New Delhi , the 27th May 1975
G.S.R. 297 ( E ) . In exercise of the powers conferred by sub - section ( 1 ) of section 37 , read with sections 3 , 3A , 4 , 6 , 7 , 11, 12, 13, 15 and 19 of the Apprentices Act , 1961 ( 52 of 1961 ) , and after consulting the Central Apprenticeship Council , the Central Government hereby makes the following rules further to amend the Apprenticeship Rules , 1962 , namely:-
1. ( 1 ) These rules may be called the Apprenticeship (Second Amendment ) Rules, 1975.
(2 ) They shall come into force on the date of their publication in the Official Gazette.
2. In rule 2 of the Apprenticeship Rules , 1962 ( hereinafter referred to as the principal rules ) ,-
( a) for clause ( b ) , the following clauses shall be substituted , namely: -
(b) "Diploma Holder " means a person who holds a diploma in engineering equivalent qualification granted by a State Board of or technology or equivalent qualifica Technical Education , or recognised by the State Government concern- ed or the Central Government ;
(hh ) " Engineering Graduate " means a person , who
(1 ) holds a degree in engineering or technology granted by
(1 ) a statutory University , or
( 11 ) by an institution empowered to grant such degree by an Act of Parliament;

(2) has passed the Graduateship examination of professional bodies recog- nised by the Central Government as equivalent to a degree ; or
(3 ) holds the qualifications which exempt him from Sections A and B Examinations of the Institution of Engineers ( India ) ;
( 2) after clause ( d ) the following clause shall be inserted , namely:-
" (dd) Sandwich Course Student " means a student undergoing a Sandwich Course of studies at any of the technical institutions recognised for the purpose and leading to the award of degree or diploma in engineer- ing or technology. " ;
(3) clause ( f) shall be omitted .
3. (a) Rule 3 of the principal rules, shall be re - numbered as sub -rule ( 1 ) thereof and in sub -rule (1) as so re - numbered for the words " an apprentice " and the word " prescribed" ,d " , the words " a trade apprentice " and the word " specified" shall respectively be substituted;
(b ) after sub - rule ( 1 ) the following sub - rule shall be inserted , namely:-
" (2) A person shall be eligible for being engaged as a graduate or technician apprentice if he satisfies one of the minimum educational qualifications specified in Schedule 1A:
Provided that.
( 1 ) no Engineering Graduate or Diploma Holder who had training or job experience for a period of one year or more , after the attainment of these qualifications , shall be eligible for being engaged as an appren- tice under the Act ;
( ii) no Sandwich Course Student shall be eligible for being engaged as an apprentice under the Act after passing the final examination of the technical institution wherein such student is undergoing the course;
( iii ) a person who has been a graduate or technician apprentice under the Act and in whose case the contract of apprenticeship was terminated for any reason whatsoever shall not be eligible for being engaged as an apprentice again under the Act without the prior approval of the Apprenticeship Adviser . " .
4. For sub - rule ( 1 ) of rule 4 of the principal rules , the following sub - rule shall be substituted , namely:-
" ( 1 ) A person shall be eligible for being engaged as an apprentice if he satis- fies the minimum standards of physical fitness specified in Schedule- II:
Provided that a person who has undergone institutional training in a school or other institution recognised by or affiliated to the National Council , or the All - India Council , or a statutory University or a State Board of Technical Education and has passed the examination or tests conduct- ed by these bodies , oris undergoing institutional training in a school or institution so recognised or affiliated in order that he may acquire a degree or diploma in engineering or technology or equivalent qualifi- cation shall , if he has already undergone medical examination in accordance with the rules for the admission to the school or institu- tion, be deemed to have complied with the provisions of this rule. " .
5. After rule 4 of the principal rules , the following rules shall be inserted , namely:-
4A. Reservation of Training Places . In respect of each of the States specified in column ( 2 ) of Schedule IIA , training places shall be reserved by the employer for the Scheduled Castes and the Scheduled Tribes in every designated trade so that the ratio of the apprentices belonging to the Scheduled Castes and Scheduled Tribes to the total numbernumber of apprentices in such designated trade shall be as specified in columns ( 2 ) and ( 3 ) of the said Schedule:
Provided that when the prescribed number of persons belonging either to the Scheduled Castes or to the Scheduled Tribes are not available , the training places во reserved for them may be filled by persons belongingto the Scheduled Tribes or , as the case may be to , the Scheduled Castes and if the prescribed training places can- not be filled even in the above manner , then the training places soso lyingly unfilled THE GAZETTE OF INDIA EXTRAORDINARY

may be filled by persons not belonging to the Scheduled Castes or the Scheduled Tribes.
4B . Registration of the Contract of Apprenticeship. Every employer shall send to the Apprenticeship Adviser the Contract of apprenticeship for registration within three months of the date on which it was signed . " .
6. In rule 5 of the principal rules , for the word " apprentices " and the words "an apprentice" wherever they occur , the words " trade apprentices " and the words " a trade apprentice" shall respectively be substituted;
(b ) after sub rule ( 3 ) , the following sub - rule shall be inserted , namely:---
" (4 ) ( i ) The period of apprenticeship training in the case of Engineer- ing Graduates and Diploma Holders shall be one year ,
( ii ) In the case of Sandwich Course Students , the period of practical train- ing they undergo as part of their course of studies shall be the period of apprenticeship training . "
7. In rule 6 of the principal rules , for items ( 1 ) , ( 2 ) and ( 3 ) the following shall be substituted , namely :

400.00 (ii ) For termination after expiry of twelve months but before the expiry of twenty - four months .

8. After rule 6 of the principal rules , the following rules shall be substituted , namely:-
" 6A . Qualifications of persons placed in charge of the training of appren- tices. A person placed in charge of the training of apprentices by the employer shall possess the qualifications specified in Schedule IV.
6B. Maintenance of record of work by apprentice . Every graduate or technician apprentice shall maintain a daily record of the work done by him relating to the apprenticeship training in the form of a work- shop or laboratory note - book " .
9. In rule 7 of the principal rules ,-
(a) in sub - rule (1 ) , for the words " an apprentice " and the word " apprentices" , the words " trade apprentices " shall be substituted ;
(b) after sub - rule ( 1 ) , the following sub - rule shall be inserted, namely:-
" ( IA) The minimum rates of stipend payable to graduate or technician apprentices shall be as follows :-
(1) Engineering Graduate
Rs . 250/ - per month ( for post In- stitutional Training) .
(ii ) Sandwich Course student from Degree Institution . Rs . 150/- por morth .
(iii) Diploma Holder
Rs . 150/ -per month ( for post Ins- titutional Training) .
(iv) Sandwich Course Student from Diploma Institution Rs . ICO/ -pel merik . " ;
(c) after sub - rule (4) , the following sub - rules shall be inserted , namely:-
"( 5 ) The continuance of payment of stipend to an apprentice shall be sub- ject to the work and conduct of the apprentice being satisfactory.
(6) Where the work and conduct of the apprentice is not satisfactory , the employer shall report the matter to the Apprenticeship Adviser and with his consent may stop continuance of payment of stipend to the apprentice:
Provided that the stipend of an apprentice shall not be stopped without intimating him the grounds therefor and giving him an opportunity of representing against the action proposed .

(7) On report being made by the employer under sub - rule ( 6 ) , the Appren- ticeship Adviser shall give his decision thereon , within thirty days of the receipt of the report and where the Apprenticeship Adviser does not communicate to the employer refusal to consent to the stopping of the payment of stipend within the period of thirty days , it shall be deemed that he has consented to the stopping of the stipend . " .
10. The rule 8 of the principal rules-
(a) in sub - rule ( 1 )
( i) for the words " an apprentice " and the word " apprentices , " wherever they occur , the words " a trade apprentice " and words " trade appren- tices" shall respectively be substituted ;
( ii ) the proviso to clause ( iv ) shall be omitted ;
(b ) in sub - rule ( 2 )-
( i) for the words " No apprentice other than a short- term apprentice " , the words " No trade apprentice " shall be substituted;
( ii ) for the words " the apprentice " , words " the trade apprentice " shall be substituted; ( c) After sub - rule ( 2 ) the following sub - rule shall be inserted , namely:--
" ( 3 ) Graduate or technician apprentices shall work according to the nor- mal hours of work of the department in the establishment to which they are attached for training ."
11. In rule 9 of the principal rules,-
(a) in sub - rule ( 2 ) , for the opening paragraph , the following shall be sub- stituted , namely:-
" ( 2) In establishments where proper leave rules exist for workers , the leave to apprentices shall be granted by the employers in accordance with those rules :
Provided that in the case of trade apprentices grant of such leave shall be subject to the following conditions , namely:-
(b) in sub - rule ( 3 ) and sub - rule ( 4 ) , for the words " an apprentice" and the words , brackets , letter and figure " clause (c ) of sub - rule (2 ) " , wherever they occur , the words " a trade apprentice " and the words , brackets , letter and figure " clause ( c) of the proviso to sub - rule ( 2 ) " shall respectively be substituted .
12. In rule 10 of the principal rules ,
(a) for the words " an apprentice" and the word " apprentices " , wherever they occur , the words " a trade apprentice" , and the words " trade apprentices " shall respectively be substituted;
(b ) in sub - rule ( 5 ) , in clause ( a ) for the words " the apprentice " , the words "the trade apprentice " shall be substituted;
(c ) in sub - rule ( 6 ) , for the words " establishment shall " , the words " estab- lishment shall in respect of trade apprentices receiving training in the establishment " , shall be substituted ;
(d) after sub - rule ( 8 ) , the following sub - rules shall be inserted , namely:-
"( 9 ) On a graduate or technician apprentice joining an establishment, the employer shall prepare index cards in Form App - 5 set out in Sche- dule III with complete bio - data and retain one card with himself and forward , within ten days from the date of the engagement of the apprentice , one card to each of the following authorities , namely :-
( 1 ) the Central Apprenticeship Adviser ;
( ii ) the Director , Regional Board of Apprenticeship Training concerned; and
( iii) in the case of a Sandwich Course student , the technical institution concerned .
( 10 ) Every employer shall maintain a record of the work done and the studies undertaken by the graduate and technician apprentices , en- gaged in his establishment , for each quarter and at the end of each 1 127 THE GAZETTE OF INDIA EXTRAORDINARY

quarter shall send a report in Form App - 6 set out in Schedule III to the Director , Regional Board of Apprenticeship Training Concern- ed.".
13. After Schedule I of the principal rules , the folowing Schedule shall be in- serted , namely : -

(b) A degree in engineering or technology granted by an institution empowered to grant such degrees by an Act of Parliament .
(c) Graduate examination of professicral bodies recognised by the Central Government as equivalent to degree .
(d) A Sandwich Course Student who is undergoing training in order that he may hold a degree in engineering or technology as men- tioned at (a) and (b) above .
2. Technician appren- tices
or (a) A diploma in engineering or techrology granted by a State Council established by aState Government . Board of Technical Education establis
(b) A diploma in engineering or technology granted by a University .
(c) A diploma in engineering or technology granted by an institute recognised by the State Government or Central Government as equivalent to ( a) and (b) above .
(d) A diploma or certificate in a vocational course involving two years of study after the completion of the secondary stage of school education recognised by a State Government or Central Govern- ment as equivalert to ( a) and (b ) above .
(e) A Sandwich Course Student who is undergoing trauung in order that he may hold a diploma mentioned in (a), (b) and (c) above , or a diploma or certificae mentioned in (d) above .".
14. After Schedule II of the principal rules , the following Schedule shall be inserted namely :-

16. After Schedule III of the principal rules , the following Schedule shall be inserted , namely :-
"SCHEDULE IV
(See rule 6A )
I. In the case of Trade Apprentices :
(a) Must possess a degree or diploma in Engineering or technology or equivalent qualification recognised by Government of India ,
OR
(b ) National Apprenticeship Certificate with a minimum 5 years ' experienca II . In the case of Graduate Apprentices:
Must hold a degree in engineering or technology or equivalent qualification as recognised by Government of India .
III . In the case of Technician Apprentices :
Must hold degree or diploma in engineering or technology or equivalent qualification recognised by Government of India .

apprentices . It is desirable that the person in charge should have industrial cxperience .

1 सा० का ०नि ० 297 ( अ ) केन्द्रीय सरकार, शिक्षु अधिनियम , 1961 ( 1961 का 52 ) की धारा 3 , 3 क , 4,6,7,11 , 12 , 13 , 15 और 19 के साथ पठित धारा 37 की उप -धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय शिक्षुता परिषद् से परामर्श करने के पश्चात्, शिक्षुता नियम, 1962 में और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: --
1. ( 1 ) इन नियमों का नाम शिक्षुता ( द्वितीय संशोधन ) नियम, 1975 है ।
( 2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. शिक्षुता नियम , 1962 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) के नियम 2 में:-
(क) खंड ( ख ) के स्थान पर निम्नलिखित खंड रखे जाएंगे , अर्थात्:--
( खख ) ' डिप्लोमा धारी' से ऐसा व्यक्ति अभिप्रेत है जिसके पास राज्य तकनीकी शिक्षा बोर्ड द्वारा प्रदत्त या संबद्ध राज्य सरकार या केन्द्रीय सरकार द्वारा मान्यता प्राप्त डिप्लोमा या समतुल्य अर्हता हो ;
( खखक ) " इंजीनियरी स्नातक " से ऐसा व्यक्ति अभिप्रेत है, जो
( 1 ) इंजीनियरी या प्रौद्योगिकी में निम्नलिखित द्वारा प्रदत्त उपाधि धारण करता है-
(i) किस्स्री अधिनियम के अधीन बनाए गए विश्वविद्यालय का
( ii ) संसद् द्वारा बनाए गए किसी अधिनियम द्वारा ऐसी उपाधि प्रदान करने के लिए सशक्त किसी संस्था ।
( 2 ) जिसने भारत सरकार द्वारा डिग्री के समतुल्य मान्यता प्राप्त वृत्तिक निकायों की स्नातक की परीक्षा पास की है ; या
( 3) जिसके पास ऐसी योग्यताएं हों जिससे उसे भारतीय इंजीनियरी संस्था की भाग क और ख की परीक्षाओं से छूट मिलती हो;

( 2) खंड ( घ ) के पश्चात् , निम्नलिखित खंड अन्तःस्थापित किया जाएग, अर्थात्: -
(घघ) ' सेंडविच पाठ्यक्रम के छात्र से ऐसा छात्त्र अभिप्रेत है जो इंजीनियर या प्रौद्योगिकी में डिग्री या डिप्लोमा देने के उद्देश्य से मान्यता प्राप्त तकनीकी मंस्थानों में से किसी में भी सेडविच पाठ्यक्रम का अध्ययन कर रहा है ।
( 3 ) खंड ( च) का लोप किया जाएगा ।
3. (क ) मूल नियमों के नियम 3 को उसके उप -नियम ( 1 ) के रूप मे पुनःसख्याकिस किया जाएगा और इस प्रकार पुनःसंख्याकित किए गए उपनियम ( 1 ) में 'शिक्षु' शब्द और " विहित " शब्द के स्थान पर क्रमशः "व्यावसायिक शिक्षु " शब्द और 'विनिर्दिष्ट' शब्द रखे जाएंगे ।
(ख) उप- नियम ( 1 ) के पश्चात् निम्नलिखित उप- नियम अन्त. स्थापित किया जाएगा, अर्थात्: --
" ( 2 ) कोई व्यक्ति स्नातक था तकनीकश शिक्षु के रूप में भर्ती के लिए तभी पात्र होगा जबकि वह अनुसूची । क में विनिर्दिष्ट न्यूनतम शैक्षिक अर्हताओ मे से किसी एक की पूर्ति करता है ,
( i ) इन योग्यताओं की प्राप्ति के पश्चात् एक वर्ष या इससे अधिक अवधि का प्रशिक्षण या जाव अनुभव प्राप्त कोई भी इंजीनियरी स्नातक या डिप्लोमा धारी , अधिनियम के अधीन शिक्षु के रूप में भर्ती का पात्र नही होगा ;
( ii ) सेंडविच पाठ्यक्रम का कोई भी छात्र , उस तकनीकी संस्थान से जिसमें वह अध्ययन पा रहा है, अन्तिम परीक्षा पास करने के पश्चात्, अधिनियम के अधीन शिक्षु के रूप में भर्ती के लिए पात्र नहीं होगा ;
ii ) ऐसा व्यक्ति, जो कि अधिनियम के अधीन स्नातक या तकनीकज्ञ शिक्षु रहा है और जिसके संबध में शिक्षुता का करार किसी भी कारण से समाप्त कर दी गई थी , शिक्षुता सलाहकार के पूर्व अनुमोदन के बिना अधिनियम के अधीन शिक्षु के रूप में भर्ती नहीं किया जाएगा । "
4. मूल नियमों के नियम 4 के उप -नियम ( 1 ) के स्थान पर, निम्नलिखित उप-नियम रखा जाएगा, अर्थात्:-
( 1 ) कोई व्यक्ति शिक्षु के रूप में भर्ती के लिए तभी पात्र होगा जब कि वह अनुसूची II में विनिर्दिष्ट शारीरिक योग्यता के न्यूनतम मापमानों को पूरा करता है । परन्तु ऐसे व्यक्ति के संबंध में जिसने राष्ट्रीय परिषद् या अखिल भारतीय परि- षद् या अधिनियम के अधीन बनाए गए विश्वविद्यालय या राज्य तकनीकी शिक्षा बोर्ड द्वारा मान्यता प्राप्त या सम्बद्ध किसी भी स्कूल या अन्य संस्थान में संस्थागत प्रशिक्षण प्राप्त किया है और इन निकायों द्वारा ली गई परीक्षा पास की हो या किसी ऐसे स्कूल या संस्था में इस उद्देश्य से संस्थागत प्रशिक्षण पा रहा हो कि वह इंजीनियरी या प्रौद्योगिकी या समतुल्य योग्यता वाला डिप्लोमा या उपाधि प्राप्त कर सके, यह तब मान लिया जाएगा कि उसने इन नि 'मों के उपबंधों का पालन किया है , जबकि स्कूल या संस्था में प्रवेश के लिए नियमों के अनुसार पहले ही उसने चिकित्सीय जांच करा ली हो ।

5. मूल नियमों के नियम 4 के पश्चात् निम्नलिखित नियम अन्तःस्थापित किये आएंगे , अर्थात्:-
4क प्रशिक्षण संस्थानों का आरक्षण प्रत्येक नियोजक द्वारा अनुसूचित जाति और अनुसूचित जनजाति के व्यक्तियों के लिए प्रत्येक निर्विष्ट व्यवसाय में अनुसूची II क के स्तम्भ ( 2 ) में विनिविष्ट प्रशिक्षण स्थानों का आरक्षण किया आएगा जिससे अनुसूचित जाति और अनुसूचित जनजाति का अनुपात ऐसे निर्दिष्ट व्यवसाय में शिक्षुओं की कुल संख्या से वह हो जाएगा जो उक्त अनुसूची के स्तम्भ ( 2 ) और ( 3 ) में यथा विनिर्दिष्ट है । परन्तु जब अनुसूचित जाति या अनुसूचित जनजाति के व्यक्तियों की विहित संख्था उपलब्ध नहीं है तब उनके लिए इस प्रकार श्रारक्षित किए गए प्रशिक्षण स्थानों को यथास्थिति , अनु- सूचित जनजाति या अनुसूचित जाति के व्यक्तियों से भरा जा सकेगा या यदि निर्धारित प्रशिक्षण स्थानों को उपरोक्त रीति से भी नहीं भरा जा सकता है , तो इस प्रकार रिक्त प्रशिक्षण स्थानों को उन व्यक्तियों से भरा जा सकेगा जो कि अनुसूचित जाति और अनुसूचित जनजाति के नहीं हैं ।
4ख शिक्षुता संविदा का रजिस्ट्रोकरण-प्रत्येक नियोजक शिक्षुका संविदा को , इसके हस्ताक्षरित किए जाने की तारीख से तीन मास के भीतर शिक्षुता सलाहकार को रजिस्ट्रीकरण भेजेगा ।
6. मूल नियमों के नियम 5 में जहां कहीं भी 'शिक्षु ' शब्द और 'एक शिक्षुशब्द ' आते हैं, वहां उनके स्थान पर क्रमशः ' व्यावसायिक शिक्षु' शब्द और 'एक व्यावसायिक शिक्षु' शब्द रखे जाएंगे ;
(ख) उपनियम ( 3 ) के पश्चात् निम्नलिखित उप - नियम अन्तःस्थापित किया जाएगा अर्थात्:-
" ( 4 ) ( i ) इंजीनियरी स्नातकों और डिप्लोमाधारियों की दशा में शिक्षुता प्रशिक्षण की अवधि एक वर्ष की होगी ।
( ii) सेंडविच पाठ्यक्रम वाले छात्रों की दशा में व्यावहारिक प्रशिक्षण की वह अवधि जो वे अपने अध्ययन के पाठ्यक्रम के भाग रूप में बिताते हैं, ही शिक्षुता प्रशिक्षण की अवधि होगी ।
7. मूल नियमों के नियम 6 में मद ( 1 ) , ( 2 ) और ( 3 ) के स्थान पर निम्नलिखित को रखा जाएगा , अर्थात्:-
750.00 'स्नातक शिक्षु
450.00 तकनीकी शिक्षु
व्यवसाय शिक्षु
( i ) शिक्षुता ग्रहण करने की तारीख से बारह महीने की अवधि समाप्ति होने से पूर्व समाप्ति के लिए 300.00 रु ०
( ii ) बारह महीने की अवधि की समाप्ति होने के पश्चात् किन्तु चौबीस महीने की अवधि की समाप्ति होने से पूर्व समाप्ति के लिए 400.00 रु ०

8. मूल नियमों के नियम 6 के पश्चात् निम्नलिखित नियम रखे जाएंगे , अर्थात्ः-
6 क शिभुश्रों के प्रशिक्षण के भारसाधन करने वाले व्यक्तियों की अहंताएं-नियोजक द्वारा शिक्षुओं के प्रशिक्षण के लिए भारसाधन करने वाले व्यक्ति के पास अनुसूची 4 में विनिर्दिष्ट अर्हताएं होंगी ।
6 खशिक्षु द्वारा किए गए कार्य अभिलेख का रखा जाता.- प्रत्येक स्नातक या तकनीकश शिक्षु कर्मशाला या प्रयोगशाला नोट बुक के प्रारूप में शिक्षुता प्रशिक्षण से संबंधित उसके द्वारा किए गए कार्य का वैनिक अभिलेख रखेगा । "
9. मूल नियमों के नियम 7 में --
(
क) उप - नियम ( 1 ) में 'एक शिक्षु' शब्दों और ' शिक्षुओं' शब्द के स्थान पर 'व्यव- साय शिक्षु' शब्द रखे जाएंगे ।
(ख) उप- नियम ( 1 ) के पश्चात् निम्नलिखित उप - नियम अन्तःस्थापित किया जाएगा , अर्थात्:-
" ( 1 क ) स्नातक या तकनीकश शिक्षुओं को देय वृत्तिका की न्यूनतम वरें निम्न- लिखित होंगी:-
( 1 ) इंजिनियरी स्नातक
250 रू० प्रति माह ( उत्तर- वर्ती संस्थागत प्रशिक्षण के लिए)
( 2 ) डिग्री संस्था के सैंडविच पाठ्यक्रम का छात्र 150 रु ० प्रति माह
( 3 ) डिप्लोमाधारी
150 रू ० प्रति माह ( उत्तरवर्ती प्रशिक्षण के लिए )
(4) डिप्लोमा संस्था के सैंडविज पाठ्यक्रम का छात्र 100 रु ० प्रति माह
(ग) उप- नियम ( 4 ) के पश्चात्, निम्मलिखित उप- नियमों को अन्तःस्थापित किया जाएगा , अर्थात्:-
" ( 5 ) शिक्षु को वृत्तिका का संदाय शिक्षु के संतोषजनक कार्य और आचरण होने पर ही जारी रखा जाएगा ।
( 6) यदि शिक्षु का कार्य और भ्राचरण संतोषजनक नहीं है , तो नियोजक इस बात की रिपोर्ट शिक्षुता सलाहकार को करेगा और उसकी सम्मति से शिक्षु को वृत्तिका का संवाय करना बन्द कर सकेगा , परन्तु शिक्षु की वृत्तिका , शिक्षु को कारण बताए बिना और शिक्षु को इस प्रस्तावित कार्यवाही के विरुद्ध अभ्यावेदन करने का अवसर दिए बिना बन्ध नहीं की आएगी ।
(7 ) उप - नियम ( 6 ) के अधीन नियोजक द्वारा की गई रिपोर्ट पर , शिक्षुता सलाहकार अपना विनिश्चय रिपोर्ट के प्राप्त होने के तीस दिन के अन्दर देगा और जहां शिक्षुता सलाहकार नियोजक को तीस दिन के अन्दर वृत्तिका के संदाय बन्द करने के संबंध में सम्मति वेने के लिए इन्कार की सूचना [PART I- THE GAZETTE OF INDIA EXTRAORDINARY

नहीं देता , वहां यह समझा जाएग, कि उन्होंने वृत्तिका को बन्द करने के संबंध में अपनी सम्मति दे दी है । "
10. मूल नियमों के नियम 8 में-
(क) उप- नियम ( 1 ) में
( i) 'एक शिक्षु' शब्दों और ' शिक्षुओं' शब्द जहां कहीं भी वे आए हों , के स्थान पर क्रमशः 'एक व्यवसाय शिक्षु' शब्द और ' व्यवसाय शिक्षु' शब्द रखे जाएंगे ।
( ii ) खंड ( 1 ) के परन्तु का लोप किया जाएगा ।
(ख ) उप - नियम ( 2 ) में—
( i ) ' श्रल्प कालिक शिक्षु के अतिरिक्त कोई भी शिक्षु नहीं' शब्दों के लिए 'कोई भी व्यवसाय शिक्षु नहीं' शब्दों को रखा जाएगा ।
( ii ) ' शिक्षु' शब्द के लिए ' व्यवसाय शिक्षु' शब्दों को रखा जाएगा ।
(ग) उप - नियम ( 2 ) के पश्चात् निम्नलिखित को अन्तःस्थापित किया जाएगा , अर्थात्- " ( 3) स्नातक या तकनीकज्ञ शिक्षु स्थापन के उस विभाग के प्रसामान्य कार्य घंटों के अनुसार कार्य करेंगे जिसमें उन्हें प्रशिक्षण के लिए संलग्न किया जाता है ।
11. मूल नियमों के नियम 9 में-
(
क) उप- नियम ( 2 ) में प्रारम्भिक पैरा के स्थान पर निम्नलिखित रखा जाएगा , अर्थात् --
" ( 2 ) उन स्थापनों में , जहां कर्मकारों के लिए उचित छुट्टी नियम हैं, नियो- जकों द्वारा शिक्षुओं को छुट्टी इन नियमों के अनुसार दी जाएगी । परन्तु व्यवसाय शिक्षुओं के मामले में , ऐसी छुट्टी निम्नलिखित शर्तों के अनुसार प्रदत्त की जाएगी , अर्थात्:--
( ख ) उप- नियम ( 3 ) और उप - नियम ( 4 ) में "एक शिक्षु " शब्द और " उप- नियम ( 2 ) के खंड " ( ग ) शब्दों, कोष्ठकों, अक्षर और अंक के स्थान पर जहां कहीं भी वे आये हों क्रमशः " एक व्यवसाय शिक्षु" शब्द और " उप -नियम ( 2 ) के परन्तुक के खड ( ग ) " शब्दों , कोष्ठकों, अक्षर और अंक रखे जाएंगे ।
12. मूल नियमों के नियम 10 में-
( क ) "एक शिक्षु" शब्द " शिक्षु" शब्द के स्थान पर, जहां कही भी वे आए हों क्रमशः "एक व्यवसाय शिक्षु " शब्द " व्यवसाय शिक्षु " शब्द रखे जाएंगे ।
(ख ) उप -नियम ( 5 ) में, खण्ड ( क ) में " शिक्षु " शब्द के स्थान पर " व्यवसाय शिक्षु" शब्दों के स्थान पर "व्यवसाय शिक्षु" शब्द रखे जाएंगे ।
(ग) उप- नियम ( 6 ) में "स्थापन रिपोर्ट प्रस्तुत करेगा " शब्दों के स्थान पर "स्थापन में प्रशिक्षण प्राप्त करने वाले व्यवसाय शिक्षुयों की बाबत रिपोर्ट प्रस्तुत करेगा" शब्द रखे जाएंगे ।

घ) उप - नियम ( 7 ) के पश्चात् निम्नलिखित उप- नियम रखे जाएंगे , अर्थात्- (
" ( 9 ) स्थापन में स्नातक या तकनीकश शिक्षु द्वारा कार्यारम्भ कर , नियोजक पूर्व ब्यौरे सहित अनुसूची III में दिए गए प्रारूप ए ० पी ० पी०-5 में इन्डेक्स कार्ड तैयार करेगा ओर एक कार्ड अपने पास रखेगा तथा एक-एक कार्ड शिक्षु के नियुक्त होने की तारीख से दस दिन के भीतर निम्नलिखित प्राधिकारियों में से प्रत्येक को भेजेगा , अर्थात्-
( i) केन्द्रीय शिक्षुता सलाहकार;
( ii ) निदेशक , संबद्ध क्षेत्रीय शिक्षता प्रशिक्षण बोर्ड ; और
( iii ) सेंडविच पाठ्यक्रम के छात्रों के मामले में सम्बद्ध तकनीकी संस्था ।
( 10 ) प्रत्येक नियोजक प्रत्येक तिमाही के संबंध में , अपने स्थापन में नियुक्ति स्नातक और तकनीकश शिक्षुओं द्वारा किए काम और अध्ययन के संबंध में अभिलेख रखेगा और प्रत्येक तिमाही के अंत में, वह अनुसूची में दिए गए प्रारूप ए ० पी ० पी०-6 में अपनी रिपोर्ट निदेशक , संब क्षेत्रीय शिक्षुता प्रशिक्षण बोर्ड को भेजेगा । "
13. मूल नियमों की अनु सूची I के पश्चात् निम्नलिखित अनुसूची अन्तःस्थापित की जाएगी, अर्थात्

1. स्नातक शिक्षु
(क) किसी कानूनी विश्वविद्यालय द्वारा दी गई, इंजीनियरी या प्रौद्योगिकी में उपाधि ।
(ख ) किसी ऐसी संस्था द्वारा दी गई , इंजीनियरी या प्रौद्यो- गिकी में उपाधि , जो संसद के किसी अधिनियम द्वारा ऐसी उपा- धियां देने के लिए सशक्त ( की गई ) हो ।
(ग) वृत्तिक निकायों की स्नातक परीक्षा, जो उपाधि के समतुल्य के रूप में केन्द्रीय सरकार से मान्यता प्राप्त हो ।
(घ) सैंडविच पाठ्यक्रम कोर्स का ऐसा छात्र, ऊपर ( क ) और ( ख ) यथार्वाजत , इंजीनियरी और प्रौद्योगिकी में उपाधि लेने के लिए प्रशिक्षण प्राप्त कर रहा हो ।
2. तकनीकी शिक्षु
(क) किसी राज्य सरकार द्वारा स्थापित तकनीकी शिक्षा की राज्य परिषद् या बोर्ड द्वारा दिया गया इंजीनियरी या प्रौद्योगिकी में डिप्लोमा ।
(ख ) किसी विश्वविद्यालय द्वारा दिया गया इंजीनियरी या प्रौद्यो- गिकी में डिल्पोमा ।

(ग ) किसी संस्थान द्वारा दिया गया इंजीनियरी या प्रौद्योगिकी में डिप्लोमा , जो ऊपर के ( क ) और ( ख ) के समतुल्य के रूप में राज्य सरकार या केन्द्रीय सरकार से माम्यता प्राप्त हो ।
( घ) किसी ऐसी व्यावसायिक पाठ्यक्रम में डिप्लोमा या प्रमाणपत्र , जिसमें विद्यालय शिक्षा के माध्यमिक प्रक्रम के पूरा करने के पश्चात् दो वर्ष का अध्ययन आवश्यक हो , और जो राज्य सरकार या केन्द्रीय सरकारद्वारा ऊपर के ( क) और ( ख ) के समतुल्य के रूप में मान्यता- प्राप्त हो ।
(ङ) सैंडवीच पाठ्यक्रम का ऐसा छात्र, जो ऊपर ( क ) , (ख) और
( ग ) में वर्णित डिप्लोमा या ऊपर ( घ ) में वर्णित डिप्लोमा या प्रमाणपत्र लेने के लिए प्रशिक्षण प्राप्त कर रहा हो ।
14. मूल नियमों की अनुसूची II के पश्चात्, निम्नलिखित अनुसूची अन्तःस्थापित की जाएगी

16. मूल नियमों की अनुसूची-तीन के पश्चात् निम्नलिखित अनुसूची अंतःस्थापित की जाएगी , अर्थात्:--

एक. व्यदाय शिक्षुओं के मामले में :
(क ) इंजीनियरी या टैक्नोलोजी में डिप्लोमा या डिग्री या भारत सरकार द्वारा मान्यता प्राप्त समतुल्य योग्यता होनी चाहिये ।
या
(ख ) राष्ट्रीय शिक्षुता प्रमाण -पत्र और कम से कम 5 वर्ष का अनुभव ।
दो. स्नातक शिक्षुओं के मामले में :
इंजीनियरी या टैक्नोलोजी में डिग्री या भारत सरकार द्वारा मान्यता प्राप्त समतुल्य योग्यता दोनो चाहिए ।
लीन, तकनीकी शिक्षुओं के मामले में :
इंजीनियरी या टैक्नोलोजी में डिग्री या डिप्लोमा या भारत सरकार द्वारा मान्यता प्राप्त समतुल्य योग्यता होनी चाहिए ।
णिझुम्रों के प्रशिक्षण का कार्यभार सम्भालने वाले व्यक्ति को इतने और ऐसे शाप फ्लोर या वर्कशाप कार्मिकों की सहायता दी जाए जितने आवश्यक समझी जाए जो, शिक्षश्रो का मार्गदर्शन देने के लिए व्यवहारिक जान रखते हों ।
