कम नहीं है । तथापि जहां कोई वस्तु या श्रभूषण , या दोनों भारत से बाहर के व्यक्ति द्वारा विनिर्माण में बुटि या क्वालिटी के कारण नामंजूर कर दिए गए हों वहां उनका व्ययन स्वर्ण ( नियंत्रण ) प्रधिनियम 1968 ( 1968 का 45 ) के उपबन्धों के अनुसार किया जाएगा , और जहां ऐसे स्वर्ण का विक्रय किया जाना हो वहां बह केवल अन्य अनुज्ञप्त व्यवहारियों को बेचा जाएगा, और इस प्रकार बेची गई वस्तुभों या आभूषणों, या दोनों की कुल शुद्ध स्वर्ण मात्रा भारत से बाहर के व्यक्तियों को बेची गई वस्तुओं , या आभूषणों , या दोनों की कुल शुद्ध स्वर्ण मात्रा के दस प्रतिशत से अधिक नहीं होगी ।
3. अनुज्ञप्ति में कोई भी शुद्धि तब तक विधिमान्य नहीं होगी अब तक उसके लिए प्रनुज्ञापन प्राधिकारी द्वारा भादेश न किया गया हो भौर उसके द्वारा वह सत्यापित न कर दी गई हो ।
4. यह अनुज्ञप्ति स्वर्ण नियंत्रण अधिनियम , 1968 ( 1968 का 45 ) के उपबन्धों के अनुसार रद्द या निलम्बित की जा सकेगी या उसके नवीकरण के लिए इन्कार किया जा सकेगा ।
5. इस अनुज्ञप्ति की मंजूरी , अनुज्ञाप्त कारबार या अनुशाप्त परिसरों पर किसी अन्य व्यक्ति के ऐसे अधिकारों पर प्रतिकूल प्रभाव डाले बिना दी आयेगी जिनके लिए ऐसा व्यक्ति किसी अन्य विधि के अधीन हकदार हो ।

अनुज्ञप्ति का नवीकरण

मैं/ हम पता (जिसे/जिन्हें इस में बाध्यताधारी कहा गया है ) राष्ट्रपति को संदत्त की जाने वाली पांच सौ रुपए की ऐसी राशि के लिए राष्ट्रपति के प्रति आबद्ध हूं संयूक्ततः और पृथकतः श्राबद्ध हैं जिसके संदाय के लिए मैं/ हम संयुक्ततः और पृथ्कतः अपने को और अपने विधिक प्रतिनिधियों को आब्रदूध करता हूं / करते हैं । पर स्वर्ण में व्यबहार करने के लिए अनुज्ञप्ति मंजूर की गई है और वह स्वर्ण निर्यूत्रण अधिकारी के अभिलेखों में सं ० तारीख के रूप में रजिस्ट्रीकून की गई है । उपरोक्त बाध्यताधारी/ बाध्यातस्वारीयों को
यतः अनुज्ञापन प्राधि हारी द्वारा यह अपेक्षा की गई है कि बाध्यत। धारी इस बधपत्र की रकम के लिए प्रत्याभूति के रू में, पांच सौ रुपए की नकद राशि निक्षिप्त करे/ करें । पांच सौ साल के कु.न अंकित मूल्य की इसमें इनके पश्चात यथाणित ऐसी प्रतिभूतियों निक्षिप्त करे/ करें। जो भारत के राष्ट्रपति के पक्ष में पृष्ठांकित की गई हों और सहायक केन्द्रीय उत्पाद शुल्क कलक्टर द्वारा उनकी और से स्वीकार की गई हों , अर्थात्: -
और यतः बाध्यताधारी/ बाध्यताधारियों में यथापूर्वोक्त रकम । प्रतिभूतियां सहायक कलक्टर के पास निक्षिप्त करके ऐसी प्रत्याभूति दे दी है ।
इस बन्धपत्त्र की शर्ते निम्नलिखित हैं :-
( क ) बाध्यताधारी और उसके/ उनके विधिक प्रतिनिधि , अनुज्ञप्ति की मंजूरी के पश्चात् किसी पूरे कलेण्डर वर्ष के दौरान ऐसी वस्तुओं , या श्रभूषणों, या दोनों का केवल भारत के बाहर के व्यक्तियों को विक्रय द्वारा व्ययन करे/ करें ।

( ii ) जिनकी कुल शुद्ध स्वर्ण मात्रा चौबीम कैरट शुद्धा ( जिसे इनमें इसके पश्चात शुद्ध स्वर्ण कहा गया है ) के एक हजार ग्राम स्वर्ण के सम तुल्य से कम नहीं है ;
( ख ) कोई वस्तु, या आभूषण , या दोनों विनिर्माण में त्रुटि या क्वालिटी के कारण भारत से बाहर के व्यक्ति द्ववारा नामंजूर कर दिए गए हों वहां उनका व्ययन स्वर्ण (नियंत्रण ) अधिनियम , 1968 ( 1968 का 45 ) के उपबन्धों के अनुसार किया जाएगा , और जहां ऐसे स्वर्ण का विक्रय किया जाना हो वहां वह केवल अन्य अनुज्ञप्त व्यवहारियों को बेचा जाएगा और इस प्रकार बेची गई वस्तुओं, या आभूषणों, या दोनों की कुल शुद्ध स्वर्ण मात्रा भारत से बाहर के व्यक्तियों को बेची गई वस्तुओं, या श्राभूषणों या दोनों की कुल शुद्ध स्वर्ण म्रात्त्रा के भार के अनुसार दस प्रतिशत से अधिक नहीं होगी ।
यदि उपरोक्त शर्तों का अनुपालन किया गया हो तो यह बाध्यता शून्य हो जाएगी । अन्यथा, और इस शर्त के किसी भाग के भंग करने पर या उसके अनुपालन में असफल रहने पर वह पूर्ण वृत्त रहेगी ।
और भारत के राष्ट्रपति, अपने विकल्प पर , प्रत्याभूति निक्षेप की रकम को समपृत करने के लिए सक्षम होंगे । मैं/ हम घोषणा करता हूं/ करते हैं कि यह बन्धपत्त्र केन्द्रीय सरकार के आदेशों के अधीन ऐसे कार्य के अनुपालन के लिए दिया गया है जिस में जनता हितबद् है ।
