8.0 . 770 ( B ) .-In exercise of the powers conferred by section 35 of the General Insurance Business (Nationalisation ) Act , 1972 ( 57 of 1972 ) , the Central Government hereby spec fies the exceptions , restrictions and limitations spec fied in column (2 ) ofthe Table below subject to which the provision of the Insurance Act , 1938 ( 4 of 1938 ) , spec fied in the corresponding entry in colina ( 1 ) of the said Table , shall applyto or in relation to the General Insurance corporation of India formed under section 9 of the first mentioned Act and to every acquiring company as defined in the said Act :

In sub - section ( 8) , for clause ( ii ) , the following clause shall be substituted , namely :-
'( ii) " Indian re - insurer " means the General Insurance Corporation of India formed under section 9 of the General Insurance Business (Nationalisation ) Act , 1972 (57 of 1972) .
2. This notification shall come into force on the 1st of January , 1973 .

का० ग्रा० 770 (थ ) साधारण बीमा कारबार ( राष्ट्रीयकरण ) अधिनियम , 1972 (1972 का 57 ) की धारा 35 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुये केन्द्रीय सरकार , नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट उन अपवादों, निर्बन्धनों और परिसीमाधों को एतद्वारा विनिदिष्ट करती है जिनके अधीन रहते हुये उक्त सारणी के स्तम्भ ( 1 ) मे की तत्स्थानी प्रविष्टि में विनिर्दिष्ट बीमा अधिनियम , 1938 ( 1938का 4) का उपबन्ध प्रथम वर्णित अधि- नियम की धारा 9 के अधीन बनाये गये भारतीय साधारण बीमा निगम को या उसके सम्बन्ध में और उक्त अधिनियम में यथा परिभाषित प्रत्येक अर्जक कम्पनी को लागू होगा:---

धारा 101 क
उपधारा ( 8 ) में , खण्ड ( ii ) के स्थान पर निम्नलिखित खण्ड रखा जाएगा , अर्थात्:--
( ii) " भारतीय पुनर्बीमाकर्त्ता" रो साधारण बीमा ( राष्ट्रीयकरण ) अधिनियम, 1972 (1972 का 57) की धारा 9 के अधीन बनाया गया भारतीय साधारण बीमा निगम अभिप्रेत है ।
2. यह अधिसूचना 1973 की जनवरी के प्रथम दिन को प्रवृत्त होगी ।

Section ro
The portion beginning with the words " and where the insurer' and ending with the words "prescribed in this behalf" in sub - section ( 1 ) the proviso to that sub - section, sub - sections (2), (2A) and (3 ) shall be omitted .
Section 28 B
In sub - section (2 ) , for the portion beginning with the words " during each of the quarters " and ending with the words "to which it relatcs " , the words "during each year within thirty- one days from the close of the year " shall be substituted .
Section 33
(1 ) Sub - section ( IA) shall be omitted .
(2) In sub - sections (2) and (3 ) , the words , brackets , figure and letter , " or inspection under sub- section ( 1A) ," shall be omitted.
(3 ) Sub - section (3A) shall be omitted .
(4) In sub - section (4) , the words , brackets , figure and letter " or under sub - section (3A) shall be omitted .
(5) Sub - sections (4A) and ( 4B) shall be omitted .'
Section 40C
( 1) In the proviso , the words , figures and letter " after consultation wth the Executive Co- mmittee of the General Insurance Council constituted under section 64F " shall be omitted.
(2) After the said proviso the following proviso shall be added , namely:-
"Provided that nothing in this sub - section' shall apply to the General Insurance Courorat- cr ofIndia formed under section 9 ofthe General Insurance Business (Nationalisation ) Act , 1972 ] (57 of 1972) . " .

Section 64UA
In sub - section ( 1 ) , for clauses ( a) to (d) , the follo- wing clauses shall be substituted , namely :-
"(a) the Chairman of the General In- surance Corporation of India or a member of the Advisory Committee to be nominated by him , who shall be the Chairman ;
(b) not more than fifteen members to be nominated by the General Insurance Cor- poration of India with the prior approval of the Central Government . " .
Section 64UC
Sub - section ( 3 ) shall be omitted .

In sub - section ( 2) , for the portion beginning with the words " of which not more than" and ending with the words " Controller " the words " nominated by the Advisory Co- mmittee " shall be substituted .

धारा 10
उपधारा ( 1 ) में, " और जहां बीमाकर्ता " शब्दों से भारम्भ होने वाले और " पृथक लेखा रखेगा" शब्दों से समाप्त होने वाले भाग का , उस उपधारा के परन्तुक का , उपधारा ( 2 ) , ( 2क ) और ( 3 ) का लोप , कर दिया जायेगा ।
धारा 28 व
उपधारा ( 2 ) में , " मार्च , जून, सितम्बर और दिसम्बर के अन्तिम दिन को" शब्दों से आरम्भ होने वाले और " इकतीस दिन के अन्दर हुई है " शब्दों से समाप्त होने वाले भाग के स्थान पर , " प्रत्येक वर्ष के दौरान उस वर्ष के समाप्त होने के इफत्तीस दिन के अन्दर हुई है" शब्द रखे जायेंगे ।
धारा 33
( 1 ) उपधारा ( 1 क ) का लोप कर दिया जाएगा ।
( 2) उपधारा ( 2 ) और ( 3 ) में , "या उपधारा ( 1 क ) के अधीन निरीक्षण" शब्दों कोष्ठकों, मंकों और प्रक्षर का लोप कर दिया जाएगा ।

( 3) उपधारा ( ३क ) का लोप कर दिया जाएगा ।
(4) उपधारा ( 4 ) में, "या उपधारा ( 3 क) के अधीन" शब्दों , कोष्ठकों , अंक और अक्षर का लोप कर दिया जाएगा ।
( 5 ) उपधारा ( 4क) और ( 4ख ) का लोप कर दिया जाएगा ।
भाग 40 ग
( 1) परन्तुक में, "धारा 64च के अधीन गठित विविध बीमा परिषद् की कार्यकारिणी समिति से परामर्श के पश्चात्" शब्दों, अंकों भौर अक्षर का लोप कर दिया जाएगा ।
( 2 ) उक्त परन्तुक के पश्चात्, निम्नलिखित परन्तुक जोड़ा जाएगा , अर्थात्:-
"परन्तु इस उपधारा की कोई भी बात विविध बीमा कारबार ( राष्ट्रीयकरण ) अधि- नियम , 1972 ( 1972 का 57 ) की घारा 9 के अधीन बनाए गए भारतीय विविध बीमा निगम को लागू नहीं होगी । " ।
धारा 64 पक
उपधारा ( 1 ) में , खण्ड ( क ) से ( घ ) के स्थान पर , निम्नलिखित खण्ड रखे जायेंगे , अर्थात्:
" ( क) भारतीय विविध बीमा निगम अध्यक्ष या उसके द्वारा नाम निवे- शित किया जाने वाला सलाहकार- समिति का सदस्य , जो अध्यक्ष होगा ,
(ख) पन्द्रह से अनधिक ऐसे सदस्य , जो केन्द्रीय सरकार के पूविक प्रभु- मोदन से भारतीय विधिका बीमा निगम द्वारा मामनिर्देशित किए आऐंगे ।" THE GAZETTE OF INDIA EXTRAORDINARY

उपधारा ( 2 ) मे , " जिनमें से " शब्दों से आरम्भ होने वाले शब्दों और नियंत्रक द्वारा नाम- निर्देशित किए जाऐंगे " शब्दों से समाप्त होने वाले भाग के स्थान पर, " जो सलाह- कार समिति द्वारा नामनिर्देशित किये जाऐंगे " शब्द रखे जायेंगे ।
धारा 64 पड
उपधारा ( 3 ) , ( 4 ) और ( 9 ) का लोप कर दिया जाएगा ।
