ORDER
New Delhi , the 5th March 1973
S.O. 128 ( E ) /18FA/18AA/IDRA/73.-Whereas Messrs . Krishna Silicate and Glass Works Limited, Calcutta, owning an industrial undertaking , is being wound up under the supervision of the Calcutta High Court and the business of the company is not being continued;
And whereas the Central Government , after obtaining permission from that High Court under sub - section ( 2) of section 15A of the Industries ( Development and Regulation ) Act, 1951 (65 of 1951 ) ( hereinafter in this Order referred to as the said Act ) , had caused an investigation to be made by a body of persons into the possibility of running or re - starting the said industrial undertaking ;
And whereas the Central Government , being of the opinion that there are possibilities of running or re - starting the said industrial undertaking , made an application under sub - section ( 1 ) of section 18FA of the sald Actto the Calcutta High Court praying for permission to appoint a body of persons to take over the management of the said industrial undertaking and that the sald High Court has, by its order dated the 21st February , 1973 granted the said permission:
Now, therefore , in exercise of the powers conferred by sub - section ( 2 ) of section 18FA , read with section 18AA, of the said Act , the Central Government hereby authorises the body of persons ( in this Order referred to as the Board of Management ) comprising of

to take over the management of the whole of the said undertaking , namely , Messrs Krishna Silicate and Glass Works Limited , Calcutta , subject to the following terms and conditions , namely- ( i ) the Board of Management shall comply with all directions issued from time to time by the Central Government;
( 11 ) the Board of Management shall hold office for five years from the date of publication of this Order in the Official Gazette ; and
( iii ) the Central Government may terminate the appointment of any of the persons comprising the Board of Management earlier if it considers it necessary to do so .
This Order shall have effect for a period of five years commencing from the date of its publication in the Official Gazette .

का० श्रा ० 127 ( श्र ) / 18 चक/ 18 केक/ आई ० डी० आर ० ए० / 73--यत मैसर्स कृष्णा मिलिकेट एण्ड ग्लास वर्क्स लिमिटेड , कलकत्ता का, जो एक औद्योगिक उपक्रम का स्वामी है , कलकत्ता उच्च न्यायालय के पर्यवेक्षण के अधीन समापन हो गया है और इस कंपनी का कारोबार नहीं चल रहा है ;
और यतः केन्द्रीय सरकार ने उद्योग ( विकास और विनियमन ) अधिनियम, 1951 ( 1951 का 65 ) ( जिसे इस में इसके पश्चात इस आवेश में उक्त अधिनियम कहा गया है ) की धारा 15 क की उपधारा ( 2 ) के अधीन उस उच्च न्यायालय से अनुज्ञा श्रभिप्राप्त करने के पश्चात् उक्त औद्योगिक उपक्रम को चालू रखने या फिर से चलाने की संभावना का अन्वेषण -व्यक्तियों के एक निकाय द्वारा कराया था ;
और यतः केन्द्रीय सरकार ने, यह राय होने पर कि उक्त औद्योगिक उपक्रम को चालू रखने या फिर से चलाने की संभावनाएं हैं, उक्त अधिनियम की धारा 18 च क की उपधारा ( 1 ) के अधीन , उक्त औद्योगिक उपक्रम का प्रबंध ग्रहण करने के लिए व्यक्तियों का एक निकाय नियुक्त करने की अनुशा के लिए प्रार्थना करते हुए उच्च न्यायालय को आवेदन किया था और उक्त उच्च न्यायालय ने, अपने आदेश , तारीख 21-2-1973 द्वारा , उक्त अनुज्ञा दे दी है;
अतः , अब , उक्त अधिनियम की धारा 18कक के साथ पठित धारा 18च क की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , निम्नलिखित व्यक्तियो

3. श्री पी ० आर ० गांगुली, पश्चिमी बंगाल श्राबकारी सेवा (कार्य पालिका ) पश्चिमी बंगाल सरकार , कलकत्ता ।
अर्थात् निम्नलिखित निबंधनों के निकाय ( जिसे इस आदेश में प्रबंध- बोर्ड कहा गया है ) को उक्त उपक्रम , मैसर्स कृष्णा सिलिकेट एण्ड ग्लास वर्क्स लिमिटेड , का समस्त प्रबन्ध, और शर्तों के अधीन रहते हुए , ग्रहण करने के लिए एतद्वारा प्राधिकृत करती है, अर्थात्:---
( i ) प्रबंध -बोर्ड, केन्द्रीय सरकार द्वारा समय - समय पर जारी किए गए सभी निदेशों का अनुपालन करेगा ;
( ii ) प्रबंध बोर्ड , इस आदेश के राजपत्र में प्रकाशन की तारीख से पांच वर्ष के लिए पद धारण करेगा; और
( iii ) केन्द्रीय सरकार, यदि ऐसा करना आवश्यक समझे तो , प्रबंध -बोर्ड के व्यक्तियों में से किसी किसी की नियुक्ति पहले भी समाप्त कर सकेगी ।
2. यह आदेश राजपत्त्र में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए प्रभावी होगा 1
